In legal proceedings, individuals have the right to invoke self-incrimination protections when facing allegations of wrongdoing, and commissions investigating official misconduct must navigate procedural complexities such as sub judice matters and conflicting investigative methodologies to ensure fair and thorough examination of evidence.

Madlanga Commission | Adv. Andrea Johnson back on the stand
Added:The Medunga Commission, now, IDAC head, Advocate Andrea Johnson, has invoked her right against self-incrimination.
This against allegations by Hawks investigators and Witness O, which implicate her in alleged interference and defeating the ends of justice with respect to her handling of a criminal complaint against Major General Fidos Khan Johnson Fidos Khan Johnson returns to the stand today. Now, for more on this, let's get the latest from SABC News reporter, Khanyi Maphanga.
Certainly, a very interesting day yesterday, but I I have a feeling today is going to be even more interesting.
>> Indeed, a good morning to Lilian and to the viewers. Once again, we expect that Advocate Andrea Johnson will take the stand at 9:30 a.m. this morning to deal with the testing of the three statements that she's put forth before the Medunga Commission. I think the Commission's bench doesn't like to call it the cross-examination. I think it's the more probing questions that are set to be put to her from 9:30 a.m. this morning. I'm not sure how the Commission will navigate the particular evidence because her responses to what she was asked to answer to in the subpoena um give a response or lack thereof on the issues that IDAC is facing, which not only deal with her in terms of her then role as a senior public prosecutor, but also their intimate operational methods in the investigations, namely investigations into crime intelligence or the crime intelligence division. Now, the difficulty is that in statement one, although she defends the case against Lieutenant General Dumisani Khumalo, she doesn't want to go into details. She states that it's sub judice, but we do know that Brian Perauchi has gone into great detail about his investigative methods, and it would only be fair for that to be put to the test before Advocate Andrea Johnson as the head of IDAC because there were a number of flaws that were found in that particular process. And in terms of the A1 statement or the section 27 referral actually not being met in terms of its requirements and how it seemed that the investigative methods followed a conclusion before you actually get to an investigation that can get to a conclusion. So, there are a number of flaws that you would expect the commission to test her on, but if she's stating that at the outset the matter is sub judice because it's before the courts, I'm not sure how far the commission will get on that particular subject and then there's also the issue of the main allegation, I think, which is the crux of whether or not there is some kind of proximity with Major General Khan and that is through the allegations made by witness or in the Hawks investigators. That is the allegations of interference and defeating the ends of justice. She too there is invoking her right against self-incrimination. So, I'm not sure how far the commission will get there as well, but we'll see after that homework what the position is and how the commission must take it forward in terms of the probing questioning that is expected from 9:30 a.m. this morning.
