Major Metro Approves EWC Process To Take Private Property

So, this video is going to focus on how expropriation without compensation could potentially take place in one of South Africa's biggest metros, Nelson Mandela Bay, the place where I stay. And uh yeah, it looks like uh it's going to kick off here because council decided to approve an item that starts the process of expropriation without compensation. Now remember when news 24 told you that expropriation without compensation won't take place in South Africa through the expropriation act. Remember that. Now what? And the same of course for Dean McFersonson, the Minister of Public Works and is a DA minister uh in the GNU that went on to a panel and told people that no doesn't necessarily mean zero. Well, here we are and uh like I said, the Nelson Mandela Bay Municipality, they had a council meeting. They sat down and they approved the item of starting the expropriation without compensation process and ultimately we are now at the first test case of whether or not EWC will actual fact take place in South Africa. So news 24 where are you now? Dean McFersonson where are you now? Let's have a look at exactly what they are going after and what specifically they want to expropriate. Uh but the article says expropriation without compensation process launched to take private land uh in major South African metro and that metro is Nelson Mandela Bay. I'm not going to read the first part because they just in essence say Nelson Mandela Bay and I've already shared that but let's get in over here. On the 8th of June 2026, a special sitting of council convened and approved the initiation of land expropriation process without compensation. This the ANC said was done in accordance with section 25 of the constitution.
Remember that part of the constitution that people lost their minds over and then mainstream media and uh minister Dean McFersonson told us to not worry. Uh well here it is right now and it's to facilitate the implementation of the clean school housing project in Bethl's Dorp. The claim school housing project is a subsidized housing development in the Bethl's Dorp area of Nelson Mandela Bay. Following unsuccessful attempts to reach an agreement with the land owner, council resolved to proceed with the expropriation process. It said I'll give my commentary on that just now. The expropriation process was to ensure the continued development of housing opportunities for residents. The ANC and Nelson Mandela region said that the matter was previously considered by the mayoral committee in May 2026 before being submitted to council. So here is the saga. The claim school settlement saga focuses on the fact that the claim school settlement saga dates back to around 2010 during the initial township establishment and the roll out of phase one of the housing project. Now what's important to note here is that this planning process actually started in 2007 and during that period nobody thought to approach the deeds office to see who the land actually belonged to and subsequently it has now come out that the municipality owns 20% of the land and then the remaining 80% belongs to this private individual. I know who this private individual is. The metro knows who this private individual is. They just can't reach this person because he has immigrated. So, he is no longer in South Africa. But instead of trying to find this individual and track this person down, perhaps this person doesn't even know what's actually happening on this massive parcel of land. Instead of doing that, they are just trying to now shortcut this entire process. Uh because they messed up in the early 2000s. If they did a proper audit, land audit, they would have already realized then that they would not be able to build on that land. So it was the municipal failure from the start, not the private land owner. The municipality messed up because they didn't audit the land. So they planned and then in early 2010 they rolled out the first phase building houses on private property and now instead of trying to rectify it correctly they now just want to expropriate without compensation. That is in essence what's taking place here. The ANC municipal administration allowed development and informal occupation to proceed without properly resolving or securing the land's legal status. It's exactly what I said. Thousands of households was were settled and infrastructure was planned on parcels of land that remained privately owned because they didn't do their work. The local government later claimed that the rightful private land owners of these properties were untraceable using this to justify an administrative intervention. Opposition parties, particularly the Freedom Front Plus and the DA, have strongly countered this narrative.
They argue that the municipality failed to table a comprehensive land audit or provide concrete proof of thorough deeds office investigations which they still have not done even though the item has now been passed by council. As it pushed to launch phase two of the claim school housing project and issue title deeds to residents, it faced a legal problem because it did not own the underlying property. So they realized in the early 2000s that they don't own the land, but they still built houses on that privately owned land. And then when they wanted to hand out title deeds, it was like, well, you can't because it's not your land. It's not your title deeds. And now what they are trying to do is to circumvent this entire process of them acting illegally since the early 2000s to now just to expropriate without compensation. You know the fears that everybody has when it comes to private property just being taken because the government messed up and now a shortcut for them is just to expropriate it. This is the example that News 24 says will never happen. That Dean McFersonson and the DA says will never happen. Well, here it is right here in Nelson Mandela Bay, the metro that I live in. Anyway, to bypass this, the ANCE coalition government in Elsa Mandela Bay moved to invoke exp the expropriation process. The move was widely characterized as an attempt at expropriation without compensation of private land. It faces resistance from political opponents and property rights activate uh advocates who view it as a dangerous precedent of administrative dereliction. And of course, the superstars, my two colleagues here, Nelson Mandela Bay, Rodri and Bill Harrington. As you can see here from the Freedom Front Plus, well done chaps. Uh doing more as two counselors than the entire DA caucus uh that consists of 40 something counselors. Bill Harrington, Freedom Front Plus provincial chair in the Eastern Cape is a strong opponent to the expropriation of private land without compensation. He said this action is a desperate attempt to cover up the Nelson Mandela Bay Metropolitan Municipalities years of administrative failures. He said the the crisis affecting the claim school settlement is a direct consequence of the metro's own negligence. Official documents show that the metro has been aware of the land ownership issue since the township establishment process began. And that was in the early 2000s. So we are here almost 20 odd years later and they still can't admit that they messed up. And now instead of admitting they messed up, they want to double down on it.
Despite this, the ANC administration allowed the project to continue without resolving the land status. The project has been dragging on since around 2010 due to poor planning. To this day, comprehensive land audit has not been tabled before council. Harrington said that resorting to expropriation to rectify these mistakes constitutes administrative dereliction, violates the law, and infringes on property rights. The coalition is attempting to take legal shortcuts that could jeopardize private property rights across the metro, he said, and across South Africa because this will be used as a test case. A hasty and unlawful expropriation process could expose the metro to compensation claims amounting to millions and protracted litigation. He said that the only sustainable solution is a land audit, transparent negotiations with land owners, and a lawful process that protects the rights of residents and owners. And if you don't believe me and how bad this is, look at this. This is an actual post by the ANC saying council victory, land expropriation without compensation, clean school housing project, phase 2, location Bethals Dor. They are actually celebrating it by posting it on social media that they are going to start the expropriation without compensation process. Now once again where are the people that said that expropriation without compensation won't happen in South Africa? Where is mainstream media now?
They wrote countless of articles stating that people that say that EWC is going to take place don't know what they're talking about. They're fear-mongering. And here we are. Here is the first case where the ANC through council approved expropriation without compensation proceedings to start. Now, where are all the mainstream media outlets? Where's News 24 that said it won't happen? Where's Dean McFersonson that said that it won't happen? And Dean McFersonson, the person that famously came up with the slogan Afrey MAGA, where is he now? Because remember, he said null doesn't mean zero. and his department public works has to implement the expropriation act and expropriation without compensation. So, I know the DA says that they're taking this uh act to court and hopefully they can get it overturned, but yet they have a minister that serves at the behest of the president and the president has signed EWC into law and as the minister he has to do what the president tells him and that is why it makes no sense. Like the DA is taking EWC to court, but they fine with having a minister that has to implement it. And here we are right now 2 years after the act was signed into law. And in Nelson Mandela Bay, they are now starting the process.
And it's because of them wanting to cover up their own mistakes. In the early 2000s, they decided to plan for this land. And then in 2007 and between 2007 and 2010 they started building and then they realized oh well we can't get the title deeds because 80% of this land doesn't belong to us.
And instead of now trying to resolve this legally and amicably they now want to just expropriate without compensation even though they know they are in the wrong and they are conveniently just saying that we can't get hold of the property owner. So, hey, let's just expropriate without compensation. So, imagine if you go overseas for a year and you've got a massive parcel of land that really at the moment doesn't serve a purpose, but you've got ambitions for it, then you better check up because before you come back, they can just say, "Oh, sorry. We tried to get hold of you. We couldn't get hold of you. Uh, we expropriated your land without compensation."
This is what many people warned you against and then mainstream media and Dean McFersonson came and said, "Don't worry about it. Don't worry. It's never going to happen." Well, here it is right now. And I would like to get answers from these individuals and these outlets. So, put pressure on Dean McFersonson. Put pressure on mainstream media and say, "What now? You told us it was never going to happen. You called the people that said this would happen. lunatics, right-wing nutters, fear-mongerers, and guess what? Here we are. So, what now?
