Somewhere in your asylum application or your declaration, there is a mistake and if you don't get ahead of it, the officer will find it first. I'm going to tell you how to correct errors in the written materials in support of your asylum case. I'm going to tell you when the window opens to do this and I'm going to tell you what most applicants miss about why corrections to their documents alone simply isn't enough. I spent 11 years working for the government's two main agencies for asylum and refugee matters and almost every case that I reviewed had something that needed correcting at the time of the asylum interview. Now, the real problem isn't having a mistake in your documents. The problem is what happens when the officer finds it before you do.
You see, officers are trained to cross-check everything. Your form I-589, the application form, against your declaration, your written materials, all of them against what you say at the interview, all of this, okay? And if you say, for example, that you were threatened three times, [music] but your declaration says it was four times, well, that gets flagged. You see, officers follow an informal rule. Three inconsistencies >> [music] >> and they call you not credible. When that happens, well, it's over. You lose your case. Now, your window to fix errors in documents is phase one of the interview. This is the administrative review of your form I-589. [music] At the end of that phase of the interview, you sign it and that signature is like the deadline. Once you sign and enter phase two of the interview, your application is considered locked pretty much and anything contradicting these written materials becomes an inconsistency. Now, your declaration's handled a little bit differently. The officer does not actually go through and review it all with you before the substantive part of the interview begins. So, you got to be proactive. My recommendation, right before you sign your form I-589, I want you to raise any declaration issues with the officer. You could say something like, "Officer, I stated in my declaration that this thing happened in March 2019, but it was actually March 2020." Now, raising this error, this this correction before the officer has a chance to ask about it later in the substantive Q&A part of the interview, well, it turns a potential inconsistency into an innocent mistake and that signals good faith, okay? [music] Don't stay quiet just hoping that the officer's going to miss it, okay? And don't over explain. Brief and calm is far more convincing than defensive and lengthy. Look, here's what most people miss. Even applicants with clean corrected documents lose their cases all the time. You see, correct documents [music] are essential, but they're not enough. What makes or breaks most interviews is testimony, okay? If your testimony is vague or disorganized or fails to connect your story to the legal requirements, then you're a serious risk, even with a perfect application and perfect written materials.
