What we have got to talk about which I'll go over here first is this um Supreme Court ruling because it could it could open up a potential for Brian Cobberger to get an appeal, which wouldn't that be a [ __ ] thing cuz he needs at the moment all the help he can get. That would be [ __ ] wrong. that would um so the Supreme Court sides with criminal appeal rights which is big this was a big case this was I don't know whether you've all been you've all been following I see someone putting Hunter versus UA USA USA 8 to1 victory yeah so US Supreme Court is an 8:1 decision on Thursday upheld a man's right to appeal prison sentence that also prescribed mental health medications um which I did notice this, right? I noticed this when Brian Cobberger was filling out his um his plea deal. That [ __ ] What the [ __ ] is See, this is what does my eding. I got rid of them stupid air things cuz people were saying that they look [ __ ] stupid. So, I got rid of them. Well, I ain't got rid of them. They're beside me, but I went back to the overtheair headphones, but now I feel like I'm on a [ __ ] lead like a dog. Um, so yeah, I I was looking and there was some things in there that was like it was almost like, yeah, sign this, but you're going to sign all your rights away and that and if the judge decides that he could punish you more, um, then you can't sort of argue with it. Do you know what I mean? Um, and I thought, what? And I think that's what's happened here cuz they kind of tied into it in when they done his plea.
This dude, he was supposed to take um some medications, some mental health medications, and this guy went, "Fuck no, I ain't." And I was like, "Well, hold on a second, mate. You signed a plea deal. You signed it, didn't you?
You signed it." And part of the stipulation of that was that you have to do this. And he went, "Fuck no."
So the case Hunter versus US focus on Hun Manson Hunter I theI who was charged with 10 counts of bank wire fraud.
Hunter pleaded guilty to one of the charges in exchange for dismissal of the other nine charges. His plea deal included waiver where he dismissed the right to appeal his conviction and sentence. However, during his sentencing, probation officer recommended Hunter take mental health medications and undergo certain mental health treatments. Hunter objected to take a mental health treatment or medication appealed the sentence. The lower court held that Hunter would not be able to appeal the sentence because he agreed not to appeal as part of his plea deal. And basically to cut a long story short, they had a vote. It's gone to the Supreme Court and it's been ruled 8 to1 in favor of allowing a man to appeal his prison sentence despite a waiver in his plea deal, which do you know what I mean? It this is a good thing. This is a good thing. Now, there is a stipulation here because what they basically said in this, this accounts to like a miscarriage of justice kind of thing. Um, let me see if I scroll down.
Um, um, where was it? Where was it? I can't [ __ ] remember. Not without reading the whole thing. But yeah, it's it's like it's it's like a miscarriage of just ah, here we go. Look. However, justice on the high court did not agree.
Justice Alina Kagan wrote, "The agreement not to appeal is uninforcable because it would result in a miscarriage of justice." And I suppose what it all take what like in the Brian Cobberger case, you could turn around and say, "Well, hold on a second. He's obviously pad guilty."
But what if all of a sudden it turns out there is evidence to support that Brian Cobberger was um was [ __ ] over by everybody who was in the system. What? Now he can't appeal and and and bring forward an appeal even if he wants to go down a route of um ineffective assistance of council. Do you know what I mean? It is. So it does open the door. Now it doesn't mean that that's going to happen. I don't know.
But um is um I think that this is a possible this is a um something that could move the needle back in the other direction. And Brian Kobener does need it. First of all, what I'd suggest he does is get better legal representation because unless Anne Taylor has got some [ __ ] deal, which I don't think she has. I don't think Ant I do not for the life of me think Anne Taylor is um is planning on some [ __ ] deal in the background. I I I can't see it. I could be wrong. I'm not saying I'm right. I'm just saying from what I've seen, I can't see Anne Taylor in the background plotting like [ __ ] some Bond villain and all of a sudden she's going to spring into action and this is going to be the um catalyst for it. But look, you know me, I'm always I'm always willing to be proven wrong. So, um you'll have to let me know in the comments what you think. Do you think that this does indeed open the doors for a potential for Brian Cobberger to appeal in the future? Or do you think that something else is going to happen?
