Fannie Nkosi court case

[00:00:00]Well, while the Madlala Commission of Inquiry rolls forward, some people who actually were questioned in that self-same forum are already finding themselves in court.

[00:00:11]One of them is Sergeant Fanny Khosi. He is suspended, but was with the SAPS Organized Crime Unit. He appeared in the Pretoria High Court today, but he is facing charges not just in Gauteng, but in Limpopo province as well. To give us some clarity on what's going on because uh >> Like with suspended EMPD Deputy Chief Brigadier Julius Mkhwanazi is facing more than one matter. Alpha Ramushwana is in a position to tie it all together, which Alpha I believe was the purpose of the court today. But before we look at what the court decided, just give us the background. What are the charges that Sergeant Khosi is facing and explain to us how they happen to be heard in two different jurisdictions.

[00:00:56]>> Good afternoon, Nduta Jonathan. Sergeant Fanny Khosi is facing several charges.

[00:01:01]One of them in Pretoria, the other one in Thohoyandou in the Vhembe District in Limpopo. I'll start with the Pretoria one. You would remember that in April there was a raid at his Pretoria North home. And the task team that is investigating cases that are being investigated at the Madlala Commission of Inquiry found a number of things that Fanny Khosi shouldn't have had at his home. I'm talking about ammunition. I'm talking about police dockets, official police dockets that ordinarily shouldn't be at a police sergeant's home, residential home. They found a stunt grenade at his property as well. So, they have charged him with fraud, theft, defeating the ends of justice, possession of possession of ammunition, unlicensed firearm as well.

[00:01:45]And the second case has to do with the matter in Thohoyandou. It's alleged that sometime in 2022 he went to the police station in Thohoyandou and presented himself as a senior police official to take narcotics that were being kept in custody at that police station. So, he misrepresented himself, to which they did give him the narcotics concerned.

[00:02:07]Then, it emerged 4 years later at the Mdlanga Commission of Inquiry that Funani Kosi, number one, was not a senior police official at the time. He was a sergeant, which is nowhere near being a senior in the South African Police Service. And also, the question is why was he misrepresenting himself to get the narcotics? What did he want to do with the narcotics and to whom did they belong? So, those are the two main cases that Funani Kosi has. So, today in court the prosecution presented a centralization certificate, which takes both cases in Pretoria and Tswane, meshes them up or merges them into one case. So, now instead of two different cases, he's going to stand trial trial on one case. They're just going to merge everything up. Unlike Julius Mkhwanazi, who is in court for three different cases, and from our own sources, he's likely to get arrested soon for a fourth one, which is the murder and of of Emmanuel Mbedzi in 2022. So, Mkhwanazi on the other side, three different cases, three different trials. Funani Kosi, two different cases, which have now become one.

[00:03:10]>> Yeah, I guess the the the action taken with Sergeant Nkosi much simpler. It's a single individual, and the matters have a degree of being related. Whereas, from the bit I understand, involving Julius Mkhwanazi, spread out across different kinds of issues. So, it looks like he'll have lots of different court dates in lots of different courts.
