While the federal court might intervene and they can say send it back for another officer to make a decision. This involved a Ethiopian man who was found inadmissible by being involved with Ogaden National Liberation Front, or also known as the ONLF. Because of his inadmissibility, he could not pursue a refugee claim. But he still stated that he was at risk to return to Ethiopia for three reasons.
Number one, because he was ethnically Somalian. Number two, was because he was perceived at perceived as an ONLF supporter. And number three, perceived as supporting terrorism and subversion against the Ethiopian state. Also asked to have his PRA application suspended or put on hold until his ministerial relief application was processed. So the federal court set aside the decision that the officer made and ordered a new officer to make a decision. And this was mainly because due to the fact that they found that the officer did not analyze key information. Found that the he did not analyze the specific country conditions and their risk profile. Also found that the PRA officer just did not address the putting their PRA application on hold where the court said it should have been addressed. PRA officers must assess key information in an application. If important legal arguments or country evidence is ignored, then it could be sent back for redetermination.
