In criminal law, self-defense claims require demonstrating that a person reasonably believed they faced imminent danger of death or serious bodily harm, and that their defensive response was proportional to the threat. The Carmelo Anthony trial illustrates how legal analysis considers factors such as the number of attackers, physical disparity between parties, the defendant's presence at the location, and whether the defendant was outnumbered and in fear for their life. Texas law requires proving intent to kill at the moment of the action, distinguishing it from premeditated murder, which requires proof of prior planning.

The Karmelo Anthony Situation Just STARTED A Race War...😳Added:
Toad's racist friends started a race riot at Carmelo Anony's trial.
[screaming] Hey man, we on the road to 1 million. If you ain't hit that like button, subscribe button, and turned on all notifications. Slap the [ __ ] about yourself, cuz that's the first thing you should have did when you clicked on this video. Let's see what it's hitting for.
>> One of Ch the Builder racist friends is outside the Carmela Anthony trial starting a race riot. This usual suspect Jake Lang is the one who went to Chutter Builder Bond Heron caused a disturbance and got arrested for contempt of court.
Now he's outside the Carmelo Anthony trial trying to antagonize black folks into >> Wait, what happened?
>> Court. Now he's out of the builders. Bon Heron caused a disturbance and got arrested for >> So So he caused the disturbance and got arrested >> contempt of court. Now he's outside the Carmelo Anthony trial trying to >> Okay. So he went to Chad's court, right?
And now he's at Carmelo's and caused a disturbance. Got arrested at Chad [ __ ] and came here and is causing another disturbance. apparently >> antagonize black folks into a reaction >> WHATEVER YOU KNOW it >> did have they ever released the the any type of footage there may not be any I don't know I I just assume that there is but have they released any footage the police you know any surveillance cell phone footage of people in the crowd of when this altercation happened.
You know what I'm saying? Of when he stabbed him. We need to see that because, you know, everyone's fighting over something that there may be a video to and can give us a clear picture on what actually happened. You know, >> I've yet to see a video. This is the reason why Austin Metaf is dead because THIS IS THE RESPONSE THAT is told. This is the response they teach their young people to have. This is the response that the mothers, the black mother.
>> Before we get this video started, if you want to learn how I made $142,000 from YouTube this month, join my community by clicking the link in the description.
That's where I give you guys all the tools to grow on YouTube and make money, as well as offering you guys the opportunity to make videos with me, to do joint videos. Don't get back to it.
>> This community, this community does not teach its people to respect personal boundaries. It does not teach people to talk with respect.
AND THAT'S WHY AUSTIN MED said because of your failure as black parents.
Failures as black parents, failures, failures as black parents. Teaching the youth to kill.
What's up, [ __ ] >> Said me and you mutual combat, bro.
[sighs] I mean, if you're going to one of these, I guess that's what you're you're you're willing to you know what I'm saying?
Like you're signing up for that. If it pops off, [ __ ] you you got to you got to keep it gangster.
But no, I [sighs and gasps] wouldn't be out there over over this over this uh situation talking about some mutual combat, me and you right now. That makes you that does make you look weak. It's like you you can't you can't uh discuss. You can't have a discussion like a man. You got to just uh feed into the stereotype he's trying to paint. You know what I'm saying?
doing all that talking and fake crazy act. But make sure to ignore that request for mutual combat. Make sure to act like he didn't hear that brother asking for mutual combat. Cuz in Texas, if y'all both agree to fight, y'all can fight. And there's nothing the police can do about it.
>> But Jay ain't >> But what is he saying though? Like I mean that's what he said. You should do better as black parents. That's worth fighting over. like actually throwing fist, my [ __ ] >> That's Mo. Yo, they yo, they just act crazy. They act like demons, man. They fake demons, bro. They not really crazy.
They're not really unhinged.
>> You can really argue the same thing for the the white kids' parents. You know what I'm saying? Why was Why was they Why was they ganging up on the the the black kid like that? You know, >> they know their limits. Jay Lang talking about low impulse, to be honest, is just >> is complete. Like, yo, they lack self-awareness completely. Jake Lang probably has the lengthiest rap sheet of anybody outside that courthouse. But he's talking about low impulse control.
Dog, you are a felon. You did multiple years in prison. You just got arrested two times within a span of 30 days.
>> Damn.
>> You are literally a career criminal. You can't talk about those impulse control.
You have none.
>> You got to look in the mirror first, buddy. these alt-right white supremacist ex pages. They don't show Jay Lang antagonizing black folks. They don't show Jay Lang race baiting black folks, but they only show the aftermath of Jake Lang successfully rage baiting black people. So Jake Lang shows up, antagonized, says all type of racial slurs.
>> Wait, so this [ __ ] is like with Turning Point USA. I see the TP USA.
>> All type of words. He finally was able to raise Bay Unk into just going off and losing his mind. and unsaid some things that again I don't support I don't stand behind >> but to take him out of context of being antagonized and rage baited and post this online trying to destroy the man and destroy his life for saying this after Jake Lang started this to me is just disingenuous bro only good only Good is a deadly good.
>> Obviously, I disavowed that rhetoric.
Somebody being hateful and racist towards you should not make you hateful and racist towards an entire race of people. Clearly, we are all on the same page. But you guys have to admit, even if we all can disavow us and say Unk was wrong for this, it's not okay. It's not cool to say something like that, right?
cuz all white folks ain't Jake Lang and Jake Lang don't speak for all white people. But there's something very wrong with clipping somebody out of context and then using this as a representative for all black people. Look, this person says let them >> Well, you know that's what they going to do, bro. Like >> go mainstream with their racism. It's time America see these degenerates for what they are, who they are, and what they stand for. Can we now stop pretending that the vast majority of black people aren't harboring hate for whites, Asians, and Latinos? Open your eyes, America. Why are the people who are online complaining about snowflake culture the biggest snowflakes? They want to be victims so bad. But here's what they're not understanding. It doesn't matter what year we're in. It doesn't matter how long you try.
Mainstream society is not going to see racist people as victims. Sorry, it's never going to happen. They're not going to see an all-right farright white extremist group and say, "Yeah, they're victims." No. Right. It would never happen. You're a waste of your time. But this Carmelo Anthony trial is divided among racial lines, bro. Like honestly, it's divided, bro. Yo, when you go outside, you literally have black people over here, white folks over here, and it's like, and they are clashing, bro.
And their strategies are a lot different, too. And maybe somebody who's much smarter than me can break down in the comment section like the dynamics of how the black protesters are choosing to protest and how the white protesters are choosing to protest. But the black protesters are staying in groups, right?
They're all kind of like concentrated in one place, in one location, and they're moving together while the anti-Comelo Anthony protesters like do have one or two like follow like the concentrated black group to protest or to like antagonize them while you have the other ones that are standing on each corner as cars drive by to spread their propaganda.
Somebody smarter than me could probably break down the social like like it'll work like I don't know like the like the like you know like the dynamics to why that happened or how that maybe like a microcosm of America. Y'all let me know, right? Comment with your best think piece on why the black protesters are moving in concentrated groups while the white protesters are kind of following the black protesters and then you know like a large majority of them are separated on individual blocks and corners to spread their propaganda as other groups is coming through right now. Again, I particularly don't think this like proc Carmelo or anti-Carlo is divided across race lines to be honest.
I know black people who think Carmemelllo Anthony is guilty. I know white folks who think he innocent.
>> Now, I I've reacted to this probably once or twice. I haven't like really went back in my own free time or on video or anything like that to like do any research on it. But I think my perspective of the situation was that you, like I said, there needs to be some type of footage released to to give a better opinion. I wasn't there. You wasn't there. Uh, my perspective was that I I believe that they ganged up on him, you know what I'm saying? Like he was outnumbered, you know, and that could be grounds for him being in fear of his life. Um, I can't remember the full detail details to it though, but that was my perspective as far as I remember.
>> Right. But the protest outside the courthouse is divided across racial lines, right? And I I I think I I was standing as in like uh he it's 50/50 I feel like with the with his situation. It could be both ways, you know, >> for some reason. Or at least that's what people is trying to portray.
>> He was NOT AN AGGRESSOR. CARMELO WAS NOT AN AGGRESSOR.
>> I don't see I don't agree with that. You see that right there? Him being an aggressor. I don't I don't I don't believe he was an aggressor in this situation. you know, he was sitting under their tent or whatever, sitting by them and they told him he needs to move, you know, like and then, okay, I remember a little bit details. I remember they had the tents, the teams, the schools tents were in the stadiums, which they do that sometimes, but like any track meet that because I I did track, I ran track for a couple years.
any track meet that I ever been to, the the tents were the the teams, the schools tents were always separated, not by each other, but they were never in the stands. Maybe under the stands, but not actually in the stands. You know what I'm saying? So like him sitting under their tent should not have been a problem if the tents are set up in the stands because it's taking up that where else is the the [ __ ] is a [ __ ] supposed to sit.
Okay. Yeah, he can go sit somewhere else in the stands. So what? You know what I'm saying? It's not that deep. You know what I'm saying?
WE WILL walk free.
WE will walk free. WE >> Who who's the random white boy here?
[laughter] Hey yo, who's this [ __ ] We We [ __ ] with you if you're standing with us.
Now, you know what I'm saying? They got they got their own little chat though.
Hey, little rhythm, no little rhyme.
Carmelo Anthony will walk free. HUH?
>> And look at this. Turning Point USC powered by Front Lines.
This Carmelo Anthony trial happening days after the Cyrus Carmarmac belt in verdict is such a bad idea, man. Yo, race relations right now is at an all-time high. There's so much tension.
Black folks just watch a 60-year-old Asian man who should have known better follow a 14-year-old black kid outside of his store who essentially didn't steal anything from his store. followed him outside of his store, walk him, chased him down, and then shot him in the back.
>> Went to trial and got found not guilty.
>> What [laughter] What is What is this case? I've never heard of this one.
>> On a jury of no black people, right? So, when black folks see that, they see, okay, there's a two-tier justice system here. All right. Rules that apply to thee do not apply to we.
All right. is the rules that apply to some like again other minority groups and some races do not apply to us.
Dominant society has different rules.
Other minority groups have different rules. We don't have that luxury.
You could follow somebody down. You could stalk them. You could hunt them down. Shoot them in the back and say you fear for your life because you thought they had a gun. So when they see this Carmelo Infinite trial, it's like, "Hold on, bro. This trial ain't much different than right like the siren carcin if that Asian man can get off for shooting that teen that 14y old in the back after stalking him then Carmelo Anthony should get off right that's the mentality right now of a large percent of black America they're fed up now I'll be real with y'all my mind isn't made up in this Carmela Anthony trial I'm literally watching this trial as if I'm a juror trying to figure out what to >> you know what's crazy we we fighting we we fighting the black or white you know what I'm saying meanwhile this is exactly what the government want bro meanwhile you it don't matter if you black white interest rates high then a [ __ ] gas prices more than doubled in in a month you saying they coming down now. You know what I'm saying? For how long?
Before they go back up, who knows?
What else was I going to say, man? I'm literally watching this trial as if I'm a juror trying to figure out what took place, trying to figure out if it's self-defense.
Cuz before the trial started, the things that came out had me thinking, "M Carmelo, you bro, you you did kind of bad, homie. You you [laughter] you whing out, son. Right. You did bad.
But then day one of trial after the opening statements, which we're about to review from the prosecutors and the defense, Carmelo Anthony self-defense case is looking a tad bit stronger.
>> Right.
>> So, the prosecutors start off their opening statement overselling. Even the professionals and the analysts who was saying Carmelo Anthony is cooked last week is saying bro after the opening statements brother the prosecutors like it sounds like they like they are overpromising something they can't deliver on and once more details come out about why Carmelo Anthony was under the tent why he was there who was he talking to things of that order the series of events is looking more like self-defense to be honest even the type of knife he had doesn't appear to be something you would unusually not have in your bag.
>> You're not supposed to have a knife on campus. So what? Yeah, you're not supposed to carry a gun at work. So what? Okay. in a in a place like Texas, Oklahoma, the South, which is where I'm from, [ __ ] where you got the right to stand your ground and something pops off and you telling me I can't defend myself because, [ __ ] [ __ ] the job, [ __ ] the school, [ __ ] the rule, what does the law say? You know what I'm saying? What does the law say? Because at the end of it all, now see see that's where the school gets tricky though because that that's literally government property though.
That's tricky. You know what I'm saying?
But say it's not that then [ __ ] the gun the gun law has is is in your favor. The job is the only thing. Yeah. The job can fire you, [ __ ] But the the the law can't say nothing about anything because you're on the clock and you shot somebody in self-defense. Stab stab stab somebody. They can't they can't do nothing about that.
You know what I'm saying?
>> Here's a portion of the prosecution's opening. So yeah, he wasn't supposed to have the knife, but if they ganging up on him, and he he could [ __ ] get jumped, get his head stomped in, you know what I'm saying? He can you can die from being jumped. You know that, right?
You can die from being jumped. You can die for in a one-on-one fight.
So he pulls the knife out, tells them, "Hey, I'm g I'm gonna stand my ground. Don't [ __ ] with me." They [ __ ] with him. Dude got stabbed.
That's >> statement. They told this jury, "We are all here because Carmelo Anthony decided to take a knife to a high school track meet and >> he decided to take a knife and provoke somebody, right?" another young man who he didn't know into touching him, holding an already >> provoked him into touching him.
>> Open knife in his hand. And so, okay, you could provoke somebody into touching you. That doesn't mean that person has to touch you, though.
Like, like come on. Same thing for Cho the Builder, right? Dude told him. Dude was pointing and laughing at him. Haha, look at you, Cho. Cho. You know what I'm saying? Don't come over here though or I will protect myself. Toad walks over there, shoots him like like come on.
Come on. And and Toad is locked up right now for it. Come on now.
>> Plunging it into his heart. They went on to say that this man decided to commit an unjustified provoked murder and that this case has nothing to do with race.
This is not selfdefense.
Let's talk about the prosecution's beginning of their >> It's definitely not pre premeditated first-degree murder though. It's not that >> case in front of this jury. With us, we have our guest, former prosecutor Nicole Deour, criminal defense attorney Joanna Neves, and criminal defense attorney Mario Galuchi. It's so good to have you all on. Mario, let me get your thoughts on this first. I've been hearing you talk about it all day with Ted.
>> And who's to say kids with weapons is a bad thing, bro? It's only a bad thing when you don't teach them how to the the the the the use of the tool.
It's only a bad thing when you don't teach them the use of the tool. You just say, "No, that's bad. Don't do that."
They don't understand. So, they only know bad things with it.
But when you hear this fact that the prosecution says they have that the knife was open inside of the bag, how compelling is that to this case? How the [ __ ] do they know that the knife was open in the bag? How the [ __ ] do they know that? Come on now. You don't know that.
And And so who? Okay. And what? Okay. So, okay. Having one up top.
Yeah, it's worse. But you still had the gun in your bag.
One up top is the way you're supposed to carry. If you're not carrying, you're actually loafing. If you if you don't have one up top off safety, you're actually loafing. You put yourself at a disadvantage. You might as well not even carry the gun.
You know what I'm saying? So, what does it matter if the knife was open? And how do you even know that? Like, come on.
>> Your thoughts on this verse? I've been hearing you talk about it all day with Ted, but when you hear this fact that the prosecution says they have that the knife was open inside of the bag, how compelling is that to this case?
>> So, I mean, >> is that really all that important?
>> Making the prosecution is trying to make it seem like he went there with an open knife in his bag to court.
>> It was like like a school shooter like like a white boy. Look, they trying to paint him like a white boy. Stop it.
Stop it. They trying to pay up like a white boy. Oh, he just had the knife open and he was ready to just to just stab anybody and go on a on a hunt and and a mass killing spree with a knife.
Like like come on, bro. Like he's some white school shooter or something.
>> Cut it out.
>> A problem. The prosecution is trying to make it seem like he went there with an open knife in his bag to cause a problem.
>> Uh I don't see it that way. It's a pocketk knife. We're not talking about a machete. We're not talking about a dagger. We're not talking about a switchblade. We're talking about uh, you know, an ordinary pocketk knife that's used on a daily basis to to do whatever utility you need to be done. So, just by >> [ __ ] I just bought this [ __ ] can of [ __ ] This [ __ ] [ __ ] you can't even tilt it, [ __ ] You got this [ __ ] still cold, >> but you can't even tilt it. Anyways, I bought this [ __ ] [ __ ] And it's some plastic on here. It's like it got like a It was like some plastic on here as like a safety mechanism. That [ __ ] was hella hard to get off, bro. Oh god, [ __ ] What my point is, he has the knife for things like that to cut in the plastic and open up packages. That's all the knife is for. Regular utility things.
>> And I believe you're going to hear this from the defense. Just by the virtue of there being an open pocketk knife in a bag doesn't mean that he went there with the intent to harm someone. Exactly. And I and I think that that's what's going to come out on the defense side once once we get this >> because you have one up top off safety doesn't mean you're you're trying you're looking to [ __ ] just shoot this [ __ ] up, bro. Like what? The police walk around with one up top off safety cuz that's what you're supposed to do.
>> Oh, up and running.
>> That's why Glocks don't even have safeties.
What do you think about the theory that the prosecution has that Carmemelllo Anony's position all along was to get someone to do something so that he could kill them? Do you think that's effective? And is Carmelo Anthony going to have to take the stand to combat that?
>> Hi, Julia. I definitely think there's a damage that happens when you kind of overexaggerate and um emphasize things that aren't necessarily going to be consistent with what the defense is going to put forward. Carmelo Anthony was a good student. He worked. He He came from a good family. He's got a support system. He participated in athletics. And you want the jury to believe that he really came to school with >> He said that he worked. So he I'm assuming he had a job.
[ __ ] I ain't had no job in high school. I was thugging. Anyways, a job. He played sports.
He He was passing classes if he's eligible to play sports. What I'm saying is his hands are free. He ain't just out here running the streets.
[ __ ] I I I couldn't play sports no more cuz I was running the streets.
I was smoking weed.
You know what I'm saying?
>> The intention of or attract me with the intention of murdering somebody. I think that's a far stretch of the imagination.
I don't think even Jake Lang, if you hooked him up to a lie detector test and forced him to tell the truth, I don't even think he would tell you that Carmemelllo Anthony woke up that day to go ahead and kill somebody like like Carmel didn't wake up that that day say, "Yo, I'm going to put this knife."
>> You know, they can't even use uh polygraphs, lie detectors in court because they not accurate. They're not 100% accurate >> in my bag so I could use it on somebody at the track. So never submit to one >> me that's a [clears throat] far stretch.
Now unfortunately in Texas though you don't have >> even if you do it's only it's only oh so good >> have to prove premeditated murder. You only have to prove intent within the moment right and that's the difference between let's say Texas and other states. Other states you got to prove this was planned. In Texas, you got to prove that when he pulled out that knife on Austin Metaf, his intent was to murder Austin Metaf, which I think even that is a hard stretch to prove to be honest. Now, >> you you can't prove it because an altercation happened where he was outnumbered. Bro, this isn't like dude, it ain't like the Austin guy was by himself. That's not what happened, bro. He wasn't just by itself, bro. That's not the perspective I left with a year ago. Whatever the [ __ ] I reacted to that [ __ ] [ __ ] Let's refresh.
Who was Let's see.
Was Austin metaf with anyone else when he got killed by Carmelo Anthony?
Let's see what it say.
Aame Kef was with his twin brother Hunter and a group of around 20 other students under a team tent when the fatal confrontation occurred, right? He was sitting next to their team tent, bro. Like come on, man. He like he was under their team tent or some [ __ ] and that was what the [ __ ] problem was.
Just the Carmelo Anthony was by himself, bro.
Uh now like during this trial or you know like within like the opening statements they was even able to prove and they actually confessed to this in their opening statement that Carmelo Anthony went under the tent a cuz it was raining heavy and then two he had a friend under the tent.
>> Is that right?
>> So he already had a friend he knew in the tent. So he went under the tent and was talking to his friend. Austin Mave came into the tent wanting to be the dictator, right? like the grand leader of the tent and decided he wanted to kick >> Carmela.
>> He wanted to be Chad that day, huh?
>> Anthony, which like most people, you come under a tent, somebody is talking to their homie, the homie belongs under the tent. Y'all having a conversation.
You don't come under the tent.
>> What it is is that's an all white school at Carmelo Anthony is black. That's what it is.
>> Hey, bro, you got to leave the tent now.
Like, what are you like the right? What?
like the all all knowing dictator of the tent and who belongs under the tent.
Like it's just the stupid kid argument that shouldn't have resulted in somebody dying. But the series of events doesn't make Carmelo Anthony look like a troublemaker, >> right?
>> He comes under the tent cuz his homie is there is raining. You come under the tent, you see Carmelo Anthony talking to somebody which is his homie who >> So what is Carmelo Anthony supposed to do? Just run away like a little [ __ ] or get his ass beat?
You know what they going to say? Oh, he should have just walked away [clears throat] for what?
They didn't have to walk away.
This is a kid telling him to walk away at that.
You know what I'm saying? Like get jumped and then he's over here seizing out cuz he hit his head too hard and it's, oh, who did that to him and now he's in trouble? Somebody's getting in trouble here.
somebody >> you know who belongs under the tent, right? Camelo Anthony is is in the tent talking to him.
Even out of sheer respect for the person you do know that's under the tent talking to Camela Anthony, wouldn't you say, you know what? Oh, that's >> there's no respect with with children.
There's no respect. You don't learn that until you've you you until you grow up, >> friend. All right, cool. All right, I'mma just leave him alone. and grow up has no age limit. I' I've been tuning in to Dean the Great and Adrien Bronner.
Really? That [ __ ] Adrien Bronner, that [ __ ] is is Boy, that's like they that's like some that's streaming [ __ ] Like I actually tuned in like Look, let me show y'all [ __ ] [ __ ] just set to got the new uh they got new uh got the new setup. You know what I'm saying? So [ __ ] [ __ ] tuned in, got the, you know what I'm saying?
[ __ ] got the new little couch, you know what I'm saying? So got new little setup. So I tuned in, put the put the Adrian Brunner and the Dean of Great on the TV, you know what I'm saying? And tuned in for a little bit. Them [ __ ] is on some high school timing. Like they kicking it, bro. Like when I was in height, like that's the [ __ ] I was doing 15, 16, 17, 19, 20 years old partying after high school football games and oh oh let's match.
You know what I'm saying? Like that's that's type of energy. Like bro, [ __ ] is that [ __ ] is 39 years old. 10 10 10 year uh 10 kids and is thirsty as [ __ ] for these little 20 year old girls that Dean be having. That [ __ ] don't be having the hoes. Dean be getting the shorties, right? And that [ __ ] be trying to force himself on them. Like anyways, that's off topic, but it goes back to like the mindset [ __ ] is what I was what I'm getting at. Let me fix this back y'all. Let's get back to the money.
But coming under the tent, like trying to bully this kid, trying to attack this kid, right? Putting hands on this kid, trying to forcefully remove this kid is right instead of going and calling an administrator to come and handle the situation is why we're in a situation right now. were not in a situation because Carmemelllo Anthony woke up today trying to kill somebody.
>> Austin Metclaf, the stabbing victim and team were under their school tent at that track meet that Carmelo Anthony went under Metaf's teen tent during bad weather. Metaf asked Anthony to leave the tent prompting a fight where Anthony stabbed Metaf. Mario, I'm going to focus on one part of that that actually has come up a lot online by our viewers.
Early on there was a question of why Carmemella would have been under the tent. And I know I mentioned on air even that it could have been because it was raining and we found out today that both sides say it was raining really bad and the school that Carmemelllo Anthony went to was not one that had a tent. Is that important? Is the reason that he was under that tent important when we had this issue of the prosecution saying he went there to provoke a murder? See what makes it th this this is an important factor and this is something that a lot of people are not even going to think about because a lot of people didn't run track. They didn't go to track meets.
And I like I said earlier, what what matters a lot is the fact that these tents were set up in the stadium in the stands.
The bleachers, not under the bleachers, not to the off to the side. Like every track meet I've ever been to, they've never had the tents, the team set up in the stands. That's what they said. That was my perspective when I reacted to it months ago that the that the tents were set up in the [ __ ] stands.
That means there's only so much space, bro. The teams are there sitting there next to the parents and the crowd. Like, so it it gives him an even more of a reason to be under that tent is what I'm saying.
>> Look, Julia, I can't agree with you more. I mean, it's raining out. There's a tent. You seek shelter. Um, I don't think that the fact that his school did not have a tent has anything to do with it. There was a tent. It was raining. He went there. And we just found out during the opening statements that he actually had a friend in the tent that he met and spoke to. So, it it's not like uh, you know, >> that makes it worse.
>> He's there's no tent and he went there with the forethought to to to start a fight, provoke a fight and and stab somebody. that helps his defense the same [ __ ] >> If this was any other state outside of Texas, he would probably not be on trial for first-degree murder right now because you'll have to prove premeditation. You'll have to prove he came to the track me looking and murdered Austin Madav. When obviously that's not the case. They didn't know each other. He went under the tent cuz it was raining not to cause trouble. He went under the tent cuz his homie was there. Austin Mave came and an altercation took place. Now him stabbing Austin Mave, I still can't get on board with. But do I think that this is just cold bloodooded? This kid went to kill like like common sense would tell you that's not true at all. Now we finally got an understanding of what the defense defense of Carmelo Anthony would be in their opening statement. And here's what they had to say.
>> But we have Cody Thomas. He's there right now and will be giving us notes throughout the day. This is defense attorney Mike Howard saying, "Self-defense is useless if you wait until it is too late to use it." In that moment when Austin makes the first physical contact, he reacts in a split he, meaning Carmelo Anthony, reacts in a split second of fear and chaos. Well, why didn't he just walk away? There's an answer. After Carmelo defended himself, he ran. He didn't stab twice. He dropped the knife right by the tent on the bleachers. Instead of running to the exit, he goes onto the track and walks right up to a coach and stayed with this coach until that officer arrived.
exactly what he was supposed to do.
>> How what else would you rather him done if he was to do what he did?
>> Come on.
>> Back in our panel, see what they think about the defense side of things. Still with us, trial attorney Mario Galuchcci, former prosecutor Nicole Deour, and criminal defense attorney Joanna Neves.
Nicole, I'm going to start with you on this one because now we're getting more details, at least from the defense perspective about what Carmemelllo Anthony did immediately after the stabbing. How important is that?
>> I think it's very important and I think that the prosecution is going to harp on the idea that well, if you're fleeing, then you that we can use that as evidence that you have a consciousness of guilt.
>> But the defense is >> wasn't he fleed to the coach to tell what he did. What the [ __ ] He told the authority, the proper authority, what he did. What do you mean? That's not that's not running from the [ __ ] scene.
He ran from the scene. He would he would have ditched the track meat.
Coach would have been looking for him.
Like what?
>> That we can use that as evidence that you have a consciousness of guilt. What the defense is going to say is exactly what you heard in the opening arguments.
He wasn't fleeing at all. He was running to safety. He was running to the safety of an adult.
>> Day one definitely went to Carmelo Anthony and his team. They did a brilliant job. Now it gets even better.
>> How hard how hard is it? It's not hard.
It's common sense.
For real >> for Carmelo Anthony, you know the narrative online, man. Carmemelllo Anthony wasn't even supposed to be at the track meet. He wasn't even supposed to be at the tent. That narrative got actually the the uno reverse card.
Carmelo Anthony team actually introduced something that I don't think anybody knew or expected. Carmelo Anthony and his attorney, they did a uno reverse on this narrative. Now, the same people who said Carmelo Anthony is guilty because he wasn't supposed to be at the track meet and he wasn't supposed to be under somebody's else's tent. I wonder if they would keep that same energy. Now, >> how is he not supposed to be at a track meet? Like like you can't like nobody can go to a track meet. A random person off the side of the road, a [ __ ] homeless person that got $3 to enter the track me can go to the track me. Bro, what are you talking about?
>> Under somebody's else's tent. I wonder if they would keep that same energy now.
So Carmela, >> oh, he skipped school and went to the track meet to kill somebody. Right.
>> Attorney says, "Yo, Carmemella Anthony was actually scheduled for long jump, right? He was actually scheduled to compete at the track.
>> Okay, long jump. The [ __ ] has a [ __ ] event. Come on now.
>> Meet now. Let's go.
>> Of course he does.
>> Oh, now Austin Mave tells Carmelo, "You can't be here. You need to leave."
Now Austin Mave makes the first physical contact in spite of the warning, "Touch me and find out." In that split second, Carmemella has a decision to make how and when to act. So, he reacts in a split second of fear and chaos. He immediately says, "I was defending myself."
Now, here's the thing. We finally got the official measurements. Uh, Carmemelllo Anthony was was uh five, they said 56, 130 lb. Austin Maf was 6215. We find out in court that >> Hey, he said 62 215.
Austin Maf was 62215.
1356.
Come on now.
That's like me. I was taller than that though.
>> We find out in court that not only did Carmelo Anthony belong there and was supposed to be there and was scheduled to perform.
>> That's way out his weight class, bro.
>> Austin >> 215, my [ __ ] And what what grade are these kids in?
Who is is Austin Metaf a senior and this is a freshman or you know like >> Melo Anthony belonged there and was supposed to be there and was scheduled to perform but Austin Mave and his brother apparently left the last track meet early to go fishing. The coach got mad at them and they were not supposed to be at that track meet. I guess they still showed up to show the coach they still come.
>> So they were the ones that were not supposed to be there, huh? Crazy how that works, huh? made it to the team, but they were not even supposed to be at that track meet.
>> Crazy how that works, huh?
>> Because they left the last one to go fishing and the coach told them right like uh like uh not to come to this track meet right now. The exact words were I >> look look being bad. You see who's bad?
You you see who don't listen.
These [ __ ] left the track meet and they they got banned from that one.
They weren't even supposed to go to that one and ended up dying after trying to pick on a black kid. Bro, that's wicked work right there, man. Let me get my sound effects for [screaming] that.
That's wicked work.
>> I need him here or I did not need him there. That's was the coach's exact word. I did not need him here.
So if that's the case, if Austin Mave was not supposed to be there, Carmemelllo Anthony was supposed to be there, Carmelo Anthony was talking to a friend under the tent, >> right?
>> How could Austin M >> that was supposed to be there?
>> Come and tell Carmelo Anthony he needs to go when he was not even supposed to be there in the first place.
>> Oh, that's tough.
Carmela about to walk, bro.
They about to walk. Even if they was to find him guilty or something, I don't I think he would still like make parole or something, bro. You know, like they they would still like they let him out early, you know? He might have to do some time, but he wouldn't have to do like no probably more than 20 for sure. You know what I'm saying? 15 10 probably.
He's young, too. So, you know, I feel like they would have spared him in this even even if he was found guilty.
>> Now, does that matter in the grand scheme of things in terms of murder? I mean, those are details that help, right? But the only details here that really matter is in the moment then often >> [ __ ] that helps that [ __ ] that helps so much.
people. They wasn't even these are troublemakers that weren't even supposed to be there started picking on him. You know what I'm saying? Like come on, man.
And got what they was looking for.
>> Maf do enough.
>> Got your brother on a t-shirt.
[screaming] >> I didn't even know his blood brother was there. So you know he was you know he had his back. blood brother. That's two That's 430 lbs versus 120, bro. 130.
That's That's That's uh 12'4.
That's 12 That's 12 foot four, right?
And 430 lbs.
>> versus 56130.
At least that. at least 430, 6 foot or 12 foot, whatever the [ __ ] Y know what I'm saying?
>> Anthony to justify deadly force. That's what they're going to be discussing. But all the character assassination that needs to stop today, bro. All right. Cuz to me, y all the character assassination kind of got debunked in court. But we'll be covering this every day. Let me know in the comment section. What do you guys think? How do you guys think is going currently? Uh do y'all believe that Carmelo Anthony will be found not guilty or guilty? Let me know. Okay. If you're >> That boy going to walk, bro. That boy going to walk. After hearing this [ __ ] that boy going to walk.
That boy going to walk, man. Y'all let me know what y'all think though, man. We on the road to 1 million. If you ain't hit that like button, subscribe button, turned on all notifications, slap the dog [ __ ] about yourself, cuz that's the first thing you should have did when you clicked on this video. I get at y the next one. And I'm gone. Ty Pine.
