[00:00:35]>> Judge, there's I'm going to detail all the medical action. Um There hasn't been any financial progress there. And again, I'm not fully aware of the particulars of that accident. But, uh he's without health insurance at this time. He needs some substance abuse treatment. And he definitely does need health care. The payments, he doesn't have any money. He hasn't worked since that time. His wife does work at an as a nurse, but has only recently got employment. So, Mr. uh McFine has not been, you know, >> Okay.

[00:01:12]So, if I understand correctly, Mr. Oley, basically since March 19th for the sentencing, he hasn't done anything.

[00:01:22]>> He does have a disability hearing on the 23rd of September. It seems like forever, but he Based upon what he's going through right now, I've done a few of them in my career many months ago, but I would believe that he would qualify. This gentleman can barely walk, and I think he'll be able to settle in terms of getting Medicare and eventually complete his substance abuse with testing and most importantly, all the payments, too.

[00:01:53]If you want to, >> Um as far as um, with reporting, um, at the time of sentencing, you were allowed we were to video call on the phone call in to report, which I did. I phone called in for it, and um, in April of this year, and um, um, I tried to go to I went to the location on on Gratiot in Roseville, Michigan, to do the hearing assessment, but um, I didn't have the money to pay for the testing, and I needed the health insurance, so I couldn't follow through with it at all. But, I've been um, in contact I called the my probation officer twice, and I've been in contact with her through email.

[00:02:42]>> All right. Well, first of all, I don't think I've ever told anybody that when I put them on probation for drinking and driving, that they could report my phone.

[00:02:52]Probably what I told you is you wouldn't have to report in person every month, but initially there'd probably be some in person.

[00:03:00]That's what I know normally tell people.

[00:03:02]I don't have a uh, specific memory of what I told you.

[00:03:06]Have you had any contact with him?

[00:03:09]>> I did hear reported yeah, that first his first month in April. Uh, no report in May.

[00:03:15]Uh, I know I know he did reach out to me regarding the testing saying >> Okay.

[00:03:22]>> to do so, but limited communication.

[00:03:26]What's your recommendation?

[00:03:29]>> I think the video close.

[00:03:31]>> Judge, again, I I can respect how the court is frustrated along with Mr. Rowland, but I'm asking for a continuation. This this gentleman doesn't have a dime to his name right now. Like, he hasn't worked in uh, he hasn't got any payments from the uh, no follow action. He may not get it because of this issue with this. Neither here nor there.

[00:03:53]He will work off after social security disability and that would have been a half to comply with the Department of Health and Human Services.

[00:04:01]Please explain what happened. Although he was a bit foolish in his initial response.

[00:04:08]>> I'll give you the same deal I gave you the on the last one.

[00:04:11]We'll review it August 20th, but I got to see some kind of action. I got to see some kind of plan.

[00:04:16]I mean this is this is July 16th.

[00:04:20]I sentenced him March 19th and literally nothing's been done.

[00:04:23]And all of what you need to do doesn't cost money.

[00:04:28]There are there are ways to do I mean there are substance abuse programs out there somewhere that you don't have to have insurance for.

[00:04:34]You but you got to you got to if you can't just do everything without fail, then you got to be seeking help from probation all the time.

[00:04:44]Cuz the monkey's on your back. She's not the one that goes to jail if I get fed up.
