In Washington State, police officers have the legal authority to detain and arrest individuals suspected of driving under the influence (DUI) who have been involved in a collision. When a suspect is under arrest for DUI, they must be informed of their rights, including the right to remain silent and the right to an attorney. Officers may request a breath test to determine alcohol concentration, and suspects are advised that refusing the test will result in driver's license suspension for at least one year, while submitting to the test may result in suspension for at least 90 days if the alcohol concentration meets legal thresholds (0.08% for those 21 and over, 0.02% for those under 21). The suspect in this case was arrested for DUI and hit-and-run, refused to provide a breath sample, and was subsequently booked into Kitsap County Jail after receiving medical clearance.
