State Police... Did They Think We Were Stupid?

[00:02:11]These checkpoints took place on July 17th, 2026. And I say these because in this video we're going to cover two different checkpoints which were both live streamed. Both full live streams are linked in the description. But this video is going to combine 6 hours of live stream into one educational video.

And the first thing we're going to ask these pirates is where is the due notice to this checkpoint which is required so that it abides by the United States Constitution and the Fourth Amendment.

[00:03:11]>> There's two things I want you to notice about what he just said. Number one, he acknowledges that the checkpoint needs proper signage. Number two, he's claiming this isn't a checkpoint because they're not actually stopping the cars, which is really cute and all, but let's go ahead and take a look at what the courts would consider a checkpoint and whether it would be considered a seizure under the Fourth Amendment. What makes a checkpoint a checkpoint? Here's some simple factors that courts look at to determine the difference. physical implements or control of traffic. Road is blocked, narrowed, or funneled with cones, barriers, or with police vehicles. Drivers have no reasonable choice but to stop. Officers signaling drivers to stop when officers wave down motion or otherwise direct vehicles to pull over or stop. Those look awful lot like hand signals the officers using directing traffic, letting people know when to stop and go. Systematic stops of vehicles. Please stopping all vehicles or every nth vehicle using predetermined patterns. If the purpose is investigatory or regulatory, the primary purpose of the check is for something DUI, license, registration, seat belt, inspections, warrants, etc. The length and the nature of the detention.

[00:04:33]vehicles are stopped, questioned, or inspected in a manner that it goes beyond a brief non-intrusive contact. If these factors are present, a court is more likely to find that a checkpoint exists. If a reasonable motorist would not feel free to drive on by, it is likely it is a checkpoint. All right, let's go ahead take a look at this chart here I've got for you guys so we can get an idea of what the difference is between what the officer claims that's not a checkpoint because they're not stopping everybody and it is a checkpoint because well you guys are going to be the judge of the public opinion. So make sure you leave your comments of which one you think it is or this is a checkpoint road narrows with cones and police cars all traffic funnel through one lane versus this is not a checkpoint police car parked on the shoulder traffic can pass through without stopping. What we all can physically observe is they set this up on a one-way road, funneled all the cars through it with police cars and cones.

[00:05:28]For the second line, officers motioning to drivers, whether it's to stop, pull over, or to keep going versus officer stands on the shoulder without signaling to anyone to stop, observing for infractions and only pulling someone over they see without a seat belt. And what we're actually physically going to see here is officers using hand signals to stop drivers, check what they want, let them go, stop the next driver. And remember, it comes down to whether a reasonable person would believe they could just drive through or they would have to stop and abide by the officer giving the hand signals. And the third line there would be all vehicles are stopped or every third vehicle or every nth vehicle meaning a certain pattern set versus no pattern. Some cars pass, none are stopped except for the ones they visibly see with the violation. Now that we got that education part out of the way, we can get back to the video where you guys sit in the seat of the judge of public opinion. [00:07:12]Around 2:00 p.m. on July 17th, 2026, I got a phone call from an Erie County family member stating that there was a very large police presence in front of the Safe Harbor on Ferman Boulevard that kind of resembled a checkpoint. So, with no delay, I headed down there. And when I got to this intersection right here, [music] [music] this is when I first noticed something suspicious when there was a state trooper set up with a radio in an unmarked car. And then the checkpoint that isn't a checkpoint is miraculously down here on both one ways kind of like well entrapment would you guys say this is looking sus this is looking suspicious illegal.

[00:08:24]But once again, fam, for the facts on the operation that's about to go down on the court of public opinion, this is the last intersection before the checkpoint.

[00:08:34]At this very point is where the sign should be stating that there is a checkpoint ahead. Otherwise, it's a violation of the Fourth Amendment because now it's not optional, fam. But the state police here clearly do not care about their oath of office or the constitution or your fourth amendment rights.
