In criminal trials, judges can issue gag orders preventing defendants from explaining their motivations or discussing the consequences of their actions, creating a coercive situation where defendants face repeated imprisonment without resolution; this legal mechanism, previously only used in murder cases, was applied to criminal damage charges in the Filton activists case, raising concerns about the potential for such powers to be used against other groups in the future.

Added:The judge didn't want any repeats. He wanted to make sure he got some convictions, and so he banned them from talking about the genocide in Gaza. He banned them from talking about their motivations for taking direct action.
They couldn't talk about Elbit's crimes.
You know, they were completely gagged.
[music] They were not allowed to tell the jury that if they convicted them of criminal damage, they would be sentenced as terrorists. [music] And some may think, well, why didn't they just do it anyway, considering what they were facing? If they had done, the likely outcome would be the jury would be discharged, they'd send them home, they'd reschedule the trial for a year's time, [music] and they would put all of them back in prison on remand for another year, for another trial. And so, you're in an impossible situation where you're all completely gagged. You can't tell the jury cuz I'll just keep putting you in prison and doing the same thing over and over again. So, yeah, so that's the that's how they managed to ensure that that they were able to convict them of criminal damage. And the damage is the key charge because the whole terrorism accusation is based on the property damage to those Israeli drones.
So, that's what they needed to try and get this through. The only way that this has ever been used before is in murder [music] cases. Multiple people being killed, and then the person may be on trial for murder, but then be sentenced under terrorism. It's [music] never been done for criminal damage.
