Homeowners Associations (HOAs) only have authority over properties within their designated community boundaries; properties built before an HOA was established and never included in their jurisdiction cannot be forced into compliance with HOA regulations, even if they are located in the same general area.

HOA Threatened to Destroy My Restored 100-Year-Old Mansion — The Sheriff Took My Side Instead
Added:When I bought the old mansion on the hill, most people thought I was crazy.
The house was over 100 years old with broken windows, peeling paint, and a roof that had partially collapsed. But, beneath all the damage, the place still had incredible character, stone walls, carved wooden staircases, and huge arched windows overlooking the valley.
For nearly 2 years, I worked to restore it. Slowly, the mansion came back to life. The roof was rebuilt, the wood floors were polished, and the gardens were cleared. It became one of the most beautiful historic homes in the area.
That's when the HOA from the nearby development started complaining. Their new luxury neighborhood had been built down the hill, and apparently the board didn't like the idea of a historic mansion that didn't match their modern community style. One afternoon, I received a letter demanding I pay thousands in HOA compliance fees and modify parts of the house to match their design rules. There was just one problem. My mansion wasn't inside there.
HOA? I ignored the letter. A week later, a sheriff's vehicle pulled into my long stone driveway. The deputy stepped out holding paperwork. For a moment, I thought the HOA had actually convinced him to enforce something, but when he finished reading the documents, he looked up at the house and shook his head. The HOA had filed a complaint claiming the mansion violated neighborhood regulations and should be forced into compliance or possibly demolished if ignored. The deputy calmly asked me for my property deed. After reviewing it, he laughed quietly.
The mansion had been built decades before the HOA neighborhood even existed, and the land had never been included in their community boundary.
Instead of warning me, the deputy took photos of the documents and left. A few days later, I received another letter.
This one was very short.
The HOA stated they were closing the matter due to a jurisdiction misunderstanding. Since then, the board has never contacted me again, and the old mansion on the hill still stands, restored exactly the way it was meant to.
