Um before I get into the facts of the case, Your Honor, um there are serious concerns for the safety of the victim. I was contacted by our division chief, uh Ms. Estrada, who said that SO had contacted her, that they have serious concerns. Um so basically, the impeding breath occurs on 6/14/26.
As they go to deliver the protective order to her, um she advised them that um she had received a phone call. She answered the phone call. Um it was uh from an uh the defendant, him calling her from jail.
Um they argued um about the incident and then she he stated to her told her something along the lines of if I wasn't going to do anything now I am.
She has concerns for her safety.
Obviously because what had occurred the night before. She says that the defendant has access to firearms which makes her more fearful and then she was showed the deputies the call log they confirmed that the call did come from the El Paso County Detention Facility the downtown facility and they were able to confirm that when Judge Moore gave his registration he also presented him with the emergency protective order. So he was aware or should have been aware that he was not to have any contact with her which of course it states not to communicate [clears throat] with her in a threatening or harassing manner.
You're honor based on that the facts of the case based on the criminal history of the defendant and based on the concerns that the victim has for her safety the state has concerns for her safety and would be opposed to a reduction of bond.

The basis for the bond revocation is because on the resisting this is an old case from like 2016 he failed to appear for a court hearing for his final pre-trial on June 27th of '17.
And then on his uh on his uh assault family violence impeding breath, he failed to show up for a court hearing on August 27th I believe I think it's 2023 or 2024. I believe it was a status hearing he failed to appear, so the Judge Lizarraga issued a warrant for his arrest.
But also, I need to let you know the immigration authorities have a hold on you.
What immigration does is completely separate and apart from what we do in this court, okay? But what that means is that if you post your bond and you dispose of your case, they're going to pick you up and I don't know what they're going to do to you, but that's something that I'll have to take into consideration when I make my decision.

All right. So, basically it's a failure to ID. Apparently the stopping for PI and gives a false name. Although it's going to be an interesting because I think they call him from his name. His name is Juan. I think he gave him Johnny and so eh it's going to be interesting.
>> Yeah, I Yeah, I saw that, Judge. My only concern is the facts of the case. I mean uh I don't know if the defendant is willing to try to get some services. I mean basically they found him passed out as he had soiled himself. There was flies on him. I mean, he clearly has a drinking problem. He was, you know, had a PI that he was booked in on 33 6.
I mean, I just would like to see if he would like to try to get some sort of help.
>> So, it's going to be it's going to be a requirement of his conditions of bond.
So, he's going to be a PR under intensive level supervision.
Okay. He's going to be released under re-entry. He'll be taken tomorrow morning to the to the OC I think or the rescue mission one he's staying at. They're going to do a Takumi screening and they're also going to do an OSA screening to see if he needs help with substance abuse and mental health issues.

This morning Miss uh Mr. Loving from their office is going to try to convince me to lower your bond. Then I'm going to hear from the prosecutor Miss Carmona then I'll make my decision. >> Um that day, the paperwork, um I had gotten on the bus and I when I woke up, I got off on the wrong stop and I just got off the bus and I left all my paperwork there, so I didn't know if they were going to call me or if I had to call them or how was I going to go about it.
>> Now, you realize now that if you don't comply, you're going to end up back in jail, right?
>> Yes, no, no, no, no, no, no. It's not a good >> It's your responsibility, ma'am. It's your responsibility, even if you lose paperwork, even if you don't know, it's your job to figure out, okay?

>> Uh yes, Judge. Um on this one, she is eligible for the BGA program, the mental health program and substance abuse.
Um would be interested to see if she would want to do that.
Um you know, we required her to be on intensive or enhanced and it would require her to be screened uh for the program, but um you know, that is something that the DA's office is willing to offer her.

All right. Yeah, I'll I'm going to put her back on PR bond under intensive level supervision. Now, listen carefully. It is your responsibility to stay in touch with your supervision officers. They're not your babysitters.
You're a baby you you you're not a baby who needs your mommy to hold your hand.
It is your responsibility to make sure that they have good contact information where they can reach you cuz I bet you they tried to reach you this time and they couldn't get a hold of you because you didn't give them good contact information. So it is your responsibility. You You come back again, I don't want to hear it because if you come back in front of me again, you're not going to get out.

Not going to fail our reporting.
You cannot commit any new offenses while this case is pending. You're not allowed to possess or consume illegal drugs or alcohol. And when you report, they're going to be testing you to make sure you're using and you're going to you're going to have to go do the the B BJA program. That's They'll explain it to you what that is. Probably has something to do with substance abuse issues. So make sure you comply with all those conditions cuz if you don't >> Yes, Your Honor.
