The next part of the evidence that the state intends leading is uh relating to the admissibility of the evidence which the state intends to lead. That is regarding to the arrest, the search and seizure, and other aspects.
So, in the ordinary course of business the state wants to lead that evidence, but the admission of that evidence is being disputed by accused number one.
That the court has found that it must then go into an interlocutory applica- interlocutory part of the trial where it is called a trial within a trial in order for the court to determine the admissibility.
So, we've now come out of the main trial. We've now gone into another compartment, okay?
And we're going to deal then with that that part of the evidence because the court will then have to then make a pronouncement on the admissibility of the evidence, and based on on that, then the matter will proceed further.

Captain Shibila Captain Shibila then called me and asked me to come down towards the the Viano.

>> Uh once I arrived, Captain Shibila asked me to identify the occupants or or to confirm with the occupants that have been detained by them are the same occupants that were in the i20 earlier.
I proceeded to the driver of the Viano, who identified himself as Musawenkosi Kana.
And I could confirm by the build of his face and the the mustard long-sleeved shirt that it was the same driver as the the as I noticed in the i20.
>> And with the court's permission, I will ask then that the three gentlemen as accused number one, two, and three just stand in court.
I see accused number one has already removed his mask as I requested.
So, Mr. Shepherd, I just want you to have a look at the three gentlemen if they stand up and see if you recognize any one of them.
>> Yes, ma'am, I do.
Only one one of the gentlemen, the gentleman to the far left.
>> As accused number one.
>> Yes, ma'am.
>> Let the record show, my lord, that accused number one, Musawenkosi Kana, is pointed out by the witness.

>> As I approached the he identified himself. The members turned him over so that I could see the face his face and I then confirmed that it is the suspect I or the person I saw of the who was driving the i20.
And he was also complaining that the SAPS members mustn't they must take it easy if I can put it like that because he had recently was in hospital and he's sick.
>> What language was he speaking?
>> English, ma'am.
>> If you say they picked him up, what do you mean by that? Why would they be >> I I think the evidence was turned him over.

So, it would appear that he was lying on his tummy, and they then turned him over so that the witness could take a look at his face.

Can you just explain that to the court?
>> It My lord, can I use that picture as an example cuz he was lying by the mag room on his stomach. So, when the members got to him, they locked arms with his arm, and they just lifted him so I could see the front of his his face and the identifying that way.
>> So, if you're saying he was lying next to the mag room, if I drag the cursor, would you say it's to the >> Yes, ma'am.

>> There. So, you're pointing towards a point um if one would say closest to the front of the vehicle.

If you can then just mark with an X on your photo album where accused number one was lying down and where he was turned over.
And if it can then just be shown to the court and to all counsel.

The witness has placed an asterisk as court noted in an area just in front of the wheel rim that is on the grassy area outside this particular property and next to the driver's door of the Viano.
