The 19th century witnessed a fundamental contradiction where formal abolition of judicial torture coexisted with systematic organized suffering through multiple parallel systems: prison reform movements that created new forms of psychological suffering via solitary confinement, persistent corporal punishment in military and educational institutions, transportation and convict labor systems that recreated punishment regimes under different names, and colonial territories where European empires maintained brutal practices despite their metropolitan legal reforms. This gap was maintained through geographic displacement (hiding practices in remote colonies), taxonomic displacement (categorizing suffering as discipline rather than torture), and racial/colonial hierarchies that excluded certain populations from humanitarian protections. The Congo Free State under King Leopold II exemplifies this contradiction, where humanitarian rhetoric masked a forced labor system causing 5-10 million deaths through amputations and violence, while the First Geneva Convention of 1864 protected only European soldiers, not colonial populations.
