In the California prison system, high-ranking members of powerful prison gangs like the New Western Familia may defect and provide information to authorities (debriefing) to escape harsh security housing units, though such defection does not guarantee parole or release, as demonstrated by Javier Zubiate's case who was denied parole in 2015 despite defecting from the NF in 2011.

Pelican bay turnt high ranking ( NF.14 ) member into a drop outAdded:
What's up, foundation? What's up, foundation? What's up, foundation?
Finish me, your big partner. Tony Tony Tony, man. God been working on me, man, since I was born.
And don't forget, man. And don't forget, man. Don't forget, I represent Jesus Christ. I represent Jesus Christ.
What's up, Foundation?
What's up, YouTube man? It's me, your big partner Tony. I'm back again. Back again. Back again. Well, we back today, man. We f to talk about a group that y'all rarely hear me talk about. Y'all, if you've been riding with me for a minute, you heard me speak on them um like a few years ago, different little endeavorments that I had going on with them in prison back in yesterday year in Cali prison system. The group I'm going to speak on today is the Newestra Familia, the 14, the Northern Mexicans out of uh out of California. Um, of course, if y'all know, y'all know that this has widely always been known as the main enemy to the southern Mexicans in the in the in the California prison system. It's been they've been warned since the 60s, man. And going back and forth, going back and forth, going back and forth. Um, when I was doing time in the California prison system, when I was doing time in the California prison system, um, they were allies. They were allies to us. Um it it's been many of times where uh the Crips and well blacks in general would ride with them against the Southern Mexicans and the whites.
You know, time goes on, time goes on.
Many, many years have passed. I from my understanding in the California prison system, it's a little bit different now.
It's a little bit different. Um it's been a truce called between the North and the South as far as the Mexicans go.
How that's going, I don't really know.
I'd have to tap in and find out. Um, of course you've heard of Bulldogs at one time. The Fresno the Fresno uh Northern Mexicans were a part of the northern car, the F, they were F-14. Whatever happened in they and they and they get down, they split. They didn't want to be a part of the 14 no more and they became what's known as the Fresno Bulldogs.
Now, I will admit that took a bite out of crime uh from the power base of the northern of the new western familia, but they survived it. They moved on and they started getting stronger. We f to speak on a guy today by the name of Javier Zubiat.
He was a high ranking New Westestern Familia member that end up telling and giving up information against the New Familia. I guess cuz he wanted to get out of lockup. But we going to listen to the story of it right here. We going to listen to it. You know what I'm saying? Let's check it out.
On February 10th, 1995, armed with a semi-automatic handgun, the West Virginia gang member Javier Zubiate along with an accomplice would approach a Santa Rosa, California motel room with an intention on killing two men inside one of the rooms. Zubiate believed that the men had robbed a family member of drugs and guns. However, he also knew that if he pulled off this double murder, it would enhance his status in the New West Familia.
And now from California, >> now that was them speaking on what Zu uh what Zubiate had came to prison for. Um he was a high ranking member in the NF, the New Western Familia. And we going to go on to hear the rest of the story about him. Let's check it out.
Bay State Prison in Northern California is designed to hold some of the state's most dangerous inmates.
Inside is a bunker-like security housing unit where hundreds of men have been held for more than a decade. Earlier this month, inmates at Pelican Bay launched a statewide hunger strike over conditions in the security units. They are seeking an end to what they call indefinite solitary confinement and an easing of restrictions.
Godfather. Everybody's seen how the Godfather himself never pulled a trigger, never strangled anybody, didn't run the rackets, didn't run the the booze.
These are those men.
>> Lewis alleges that all the inmates here are in the upper echelon of dangerous gangs and would operate with impunity if they weren't locked up at Pelican Bay.
>> These are not your burglars. They're not not your straight corner drug dealers.
These men are highly violent and it provides for the safety of my staff, which is paramount.
>> Basically, what what this is about is now in Pelican Bay in in Pelican Bay Shoe, you got dudes been back there for decades, 5, 10, 15, 20, 25 years that the administrations are scared of them and they don't want to let them out. So what they want to do, they want to just put these dudes back here and just leave them forever and ever and ever and ever.
And that got a lot of dudes been back there for a long time, man. And that can that can play games with a person's mind after a while. You know what I'm saying?
I don't care. You know, you got to be a super duper strong individual to go, you know, to go up under them type of harsh conditions and after 10, 15, 20 years and still be able to maintain. Everybody can't do that. And you know what I'm saying? And you, that's why you have a lot of dudes that start debriefing. They start getting out, they start, you know what I'm saying, basically giving up the ghost. They write letters to the administration, tell them, "Hey, man, I'm ready to talk. I'm ready to let you know everything you need to know about whatever organization they might be a part of. It's called debriefing.
Whatever organization they might be a part of, because they want out of lockup, man. They tired of solitary confinement. And and it happens more than what you what you expect. It happens a lot, man. Them dudes be wanting out. And I believe this is the story of what happened with this guy right here. Let's check it out. Hear it for yourself.
>> So today we're going to be talking about a one-time NF or Newestra Familia Lieutenant guy by the name of Javier Zubate. He's currently still incarcerated. All right. Uh he's from Santa Rosa and he defected not long after the Pelican Bay hunger strike that started in 2011. Now I've covered that on a couple different videos. That was the leaders of four of the most powerful and well-known gangs not just in California but across the country. You had the Black Girl family, the Aryan Brotherhood, the Serenos of the Mexican Mafia and Mortenos of the New West Familia. Okay.
Guy by the name of Antonio Chuko Guen was the face of the NF in the face of the hunger strike who represented the new West Familia. All right. And one of his lieutenants was this guy Javier Zubate. Okay. He committed a murder and an attempted murder and a botched robbery back in 1995 on February 10th, 1995 to be exact. Okay. Um he would get he would commit the robbery 13 days later on February 23rd. 1995 him the codefendant would enter not guilty please and then a few months later on November 2nd 1995 he was given 19 years to life because of this botched robbery and murder and attempted murder okay there actually have two brothers his status within the gang would continue to rise so first thing we're going to read about okay before we get into um sort of the ending of his story which is defecting is the actual double uh murder and double murder itself. This is what's crazy. Okay, he had just gotten out of jail. So, this is an article from February 19th, 1995. And I'm just going to start reading it. A 21-year-old Santa Rosa man charged with murdering a Cooll man after chasing him across Highway 101 had been released from jail only a few hours earlier. Javier Alex Zubiate completed a 10-day sentence for giving false information to police officer on February 10th. He was released at about 4:30 p.m. and returned to jail after a shooting incident about 5 hours later.
It's [ __ ] nuts. That's why I like to dig a little deeper because I was about to start this voice over before I found this article. So, felt like I had enough to talk about, but that really puts it into some perspective.
Zubi and Raphael and Pierre Jr., who was 18 years old at the time, his codefendant, who were arrested on suspicion of murdering Joseph Littlewolf Lincoln, aged 20, his 18-year-old brother Eugene Winterhawk. Sergeant Brian Davis said Zubiate had been arrested by Santa Rosa police January 28th for having a loaded gun in a car and giving false information. Court records show the gun charge was dropped and Zubiate only had to do 10 days. On the lesser charge, Zubiate has a previous criminal record. So, this is some background on him. Okay. And again, this is a guy convinces 21 who would rise to become a lieutenant, one of the most powerful prison gangs um within the state of California and across parts of the country. He was parrolled from the CYA, California Youth Authority, state prison for juveniles in September 93. He violated his parole a month later and apparently was returned to custody. He was not on parole at the time of his January arrest for that weapons charge.
After his release, police say Zubiaté Nierre went to the Cleveland Avenue Motel where the Lincoln were staying. A dispute broke out over money which led to a foot chase from the motel to the nearby highway where Joseph Lincoln was shot in the head and killed. His younger brother was chased across four lanes of traffic by the suspects after being shot and wounded. He survived, flagged down a police officer and identified the suspects. Davis would not say which man, Zubi or Aier is believed to be the gunman. Both men are charged with first-degree murder with special circumstances and face life in prison without parole if convicted.
Let me go to the next one. This is a few days later. Another article, same um same website, same newspaper. Two Santa Rosa men were bent on robbery when they chased two Cabela brothers on the Highway 101, shooting one to death and wounding the other, a prosecutor said Thursday.
The February 10th shooting at Santa Rosa disclosed one of the suspects as 21-year-old Javier Zubiate. He stole $2,000 in cash from the dead victim, Joseph Littlewolf Lincoln, age 20, of Coelloo. Zubiate fired the gun. So by now, 5 days later, they had figured out that he was in fact the gunman that killed Lincoln and wounded Lincoln's 18-year-old brother, Eugene Winterhawk Lincoln of Coella, McBride said. I was prosecutor. McBride said Tubi's codefendant Rafael Mierre Jr. 18 of Santa Rosa knew Joseph Lincoln had a lot of money on him when they went to his hotel room uh at the Moto 6 on Cleveland Avenue. The Lincoln brothers fled from the room and were chased on a nearby Highway 101 where they were shot.
McBride said Eugene Lincoln told police his brother had two grand on him at the motel, but police said it was missing.
Again, they mentioned his five hours uh jail release previously. That's insane.
Um, that's [ __ ] nuts, man. Five hours. That means you were you were planning this. You were you were plotting this 100%. And then November 2nd, 1995, man gets 19 to life for killing Lincoln Kinsman. Javier Alexi was sentenced Wednesday to 19 years to life for second degree murder, the shooting death of 20-year-old of the 20-year-old Cabela man, and the wounding of his younger brother. It's only only secondderee murder for that. That's it's pretty crazy, man.
uh you kind of ran down like like dogs in the street and attempted to you murdered one and attempted to kill his brother. I feel like that's almost a light sentence. Uh after the incident at a Cleveland after an incident at Cleveland Avenue motel uh on February 10th, the superior court judge Gallinger Gallagher also sentenced Zubiat's companion Rafael Empir Jr. 18 to Santa Rosa to only Wow. He only got three years in the CIA for assault with a deadly weapon. Okay.
Um Oh, and they made a side note here. The victims were actually the nephews of a gang member by the name of Eugene Bear Lincoln, a round valley man who murdered a Menescino County Sheriff's deputy by the name of Bob Davis.
Huh. Okay. now getting in a put a pin in that, right? We're going to come back to a parole hearing that he had on that murder 20 years later. All right, when he was aged 42, but we're going to talk about this hunger strike here. This is an article from the LA Times in July of 2013. Now, here's the important part, okay? Not only did he defect, okay, but Zubi basically said that this whole hunger strike thing was just a ploy for gangs to unite, run drugs, make money, and do other seedy things, basically other criminal offenses, masking it as this human rights violation of extreme isolation that was going on inside Pelican Bay and other California state prisons. And this is how it reads.
California prison officials in federal legal filings alleged that the ongoing inmate hunger strike was orchestrated by prison gangs. Attached to legal filings in US district court on Thursday, the state included declaration signed by former members of the prison gangs known as New West Familia and the Aryan Brotherhood. So again, he's one of these inmates who basically signed an affidavit signed a statement, okay, to the feds. The two inmates, both convicted murderers, have agreed to provide information against the gangs in return for getting out of isolation. All right.
inmate Javier Zubi, who states he was a second tier leader of the New Western Familia, said he and other gang members went on similar hunger strikes in 2011 because so he's basically saying one of the public leaders, Antonio Chuko Guen, a Pelican Bay inmate who Zubiate alleges is the highest ranking general within the NF. To my understanding, the Aryan Brotherhood and the Black Gorilla Family organized >> Hey man, y'all hear it? It sound to me like uh Javier got hungry. You know what I'm saying? Them hunger strikes ain't no joke, man. Um I done been on several of them. Several of them. You know what I'm saying? That's why you know when you doing time in the California prison system, you always got to keep you a bag of goodies up under your bed for emergency. You got to keep what's called that emergency bag. You never know when you go in lockdown. You never know. And see ain't lock down in California prison, it ain't no play play. It ain't like a lot of these other states where they go down a couple hours or one day and they back up. No, you looking at weeks on weeks on months on months, man.
Yeah. No store, no none of that. Better have you something to eat up in there.
And when the and when the and when the call get made for the hunger strike, it's the call, man. You know what I'm saying? A lot of time, you know, if you ain't got nothing, people going to look out for you. You know, your people going to look out for you, but you know, they got to look out for themselves at the same time. You never know how long it's going to last. You get hungry, man. It looked like uh his hunger got to him. He was like, "Hey, man. I'm out of here, man. Hey, got to go. Let's check it out a little bit more."
>> To my understanding, the Aryan Brotherhood and Black Gerilla family organized the hunger strike and the New West Familia was the last to sign off.
According to Zubiat in a sworn statement, quote, "If you didn't participate, it would be remembered when the time came for promotion." Deianne is one of four inmates who name appears on the current protest demand letters from Pelican Bay State Prison. He's also one of 10 10 Pelican inmates who are part of a federal lawsuit over solitary confinement. This also involved Todd Aser.
Um, oh god, I'm already forgetting the names. I put them pictures up there. You got uh Castanos, Octo Castanos from Fencia 13. He's representing the M. And I think his last name is Dubberry. He changed it to like Jamba or some religion. I'm not trying to disrespect his religion. He was representing the black gorilla family. I put his picture up as well. Um, but these were the faces of this hunger strike as gang leaders.
But here comes Ubiat. Okay.
And this Aryan Brotherhood defector who said the goal of the hunger strikes from the perspective of the Aryan Brotherhood was to get out of the shoe because we knew it would kill the organization.
Inmate James Lrod sworn declaration state. So this is the AB guy who dropped out. We believed that if we were in general population, we could sell drugs, make money, and develop an influence on the street. All right. Corrections officials said that,200 inmates remained on Hunger Strike Friday. All right. So basically him this this AB guy and Zubate came out and said yeah uh it all sounds legit but no they were doing it to run drugs make money and do other illicit illegal activities which is going to benefit the government and what they believe in. So, um, that's a big deal to be honest that Dubia did. That is a massive, massive deal to go against, not only to drop out, but in one of the more important moments for like a leader like Gued to go out against him. And I what's interesting about Zubat is those I've used some of his pictures in videos. Um, the guy standing in the Pelican Bay shoe housing complex.
Um uh uh the guy with uh uh his suit his basically his suit on his his jail uh outfit. Jail clothes.
Got him. Don't know. I'm having a brain brain fog right now. But he's got his clothes down and you can see the big NF and all that. Those are all of Javier Zubiate. Uh and I did not know that until I started making this video. Okay.
And then the last thing, couple years later after he had dropped out of the NS, okay, this is the title. October 12, 2015, a man convicted of Sonoma County execution style murder denied parole. Parole was denied last week to a man convicted of the 95 execution style murder and attempted murder at a Santa Rosa motel.
According to the Sonoma County District Attorney's Office, the parole board found on October 7th that 42-year-old Javier Zubiate presented an unreasonable risk of danger if released. Prosecutors said Friday, quote, "He is still a danger to society if released back into the community." His new western friendly gang affiliation, even though he had dropped out already, even though he defected, poor institutional behavior, and lack of rehabilitative programming support, the conclusion he should remain incarcerated. On February 10th, 1995, Zubiate along with an accomplice went to a motel room armed with a semi-automatic handgun. Zubiate intended to kill two men inside the room, Joseph Baserto and Eugene Lincoln, whom he believed had robbed a family member of drugs and guns, prosecutors said. But he also believed that it would enhance his standing in the NF, okay, and that the killings would help that. Once inside the motel, Zubi and his accomplice entered the room and confronted the victims. Zubiante took all of the money, which was about $2,500.
After the robbery, Zubiante and his accomplice went outside and the victims followed. Once outside, he produced a firearm. Now, this is interesting. Okay.
Uh it doesn't say that in these articles, like the ones initially after the shooting said, doesn't say that uh the brothers ran, you know, trying to look it across Highway 101. It just says they're both shot, one dies, one survives. And then it makes them note that the officers happened to be in the area. They heard the shots and responded. Okay. And one of the brothers, Lincoln, was able to tell the officers what happened and they were located and arrested a short time later.
Um and then yeah, just a really interesting story about a New York famili lieutenant. I found him mentioned in an appeal uh for a lieno gang member out of Santa Rosa.
and he's just mentioned basically briefly by a gang expert who had testified right and it talked about uh the newest familiar street gang and its sibling gang the northern structure were two north gangs that led over son county subset subsets such as uh NX4 through a formal level of chain of command Javier and here his name is Javier Zubiate once a streetle foot soldier out of Santa Rosa okay for NX4 controlled Now, he controlled gang activities in Northern California, including Santa Rosa, via the New West from Pelican Bay State Prison. Okay. Um, yeah, it's just gives you an idea of his power. That's why I like reading through some of these appeals, even if it's not directly their appeal. That's pretty much it right there, y'all. But uh oh boy before he uh before he defected before he uh said I can't take it no longer like he was a high ranking member he you know what I'm saying he did his thug thistle in that thing but now he ain't the only one it's a lot of them in every group you got them every group [ __ ] blood bsos nanos uh whatever you know what I'm saying the whole hookup You got dudes that can't cut the mustard, man. They can't cut the mustard. You know what I'm saying? And them walls walls start closing in on them and they they got to get up out of there. But now he did all that and still got denied parole.
White folks don't care nothing about all that, man. You can spill your guts all day long. They going to hold you in there until your toes ball up like fish hooks. Hey, man.
In the meantime between time, man, stay out of prison. You ain't got to go through that. You ain't got to worry about that. Stay out. Just stay out. So in the meantime between time, man, it's that Foundation Nation. Y'all know it.
That Foundation Nation, man. You know, in the meantime between time, man.
Hey, Auburn. Tell the people that you love. You love them. And it's me, man.
Your partner, Big Tony, man. I represent Jesus Christ, y'all. I'm out. Peace.
