Immigration Update for June 17, 2026
Added:Hey everybody, Charles Cook here. Great to be with you today. We obviously are in a different location than we normally are. Uh, I am at the annual conference of the American Immigration Lawyers Association and as a result, I'm in some room that I found that everybody's quiet. So, excuse the decor.
I guess I could use one of those funky backgrounds, but yeah, you see where I am. I'm at a conference. Uh, and in San Diego here, there are, I think, three or 4 thousand immigration lawyers. Uh, I'm speaking tomorrow morning on, surprisingly enough, litigation. But let's get into some of the questions and issues that we have we need to talk about today. Give an update. First of all, let's start with DACA. Um, if yesterday was the was yesterday, I guess Monday was the 14th anniversary of DACA, which means the oldest DACA recipients are 45 years old. And the youngest DACA recipients are 25 years old, if I get that right. uh 24 20 25 or 26 years old because of course the Trump administration and the Obama administration didn't adjudicate any new DACA since 2017 and there are literally tens of thousands of people uh with pending cases 90,000 of them pending at USCIS waiting on Judge Hannon to make a decision on the case the only decision he is allowed to make which is to allow immigration to continue doing DACA cases and at the same time taking away work permits from Texas DACA recipients. Not DACA. Can't take DACA away, but he can take work prints away. It's just I I can't tell you why he hasn't done it. I can't tell you other than clearly he doesn't like DACA. He doesn't like being overturned by the Fifth Circuit. And honestly, there's really no way to force him to make a decision. Uh and the parties that can request a status conference are deciding right now to do nothing. So that's your DACA anniversary update. I'm sorry for everybody. Um, now let's update you on processing times.
So, here's what's crazy. Every case that we filed in May has been approved for an extension, but cases filed prior to that have not.
Now, question is one, why? Two, isn't that illegal? Because they're supposed to take first in, first out, right? The answer to the question, yes, that's illegal and they're supposed to take first in first out. At least if they tell every court in the country that they take first in, first out. Now, last week I talked about maybe possibly putting together a mandamus. Uh we're in the final stages of discussing that and making a decision. What we don't want to do obviously is you know why we didn't file on the advanced paroles is we don't want to push the government to just say screw everybody and deny everybody and we don't want them to do that. Now that we we think such retaliation would be illegal. We've never seen them do it before but this administration's awful.
Clearly, they're awful and we've seen them do awful things, especially with Zach recipients. Uh, so we're we're we're talking to our colleagues. We want to do it. We think it's a winner right away with the TTRO, especially since we now have proof that they are adjudicating new cases. Now, somebody asked me last week, well, should I just file my case again, file my extension?
Well, first of all, there's a problem with that. If you've already expired, if you haven't expired, can you file a second extension? Well, technically you can. It's a waste of money, but and would that result in an adjudication? I don't know. I I wouldn't recommend doing it. And I know some people will ask me this today, but I would not recommend a docker file a second extension. What I continue to recommend is you file your DACA extension a year in advance.
Period. Um, how else can you beat the system here? I mean, otherwise the system, they're going to use this to make you lose your job. but they're going to make this to make you begin acrewing unlawful presence and it's just awful. Now, I've had a lot of emails in the last week or so about documents who applied for advanced pole. Obviously, we've talked about this before, they're simply not adjudicating them. And while you could file a lawsuit, not sure it's the best thing to do because you're asking for discretionary benefit, right?
And they can just say, "No, we're not going to do it." Um, now obviously they should give that money back if they're not going to adjudicate them. And that's that's a discussion for the future. But there's a lot of people that were doing advanced parole because they're married to a citizen and they just need that legal entry. So they've asked me, should I start the waiver process? So the answer is yes. Um you should in any case file an I130. You should definitely file a petition an I130 if you're married to a US citizen because you have DACA.
Nothing can be done to you. U could they put you in deportation? Yeah. Can they deport you? Not legally. And of course, we've gotten two people back that were illegally deported. Um, oddly enough, they were then parrolled in, which now makes them adjustable. Yes, I know it's completely insane.
The system, but if you are married to a citizen and you're a dock recipient, file the I130. If you got an I130 approved and you're waiting on advanced parole, wait no longer. Go ahead and um and do the uh and do the waiver. Do the 601A waiver. We do them. Happy to give you happy to help you with that. But that that's kind of where we are on the DACA situation. Now, but the other big thing, the big update uh is the pause and discrimination memos. Now, we're going to get into the litigation later, but the memo obviously all them, all three memos were set aside by a federal district court judge in in Rhode Island who then issued a subsequent order to the government say, "What are you doing?
I need a status update." Um, and actually thinks there's a status update due today. So, Friday night, the USCIS put on their website that they are no longer enforcing the memos and supposedly sent an email out to all officers that says they're not enforcing the memos. Go ahead and do the cases.
Now, it's only been really two days, right? Nobody worked on the weekend, and I don't know anybody who's been approved who had previously been held up, but we know that there are tens of thousands of people whose cases were skipped because of the pause. Now, what does that mean?
Um well, you know, that means that immigration should be doing those cases first to get back into a first in and first out process. Um but they're clearly not doing that. Clearly not doing that. Uh we should know more later today because there's supposed to be a status update in that case. Uh but those memos are now gone. Now the question becomes, what does that mean for all litigation? Well, we'll talk about that in in each case as we go through them here in a second. I also want to update everybody on immigration dennaturalization. So, I know you're all aware that USCIS has been um has been assigning people away from cases they normally would do and making them go back and look at every naturalization case over the last five years. To date, they've probably put 50 people in denaturalization proceedings.
So, people come to me freaked out. Are they going to denaturalize me? No, they're not because there's there's a rule. They can only dnaturalize people who should not have been naturalized in the first place. Meaning, for example, that they had some sort of criminal uh criminal action that occurred before they were a citizen because there's a question on the form.
Have you ever committed a crime for which you have not been arrested? And everybody says no to that because why would you admit to committing a crime?
But if you in fact did commit a crime that you were then subsequently arrested for and convicted, now you can be naturalized or and I'm handling a couple of these cases or for example you have an individual who lied about who they were at some point in the past and never disclosed it subsequently.
Well, that's fraud. and they can denaturalize you for that. And I'm handling a couple of those cases. So, you're talking about 50 cases out of millions of people in. So, don't freak out about this. But if you were naturalized and in fact you were convicted for a crime that occurred before you naturalized or you lied at some point on some part of your naturalization or other green card application, yeah, maybe you want to talk to a lawyer uh to be prepared for denaturalization. Again, they're going to go through millions of cases. it's going to take them forever. But just understand that they are using AI to find these things. So just be aware of that. Um let's see the uh birthright citizenship. So the Supreme Court is uh supposed to be issuing a decision this term which means generally generally speaking anytime before June 30th, although I've seen them go into early July in the last couple of years. Now I I I was on I was on the Twitter machine yesterday. I can't wait for birthright session to be struck down. I I don't see any circumstance in which a maj five members of this Supreme Court strike down the exact wording the very plain meaning of and and and historic and and history of the 14th amendment. I just don't see how they do it. Uh, so I I think Scotas my my prediction is on July 3rd they'll issue a decision saying 14th amendment is says that if you're born here you're a citizen regardless of your your parents immigration status. So that's out there that's coming down.
Don't freak out when the opinion comes out. We'll go live when that opinion comes out and talk about it. Uh, next thing I want to just mention just briefly is the student visa rule that is coming out. So, the student visa rule is changing a lot about the program, making it much harder to change programs, limiting the amount of time that you have to finish your program, uh, barring you from doing a subsequent second degree of one you already have. So, you one masters, you can't get a visa to do a second masters. You can only get a visa to do a PhD. uh much more strict on changing schools, much more ch strict on changing from a different status to student. When is that good rule going to be final? Well, what the the proposed rule, which they're commenting on right now, uh that those comments end shortly and they'll probably take 30 days or less to then issue the final rule. Now, somebody said to me the other day in a console, well, they said it would take 60 days. I said, no, they didn't say that. They said they could take between 30 and 60 days to make the rule final.
and I have it on pretty good sources that they want this rule final before most schools start in August. Otherwise, a whole new trench of students is going to be covered by the old rules. Uh, and that old rules 60-day grace period change, etc. So, they're going to they're going to want to do it as quickly as possible. So, if you are an F1 student and you're thinking about changing schools, you do it now when you can do it. You get into the SE system and you change schools now and you start school now. you don't wait until the new rules come because they're going to be a heck of a lot harder. Now, a couple weeks ago, we went through the details of that rule and we'll go through it again once the final rule comes out. Uh the last thing kind of a general update is on VAWA fraud and Lozano Menzes and now the uh the other woman who's Linsk's cases. So, they all been sued by this one lawyer uh or law firm claiming that they committed fraud. Look, I don't know what they did. I mean, I read the complaints. pretty bad allegations of what they did. Uh Lasinski's fighting back. She filed a lawsuit against the lawyers for defamation. You know, truth is a defense, just FYI. Uh so, we'll see what happens there. We had a lot of console from people who, you know, they were they were they were tricked, right?
They go in for an EAD extension, they walk out paying $13,000 for uh Larars Salazana's now quit the practice and her whole her whole law firm just closed.
So, if you're one of those people who've been affected by these and you want to talk to an actual lawyer who tells you the truth, give us a call. We're happy to talk to you. Um, it is a very difficult and terrible situation. Uh, generally speaking, you're kind of stuck in the system because if you withdraw your case, let's say you find out that they lied, right, that you signed blank forms and they put stuff on there that wasn't true, which is some of the allegations. Uh, the problem you have is you're stuck with that lie. And if you withdraw your case, one, you're stuck forever with that lie. Two, they'll put you in deportation proceeding. So, it may just be wise for most people to just wait out the interview and then go to the interview and say, "Here's what happened. I'm a victim." And then maybe even apply for apply for a T visa or U visa as a victim of a victim of fraud.
Uh, so there you go. That's kind of our updates on the general law. Let's look at litigation. All right. The DV 2026 litigation. Uh, we're gearing up our second round. It closes. The signin signons close on Friday. I'll be filing next week, probably Wednesday. If I can get it done sooner, I will. Um, and the other case is still pending uh in front of Judge Leon. Uh, not much we can do at this point. Uh, it's not been pending long enough to to do anything other than just wait a little bit. Uh, keep in mind Curtis's suit is also with Judge Leon.
It's a week ahead of us. Um, and he hasn't consolidated the cases, although they're both with him. Uh so that's kind of where we are. We think we've got the strongest claim here. Uh but we will not let you die on the vine. I promise you we will not let you die in the vine. Uh the 75 country ban case uh is uh soon to be fully briefed. Uh I actually read I read last night the reply brief which Jesse's probably filing today. It is it's a work of art. Really? It's a work of art. Uh there is the government's brief was garbage. It was garbage. They didn't. They had no legitimate defense honestly to our complaint. So, we suspect we're going to ask uh obviously we ask for a hearing. Uh hopefully we'll get it quickly, but that that reply brief will be filed today. Hopefully, we'll get that that ban struck down soon for all our clients outside the United States. On the student visa revocation case, that is still pending with the judge. A motion to dismiss. We're just kind of waiting for his decision. We can't really do anything. So, the judge rules on on that motion to dismiss. So, here here we sit on the $100,000 fee case. Yeah. The judge ruled it. Judge in different case on our jud our judge hasn't ruled on it yet. The judge uh in uh in uh Massachusetts ruled on it and then he gave them a stay until the 18th.
18th or the 26th. I forget which it is.
Maybe it's the 26th for them to get it just to get for them to ask for a stay from the court of appeals. Uh they they had this whole crazy Saab story about why it would detrimentally affect the agency if they got rid of this fee, which only 80 people have paid. It's a joke. Uh let's see. The 39 country ban cases uh are all still pending.
Obviously, our Georgia case, which I'm working on uh directly, I will tell you this. I had a conversation this morning with government counsel. uh his contact so that his people that he represents was out of the office until today. So they were not here all last week. Uh and he asked for more time to file his response to our TTRO and I said I can't do that. I can't do that. Why don't your client just issue the EADS? I told you what they're doing. They said that's what they're not banned anymore. And uh while you kind of partially won, you're not going to win this. Now the problem of course that comes here is that if there is no ban that is our whole case right so we will we we're going to have probably have to amend the amend the complaint to make it an unreasonable delay case now we avoided doing that previously because unreadable cases are really hard to win for EADs. Uh but we kind of have the judge on board here. So uh he's going to get back to me today.
He's got a meeting with his client at 4:00 today Eastern time. By the way, it's only uh 10 in the morning here in San Diego. Um and so I'm going to speak to him at five o'clock, which is would be which would be two o'clock my time.
So we can give you a more further up on the Georgia case at six o'clock when we go live on our impact. And I apologize for last week. I was unable to be at beyond that impact live and and apparently it never happened and I apologize for that. But I was literally doing something else for church and I couldn't get I couldn't get out of so sorry. But this week we'll be live uh with our with our whole impact team at six o'clock at least with Jesse and and Zach. Uh on the other cases, Zach will update everybody on Chacumba uh as well as on the uh the the Denver case, the Colorado case. He'll give you updated because he's got he's got the updates. Hello. Don't you think Judge Lee is a bit late for his order for we are not? I obviously wanted sooner rather than later. Remember the last time we did this litigation, we got the order September 9th and we still got a lot of our plaintiffs approved. So, we can't you can't force a federal judge to act. Just get that through your head. You can't force a federal judge to act. You can just follow the rules.
Um on Majolan. Okay. Any update on Chukumba? Yes, the update is that Zach's going to update you tonight. Um Hi, Charles. Uh, Jesse uploaded a joint appendex. Yes, he did. Was it requested by the judge? No, it's requested by the law. The law requires a joint appendix.

How can the impact lawsuit help me in that? Um well again it's about visa issuance and know we haven't filed a 212F lawsuit because that's going to take a lot of effort and a lot of money and a lot of time. They're, as I said, they asked me today for an extension. And I said, I can't give you an extension.
Can't give you an extension. Now, they might move to dismiss the case at which point I would we'd have to file an amendment. So, we're we have an argument that, you know, they should be adjudicating the case and the judge could still rule on the TTRO.
Good morning, Mr. Cook. Is there any reason why 2020 and pending DACA are receiving emails saying we've taken action in your case? Uh probably because they're gearing them up, but they moved them locations. I don't know. I immigration has not said publicly and I have no source that's told me otherwise.
I don't know. It doesn't mean they're working on them. I am one of the I was placed 212F DV27. I would like to join the impact lawsuit. Uh how it helps on that? Well, you're not coming unless you have a visa. You can't challenge the 212F unless you have a visa. So, get the visa.
Is the first circuit generally liberal?
Generally, yes, generally. Um, appeals take unless the government asked for an expedited appeal, they take forever, a year. EB2NW approved in May and Rio.
Living in Italy, soon to get my Italian passport. Oh, just process in Italy then. Process for the green card there.
My Euphoya request been pending for records over a year. Should I resubmit the request? No, you should sue them.
So, Elizabeth, just here's a little trick of the trade. They only have 20 days to respond. They don't respond in 20 days. You can file an appeal and say, "I consider your non-response within the statutory period a denial. I appeal." At the 20-day mark on the appeal, you can file a federal court lawsuit. You're likely to get your results much faster that way. Can you talk about traveling right now? Your app should be flying.
What about those who have 20? Look, if you have if you have DACA, I've said this a thousand times. You can travel all you want inside the United States.
You can fly inside the United States. If you don't have any lawful status, then you don't fly. Period. It's pretty simple. The real Hey, ear font. I contacted PP. They told me my case on hall for extended review. You know, it seems like they are not complying with the corner. Okay. Well, that's why we sue. It's why we sue. Uh, good news is that a lot of renewals submitted in late December starting to be approved. Seems like USA is working backwards.

I like to have both spouses there. Generally, I don't require it, but but sometimes beneficiaries come on their own. Just depends.

Yes, she needs to go. You need to bring your daughter to that interview. Been waiting for a DACA approval since January. Can I send for a foyer is not going to speed up your case. In fact, it'll slow down your case. You have to move your physical file. Don't file a foyer. I'm applying a year in advance doc approval. And yeah, that's what you do. Just apply a year in advance.
