Citizens have a constitutional right to record police officers and public officials in public spaces under the First Amendment and the plain view doctrine, which states that if something can be seen from a public space, it can be recorded; police cannot turn this constitutionally protected right into a crime, and officers have no reasonable expectation of privacy when performing their public duties.

Tyrant Clown Cops Triggered Over A Camera Owned And DismissedAjouté :
The reason I'm talking to you is we've gotten some complaints about you going around filming in police department parking lots, things like that. What's going on? Do you have your ID on you?
>> Uh, no sir. I don't have an ID on that.
>> You don't have an ID on you?
>> No sir.
>> What's your name?
>> I'm not giving my name sir. I have no reason to.
>> Why are you videoing our property?
>> Because it's public property and it's a constitutional right. It's freedom of the press. You can you can video public property, but you have a right to video >> our our employees families or >> like this in a public lobby.
>> Ma'am, >> yeah, in a public lobby, I can video.
>> Hey guys, welcome back to the channel.
I'm your host, Peeps. And in today's video, we have cops educated on the right to film in public. Generally speaking, if you can see it from a public space, you can record it. Police cannot turn a constitutionally protected right into a crime. But these cops in the following clips are either uninformed or just plainly do not care about our rights or the oath they swore to protect.
>> Hello. How are you?
>> I'm great. How are you?
>> How are you? Take that down. Take that down, man. Please. No, thank you.
>> Who are you?
>> I'm a photographer.
>> For who?
>> I'm independent. Can I get your name, employee number, or badge number?
>> Excuse me?
>> Your name and badge number?
>> Why do you need my name and badge number?
>> Because you addressed me and I'm part of the public and that's your policy. You a police officer?
>> Yes. Yes, I am.
>> Okay.
>> Hold on just one moment. Okay. Let me let you talk for a few seconds.
>> Yeah. Let me let you talk for real.
>> Sure.
>> Did you give me your name and badge number? I'm going to ask you to step outside the door. Ma'am, >> this is a public lobby.
>> Ma'am, I'm going ask you to step exit the building. Okay. Please step outside the lobby.
>> You know, this is a public lobby.
>> I understand that, but I have asked you to exit the building at this point until we get a supervisor to talk to you.
>> Step right outside the door.
>> Okay.
>> Thank you.
>> What is your name and your badge?
>> You'll get my badge number and name when I get ready to give it to you. Not until >> Okay.
>> Thank you very much.
>> Hello.
Hi.
>> How you doing?
>> Are you the lieutenant? I am. And your name?
>> Lieutenant Owens.
>> Lieutenant Owens. Nice to meet you. I'm really good. You're so tall. Um, your your name and badge number.
>> Officer McCabe.
>> You, sir. Officer.
>> Nice to meet you. May I come inside and speak with you? Uh, what's it in reference to? You can speak to me here.
>> I would like to speak to you in the lobby if you don't mind. It's a public lobby and that man wouldn't let me in the lobby with my camera which violates my constitutional right to video on public property, public officials, public lobby. What do you >> I'd like to file a complaint against him because he refused ID. When I asked him to, I explained to him his policy. He refused what? Five times.
>> Ma'am, so I'd like to file a complaint.
>> What do you need? What do you need us to do for you?
>> File a complaint.
>> Okay. I I've heard your complaint.
>> Yeah. I'm I want it I want it in writing. I want it to be official.
>> File an official complaint. Then you can go to internal affairs.
>> Do you have a Do you have a form here?
>> No, ma'am.
>> You don't have internal affairs and and file.
>> So, you're refusing to take my complaint?
>> No, ma'am. I said if you want to file >> Where's internal affairs complaint? It's at the main building at 8:15 Wheeler Avenue. So, I had to go there in order to file a complaint against this man right here that refused to identify over and over again when I did absolutely nothing wrong.
>> What can I help you with?
>> All I was doing was videoing the property and then I was approached by that man rudely.
>> Why are you videoing our property?
>> Because it's public property and it's a constitutional right. It's freedom of the press.
>> You can you can video public property, but you have a right to video >> our our employees. Yes, I do.
>> Families or >> like this in a public lobby, >> ma'am?
>> Yeah. In a public lobby, I can video on public property.
>> What What is your purpose here?
>> All I wanted to do was get video of the public.
>> You got your video. So, >> I know it. Well, it was a complaint against him. Why? It took 1, two, three, four, five, six people to come and harass me over taking pictures outside.
arrest.
>> Before I ever walked in the door, I was standing out there in the parking lot and she started her crowd.
>> You ready?
>> Uh, no. You're ready. You can leave our property. Really?
>> If unless you have a reason to be here.
>> Okay. I'll file a complaint.
>> You file a complaint here. Let me give you a card so you please do.
>> Do you all have a card?
>> No, they don't have a card.
>> Okay.
>> You need to learn about the Constitution is what you need. Where's your vehicle at?
>> Who said I drove? And why do you care?
>> Like my lieutenant said, you need to go ahead and leave.
>> Then don't talk to me if you don't want me to stand here and answer you.
>> Okay, just leave.
>> So, there we have it, folks. This is what policing in America looks like.
Cops hate being recorded. Something about recording them performing their duties triggers them. Some will try to intimidate you to get you to stop, even though it's a constitutional right. This is under the first amendment and the plain view doctrine per the supreme court. If you can see it from public space, you can record it. No officer, public official or individual has the expectation of privacy in public.
>> Are you filming me?
>> I'm filming you. Put that down.
>> This is a public accessible area.
I don't want to be >> ma'am. Ma'am, you don't want to go. You don't want to go here right now.
>> Have a seat, please.
>> I don't have to have a seat. but they don't have a seat.
>> So, we have a protocol we need to follow. If you have a complaint you'd like to make against this female officer, I've got some paperwork I'll hand out to you. You can fill it out.
You can on the back you can put down your complaint or your personal information. What happens is I sign off on it and I'll bring it upstairs to internal affairs tonight. I'll slide it under the door and tomorrow morning they'll get it and they will contact you at the number you provide. And what they'll do is they'll start their investigation. And even if you can't come up with a badge number for this particular female, um I'm sure that they will do their best to get the pretty good physical description of her and then they will talk to you about it and figure out the scenario that what took place and everything.
>> Probably at some point they will show you a photo ID or a lineup of some sorting.
>> So she was driving >> even better if you have 408.
>> Okay. So anyway, like I said, there's a process that needs to be followed. I can get you started with the process and someone from internal affairs or OPR will follow up with you guys. Couple minutes and I'll be right.
>> No problem.
>> He's actually probably one of the better ones I've spoken to here.
>> Um, he lives in Bristol.
>> Can I help you?
even not.
>> Who are you?
>> Who are you?
>> Who are you?
>> My name's Tuck.
>> How are you?
Are you guys this weird all the time?
>> Yes.
>> Oh, okay. Well, hi.
Say hi, Mom. Want me to do a pose for you?
>> Sure.
>> You probably like that better, right?
>> Do whatever you want.
>> I'm asking what you like.
>> This is your time right now.
>> Here for your entertainment. I'd like to I'd like to entertain you more.
>> You're here for our entertainment.
>> It seems that way, right?
>> It's entertaining, but I don't think you're here for our entertainment.
>> Well, it seems like that's why he's playing around.
>> Are you a cop?
>> Would I be wrong in saying that?
>> Are you a cop?
>> Am I actually wrong?
>> What's your name and batch number?
>> He's just recording.
Okay. So, you're see you are here on uh for a reason. Okay.
>> I don't have to have a reason to be here.
>> Well, there's no loitering. There's no lawyering. There's no lawyering.
>> This is a public place. You don't know what you're talking about. Are you serious?
>> This is a public place.
>> You guys are fools.
You guys are fools.
Learn your jobs.
Constitution. You know what? First amendment, man. Firsting amendment.
>> How you doing, >> everybody? Everybody here is weird.
Everybody's I need about >> I need about 15.
>> Yeah. No, you're good for now.
>> That's good. What do you mean for now?
>> Well, I don't know, man. This is a >> for you guys. Oh, thanks. Okay. Did you leave your phone number on here?
>> I left my email.
>> I'm sorry.
>> Okay. If you leave me a phone number, it'd be a lot easier for them to get in contact with you. Um, they'll still email you. Um, >> for now.
>> What do you mean for now?
>> Well, I don't know, man. This is a >> That's for you guys.
>> Oh, thanks. Okay. Did you leave your phone number on here?
>> I left my email.
>> I'm sorry.
>> Okay. If you leave me a phone number, it'd be a lot easier for them to get in contact with you. Um, they'll still email you. Um, you can also >> I rather do it by by email.
>> Also, you can submit it via online. So, you guys decide what you want to do, but So, you you're refusing to give me your phone number, though.
>> Yes. Okay. Sorry.
>> Okay. Other than that, I will submit it and you guys will be all set. Okay.
>> All right.
Come on. Right in here for me.
>> You swore. You swore to protect the Constitution and you forget that we have freedom of press.
>> I completely forgot. You're absolutely right.
>> Whoa. You're absolutely right.
>> You can't forget, man.
>> I got I got to read that again.
>> It's like the first article of your job.
>> The right to record in public spaces is generally considered a protected first amendment activity allowing citizens to document events of public interest. As a rule, if you are not interfering with the ability of a public official to do their job, and the record activity is in public view, then the recording is protected under the First Amendment.
Police and other government officials typically do not have a reasonable expectation of privacy when carrying out their public duties. Let's watch.
Can I speak with you just a moment?
>> Sure.
>> How are you today?
>> All right. My name's Officer Carrison.
>> Little hot.
>> I'm with the police department here in Bristol.
>> The reason I'm talking to you is we've gotten some complaints about you going around filming in police department parking lots, things like that. What's going on?
>> Just doing some filming today.
>> Doing some filming today? Yes, sir.
>> Okay. Are you looking into the some of the Commonwealth attorney's cars and things like that? I'm just >> places where they have a reasonable expectation of privacy.
>> Uh, you know, there's no reasonable expectation of privacy in public, sir.
>> There is, sir, inside of vehicles. There is.
>> No, if you can see it from public, sir, you know better than that.
>> No, that's not entirely accurate.
>> Is that right?
>> Accurate.
>> You all don't use uh you don't you all use that to your benefit?
>> No sir, >> it's not.
>> Absolutely not. Do you have your ID on you?
>> Uh, no sir. I don't have an ID on me.
>> You don't have an ID on you?
>> No sir.
>> Okay. What's your name?
>> I'm not giving my name, sir. I have no reason to.
>> Okay.
>> It's called the plain view doctrine. You should know about that. Anything you can see from public view is filmable and recordable.
>> Okay. So, trespassing trespassing on property like over here where you're not allowed to be. Restricted areas.
>> Where's restricted areas? Right over here.
>> Show me where it's Show me where it's restricted.
>> Right over here where you were just We're not walking over there.
Show me where it's restricted.
>> Where does it say restricted?
Where's the restricted signs? Where's the private property signs?
>> You're over here on property.
>> Where?
>> When you're over here on fire department property.
>> Fire department. That's not That's not public property. Yes, sir. It is. No, sir. It's not.
>> It's not funded by the public.
>> It is funded by the public. It's public property.
>> They have a reasonable expectation of privacy of the fire department, too.
>> Sir, you don't know what you know what plain view doctrine is, dude.
>> Are you the attorney?
>> How do you know I'm not an attorney?
>> Are you the attorney?
>> How do you know I'm not an attorney? How do you know I'm not an attorney?
>> I don't know. That's why >> All right. Well, no doubt my intelligence.
>> I'm trying to have a conversation.
>> Well, I am kind of having one with you, too.
>> Okay. All right. So, what >> you know what the plain view doctrine is, right?
>> Around filming everybody.
>> You know what the plain view doctrine is, right?
>> Things like that. You know what the plain view doctrine is, right?
>> I do know what the plane view >> Well, then why are you even questioning plain view? I absolutely do. Anything that you can see from public is recordable.
>> Okay.
>> So, you're you're saying you're saying that people don't have a reasonable expectation of privacy inside their vehicle?
>> No, sir. They have to the onus is on them to create that privacy just like in your squad car. I can walk up to your squad car right now and film everything I can see in here cuz it's called plain view doctrine. You've left your computer on, which is not a good thing.
>> Is it not?
>> Cuz that's on you to create that privacy on that computer. Right.
>> Okay.
>> Right.
>> No, >> that's not right.
>> Is it on me to create that privacy? Am I the one that's supposed to shut it?
>> Are you schooled with the police department policy or anything?
>> I am, sir. And in normal constitutional law as well.
>> Okay.
>> Yes, sir. Are you >> So, basically, you're just out here to cause trouble for everybody.
>> I didn't talk to anybody. So, who's causing the trouble? You're the one that stopped me.
>> You're the one that stopped me. I >> stopped you.
>> Yes, you did. You hollered for me and told me to stop. Did you not?
>> Did you not?
>> All right. So, then you stopped me. So, don't say you didn't mind. I >> shut the [ __ ] up.
>> Do you mind if I talk for just a second?
>> I'll talk to you, but he he ain't make no [ __ ] sense.
>> So, we just we got a call down here, as you can probably understand. Someone >> told me what the call was that we received.
>> I don't give a [ __ ] what the call was.
So that's why if I'm breaking a law, >> we come down here to make sure your voice you're the servant. Understand that >> that you are safe and everyone else is safe. Okay. Talk over you. Have a nice day, [ __ ] >> You ain't wasting my breath with your dumb ass.
