[00:00:17]All right. Um, >> your honor, we are here to set this matter for trial. The court had given us some ideas of availability. I spoke with Miss Schlax, Mr. Missrahi, and Mr. Cooper who had the other case and we've agreed upon if the court's amendable jury selection beginning March 29th, 2027 with trial to commence that week and into the week of April 5th.

[00:00:44]>> Last time we were here, Miss Schlax had uh some I think trial conflicts with some other death penalty cases. She and Mr. Ms. He has a capital case as well in January or February.

[00:00:59]>> Each month, >> okay.

[00:01:02]>> And and your honor, I'll I'll be happy to kind of go through the months. It's unfortunately I have five pending death penalty cases and every judge wants me to go ahead and set a date. I don't know if they're realistic or not at this juncture.

[00:01:16]>> Perfectly cam with the court.

[00:01:18]>> Um so I have a death penalty case set for November. That one I can probably say the most concretely should be ready to go. I have another two-week um non non-death but homicide set in January. I have a death case set in February. I now have this case set in March, early April. I have another death penalty case set with the court. I have a further death penalty case set in May. And then I just set the final one for August.

[00:01:44]>> And you're I did clear the trial date with the deceased victims next of kin. I also wanted to avoid for child care issues uh school holiday weeks for them.

[00:01:56]I think spring break is early March according to my calendar. Spring break is March 15th for Duval County.

[00:02:15]I believe it's either the 15th or the 8th.

If we're able to select a jury that first week, we can begin trial without taking a break and then have that second week to spill over. I build in a week for jury selection and a week for trial with those dates. But we might not need the full week for jury selection.

[00:04:38]>> All right. So, all right. Working backwards then for trial. Well, jury selection will be March 29th, 9:00 am, and that's for um jury selection um the trial to commence um that week. And also, please reserve the week of April 5th.

[00:05:17]Those will be the jury selectional week weeks. Then the final pre-trial.

[00:05:36]Is there um is there court there's no court holiday on the 22nd. Correct.

[00:05:51]>> Okay. Um, so March 22nd, 9:00 a.m.

[00:05:59]final pre-trial.

[00:06:14]My plan would be now that we have dates that I'm going to put in um a priority case order and a case management order.

[00:06:22]So um with you all present, I'd like to give you input in that. So do you anticipate I'd like to maybe handle motions the month before >> like sometime in February.

[00:06:36]>> Quite if there's if there's anything to start in January.

[00:06:40]>> Okay. because with with rare exception I have been able to make the vast majority of all the depositions that are taking place. I think Mr. Blight >> I saw that one that I can identify that I know I will need to redepose but it's it's going to be scanted witnesses.

[00:06:58]>> Okay. And I I did sign um an order this week with all the depositions. Yes.

[00:07:03]>> So I appreciate that.

[00:07:07]So tell me tell me what y'all are thinking.

[00:07:12]I mean like we can reserve the time or you can just let me know when you need me.

[00:07:30]Well, um, what I'm thinking about is maybe we should just I'll just leave it on like status and pre-trials. I I think that both sides may learn Okay. Um, I think both sides may want to talk about jury selection, logistics, and things like that. So, I'll just I'll just leave it on a pre-trial status, and you all we can touch base early in the year.

[00:09:42]So if there are any special requests such as um any type of post evidentary sequestering the clerk's office needs to ask for the money sooner rather than later. If you all are anticipating things like that, we need to talk about that um before there when is your budget year end or it starts in July, >> right?

So, we need to maybe y'all can have some of those discussions and I we I can give a preliminary idea of how many jurors, but if there are any type of special accommodations i.e. Okay. which is what we're doing in Gardener and Fernandez, which is sequestered lunches. Like they're they're not going out, we're catering in, they're not going to be milling around. Um, so if you all are thinking about those same type of things, we need to let the clerk's office know so they can ask for the funds. Okay.
