The Supreme Court of Ghana has criticized the Ghana Police Service for allegedly conniving with a complainant in a $270,000 gold export scam case, where the court found that the prosecution's case was fatally flawed due to the complainant's absence from trial and the reliance on hearsay evidence, while also noting that police investigators were too close to the complainant to impartially pursue justice.

Added:[music] >> I think a former judge will be there.
Aha, Daily Trends TV.
And also it be to a fear. You move right and settle in more.
Supreme Court the Ghana Police Service. A very, very surprising say and in July 17th and a graphic Daily Graphic, graphic.com I'm going to report this sensational story. Very, very interesting. [music] So, Supreme Court for Accra at here the Ghana Police Service and for acquire a more handle a certain case. Now, one of the before one of the individuals, social media commentators, [music] political activists only the Ghana Police Service in here a lot of banter even to the point of the IGP >> [music] >> the way I handle the Ghana Police Service. And to you all share public criticisms and before we begin as put it said [music] political figures they are a tight a criticizing the Ghana Police Service.
This time of year a group of judges now Justice Baffoe Bonnie, the current Chief Justice at the hobby and the more cassette here the Ghana Police Service.
What is the reason in here? Justice Baffoe Bonnie as well as the empanelled judge justices of the Supreme Court because I [music] it's here the Ghana Police Service. Now, title here Supreme Court criticizes police for conniving with complainant in [music] $270,000 gold export scam case. Now, some case we almost say 4 years ago and the Ghana Police Service and as a court a convicted in Kumasi and someone served a 2-year sentence.
And case came out of the court of appeal and the court of appeal dismissed the year.
Now, this case went to the court of appeal and the Supreme Court. And the Supreme Court reversed the ruling of the court of appeal.
Now, so back and forth case here goes to from the high court to the court of appeal to the Supreme Court and the Supreme Court judges Justice Baffoe Bonnie and Justice Kwaku Tetteh Akuffo all of them delivered lead opinion.
Uh other justices are Justice Ernest Gawu [music] Justice Henry Kwofie and Justice Hafisata Amma Adoma among the justices on the panel this particular case. Now, I'm saying a five-member panel presided over by Chief Justice Paul Baffoe Bonnie with Justice Kwaku Tetteh Akuffo delivering the lead opinion dismissed the Republic's appeal seeking to overturn the acquittal of Kwame Ansong and [music] Christopher Obareke on charges of conspiracy to defraud or defrauding by false pretense [music] and money laundering. Now, case that they crack on the case background in the case >> [music] >> so Ansong and Obareke they were tried 5 years ago uh said uh transaction being a foreign investor from Dilorenzo I'm going to say on behalf of the $270,000 paying $270,000.
Nobody 200 kg of gold. I mean I'm going to 200 kg of gold for $270,000.
2 kg out of 200 and 2 kg back.
I'm already home to Dubai.
In T So Dino Enzo echo reported case to my Ghana Police Service. And I'm going to convict him for saying about a key. So I'm I'm a fraud Dino Enzo. Now High Court will convict him in 2019. I sent him 24 months imprisonment with hard labor plus fines.
And I caught him up here and quashed this conviction in 2021.
So that time he never served it.
Uh I'm going to charge him but uh of course and that I'm going to record so say I'm already I'm he has sentenced him in jail because Court of Appeal I I reversed the charges even though I'm not serving this conviction.
And Supreme Court for actually said reasons in jail.
I'm going to find me this judgment said and conveyed and said The Supreme Court found that the complainant's absence from trial was fatal to the prosecution's case.
Since the prosecution relied on hearsay evidence from an interpreter without proving the complainant was genuinely available to testify.
The court also held that the evidence trying the two respondents to a prior agreement to defraud the complainant was largely circumstantial.
Leaving open the reasonable possibility that the two corporate were among the co-accused of appeal's finding that the absence of the original investigator alone was fatal to the case, it held this error it held that this error did not change the outcome. The appeal was accordingly dismissed and acquittal affirmed. Empty uh critique of the Ghana Police Service and said not investigator are too close to the complainant to the pointed even a good job complainant to know a airport a man of free Ghana a call Italy.
And the Supreme Court has said a microphone I said police phone I would be instead of I would be pursue justice now I would be sided with different people in the case empty over the assignment program and then necessarily no credit and then we get you and then said I would secure conviction you know I would imagine Ghana send that to me if you say you would bring me and I say please send me the same money so I can enjoy care in the case of battery cover to and then we get you and then say I would investigations I should say they need money can I call you and I say and then no credit empty and then very very rare said justice of the Supreme Court and then say it here the Ghana Police Service acquiring of more faster your investigations acquiring of more faster a draw conclusion said I would be a guilty and I said I would be a guilty talking about the Supreme Court the minority led by uh honorable uh Baffour Awuah Nana Baffour Awuah member of parliament for Manso South see almost as you call the Supreme Court I could challenge the bill law a granted the government of Ghana said they would set here regional tribunals and I said district tribunals I will believe this is strongly unconstitutional. It is the Justice Baffour Bonnie led Supreme Court, you know, apart from the fact some will criticize the Ghana Police Service.
Another case here is some will criticize [music] also uh yeah, the unconstitutionality.
That is the allegation of the minority led by lawyer Baffour the lawyer Baffour Awuah said such tribunal bill now parliament for our passing.
I will reverse it.
Lawyer Baffour Awuah and the NPP Accra side equal citizens.
>> [music] >> As uh as many lower courts and tribunals our parliament has to be treated.
>> [music] >> The law I must ensure that we say you will be dealt with under the tribunal system.
And so, it is either a regional tribunal which is part of the superior court of judicature or a a a lower tribunal which is part of our lower court system.
In case the government also establish it, a tribunal system I must say regional tribunal I will question as fair. Now, what about the two district tribunals now where they are concerned?
>> [music] >> Then and your constitution and I said it and your share and your constitution in the program.
Liberty affair >> Mhm.
>> The first one is new.
And then and you should say you bring your a tribunal system one a year independent of your your judicial system.
And you keep before 1992 now many of you were a tribunal system now not in Kenya judicial >> You know exactly what will take your business to the next level. Websites, apps, newsletters.
And we are here in the judicial system of Ghana or establishing under the 125.
Such as here.
Who established a tribunal system?
What you say?
Such as here.
>> Before 1992 and I said it.
>> Before 1992.
>> Mhm.
>> A public tribunal.
>> Mhm.
>> We said the transitional provisions of the constitution not cancel that within 6 months of the passage of the constitution the public tribunal board is abolished.
Constitution and the tribunal will be turned over.
But you know who got the tribunal system?
And the operating as an independent body.
Under section 5 of the act.
>> Mhm.
>> What is the administration of tribunals.
The judicial council shall in consultation with the tribunal oversight committee do The judicial council shall in consultation with the tribunal oversight committee established under section 4
