In personal injury cases involving multiple defendants, the case value is determined by the severity of injuries, medical expenses, lost wages, and pain and suffering. A case with significant medical bills (e.g., $304,000), serious surgery requiring multiple anchors, and lost wages can potentially settle in the high six figures or reach seven figures at trial. Key strategies include filing spoliation motions for missing evidence, maximizing each damage category, and leveraging multiple defendants who may have deep pockets.

Three Defendants One Shoulder Surgery — Millions
Added:Oh yes. Hi. How are you? This is the attorney.
>> Yeah. How you doing, Mr. Yeah, I'm Junior, man. I want I'm one of your YouTube followers, you know.
>> Oh, thank you so much. Thank you for watching. I really appreciate that.
>> Yeah. So, tell me what happened. How can I help you? Um, tell me like in your >> Yeah, I got my attorney, but like I got communication with them, but like I'm con I'm more constantly speaking with the legal cuz the last time I spoke to the attorney was in He's a good attorney. It was in January. All right.
My my case is like happened in 2024.
>> And then what what was the date of the incident? When did it happen? What was the when did you get hurt?
It was in May of 2024.
>> Oh, May of 24. And And what happened?
Just tell me the fact. It's almost like so I could see almost like I could see it happening like I'm like I'm watching it.
>> What happened was is that >> I walked in one of their grocery stores.
So I thought well I was going to buy but when I was leaving the store I noticed was there was a lot of people. [music] And that store like after 8:00 in the night they close they only leave like one set of automatic doors open where everybody has to exit.
>> So in front of me there was a family that they were they were when they were going to pass through the automatic doors the doors didn't they like they didn't the doors didn't open like they they just they had to like for they open it with your hand.
>> So these are the exit doors just to leave the grocery store. They wouldn't open. So you had to like pull them pry them open with your hands.
>> Yeah. They come out. Yeah. Like the the first people that tried to leave, they had to open the door.
>> Okay.
>> So I was behind them.
>> I was behind them. But when they open the door, instead of the door like instead of the door recognizing that I was passing through, it just shut and completely hit me with force in my especially in my right my right side of my body. So to define myself, I raised my right arm, arm, my shoulder.
And I know because all of that I had a big big surgery.
>> What kind of what kind of surgery to what body part? Like how did you >> I had a shoulder surgery as a >> Oh, a shoulder. Okay.
>> Yeah. with with with bicep tendonosis plus I think I have like three or four anchors cuz they had to cut like a tendon in my bicep and reattach it plus the lab the lab had a >> and how how old are you >> by that time I was 33 [music] now I'm next month I'm going be 35 >> oh so you're a young guy yeah that's >> yeah so >> I'm an I'm an huh >> they're automatic right so that when they closed. They just closed with a lot of force. It was It was really >> Yeah. Yeah. Yeah. Like they know like when they like like crazy instead of opening like they close like boom force.
>> They didn't I guess they didn't have the sensors or the sensors weren't working.
They really closed hard on you. Did you fall to the ground after they closed on you or >> No, no, no. That was a good thing. You know, I didn't fall because, you know, I'm a I'm a young person. But what I did was to defend myself and [music] avoid not getting hit in my face. That's when I raised my right arm and I [music] and I push and I pushed back the >> I pushed back the doors with my right arm.
>> Oh, I see. So then it caused its injury.
And then did you go to the hospital right away? Right. The same day when you got hurt. [music] >> Yeah, that same day because like no one like came like to help me or nothing.
The only thing was the supervisor for that night. He just came and he just like he just like wor worried about his his doors. He never never told me if I needed like medical assistance or whatever.
>> He didn't offer to like call an ambulance, get you to the hospital and nothing.
>> Did you Did you go >> What was the first medical what was the first medical treatment you you obtained after the incident? So, the doors closed on you. What's the What's the first medical uh treatment that you got? Did you go to the hospital or something?
Yeah, I went directly to the emergency room >> right away. Right when it happened, you went to the emergency room. Okay. Did you call an ambulance to the scene? Did the ambulance come to the >> No, I was living with a roommate and she drove me to the um to the yard.
>> What was your Tell me a little bit about your medical care. Like for example, you know, did you go to physical therapy, orthopedic? You said you had surgery, but like just tell me a little bit about your medical care. How many how many times a week were you going for? How long total? I remember the first time I started taking the um therapies and I was out of my job for one month. One month because my job is I'm a I'm a order in order to to go to go back to work you got to be paid dude you know.
>> No of course >> so yeah so I took that that whole first month of therapy orthopedic and [music] injection.
Okay.
>> So after that like I went back to work but the problem was like every um when my by when the day day and time was fasting I was getting worse and worse like my shoulder like [music] a lot of pain like a lot of a lot of um >> So how long did you get how long did you go to therapy for? Did you go for like six months or or less or more? or like just all your medical care. It doesn't have to be exact, you know, just approximately.
>> In total, I know and to it was I think it was more than 3 months. Yeah.
>> 3 months. Okay. And then they they referred you to the orthopedic and I guess he did an MRI and then he ended up doing the arthoroscopic shoulder surgery, right?
>> Exactly. Exactly.
>> Okay. And then so you have a lawyer now, right? Who who which law firm do you have handling it for you now? Okay. So that's who that's who's handling your case.
>> Yeah. [music] Is that like is he an individual like a is he part of a law firm or >> he's a law firm?
>> So he has other lawyers working for him.
>> Oh, yeah. Yeah. Yeah. Yeah.
>> Okay. Okay. Okay. That's good. Yeah. If you want I could do a um I could do like a verdict search and send it to you.
It's confidential, you know, so you could see like what kind of settlements he's won in the past, what kind of verdicts he's won, >> things like that.
>> Exactly. I never too like after the surgery [music] like I was making like I was working 70 hours, 7 hours, 50 hours like after that like everything and right now my that job I had I've been out for a whole year.
>> So So what So you said you missed a month then you went back and then when did you start missing time again? Was that when you had the surgery or when did you start missing time?
>> Yeah.
>> Okay. So you've been out for a whole year.
>> Yeah. because like like at my surgery was in February February 20 25.
So like they did a whole lot of a lot of surgery proced plus and also too like my parallegal told me like our medical bills right now are 304,000 verified most >> and he has he filed a lawsuit already?
The case is in court already.
>> Yeah. Yeah. Yeah. The trial was the first trial was from the man room 2025 and they continuing for May of this year. So now they [music] they continue and then they continue the trial again for October.
>> Oh okay. So do you think the trial will happen in October? So it's already going to trial. So it's already almost done, right? I don't know because like they trying to because the defense they going to the manager they did it in January but now they want to depos the defense they they they file a motion to quash of deposition motion to quash. So, the hearing was on the 15th, but it had to [music] be scheduled again because conflict.
>> And you said the lawyer isn't really isn't really speaking to you too much.
You don't get to speak to the lawyer.
>> Yeah. I usually keep me update, but like you know, sometimes you want to speak with >> Right. Right. And you don't get to speak to the attorney at all?
>> January. February.
>> And he's And if the case goes to trial, he's going to be the trial attorney.
Yeah, like the name last month, they they hired a co-consel.
>> Okay, maybe text me text me the name just so I have the correct spelling and then I'll I can run a search on him, too. So, he's What's the point of hiring the co-consel? he's going to do the trial with or what's the >> the parallegal told me that they chose him because because like you know um the law for me is >> oh he's a local he's a local attorney there and but he's a I think he's a judge as well like >> Oh so they thought it's going to help them. Okay, >> probably. Yeah.
>> Yeah. I mean I could do I could do a search on him too. Just let just text me his name because I I don't know if I got the spelling. It's kind of hard. It's kind of hard to hear a little bit. The connection's not so great.
>> Yeah, I I texted I texted you already.
>> Oh, okay. Okay. But I could I'll take a look. I'll take a look for this guy if he has anything. Let me see.
>> Because that's what I want to know. Like I don't I want to know because I got my parents. I'm not going to lie. They're good. They're a blue golfer, you know.
Sometimes I'm looking for a second opinion, you know.
>> Yeah. Of course. Of course. Yeah. You know, everyone's going to get some for zero because sometimes cases do get lost. But it looks like, okay, he's got eight cases and three are for zero, but the rest are like for hundreds of thousands and one of them is for like 19 million. I don't know what kind of what kind of case that was. That must have been some crazy injury, but >> So, yeah. So, that's good. So, and he's already got another lawyer, too, right?
So, you got two lawyers. So, yeah, you should be you should be in pretty good shape. And it's almost going to trial.
So, at this point, I would just, you know, recommend staying with them and let them finish it out and get you a good result. Yeah.
>> Yeah.
>> Has there been any offers? Have there been any like settlement offers or they haven't told you anything?
>> No, they haven't told me that. I haven't know cuz my my legal told me that like cuz they're like two dependent and now they add a third one. So is the supermarket is the doors company and the door company and there's a another company that is the one that does the service for the doors. So before the last defendant, my um parallegal told me that the policy the the the max policy was 2 million.
>> Well, combined combined. But you know like I was that they might have umbrella policy, [music] >> right? Umbrella beyond that. Yeah, you should always check that. And now you have a third defendant. So that's good.
You you know Yeah. Get them all. And then it's also good because they're all going to like blame each other. But you say, "Look, you're the supermarket. you have to it's your property, you're the door company, so why isn't the sensor working and then if you service it, maybe they didn't service it properly.
So, I guess he's probably going to find all that out or he did already in discovery and then whatever he found out, all the depositions, all the documents, he's going to use that at trial to then get you the maximum.
>> So, it sounds like you're in good shape.
You're in good shape with this case.
Yeah. Let me know how it goes. Like, let's stay in touch. You know, if you you could always text me, we could do another call, whatever you need. I'm I'll be happy to help. I think that specific case >> and al Yeah. And also like also like like I'm I'm telling you Mr. that that door man if that door would have hit a kid or elderly person that that person going to go down because you know I use my but I use my body I can't do it. So it's like >> right because you're like a young guy and you're in good shape right? So if what if it would have hit like a old person it could have killed him. That's why it's important like in the trial to like focus on the defendant's conduct, right? What they did and it's kind of like spread the >> the tentacles of danger like spread and then the jurors if you if you have a jury they're going to think like yeah what if this happened to my [music] you know grandma? What if this happened to my elderly mom or my you know and then that that's what you want to do to to really show what the defendant did and the fact that they don't want to take any responsibility. They don't want to take ownership of their own action. So that makes the jury mad and get leads to a bigger verdict. So no I think yeah I think this is a good case.
>> Yeah. And another thing Mr. Grace does I got also and I think I have to I have bulging in my neck and back. So because they gave me injections in my neck as well [music] my back too my shoulder plus one another issue is that you know they have cameras right.
>> All right. So did you get the video of the of the incident? No, that's the problem that in January's man the manager position he said that they were camera and and they told him that he saw video and he said yes but the problem is that they haven't sent any kind of videos for us like >> my attorney say he was going to file a motion of spoilation of evidence. Oh, [snorts] spoilation, right? Cuz if they got rid of the video or they didn't preserve it, then that's spoilation, right? You should do that >> cuz that would that would help your case.
>> No, it sounds like you're doing the right things and it sounds like a good case. So, yeah, I wish you all the best.
I think you could build this up and get get a good result and it's good. It's coming up soon, just in a few months.
So, hopefully, you know, but I would recommend maybe trying to speak to the attorney to you know, make an appointment in the office or, you know, get on the phone with them just so parallegal. Definite. I'm a better, >> but it's good to speak to the attorney as well. And yeah, it sounds like a good case. Yeah, good luck with it.
>> And like I said, if you have any other any other questions or anything new happens, just text me. I'm happy to do another call and stay in touch with no problems. Based on your experience, I you think my my case will reach a settlement or or it will go straight to >> I mean, it sounds like probably it's going to settle because I don't really I don't know what they're defending it on.
Are they defending it on saying like they didn't do anything wrong or are they defending it based on the injury saying the injury is not from the door?
You know, it depends on what their defenses are, but I think like it sounds like it's hard for me to say, you know, cuz I don't know the case, but I think that most cases do settle. So, I think most likely it's going to settle and you have like a serious surgery, but it's not like such a, you know, life-changing injury that it's like, you know, worth uh, you know, a huge amount where, you know, I think probably it'll settle, but you have like significant medical bills.
So, yeah, between the medical bills and the lost wages and the [music] um all the different categories. So, what I always recommend is like, you know, maximize each category of damages. So for the lost wages, if you haven't been to work in a year and then the doctor [music] thinks you have to stay out of work in the future, that could be a big category because you're a young guy, right? You want to be able to work and losing all that salary. Then of course the past pain and suffering, the future pain and suffering including loss of enjoyment of life and those are huge categories. [music] And then medical bills are big already like 300,000. So you're just trying to maximize each category and then when you add it all together, it could get into the really significant numbers even into the millions, right? So that's how the best way to do it, you know, but I'm sure they know, you know, how to do it. So I would let them like build it up and try to do a maybe a mediation or a settlement letter [music] and then, you know, especially with three defendants cuz they have a lot of deep deep pockets so they can get money from all three, put some kind of package together. So I think it's probably it sounds like it's probably going to settle, >> but I would defer to the, you know, to the handling attorney, of course, ask them ask them what they think, you know.
>> Yeah. And it's and like right now I go see the medical had a had a flap here repair like they drill into the socket bone the humorous and I had the open open bicep tendinosis is like cutting and [music] relocating the tendon and they they also put I think I have like three or four ankles [music] in my shoulder.
>> No, that's pretty serious. That's really serious. Yeah. No, I think that's a good case. No. Yeah. So, good luck. Yeah.
Keep me keep me informed. If you have any other questions, just let me know and I'll um >> All right.
>> Yeah. No, I'll be happy to help and I I wish you all the best. Hopefully you get a good result in the case like the top result and the most important thing is that you know you get healthy again and have the best of health. Yeah.
>> Yeah. Yeah. Thank you.
>> Okay.
>> One last question. One last question.
Like >> a case like mine, how much do you think as a professional like does it work?
What's the value? Well, I mean, you know, it's hard to say exactly. I don't know the values in Texas so much, but in New York, like a case like that, like with Anchors, I've settled for like over 500,000 even. I think one we got like 850, so closer to the million, especially since you have like the medical bills, [music] 300, that's already what you spent, but then I don't know if there's an u like a a doctor or like a lifeare planner who's going to give you an estimate of future medical expenses, right? Because that's going to be big, too. And then [music] with the wages, you know, plus the like the biggest categories will be all the pain and suffering, loss of enjoyment of life. I think it could be big. It could be, you know, depending a settlement could be in the high six figures, you know, but um I think a a verdict could potentially even be if you get the right jury, it could even be into the seven figures, you know, over a million. So I think something like that, you know, I think it could be significant. And based on this guy's past results, you know, he's gotten >> most of the cases are like 300, 200, but hopefully yours could be even even bigger.
>> Yeah.
>> You know. Yeah. Cuz it looks like >> Yeah. I see one [clears throat] case he got a micro disquectctomy, which is a back and he got I think it was 366. So, but yeah, yours is like probably a little bit more serious because you had the anchors and it's a serious uh serious injury. So yeah, I think it should be, but I would definitely defer to him like ask him what he thinks it's worth and what what he's uh >> Yeah, that's why I'm wait till Monday to call them and probably I need I need an opponent. I know I want to talk to him.
>> Yeah, for sure. For sure. Yeah. Get all the information. But it sounds like he does some premises cases. So that's very good cuz if that's what he does.
>> Yeah. Yeah. Yeah. He they're good. You understand? the guy that they the local co- counsel I read about. You gonna write about you're going to read about him. He say he's good too. So >> yeah, he's good too. Yeah, I'll I'll research him as well and then I'll send you the um I'll I'll text you or I'll email you if you drop me your email.
I'll email you the results for him as well. Yeah.
>> All right. All right. Thank you.
>> Okay. Thank you so much. Okay. All the best. And yeah, let's we'll we'll stay in touch for sure. Yeah.
>> All right. I'mma keep you I'm gonna keep you posted. Don't worry.
>> Okay. Okay. All the best to you. All right. [music] >> Okay.
>> [music]
