This video serves as a sobering lesson on how legal illiteracy and misplaced defiance can escalate a minor traffic citation into a criminal arrest. Refusing to identify during a lawful stop doesn't protect your rights; it simply guarantees a trip to jail for a completely avoidable charge.

He Turned a Golf Cart Ticket Into an Arrest | Bodycam
Added:not how that works.
>> Well, you don't do it. Sorry.
>> That is not how that works.
>> That if you don't do the things when you have to do that in the moment that you have to do, why you don't stop him in the in that part?
>> Oh, you study criminal justice.
>> Huh?
>> You're a police officer.
>> Well, that is not your business.
>> In today's body cam video, police show up on scene for a situation that is about as minor as it gets. Someone was driving a golf cart where they shouldn't have been. That's it. There's no high-speed chase, no felony investigation, no dramatic manhunt. But instead of just handing over his ID for a simple investigation, this guy decides to give the police a masterclass in constitutional law from the driveway.
So, let's watch and see how exactly a golf cart violation snowballs into handcuffs, a little bit of family drama, and one very expensive lesson in picking your battles. On January 27th, 2023, an officer attempted to conduct a traffic stop for driving a golf cart on a public roadway.
>> West, >> not on community. I've followed you since community.
>> Do you have your license registration?
>> I don't have to give you anything on my Get off my property.
>> Yes, you do. You committed a traffic infraction.
>> Okay, good. Send me a ticket.
>> I need your license, registration, and proof of insurance.
>> I haven't I have not committed a crime and I'm not going >> You committed a traffic offense. Yes, you did.
>> I did not, sir.
>> Yes, you did. I did not, sir.
>> Okay. Are you going to turn this into something criminal?
>> That's up to you. I'm my house. If you If you saw me out there, then you got to pull me over out there.
>> That's not how that works. A traffic that's not how that works. Move your vehicle from my >> No. A traffic infraction happened on the roadway. I need your license.
>> You're not getting anything.
>> I need your license.
>> Not enter my property, sir.
>> I am not on I need your license.
>> Thank you so much.
>> I need his license.
>> Uh I don't know, sir. Okay. I need his license or he's at risk of interfering with an law enforcement investigation.
>> Does he want to get arrested for >> what investigation?
Call the supervisor.
>> Okay, I will.
>> I don't know why investigation.
>> And please move your vehicle out.
>> Call Sergeant Garcia.
>> Wow. This guy really thinks that he is an authority on what is and is not allowed regarding traffic law. Huh. HE'S LIKE, "OH, IF I was doing something wrong on the road, then you have to pull me over on the road. But I'm in my driveway, so you have no authority here.
Dude, if that was true, everybody who was ever caught speeding or violating traffic law in any way, as long as they could get off of the road that they were caught on, they would no longer be held liable for any offense. No, no, no, no.
There are so many circumstances where somebody is breaking the law and the police officer just has to follow you to a safe location to pull you over. So, sorry, dude. You I don't I don't think you're going to win this one. And what does he mean? Okay, WRITE ME A CITATION.
HOW IS HE SUPPOSED TO write you a citation? I am not very familiar with golf carts, but I don't think that golf carts have license plates like cars do where they could just like run your golf cart plate, find out who you are, and send you a citation in the mail. I don't think it works that way. And he really thinks that just storming off into his house is going to avoid this entire thing. This is like the epitome of the situation where people think if they ignore a problem, it just goes away. I don't think this officer is going away.
Sorry, dude.
>> Hey, do you want to come 51 out to me?
>> Uh, now I'm inside the gated community, but he was driving on the public roadway. He's refusing to give me his license.
>> Okay, you're refusing.
>> All right, you're heading out here.
>> Okay, here we go.
>> Officer, I'm going to ask you again.
You're in my driveway. Please move.
>> You committed a traffic infraction on the public roadway. I'm respectfully asking you again, sir, if you please. I am not my driver. around 1164. And if there's another meeting, >> please move from my you are blocking my driveway. Are am I being detained?
>> Yes, I need your I need your identity to identify you.
>> I need a supervisor.
>> I'm sorry, but you cannot you are not allowed to do that.
>> Okay, you can think that.
>> I I know I know how the police are working.
>> Okay.
>> Very well.
>> Okay.
>> Can you come inside?
>> Yes, our property. You can go back inside. Thank you.
>> No, he's going to bring a supervisor.
I'm not running from anybody. He'll he'll bring a supervisor.
>> Okay. I'm legally permitted to drive in this in this neighborhood. I'm >> not on public roadways.
>> This is not public, sir.
>> You were on the public roadway.
>> Say, okay. Do you have proof of that?
>> Yes, I do.
>> May I see it?
>> Uh, it's on the body camera. Perfect.
>> I can give it to you after you give me your driver's license.
>> I'm not giving you my driver's license.
>> Okay.
>> Why you Why he don't stop that part?
>> That's what I want to know. If he says that was on the road, >> there are other cars on the road.
>> Oh, >> yeah. You don't stop at the right moment. That's not it's not counted.
>> That's not how that work. A traffic stop can be initiated anywhere. A violation.
>> You do that at that moment. That is mean you do that when he come back in here in the house. That is mean you don't do that in the right moment in the right moment when you have to do it.
>> Yeah. That's not >> No. Again, if that was the case, anybody that broke a traffic law, as long as they got off of the street or the area where they broke that law without the officer pulling them over, that would mean that they would be scot-free. That is not how it works. The police officer, as long as they catch you doing something you're not supposed to be doing, they could pull you over anywhere, baby. They don't have to pull you over on that exact road at that exact time. We've seen other circumstances before where police have had to follow people for a really really long time just so that it's safe enough for everybody to pull over, get out of the car, and you know, start the investigation. If her logic and his logic was sound, none of those people would have received violations or been, you know, arrested for the stupid [ __ ] that they did either. Man, it really cracks me up when people think that they are right and they are so wrong.
>> Not how that works.
>> Well, you don't do it. Sorry.
>> That is not how that works. Is this allowed? Are you allowed to block my yard?
>> Yes.
>> Okay. You are.
>> I'm trying to initiate a traffic stop on you.
>> Didn't you on private property? You tried to do it >> because of a violation that occurred on a public roadway.
>> You are not allowed to enter private property to come after me. You can't do it. So that's why I asked for there's a supervisor coming.
>> Nothing personal.
>> Hey, there's a supervisor coming and you could explain this all to him. Then >> when you have the moment and the opportunity for do that, you don't do it. So that doesn't mean you don't do it right your job. That is not how that works.
>> Okay.
>> I am >> I am not giving you permission to enter my property.
>> I'm not on my property.
>> I'm not on your I'm not in your house.
>> This is HOA property.
>> This community is HOA property.
>> Yes, it is.
>> HOA property?
>> No, it's not.
>> Yes, it is.
>> Okay. This is HOA property.
>> Okay. So, so you're saying that this is not my property?
>> This right here is HOA property where you committed a traffic offense is public roadway.
>> This part is in this property. This is our property.
>> Okay. If you guys want to turn this into something more, >> nobody.
>> Okay.
>> You have to do the right thing.
>> Okay.
>> Moment you don't do it.
>> Okay.
>> Sorry.
>> Okay.
>> You lose that.
>> I know you saw everything from inside the house, right?
>> Sir, I am not afraid. I am not afraid for you. I'm here and I'm telling you that if you don't do the things when you have to do that in the moment that you have to do why you don't stop him in that in that part.
>> Oh, you studied criminal justice.
>> Huh?
>> You're a police officer.
>> Well, that is not your business. If I know if I not that is not your business.
>> Okay.
>> Okay. But that is that I'm telling you.
>> Okay. I mean, you're trying to tell me how my job works now.
>> But you don't do that.
>> Okay.
>> You do that.
>> I don't know what you're saying.
>> I know. You know what I'm saying? No, I don't.
>> You know what I'm saying?
>> No, because >> I don't know what you're saying either, lady. You sound pretty stupid. Talking with authority. And I And I I really can't I can't stand people like this. I can't stand people like this that speak with authority on things that they are not well enough educated in to be speaking in authority and then they dig their heels in and they're like, "No, I know better than you." This guy is literally a police officer, okay? And he's risking his badge, breaking rules. Everything is being recorded, baby. Everything is being recorded. And the original traffic stop was also freaking recorded. And I'm very, very upset that we can't see it because I would like to see the proof that he did in fact catch this guy riding in his golf cart on a public road. I mean, at this point, I'm just going to, you know, take the officer's word for it because I know that there are police officers out there that do shady things and they, you know, lie or whatever. So, I will never ever think that every single law enforcement officer is this way. I always tend to side with law enforcement and it's just out of the respect that I have for them.
But what I don't have respect for are people telling the authority figures how to do their jobs while acting like they are the authority in this situation.
Oh, woman, shut up. You weren't even there.
>> You are not >> a traffic infraction.
>> Uh-huh.
>> You can make a traffic stop >> all the time, but if you don't do that at the right moment, at the right second, you don't do that in that minute.
>> Okay.
>> Well, you have I'm not here to change your mind.
>> No, you don't wait. You wait for to come here. I am not here to change your mind.
>> Yeah, you have to change.
>> I'm not here to change your mind.
>> No, I know.
>> And you weren't driving the golf cart, so I don't know why I'm talking to you.
>> Because you are the law of enforcement and you have to respect for me because you are the law, >> right? Or >> and I'm trying to enforce the law and you're impeding my investigation.
>> What investigation, sir? You don't have any part. You don't have any paper.
>> Your your supervisor is not here.
>> Do I need to pull up? Okay. If I pull up a printed sheet of what law he broke?
>> No. If you show me proof of me breaking the law, >> I absolutely will.
>> Perfect.
>> Okay.
>> And then I'll I'll stop the vehicle.
>> You don't stop the vehicle. You don't stop and you don't ask for his driver license. You don't do the things that a police officer have to do.
>> I asked for his driver's license. You were in >> I'm on private property. You can't ask.
>> That's not how that work to give you that.
>> Just because you come to your house doesn't mean it's safe zone. I didn't say >> anybody else get like a visual when kids are playing tag and they're like base.
LIKE HOME IS BASE. YOU CAN'T ASK FOR MY ID. You can't give me a ticket anymore.
I claim base. I'm at home. Private property. I win.
No, no, no, no, no. That was the case again. Every criminal would just run into private property and be like, "You didn't catch me.
I'm at my home now. You can't ask for my ID.
>> Dude, you sound really dumb.
>> I didn't say anything about safe zone.
I'm in private property, sir.
>> Okay.
>> I am on private.
>> Okay. You can have this argument with the sergeant.
>> Okay.
>> But the jaw and everybody.
>> Yes. Absolutely.
>> Okay. So, that's fine. So, we'll take it for >> How you doing, boss?
I pull up here with my son and all I'm trying to do is go inside inside the house and he pulls up in my driveway. I asked him to leave.
>> He said, "I want to see your driver's license." I said, "For what?" He said, "For driving the golf cart."
>> Mhm.
>> I He said, "It was on a public road." I said, "Well, number one, we're on private property. This is private property.
>> I'm more than okay to drive my golf cart on here. It's insured."
>> And he wants my driver's license. I said, "Okay, well then, show me what I did wrong." He's saying, "I was following you from somewhere, but there was cars." I said, "Well, I'm not giving you my license for that." I mean, I'm not hiding. This is my house. You find out who I am, but I'm not giving him my license for something. If he if he's saying I was doing something, then he's got to pull me over and he's got to do whatever he's going to do at the time that he thinks that I'm apparently breaking the law.
>> So, yeah, inside the HOA communities, you're allowed to. Um, but anywhere it's like city on roads like Village Parkway, Community Boulevard, Gatlin Cross, anything else that's not inside of like a community area.
>> I understand that.
>> And then um >> I mean I understand that.
>> Yeah.
>> I mean to pull me over right here in my house and he wants to put the lights on and make a big commotion blocking my driveway.
>> Yeah, he he has um the supervisor on the way also.
>> I do the supervisor.
>> No, no, no, no, no, no. I have a trainee. We were close by.
blocking my >> Oh, yes. You don't have to in here. You can put it in here.
>> Normally, uh, we're stopping out stopping the golf cart cuz it's a lot of people calling them city hall one. It's It can't be on the roadways.
>> I am agree with you. You better do it in the moment. You have to do it. You don't have to wait. You don't have to do this.
We respect the law enforcement.
>> Absolutely.
>> But the thing, you have to do that. If you told me if I am broken the law outside, >> you have to pull me over and right away in that one. That's like >> these police officers are not puppies in training, baby. Okay? You can't like there there's not like a 3second timer where your dog pees on the carpet, you got to rub their nose in it because after 3 seconds they don't know what they did wrong. That is not what this is. Okay? If you break the law, THERE'S NOT A time limit on it for you to get pulled over. If you're doing something you're not supposed to be doing on the roads, there is not a time limit. the police officer pulls you over when the police officer can pull you over.
Because again, if your logic was sound, that would mean that anybody that could outrun the police officer and get off of the street where they committed the infraction, they would be scot-free.
That's not how it works. You have to pull over when it happens. And she keeps doing that. When it happens, no. No. And did you see how like agreeable they were when they thought that this guy was the supervisor? They were just like, "Yeah, I know. You're not allowed to drive on the public street. If you knew that you weren't supposed to be driving on the public street, why are you acting so surprised when the police officer rolls up and asks you for your driver's license to give you a citation?" I can tell you exactly why. He It came out of his mouth. He is not happy that the police are making a scene at his residence. All of his neighbors are seeing these police cars with their lights on causing a scene. It's probably embarrassing him.
So, he feels the need to buck up in the driveway, stand his ground on his personal private property. That way, if any neighbors are looking out the windows, he looks like a tough guy.
Guarantee you. Guarantee you. That is what is happening right now. They want to look like they're tough because they're embarrassed and they know that their neighbors are probably all looking out the windows wondering what's going on. And so they want to look all big and bad against the police like they're standing up for something so that later when their neighbors at the little HOA pool or wherever, they want to be able to look good to their neighbors and be like, "Yeah, these [ __ ] cops showed up, tried to give me a citation for driving my golf cart in our neighborhood."
Yeah. They want to be able to do that because they're humiliated right now.
Bet you that's the reason that they're acting this way.
>> Telling me, okay, I mean, somebody pull up to your house say, "Oh, you broke you broke the the speed limit on the highway." Well, we're at my house. What are you talking about? You know, I mean, come on. I guess >> Hi. So, I'm his supervisor, so I'm going to make I'm going to make one request.
>> Okay.
>> Okay. Um, being in your pulling into your driveway doesn't negate the stop.
I'm going to give you the option right now because what's going to happen if you don't pro provide the identification and I have to arrest you. We don't want to arrest you.
>> Yes. Would you prefer to present the identification or not?
>> I am I am I have a question. No, no, no, no, no. I have a question. I have I'm not fighting you. I'm not fighting.
>> Stop. Move away.
>> Don't say anything without your lawyer.
And they don't have any. So, if I give you my driver's license, >> so if I give you my license, you will permit me. You You will have a conversation with me. I knew about the law.
>> You're under arrest.
>> Is that not resent?
>> Damn.
Did he just basically say, "Okay, so okay, back up." He asked him point blank. He said, "So, you're telling me if I don't give you my driver's license, I'm under arrest. Why? Because you're obstructing, right?" What did he just simply say? No. And then they started putting him in handcuffs and then the wife is starting I'm assuming it's the wife. She's starting to freak out and he's getting handcuffed and he's just over here going, "Okay, okay, okay. So, if uh I give you my driver's license, we can have a discussion." And the police are like, "No, the handcuffs are already on. We're we're not talking anymore.
You're under arrest."
Kudos to him for not fighting, though. I can understand why he's not fighting because then that'd be even more embarrassing for him. Could you imagine what the neighbors would say if he was face down in his driveway getting handcuffed by all of these freaking cops? That would be the talk at the next HOA meeting for sure.
>> The kids the kids down in there.
>> The kids down in there.
>> I didn't tell you no. I said I was going to ask you a question.
>> You did tell the officer know, right?
>> I said I said I want to understand what the law is. That's all I asked.
>> Okay.
>> Please tell him tell him that you're 14 years old and he 6 years old. Okay.
>> Don't leave it alone.
>> One second. Let us do one second that time.
>> You don't have my kids are inside. Please be quiet. She'll be quiet. Please let my kids are inside. I have a six-year-old daughter in there. Sir, you can't.
Please let her have to find somebody else.
>> Let her go. I She didn't do anything.
>> Put her in the car, please. In the car.
>> Okay. Can I tell my son? Wait a minute.
I have liners in here. Can I tell my son? Let's go. I'm not fighting. I'm not fighting.
>> Let's go to the car, sir.
>> Let's go to the car now, please.
Believe. Is that okay?
>> You cannot leave my piece alone.
>> We're right here.
>> Why are you doing this?
>> I'm doing this. Please walk to the car.
>> I asked you. I just said to you if I I said I wanted to make sure that it was that I'm legally required to give you my ID.
>> Yes, you >> Oh my god. I think we've we've looked this up before. We've looked this up before. If a police ask you for an ID and there is a legitimate reason, you have to give them an ID. That's what the obstruction charges are for. They're arresting her, too. They're arresting her, too. I mean, don't get me wrong, I I do think that she deserves it, but there is like zero zero hesitation with these police officers. They're like, "Please, we have kids inside. We have a six-year-old daughter, a 14-year-old son. Please let her stay. She didn't do anything wrong."
She kind of did do something wrong.
She's impeding an investigation. I am not at all happy about the fact that there are two children in the house right now likely watching out the window while their parents are arrested. I am however very satisfied with the fact that these two loudmouths are both getting some consequences for their actions. They are learning a very very valuable lesson today. Very valuable lesson. And I like it when people are held accountable. I just do. I don't like it when people just get away with stuff because, oh, this, that, or the other thing, or the police officers are being too lenient. These police officers are teaching them a lesson today, and I'm here for it. And hopefully they learned a little something about providing your ID when an officer pulls you over, right?
>> Yes, you are legally required. If you would have told me that, >> I tried to explain that to you.
I did, sir. I told No, no. I was asking for a supervisor for the car.
Thank you.
>> Please, man. My >> You would have literally gotten a warning >> and I was trying to do that and give you my license is right here.
>> Okay.
>> I was Come on, man.
>> Why didn't you just s >> I'm not wanting to do any of this.
>> Give my kid my kid a ride to school.
Please. Come on, man.
>> Don't do that. Please turn around.
>> Do you have anything on Come on. Do you have anything on you that's going to poke me, stick me?
>> I asked for a supervisor. That's all I asked, sir. Sir, >> please.
>> Manto man, if you have kids, please don't do this. My kids are inside.
>> Listen, >> all you had to do was put right there in the front. As simple as that, sir.
>> I don't understand what the point of refusing.
>> He wasn't. No, no, but what I'm trying to tell you is I wasn't trying to refuse it from you, sir. I was asking you if I'm legally required. That's all I was asking. He asked >> [ __ ] [ __ ] You weren't refusing to give it. You had how many opportunities to hand your driver's license over and you refused every single time? Instead, you dug your heels in and you were like, "I want to hear this from a supervisor. Get a supervisor here. I shouldn't have to give you my ID. You need to pull me over where I formed the infraction."
No, you absolutely were not willing to provide your ID, sir. We all watched all of this on body camera. You were trying to be a tough guy. You were basically calling safe space on your private property. You went inside the house.
Your wife came out, started impeding the investigation and run in her mouth, and now you're both in handcuffs. These are the consequences of your actions.
There's no going back now.
>> Right. I know.
>> Well, he asked me, but he also was blocking my property.
>> And I didn't understand what that was.
That's why I requested respectfully. I told him respectfully, "May I please speak to a supervisor?" That's all I said.
>> There's no going back.
>> Okay.
>> All right. Where are my kids? Is there So here's my next question. Is there a relative, a neighbor that you would call her?
>> Absolutely.
>> Can you just go in a pain in here?
>> She was being a pain. That's all, >> sir. Okay. Can you do me that favor?
I'll go.
>> She can't put her hands on officers when they're trying to >> She wasn't trying to put her hands to hurt anybody. Come on, sir.
>> No. No. I'm I never said she was she can't >> and I respect that. I apologize to you, men. Can you please let her stay with your kid?
>> No, sir.
>> Please, sir.
>> Who Who am I calling for your >> 703?
>> And who is that? That's That's their mother.
>> Okay.
>> She's right down the street. Can you call her?
>> And why is this guy walking?
>> I couldn't tell.
>> Huh?
>> Uh, well, yeah. I got pulled over for driving a golf cart.
>> What's the name of the mother?
>> I'm getting arrested and I just >> He's throwing me in. Yeah, my kids are in for driving the golf cart.
>> Okay, get your extra and push me in like you want to. Go ahead.
>> Why would I do that?
>> Oh, man. I got kids. Why you got I asked for you know why. Just like you.
>> I was nothing but respectful to you.
>> You weren't. I was respectful to you, too, didn't I?
>> [ __ ] >> I was respectful to you, too.
>> No, you weren't, you jackass. And yeah, let's tell your neighbor the full story.
He pulled me over and he's arresting me for driving my golf cart. [ __ ] You know it. You know it. You liar. Liar.
Liar. Let's twist the truth so that you look like a victim. Oh, poor baby. He was driving a golf cart. Now he's in the back of a police car handcuffed. And his poor wife is arrested because she touched a police officer even though she had no intent to hide him. Oh, these poor HOA babies. Oh, poor poor guys. Uh, at least they didn't seize your golf cart. They really wanted to be [ __ ] They could have found a charge to do that.
>> I tell you nicely.
>> Can you make sure Please don't leave until my kids are here.
>> We are not going to go anywhere. cannot leave until my We are not going anywhere yet.
>> Where is my phone? You took my phone out of my pocket.
>> Yes, I have that.
>> Where is it?
>> It'll be going with you to St. Lucy County Jail.
>> I need to see it.
>> It will be going with you to St. Lucy County Jail.
>> Okay. Hope you feel good, man. Doing that to somebody with cars. I wasn't rude to you.
>> I don't like doing it. All I All I needed was your ID, man. But but I I wanted to know if I'm legally required to give it to you and that's why I asked for >> You are legally required.
>> I'm sorry, but I don't think that a police officer needs to come out and say, "Yes, you are legally required to give me your driver's license if I ask for it." When he's refusing to leave, he's kind of answering your question.
He's like, "I'm not leaving until I get your license or you're arrested." One of the two. This is common sense. Wow. They learned a lesson today.
They learned a very, very valuable lesson for the future, didn't they? Yep.
There you have it. The world's most unnecessary arrest.
