But, regarding indefinite leave to remain, what are the qualifications and the requirements that are needed right now?
Because there's a lot of confusion. Like I said, some people actually think those changes have been implemented and many people are actually losing guard of the current requirements. I know somebody who was rejected just last week because she missed one point thinking that it had been removed as per previous proposals and all of that. So, the first thing is if you're following the skilled worker visa pathway, so you've been in the UK on a work visa, you need to make sure that you've been in the UK working for at least 5 years. So, the 5 years stands, nothing has changed. It is still currently 5 years. So, but you must have lived and worked in the UK for at least 5 years. If you're somebody on a skilled worker visa, that's why I give an example of my nurse friend who my supported to relocate to this beautiful country 5 years ago. She just applied today and we're going through the application and I was thinking, this is amazing, you know, welcome. And it's just the relief and just like the peace of mind, the freedom and all of that.
And the best news is I've been able to support her in the 5 years to progress into a band 7 nurse and our plan now is, you know, she's going to be progressing into an advanced nurse practitioner which obviously, as we know, is a job I'm very passionate about because that's my own pathway. So, yes, that's the first requirement, 5 years in the UK.
Now, what is the next requirement? By the way, it is our first time meeting.
Obviously, my name is Melvis. I've been in the UK now for 15 years. I've got 17 years of experience in healthcare. I started my UK journey 15 years ago as a carer in a nursing home like many of you are or planning to do. But, I decided to upgrade because I was earning peanuts, 16,000 a year working 40 hours a week and earning less than 1,000 pounds after tax. So, I studied nursing. I've got a first class degree in adult nursing. I later on did a master's degree in mentorship in nursing which helped me to progress into senior management and leadership jobs within the UK National Health Service where I've got 13 years of experience. I then later on did another master's degree years in advanced clinical practice which helped me to further progress into an advanced nurse practitioner which by the way is the most senior clinical nursing job and I studied for free. I paid no tuition fees for both of my master's degrees despite being an international student.
I was given a work visa. All my tuition fees were paid and I was getting paid over 50,000 pounds a year to study for my second master's degree and 30,000 for my first master's degree. So, leave a comment and say I need work from home jobs. The next thing is you obviously need to have all the dates that you traveled out of the UK. So, in the 5 years, if you've been out of the UK, you must write the dates that you left the UK, where did you go, what did you do, every single thing. That is a mandatory requirement that many people don't know about. So, if you're leaving the UK three times every week, 10 times every week, 10 times every month, make sure you're writing the dates because that's a requirement when you're applying for indefinite leave to remain.
Many people are not aware and they are always shocked when they are received, you know what I mean, by the requirement. So, the next thing is have you been working full-time for all employers that have given you visa sponsorship in the 5 years?
Yes or no? So, to qualify, one of the requirements is you're supposed to have been working at least full-time hours, which is 37 and 1/2 hours a week, for the entire 5 years for all employers that have given you visa sponsorship.
The number of employers doesn't matter.
It's more about the fact that it has to be all. For example, when I worked as a nurse in the UK, my first 3 years as a nurse, I had about seven different employers. Seven employers, which means when I was applying for indefinite leave to remain, I had to produce all of that, every single thing. And so, to make sure that I worked full-time for each and every one of those employers. That's what they're looking out for. You need to write your life in the UK test.
After that, you need evidence of English. You know, you're supposed to have an English test.
Which by the way, from March of 2027, the government has increased the level to B2, but as of now, it is not yet that. So, the government said they wanted to give immigrant a whole year to adjust to the new change. So, that's the only change that I've made, which they've confirmed implementation date from March of 2027, and everything else remains the same.
Now, the next thing, like we said about the English, mind you, if you've shown evidence of English in previous applications, it makes it a lot easier showing evidence of English, you know, for your application as well. Or, if you've studied in the UK, a university degree, obviously, then that also helps as an exemption. So, you don't need to go writing IELTS or OET getting excited about English exams, because again, many people write them and you don't need it.
