Public filming on sidewalks is protected under First Amendment rights, and Texas election laws only prohibit recording within 100 feet of the actual voting station (where ballots are marked), not the entire exterior of a polling place building; this distinction is crucial because if the voting station is located inside the building, the 100-foot restriction zone begins further from the building's exterior, allowing public filming on sidewalks to remain legal.

KAREN CALLED THE COPS ! Accused of Baiting the Police!
Added:Hey everybody, welcome back to the magic camera.
>> [music] >> This is the place where you're going to find the most entertaining public filming ever.
And I'm filming for Laruta Productions.
So today's email has sent us off to Nocona, Texas.
It's a little town. It's only got like 2,000 people in it. They're famous for their boot shops. They make Nocona boots there. But we're going to we're heading towards the Wells Fargo. We're going to do a little bit of stress testing the first amendment, maybe doing some interviewing of people, maybe throw some social experiments out there. Who knows?
But it's public filming and it's the best channel ever for that. So, let's get into it, guys. We're almost there.
Well, I made it to Nocona, Texas and I was getting my camera equipment all ready to go across the street to shoot the Wells Fargo when suddenly this little lady comes out of the building and starts yelling at me.
>> Pictures are recording violation.
>> What are you talking about? I would I What are you talking about?
>> Are you taking a picture?
>> Of what?
>> Of me and this >> I'm taking pictures I'm going to take pictures of Wells Fargo but I can't take pictures of this. It says >> not supposed to.
>> Why?
>> I'm not supposed to have cameras here.
It's a voting location and you have to be 100 ft away.
>> 100 ft away? Oh, do you have that in writing somewhere?
>> Yes, ma'am, I do.
>> Oh, okay.
>> So like you're recording, [music] I need you to delete it.
>> No, I'm not deleting anything. I'll stand I'll stand How far is 100 ft?
>> See the sign over there?
>> That's 100 ft.
>> Yes, ma'am.
>> Oh, well. I'm not going to record you.
>> You got to go there or you got to go to that sign up there. You cannot take You cannot record or take pictures in here.
>> I'm not inside.
>> gift I don't care. It's state law.
>> I mean, I can't believe you came out here to talk to me cuz I wasn't even going to film here. I'm filming the bank.
>> I've seen the phone or recording device up there.
And as a judge I'm responsible >> You're a judge?
>> of this polling >> You're a judge?
>> I'm for the polling here.
>> Well, good for you.
>> I have to obey the state laws.
>> Yeah, you do. We all have to obey the state laws. You're right.
>> So, I need you to move with the >> I'll move over here, but I'm going to still I'm going to still film you. And I got to tell her I got to I got a a lens where I can get you, too.
All right.
Bring that out to me in writing, cuz I'll be back.
I'll be back, so bring it out in writing. Show me in writing where I have to be 100 ft away.
Okay, go get it. Go. You go. Here's the Smith. Go get it.
>> No, ma'am. I need you on the other side.
>> Okay, go get the go get the order.
Go get the order. Go get the order.
>> I need you on the other side.
>> Go get the order. I'm more than a I'm more than 100 ft away from you.
I'm not.
>> No, we measured with a rope.
>> Oh, you measured with a rope?
Good for you.
All right. There you go.
This pole right here?
Okay, go get your order.
Go get your order.
Go get your order. Go.
Go. Here's the Smith. Bye.
>> You want to read it?
>> No, I'm not interested in that. I'm just trying to do my job.
>> And this here is the end of the street.
>> Okay, so 100 ft from the polling place is so >> From any door. At the polling place, ma'am.
>> Okay, whatever.
All right, thank you.
So, these guys are freaking out. She's freaking out because she thinks this is a polling place over here. So, she's like, "Oh, you have to be 100 yd away from our door, 100 ft."
Well, I have I happen to have I know that I'm more than 100 ft from her door, but she's freaking out over it. They're all freaking out cuz I'm a I'm recording on the sidewalk. I don't think that's right. I went and looked up the real rules, and the real rules say that from 100 ft from the door, you're not supposed to have any polling signs.
Polling signs like vote for her or vote for him.
As far as cell phones go, persons may not use any mechanical or electronic means of recording images or sound within 100 ft of a voting station. And a voting station is the area where the voter actually marks the ballot.
So, if the voting station is way here in the middle of the building, inside, it's at least 40 ft to the door.
So, that gives me 60 ft from the door where I can film. So, I was within 100 ft of the polling station the whole time.
>> Some judge see you.
>> I think I'm allowed to film on the sidewalk.
Wow, she's freaking out.
I always double-check what some official tells me because sometimes they are wrong.
The show dismissed.
She's freaking out. You're judge. Okay.
She said she's a judge.
I don't think she's a judge.
So, I'm supposed to film the bank.
Cuz that's what I'm getting paid to do.
>> So this is the colony Texas.
It's the West Fargo.
Oh look at her. She's in the window thinking I'm filming her.
Look at her.
Like like why does anybody want to film the polling place? Look. Look.
There she is.
Freaking out.
Freaking out.
Why would I want to pull a polling place?
Look at her in the window.
So that's weird.
She's saying I have to be 100 ft away from her any of her doors that she's a judge.
Good luck with that. Now she's looking out the window at me.
I don't know what to do. She's filming us.
And I've got Oh my gosh. What what am I going to do? She's filming us from a far away. I got to be at least 2 or 300 ft.
Oh my goodness.
Oh my goodness. She's filming us.
There she is.
Slipping out.
Who's she going to call? The police?
Call the police. Police, call them.
Here come the po po.
Oh, no, it's the cops.
>> I want to advise you.
>> Okay.
What's going on?
>> I just wanted to tell you the law.
>> I can't see it.
>> If you don't mind.
>> Okay, what's it say?
>> read it to you so you can see it.
>> What's it say?
>> Okay. No audio recording within 100 ft of polling.
>> Yeah, but I'm not recording them.
I'm here to record the bank.
>> I understand you're recording the bank.
Yes, I get that. I'm not trying to cause any problems. All right? So I'll read it to you.
>> Okay, read it to me.
>> Prohibition of certain devices within 100 ft of voting stations, okay?
>> Okay.
>> I'm sure you understand what it says, right?
>> No, I will. Go ahead and read it to me.
>> Okay. So I'm going to read it to you.
All right?
Persons are not allowed to use a wireless communication device within 100 ft of voting stations.
Additionally, persons are not allowed to use a mechanical or electric device to record sound or images within 100 ft of the polling station.
>> Okay.
>> Said devices include, but are not limited to, cell phones, digital phones, cameras, phones, cameras, and sound recorders.
>> All right, am I 100 ft from them?
I'm more than 100 ft away from them.
>> Right here is the polling station.
>> Yeah, I'm I'm more than 100 ft from them.
>> Uh I don't think you are.
>> Yes, because 25 ft is three parking spaces.
So I'm more than 100 ft away from them.
>> Okay.
>> I think.
>> I'll put it >> I have a measuring tape in my in my glove box for some reason.
>> Yeah, we can get one out. I mean, I'm >> Like I said, I'm not trying to call the police. I'm I'm not I didn't come down here because I seen you recording and and I care. I came down here because I was called by by the people at the polls.
>> They're dropping men over there. Like it's Have you ever kicked over an anthill?
>> Yeah.
>> And that's what they're acting like.
>> Oh, are they?
>> Yeah.
>> So I have to already talk to you or >> Yeah, that little lady came out and she said, "I'm the judge around here and you can't record." She can't >> She said you're the She said she's the What?
>> And I'm like, "I'm recording over here."
>> Like a poll judge, I do?
>> Yeah, I guess so.
>> Okay. What about the lady that I just seen over there?
>> No. Did you say to some lady coming >> I just seen another lady over here.
That's why I was talking to her. And I was like, >> And I was like, "Well, you're here, so I'll come talk to >> Yeah, I was paid by someone to come to the bank and I And then I guess this is in the way here.
>> You were paid by someone to come to the bank?
>> Yeah, I'm supposed to film um I'm supposed to film how many slots they have and how busy they are.
>> sure somebody's not paying you to just stand within 100 ft of >> Yeah, I didn't even know about them.
>> a You know, any other actual police or something?
>> No.
>> You sure?
>> Yeah.
>> Cuz it that's kind of sounds like a police >> they um I just need to know how like did they Well, I'm really I can't tell though. Like did they change their sign to the red yet?
I >> Change what sign to the red?
>> The Wells Fargo is supposed to be red.
>> Wells Fargo is red.
>> Okay. Cuz it's not wasn't that red before. So I can't tell if it's a new paint or the old paint, but >> Uh well, >> That's what I'm checking.
>> Did you really get paid to come stand here at the bank?
>> bucks. Can I just have to check to see if the Wells Fargo sign All right.
>> I I guarantee you somebody paid you to come and stand here and film because it's within a certain amount of feet of the election polls. You're not allowed to record >> Well, I'm done now because I already got what I needed.
>> Okay.
>> Cuz I I got to see like I just had to >> I I probably all you needed was me interacting with you, which is okay.
>> No.
>> Okay. I'm in I'm not trying to cause you problems.
>> Okay, cool.
>> You do understand you cannot record within 100 ft >> Yeah.
>> Okay?
>> Yeah, but I don't think that >> I'll bring you a tape.
>> to I'll have to go home and I'll have to go and >> don't think we need to bust out tape, >> I got some tape I should measure it just because.
>> If you do me a favor please just don't record within 100 ft of the polling station, okay?
>> All right.
>> Do you mind if I get your name?
>> Carolina.
>> Carolina?
>> Mhm.
>> Okay, I think we've talked before.
>> Have we?
>> Yeah, we have.
>> I don't think so.
I don't think we have.
>> All right.
>> Have a good one.
No, I'm you're good.
You're good.
>> So, we're going to stop recording.
>> Yeah.
>> You're still recording.
>> Oh, yeah, I'm recording you now.
>> You don't want me to ID you, do you, right?
>> You already got my ID.
>> Yeah.
>> You know who I am.
>> Yeah, we got you.
>> Me, too.
I think he wanted some more camera time.
