Bomet Governor Hillary Barchok sentenced to one month in jail for contempt of court

[00:00:01]I'm the branch secretary Kenya County Government Workers Union Bomet County branch.

[00:00:06]Uh we want to thank God uh this time.

[00:00:10]Uh whereby we had a case in court uh 016 of 2022.

[00:00:16]Uh today uh uh we have got justice uh from uh the judiciary uh High Court Nakuru.

[00:00:30]Uh whereby uh there was a court condom uh whereby union had filed a uh a court condom against County Government of Bomet.

[00:00:43]Uh and today uh uh justice has been given and further directions and orders has been given as per the law.

[00:00:54]Uh uh we won the we started the case uh October 2022.

[00:01:03]Uh and there were orders in the the liquid orders or interim orders were given but the employer failed to comply with the same orders.

[00:01:13]Uh judgment was given on 29 February 2024 and in favor of county workers.

[00:01:22]Uh by winning the county workers won all the prayers that given in court.

[00:01:29]Uh the County Government of Bomet appealed the same on the same judgment and uh the Court of Appeals uh gave judgment on 20 uh 18 February July 2025.

[00:01:46]And uh the appeal it was taken by the County Government of Bomet was dismissed with cost.

[00:01:52]Uh and still county had uh failed to comply with after court had uh for failed to comply with the court orders.

[00:02:02]Union filed the same uh contempt of court uh on August 2025.

[00:02:09]Uh the same contempt of court was ruled on 6th February 2026.

[00:02:18]And in fact, county government of Uasin Gishu was favored and they were given time uh to comply with the court orders.

[00:02:27]But still, uh the county government of Uasin Gishu have not complied uh did not comply with the court orders, which was delivered on 29th February 2024.

[00:02:37]Uh Uh On July 2025, county government of Uasin Gishu after court of appeal had called union.

[00:02:52]They had invited union so that union could uh uh uh tell them or guide them on how to implement the the judgment, which was given on uh February 29th 2024.

[00:03:10]Uh we had given county government of Uasin Gishu on some implementation matrix how they were supposed they were supposed to implement the court orders. Because on the same implementation matrix, uh we have categories of county staff whereby uh we had over over 595 county workers who had been dismissed uh on October uh September Yeah, September 2022.

[00:03:44]Well, that is when the court the the union uh uh proceeded to to to court after they were the county were given uh notices for dismissal.

[00:03:56]Uh on the termination matrix, we had briefed the county government of Bomet that uh we have uh staff who are o- uh o- over 60 years.

[00:04:11]And the same county staff, they were supposed to be uh given their arrears, salary arrears, and benefits for the time they have they they had worked for uh during the in the county government of Bomet.

[00:04:26]Uh the same in the same matrix, we have county staff who are who are in the list who are dismissed.

[00:04:35]And uh they they have been they have been paid and they are in still they are in payroll.

[00:04:42]As uh those staff, they were supposed to be given their salary arrears and they continue they are supposed to continue working uh as the staff of county government of Bomet.

[00:04:55]Uh we have staff who are who are who are deceased.

[00:05:00]So, the same uh for the same staff who who are deceased, we have uh beneficiaries for those staff.

[00:05:09]So, they are they were supposed they are they were supposed to be paid uh benefits for those who are who are deceased.

[00:05:18]Uh and the county county government of Bomet have done nothing on those uh remuneration matrix.

[00:05:26]Uh the same, we had uh county workers uh who uh who had who have gone who are not within the county government of Bomet as at now, but they by then uh they were dismissed uh with the same notices.

[00:05:47]So, uh, the the same staff that was supposed to be cleared by county government of permit and be paid their their their dues.

[00:05:55]Uh, so we thank the international office uh, for the same support for the support uh, in in the in the same case because the the the union county government workers union uh, uh, led by uh, honorable Robert Duba who is the general secretary uh, assisted the the branch uh, by filing the same case and we thank God for the same uh, union because we have won the we won the case from the beginning up to to date.

[00:06:29]Uh, today we won the the the same uh, case uh, on the on the on contempt of court whereby uh, the the the direction from the judge has been given uh, whereby we are waiting for the the same orders.

[00:06:46]Uh, to be enforced by uh, wherever are supposed to enforce the the the the the same meaning the same uh, orders.

[00:07:04]Uh, uh, still union uh, we are are we insist that the the same illumination matrix should be implemented by the county government of permit as they were given by union on July 2025.

[00:07:23]Uh, we want to thank the county government workers uh, staff, all the members and county workers uh, for their patience, their their prayers and support they've given union during the the time we were in court.

[00:07:38]Uh, and we are waiting for the enforcement of the the orders from the court whereby county staff they are supposed to be paid their salaries and arrears and all the benefits for 42 months.
