>> The subject repeatedly demanded to know the reason he was being removed. Under Florida statute section 810.08, no reason is legally required beyond a lawful removal order issued by an authorized agent of the property owner.
Once that order is given and the person refuses to leave, the crime of trespass after warning is complete regardless of whether admission was paid. Payment establishes a service agreement, but Florida law permits property owners to terminate that agreement at any time absent unlawful discrimination. The subject's belief that paying admission created an irrevocable right to remain is legally incorrect. The sustained profanity directed at officers raises First Amendment questions. In city of Houston versus Hill decided in 1987, the Supreme Court held that profane criticism directed at law enforcement constitutes protected speech under the First Amendment.
