MALCOLM JAMAL WARNER's WIDOW SUES his MOTHER?

I loved him on The Resident. I I loved him on so many shows and so many things and it's just really tragic his death and everything else. Well, we are a year later you guys and unfortunately there's a family feud. There's a family feud over his estate in terms of what was a part of the trust and the prenuptual agreement that we've got to get into. So, this is courtesy of the go and it says the following. It says Malcolm Jamal Warner's widow files lawsuit over family trust and prenup.

[00:01:30]The complaint filed one year after the actor's death seeks to resolve a dispute involving the Warner family trust and the couple's prenuptual agreement.

[00:01:42]The widow of Malcolm Jamal Warner has taken her late husband's family to court, alleging the beloved actor never fulfilled the terms of the prenuptual agreement the couple signed before marrying. The Atlanta Journal Constitution reported that Tanisha Warner filed the lawsuit in Dabb County Superior Court against the actor's mother, Pamela Warner, seeking to recover money she says she is owed from a family trust. According to the AJ, Tanisha lodged the complaint on Monday, exactly one year to the day after Warner drowned while on a family vacation in Costa Rica. The actor best known for playing Theo Huxable on The Cosby Show was 54 years old when he was unfortunately uh uneleded and after being caught in a rip tide at a beach where there were no lifeguards on duty. At the center of the dispute is the Warner Family Trust, which the actor established in 1996 and for which his mother now serves as the successor trustee.

[00:02:57]As reported by the AJC, Tanisha's complaint contends that Warner was contractually obligated under their prenuptual agreement to provide for her and that those obligations went unsatisfied at the time of his death, leaving her to pursue the estate as a creditor to recover what she claims she is entitled to. And according to the court filings, Tanisha claims that Malcolm Jamal, who allegedly earned an estimated $680,000 a year and had an estimated net worth at the time of his passing of $3.4 4 million was obligated per the prenup to secure a $1 million life insurance policy, naming her as the sole beneficiary and a reciprocal policy on her life. Pay her $5,000 a month as his quote unquote chief of staff. give her $16,000 a year on their anniversary, fund a tax-free retirement account for her, and maintain college funds for their children. According to the suit, several of those agreements were not met by the time of his passing. The suit also attempts to block Pamela Warner from distributing trust property until the dispute is resolved.

[00:04:35]Warner and Tanisha, a doctor of psychology, married in 2017 after years together and they share a young daughter. The actor was famously private about his family life, keeping his wife and daughter's identities out of the public eye until Tanisha stepped forward months after his death to confirm her identity and launch initiatives in his honor, including the Warner Family Foundation.

[00:05:08]The AJC noted that attempts to reach Pamela Warner, a California resident, were unsuccessful and that attorneys for Tanisha did not respond to inquiries about the case on Monday.

[00:05:27]The legal action marks a somber turn for a family that has spent the last year publicly grieving one of television's most recognizable figures. Rather than a private reckoning, the dispute over Warner's estate now plays out in court, pitting his widow against his mother on the very anniversary of the loss that was set in motion. You guys, this is really, really, really, really sad.

[00:06:00]This is really sad, right? I I think really it should be pretty cut and dry.

[00:06:06]If there is documentation, you know what I'm saying? to support, you know, the prenup, to support the life insurance policy and all the things, then all of that should help be held up in court, unless there was an updated will or something else that got updated uh prior to Malcolm Jamal Warner's passing that maybe the wife is unaware of that, you know what I'm saying? Maybe the mom's aware of or things like that, then that could be where, you know, something could potentially be challenged. But um if the latest will indicates these parameters and these you know obligations and things like that that was supposed to be a part of you know what this is because I think the total of what uh they are also saying cuz I also wanted to um there was something else I wanted to take from TMZ really quick. Something else I wanted to um talk about. She's saying also in the lawsuit that she says that the unpaid obligations are totaled at at least $1.2 million, $76,42 and46.

[00:07:19]Um that would include of course the $1 million for the life insurance policy.

[00:07:24]And she also is to totaled and tallied the $50,000 for anniversary payments, $30,500 for the IRA and alleged 193 95,000 in an unpaid salary. She believes that Malcolm's estate does not have enough assets to cover the alleged debt.

[00:07:43]So, she wants the court to allow her to recover the money from his family trust.

[00:07:47]So, I was trying to figure out in the Grio's article why she was going after the trust, but now it makes sense. She doesn't believe that the estate has enough assets to cover the alleged debt and all of the things. She is also seeking interest, attorney fees, and an order barring Pamela from handing out any money or property from the trust while the case breaks out.

[00:08:09]So that gives a little bit more context and everything else, but um you know ultimately like like I said I if everything if all of the paperwork and everything is in place, this should be a pretty opensh case, right? if the prenup is matching what this lawsuit is stating, if it has the, you know, receipts, the proof of the life insurance policy and what was outlined in the prenup and all the things, then then I feel like this is cut and dry.

[00:08:40]Unless the mom knows something else. The only thing that I am curious about that might be potentially a loophole now that I picked up that TMZ piece of it is if she is allowed to go after the foundation.

[00:08:56]That could be pretty interesting if she is allowed whether or not she's allowed to go after the foundation because she does not believe the actual estate itself has the money to pay that 1.2 million. So that's why she's going after the foundation because she believes that the foundation has that 1.2 million that she feels that she is owed.

[00:09:22]And I feel like there's going to be mixed reviews on this because people are going to, you know, potentially see this as a money grab or potentially see this as is something else. But here's the thing. We don't know what the wife does or doesn't do for a living. We don't know what their situation was when Malcolm Jamal Warner was alive because ultimately he kept his private life completely private. He referenced that he had a lady in his life. He referenced that he had a daughter and stuff. However, we we're completely out of sight and out of mind in terms of those details, right?

[00:09:57]However, we do not know if the wife works and ultimately I think the bigger picture is about caring for the child and providing for the child.

[00:10:09]People are going to argue what what they feel is or isn't appropriate. But if that is what Malcolm Jamal Warner outlined in his prenuptual agreement and it gets upheld, then then that's what gets upheld. But if there is a different, you know what I'm saying, documentation or something that might have been modified that the wife is unaware of or other documentation that maybe the mom is aware of that, you know, overrides what she is requesting in this lawsuit, then this could be a whole this can open a whole another can of worms. You know what I'm saying? or if they say you can't go after the foundation, we can only give you whatever is available or whatever we can as far as the estate goes. But I'm wondering how all of that is under play considering the mom is in charge of the foundation and it seems like with the estate, you know what I'm saying? Like what is all of that entailing? Is that just entailing all of the royalties that Malcolm Jamal Warner would still be getting for like the Cosby Show, for like The Resident, for like all of the TV shows that he has done that is now syndicated that is now airing on other networks and things like that. Uh it's it's a whole lot to kind of, you know, dissect here, but it's really sad at the end of the day. It's really a sad story because you hate something like this to happen because I thought usually, you know what I'm saying? Like if there's a living will or things like that. Um, I thought all of this stuff would be enforced shortly after he passed, right?

[00:11:42]Sometimes people do it like at the funeral or right after somebody, you know, after you bury somebody, the, you know, whoever the executive is, the attorney, all of this and that. But maybe grief and other things kind of put took a backseat to all of that. And maybe perhaps the wife possibly was trying to find other means to try to address this with her mother-in-law and maybe it just couldn't come to a resolve. I do find it interesting they said that they cannot locate Malcolm Jamal Warner's mother. So So where is she? Like like there's a lot of interesting tidbits that that this article that both on the go and TMZ are throwing out there and I'm like uh this should be a concern. What where is Malcolm Jamal Warner's mom? You're aware she's a California resident but where is she?

[00:12:33]And what has happened, you know, since uh his untimely passing? Is the wife and the mother-in-law still in communication? Has the mother-in-law saw her grandchild? But like there is so many questions that your girl has as far as all of this, but it's just really unfortunate that it has to come to this point. You know what I'm saying? And ultimately, it's about providing for the child. But like I said, we do not know what type of agreements, what type of establishments, and things like that took place in the marriage.

[00:13:04]But what we do know is if there is documentation to support the wife's lawsuit, to support the widow's lawsuit, then it's pretty cut and dry in terms of implementing those measures. But first, it sounds like, you know what I'm saying? Y'all got to get a hold of Malcolm Jamal Warner's uh mom first.
