Citizens have the constitutional right to record law enforcement activities in public spaces, and police officers must identify themselves with name and badge number during encounters; officers who fail to understand or respect these constitutional rights may face accountability, as demonstrated in cases where officers were corrected by First Amendment auditors and held responsible for excessive force incidents.

Corrupt Cops Try to Intimidate First Amendment AuditorsAdded:
Police officers often make humiliating mistakes that are captured on camera exposing them to the public just like these police officers who were exposed and ended up doing a walk of shame starting off with these tyrants who thought they could bully their way into anyone. However, they had no idea they were up against someone with a better understanding of the law than them.
>> And what's your badge number?
I don't need to provide that. You already have Yes, you do.
At this point you guys are in a suspense, babe. You're out of here. In January 2021, a First Amendment auditor decided to head to the Yolo County Sheriff's Office and exercise his First Amendment rights by taking some picture.
Just moments into the audit, he was confronted [music] by a deputy who wasn't too happy with him being there.
All right, how about you? I'm good.
Cool. Can I help you with something?
What was that? Can I help you with something? No, I'm good. What are you doing taking pictures of?
What's that? What are you taking pictures of, sir?
I'm just taking pictures.
What's your name, bud? What was that?
What's your name, bud?
Did I do something wrong or something?
I'm just asking. You're taking pictures of stuff, so I'm just asking.
>> Yes, taking pictures. Okay. I'm just asking what your name is. Yeah, I got you. Okay. So, you're going to give me your name or Well, I don't know why I have to. Did I do something wrong? I don't understand.
>> It's suspicious you're taking pictures of stuff, so I'm just asking.
I don't No, I don't understand, man. Am I in trouble or something? No. All right, if I didn't do anything wrong, you just said it. I'm not. I'm just asking what your name is. You can say no if you don't want to give me your name.
It's simple. Yeah, well, I Yeah, I mean, if I didn't do nothing wrong, I don't see why I have to give you my name. The deputy clearly had no understanding of the law and was being schooled by the auditor. Moments later, the deputy had no option but to leave the auditor alone as he had no answers to offer.
>> Make sure you read all posted signs, okay?
>> What do you mean all posted signs? Okay.
Start taking Start taking pictures of jail facilities and stuff like that. You can get in trouble for that.
You can get in trouble for taking pictures of jail facilities? Yes. So, like I said, there's a bunch of signs I would read on 50, okay, >> Like this one? That's not a jail facility.
>> Which one is? Read the signs better, all right? Well, I just want to make sure cuz I'm going to go take a picture of it right now. But, do you want to? What's your name? Sergeant Juan Ceja, with the jail sheriff's office. Sergeant what?
Juan Ceja. Juan Ceja?
>> That's correct.
>> So, what's the issue?
I don't understand why you came up and >> put a camera in my face isn't going to change anything, okay?
>> I'm not saying it is. I'm not saying it is.
I don't feel like I'm done. I'm just asking what the problem is. I'm not trying to debate you. I'm asking what the problem is. That you're taking pictures.
>> But, now you're telling me Now you're telling me Now you're telling me you can't take pictures of a jail facility.
I I can absolutely take a picture of a jail facility.
>> Okay. Make sure you read the signs, okay? No, you make sure you get back in your car and you're dismissed and get out of here. How about that? See you later. You're dismissed, babe. Yeah, see you later. The deputy left [music] and the auditor started to go inside the facility. That's when he was interrupted by another officer who straight away started to intimidate him.
You're not going to like talk to me or anything like that?
Well, I'm just taking pictures. Okay. I don't see Is there much more information to give?
I'm just taking pictures. Okay. So, I'm just I'm just asking you any reason why.
I mean, I'm not being a jerk or anything.
>> I get it. And I'm just saying I'm just taking pictures. But, you're just taking pictures. Yep, that's it. Yeah.
So.
Is there But, what's the reason why?
Just taking pictures, you know?
Okay.
Is that okay? Take pictures of cars Yeah, but what? Just because.
Because But, see, that's the thing. Do you have an ID on you? I do. Can I see it?
Why do I have to show my Do I have to show it?
>> asking I'm asking if I can see it.
You're just asking if I can see it? Oh, if I don't have to show it, I'm not I don't know how the law works on that, but I'm not going to show it if I If I have to. It seems like every officer in this facility had no respect for a citizen's constitutional rights. Despite the officer's attempts at intimidation, the auditor remained calm and countered their unlawful action. This is private property? This is private >> You are this is you are I didn't know that.
>> It's open to the public for legitimate reasons.
Okay, so technically at this point, just to let you know. Okay. All right, once you go past that little area over there Okay. you are subject to search at no for no reason much over just for being here. Mhm. You probably don't want that to happen, do you? Not really.
>> Exactly.
You are required to identify yourself because we this is this is an actual government area. Okay. Okay? So, what you should do if you don't want to be like talked to or searched or anything like that is go stand at the corner. Cuz then you're not on my property. Cuz actually as of right now I can search you and anything I find I can seize. Is that right?
>> If it's if it's illegal.
Uh Uh I don't think that that's I think that's a probably not going to hold up in court, but you can't just search somebody cuz they're on this property.
>> Yes. Is this this is private property?
Is that it? It is private yet open to the public for legitimate business. The officer wasn't even aware that a sheriff's office constitutes a public building and that the auditor had every right to film there. Publicly accessible property, like you said, I'm on public property. Not at the jail, not mind you.
You said this is a whole No, it doesn't work cuz anybody can come in here and not be at the jail. This is a sheriff's office, right? Why do you have the right to ask me questions?
>> Cuz you're a public servant and I'm a private citizen.
>> So, you can't answer my questions? I can if I choose to. Okay, how about I choose not to then? Well, you're a public servant. You get paid to answer my questions. You get paid to serve me and and if if you're here and you're talking to me and harassing me harassing me like you are right now.
Well, you are. You're threatening to search me and that I can't be here and you you even said this is private property.
I'm just taking pictures. There That's the That's the telling you. Just taking pictures. I'm taking pictures to take pictures because I like cool [ __ ] And I'm a photographer. I mean what what is the what I could be working on a story that you don't need to know about.
It could be a million things that I don't have to tell you because there's something called the Fifth Amendment, right? The corrupt cop had no answers for the auditor's claims and that's when he proposed a hilarious situation to him which further highlighted his lack of knowledge about the law.
I'm just taking pictures.
>> was at your house taking pictures, would you want to know why?
But you're not I'm >> [laughter] >> I'm not at your house though. I mean I I have never even done this before. I was just out taking some pictures today.
And and I'm not at your house. If you were at my house, yes, I would come out and say why are you taking pictures of my house?
Have the Have the freaking president come out here. [music] On this property, so you are subject to search if we choose to search you cuz we don't know you.
You are subject.
Okay? You're subject to search.
So, I'm going to go over and take a picture of the sign.
You're Mr. Metal up, right?
What was that? You're Mr. Metal up, correct?
Oh, I I see what's going on.
Is that you? I have a letter for you if it's you.
Slowly the auditor was surrounded by law enforcement officers and the initial deputy also arrived on the scene and attempted to do something cool not knowing that he was about to be schooled by the auditor once again.
Is that your personal phone?
Hey, is that your personal phone? Both of you guys.
Personal phone or not? Company phone or personal phone?
I don't have You have to answer. Yes, you do. Yes, you do because that's now a public record and if I want to request it I can. Is that your personal phone or company phone?
>> Well, when you go to that you can do that. No, is that I need it for the record. Is that your personal phone or a company phone? Can you make that up? And what's your badge number?
I don't need to provide that. You already have Yes, you do. What's your badge number? You have to give me your name and badge number. I believe in your policy it says your identification has to show. Is there nobody else in this department named Seha? No. There's nobody else in this department with the last name Seha. That's what you're saying. Correct.
>> [laughter] >> Davis, and badge number? 15 What's your name and badge number? I'm not going to converse with you until I get everybody's identification here. So, that's the bottom line. Name and badge number. 10115 Okay. What's your badge number? I don't need to provide you that What's your badge number? You already have my name. Are you refu- You're so you're refusing to identify yourself?
The deputy's ego was skyrocketing as he didn't even tell the auditor his name, which every public official is obliged to do so. It's concerning to see how these cops consider themselves above the law. Just then the supervisor arrived and started confronting the auditor. Why is it that you're taking pictures? Are you just out here to >> pictures.
>> For what? Taking pictures. Are you conducting an investigation or something? Taking pictures. But for what purpose though? I'm taking pictures.
So, you don't want You want us to help you but you don't want to help us, right? The And I've explained this to your officers. I haven't asked for your help at all. I I'm at You guys can go back to work.
>> concerned because we have secured people here.
>> Okay, so So, just make it clear. I'm not asking for your help. But if I ask a question, yeah, you're required to answer it because why? Do we know?
Do you know that information? Why are you required to give your name and badge number and provide service to us? Do we know that?
>> What can we help you with? But I'm just asking, do we know that information?
It's cuz you're a public servant, right?
And I can choose not to answer the questions. Why? Because I'm a private citizen, right? Shortly it became apparent that the supervisor also lacked a profound understanding of the law. It was not understandable as to why these cops would fear public photography so much.
>> You're right, but there would be gates.
>> I'm not going to argue with you.
>> There would be gates.
>> I'm I'm giving you a lawful order to go to leave this area. Okay? If you want to go stand over there in the parking lot, you can. But there has to be a law backing it up. And if this is publicly accessible, I am totally allowed to do this.
That's what I'm telling you.
Not arguing with you. I'm not getting nasty with you. What I'm saying is if this is like I've been told, like you've said, like the other officer said, this is publicly accessible. You might not want me here. You see that sign over there? There's a sign over there tells you you can't. Yeah, juvenile detention facility. Could I drive back there and do that?
If that's where you want >> Could you drive back You could? Okay, publicly accessible. If I wanted to walk in here, am I able perfectly to walk in here? That's not the point. Publicly accessible. Here, Deputy, can you sign that information for me? Where'd you get that picture from? Right there. Where?
Down there? I'm not past it. But you're in the grounds of negative.
I'm not past it. I am at the sheriff's office.
I'm There's Do you understand there's borderlines? Seeing the sergeant's shortcomings, the auditor also took him to a law lesson, ensuring to humble him.
Shortly after, the sergeant realized that the auditor made sense and asked his fellow cops to leave him alone.
Coming onto it, I would be trespassing, but not coming onto it is not breaking a law. Do you see what I'm saying? So, you can't give me At that point, you can't give me a lawful order to not be here.
Don't Do you understand that? I'm just trying to get you guys to open your mind a little bit and teach you a little different than what they taught you in your training. All right? If it's not a law, there's literally nothing you can do. Nothing. Nothing any of you can do if it's not a law. Okay.
>> So, if it was a law, and I was breaking a law, I'm a law-abiding citizen, I would absolutely move. But because you're giving me directives that I don't have to follow, that aren't based on a law, a penal code, or some sort of violation, then I don't have to listen to you, and you need to just accept that, suck it up, and move on. That's That's it. Bottom line, right?
So, at this point, you guys are dismissed, babe. You're out of here. See you guys later. Yep.
Dismissed, fellas. Thank you. I appreciate you guys.
>> The cops left the auditor alone, and he was allowed to film the building. He gathered content for his YouTube channel before he left. Well, if you think these cops got humbled, this next officer made such a blunder that he resigned immediately.
Shots fired!
Shots fired!
SHOTS FIRED!
ON NOVEMBER 12TH, 2023, a couple of deputies from the Okaloosa County Sheriff's Office were dispatched to a house after a woman claimed that her boyfriend had stolen her car and was threatening her. Soon, the officers reached her house and talked to the distressed woman. I want my car back.
I've been asking all night. Can I get my car back? Like, I don't care about the argument. I don't care about I don't even know what the argument is about. I just want my car. I don't want to deal with anything. I know anytime we get into it, whether I'm right or wrong, like, he puts his hands on me, or he threatens to put his hands on me.
It gets very violent. There he is.
And your car are walking out. He's walking.
As the officers were understanding the situation, the boyfriend of the woman arrived on the scene and was immediately apprehended by the cops.
>> Why am I getting patted down with Because you're getting patted down.
>> Why?
Do you have any weapons on you?
>> No, I don't have no weapons on me.
What's that in your pocket?
This is a toothpick.
I don't got no weapons on me. Hands out of your pockets.
Okay.
What do you want to do? I want my car. I think it's at your mom's house is what he's saying. How did he get here if it's at my mom's house?
Can you call your mom to see if the car's there?
Yeah. Okay.
It's not at the house.
Okay. It's not home. Okay.
Okay.
I didn't send you my Well, you have my location, mate.
I'm on Green Acres.
Yeah. 22-year-old Marquis Jackson claimed that the car was at the [music] woman's mother's home. However, this soon came out as a lie and the officers decided to arrest him for further investigation.
Where's your car?
Where's your car, Marquis?
Can I talk to her? No.
Can I call her Can I talk to her mom?
Mm-mm. Oh.
My My keys are here.
My keys are here. Can I get my keys?
It looks like a gun.
Yeah, that's what I'm not going to do with us before.
Okay, so the suspect, that's going to be his information. This where it says narrative, that's going to be what [clears throat] happened, the incident, okay? Marquis was searched before being placed in the back of the police cruiser. The officers started to gather information about the case. It's from here. My screen.
>> Right. You know, so it's like why would you send me a picture of that? I'll show you again. Tell me what that is. I don't know.
Wait, I don't know what that piece is cuz that's not ordinarily there. Right.
Does he have any anything on the firearm like any aftermarket items?
>> Mm-hm.
That's what that is.
I couldn't even tell. We couldn't even tell, but more than likely it probably is a weapon. He's like, "I'm going to bust your whole [ __ ] up. Like I'm going to bust your windows. I'm going to bust your radio, whatever. He's like, "I'm going to bust your whole shit." I got it. By the time you get to your car it's going to be over with. And I'm like, "Okay." At this point I just I want to be done with it. I don't even want to entertain it cuz he is known for playing games.
So it's like I need to show you like I'm not playing. I'm in my car. That's that.
Like how much I paid for my car?
>> Yeah, or how much you think that it would value out right now? It's um so okay.
Okay.
They found it. Where is it? 1656 Hunt Club over here off of MLK. Deputy Jesse decided to head back inside the car to ask Marquis some more questions.
However, suddenly something unexpected happened and the entire situation [music] escalated in seconds.
Shots fired!
Shots fired!
Shots fired!
Shots fired!
GET DOWN!
I'M HIT!
I'M HIT!
WHAT?
I HEAR IT IN THE CAR! YEAH, HE SHOT THROUGH THE CAR!
NO!
The whole situation was bizarre to say the least as the officer claimed to have been shot by Marquis. He immediately opened the car and was quickly joined by the female cop. Both of them combined 22 the car, but surprisingly Marquis was not hurt.
>> I I'm I'm good. I feel weird, but I'm good.
I'm good. I'm good.
The officers never considered the fact [music] that Marquise was searched from top to bottom and did not have a weapon.
However, the ignorant cops [music] kept on the poor guy.
I'm not.
Marquise!
Okay.
I don't know. I feel I feel like it.
Jesse, move over to me. I got you. Move over to me.
Jesse, come back.
Uh Marquise, come right here.
Dude, am I hit?
Let's get further back. Further back.
Further back.
Shockingly, it was later revealed that Deputy Jesse [music] was never struck by a bullet. In fact, there was no gunfire as Marquis remained inside the car with his hands cuffed behind his back. It was an acorn that fell on the roof of the car which the cop mistook for gunfire. Have a look at the distressing incident from the female officer's body cam.
>> What? What?
WHERE? RIGHT THERE?
JESSE! JESSE, ARE YOU OKAY?
GET OUT!
GET IN THE HOUSE! JESSE! GET BACK! GET BACK! WHERE IS HE?
WHERE IS HE? HE'S in the car.
43, give me traffic. Shots fired. Shots fired. I got A DEPUTY DOWN.
OFF THE MCLAREN. OFF THE MCLAREN. Shots fired. I GOT A DEPUTY DOWN. JESSE, HOW ARE YOU?
>> [screaming] >> At one point, even his girlfriend became worried about his condition as the cops kept on firing non-stop at the car.
>> It might have hit MY VEST. OKAY. OKAY.
OKAY.
GET BACK! GET BACK! I'M NOT GOING TO TELL YOU TO GO! GET BACK!
GET BACK!
GET HER! GET HER AND GET HER BACK NOW!
>> [screaming] >> STAY INSIDE YOUR HOUSE. STAY. YEAH, STAY INSIDE your house.
The situation eventually calmed down and Marquis was recovered from the car.
Luckily, he had no serious injury. The police department immediately launched an internal investigation into the incident and during the investigation Deputy Jessie resigned from his position. However, this wasn't enough as Jessie went on to file a lawsuit against the officer and the city. This is what his lawyers had to say about the troubling incident. My name is Julia Quesada. I'm an attorney with Burris, Nisenbaum, Curry and Lacy.
It is not acceptable that these officers, deputies, and their department is calling this a mistake.
It is not okay to call it a mistake.
There is no mistake. There was no mistake that Marquis was unarmed.
There's no mistake that he had already been searched.
There's no mistake that he was already handcuffed in the back of a patrol car when these deputies opened fire.
And there's no mistake that the department hasn't released all of the footage or the information related to the shooting. This is not okay.
The deputy that shot, that said that he heard an acorn or after the fact that that's a mistake, that's not acceptable. He resigned.
That's not accountability.
The other deputy that was exonerated, that is not accountability. There has been no accountability, there has been no transparency, and there has been no justice. And we demand that. We demand transparency. We demand accountability and we demand justice and we stand with Marquis with this. That is a question I wish that you would ask the law enforcement community. But I think the rush to judgment shown by the sergeant uh there were some allegations that were made at the time uh which turned out to be untrue.
There was no real investigation by law enforcement except well, we'll handcuff him and put him in the back.
And then somehow, I don't know, maybe they thought you were Jason Bourne or somebody, Marquis, said that he escaped from handcuffs, pulled out a silenced weapon, and started firing from inside the car. It sounds ridiculous.
It sounds ridiculous, and I hope it sounds ridiculous to the public.
Uh so, that's what we're here about. The lawsuit is still under proceeding, and we can only hope that Marquis gets the justice he deserves. Well, that brings us to the end of this video. Today, we got to see cases where cops made huge fools out of themselves. Particularly hilarious and disturbing was the second case where a police officer mistook an acorn for a bullet. It's shocking to realize the number of bullets fired by the officers at a handcuffed individual.
Fortunately, these cops were held accountable for their action, and I hope that this serves as a reminder to the other officers to remain vigilant during duty. But, before we continue, if you're new here and this is the first video you've stumbled onto, hit that subscribe button right now. And if you find value in what we do here, you can support the channel by buying me a coffee. The link is down in the description. On June 9th, 2021, First Amendment Auditor Sean Paul Reyes from the YouTube channel Long Island Audit was peacefully exercising his constitutional rights at the Danbury, Connecticut, Public Library.
But, the library staff alerted the authorities in no time at all.
There you go, sir. Hey, how you doing, officers? Yes.
Can I get your names and badge numbers?
Sure, can I see your ID, please? Uh no.
Then then you can't.
>> Excuse me.
Is Have you not heard that before? I I've heard it plenty of times. It's just I'm surprised cuz Well, my name and my badge number's right here. Uh-huh. Okay, you see it? Tibbets. Yep, 640.
>> The pen is blocking the the number. Oh.
640? Yep. And Dennis, 647. So, I was told that you were asked to leave.
Okay. So, would you like to know >> Is that correct? Would you like to know what I'm doing here, sir? Were you asked to leave?
Sir, can Would you like to know what I'm doing here?
>> to answer my question.
Sir, this is a public library. I I where I see where this is going.
>> you to answer my question.
>> where I see Officer Tibbetts didn't want to hear anything and jumped into a demanding stand. I think he's forgetting that he wouldn't have a job if it wasn't for good citizens like Shawn.
>> We asked you to leave. I see where this is going.
>> Security asked you to leave and did the employees ask you to leave, sir? No. No.
Are you I was not I was not >> Would you like Would you like him to leave, sir? Sure.
Okay. So, security So, let me explain just just so you get a Let me just explain really quick so you guys can understand. So, what I'm doing here is a First Amendment protected activity. I'm I'm recording. I know you don't care, sir, but listen, you know, if you violate that in any way and interfere with that, I'm not violating it. They asked you to leave.
Yeah, but that that they they can't ask me to leave. This is a public library.
Can I get Can I speak to a supervisor, please? The cops were surprised to see that he wasn't intimidated by their guns and badges. So, they got more focused on throwing him out rather than getting his side of the story. So, Well, I mean, just just because you guys seem real hostile, I'm going to explain myself ahead of time. Normally, I don't explain myself, but >> explained yourself yet. I told you I'm gathering content for a story and I'm engaging and I'm engaging in a constitutionally protected activity. For what? What is the purpose of this? For what reason? I'm not I'm not willing to disclose the until it's published. Until it's published, I'm not going to disclose it. Videotaping in a public place is allowed by the Constitution of America, which comes above any local policy or ordinance. Usually, in many of Shawn's interactions, the people in the public place never complain about his recording. It's just the corrupt security and cops. You can't just go up to somebody and say, "Listen, you feel uncomfortable or uncomfortable. They're uncomfortable. You're breaching their peace." No, that's not true. Oh, okay.
You can't You You can't Yes, I do. More than you, for sure.
More than you, for sure.
You can't turn a constitutionally protected activity into a crime, sir.
Unfortunately, as much as you would like to. You even admitted Shawn approached you. It's creepy as heck. I'm going to request another supervisor again.
In a minute.
I'm going to request one. I'm pretty sure your policy, if I go home and look at your policy and uh I'm pretty sure if I request a supervisor, you you guys should call one, correct?
Shawn repeatedly asked for for supervisor, but his request fell on deaf ears. They can't deny him his request, so they stay quiet or delay him.
>> See what I'm doing there? Acting like a child? Yeah, so we >> [laughter] >> Acting like a child. We have a supervisor coming out here to appease your request. But we're not friends.
You're my servant, right? You're my public servant.
>> That's right. You're here to protect and serve me.
>> Sure. And I'm also here to protect and serve you, too.
So I don't need protection. I don't need protection, so that's So that means >> going to be okay and the people are going to be okay. Beca- because I don't need protection, that only leaves one more thing. You're here to serve me.
That's what you're here to do.
>> Here's another thing. Did you get permission when [music] you post that video of these people >> Don't need it. They're in public. Yeah.
They're in public.
Don't need it. See, you're learning something here today, man. Come on. This is what I do. The same way that it's kind of shocking that you don't know the law.
Well, you know I can post your I'm going to post your face and there's nothing you can do about it. Eventually, the cops agreed to bring their supervisor to the scene, but not before getting schooled on the law. 24 years in service and he doesn't even know what's protected by the Constitution. Says a lot about the kind of cop he is. Imagine what he would do when a camera isn't pointed at him. How much power do you have on that so far? Yeah, I think I could. Okay, so do it.
It'll be up It'll be up tomorrow. It'll be up tomorrow.
And this is going to be a And this is going to be a good one, too. Normally, you know, I don't know, maybe like 30,000 views, something like that. This one definitely 100,000 view uh video. All because of Tibbetts and utter and uh I forgot your name.
Dennis. Dennis. Dennis.
What kind of phone is that? A Galaxy Z Fold 2.
It's going to say It folds. It's pretty cool. Yeah. Oh, that is pretty cool.
These cops have nothing better to do except wait and suspect what sort of phone Shawn is rocking. What a fruitless waste of good taxpayer money. These cops could have been somewhere else making an actual difference. I don't got nothing personally against you. It's just the way It's just It's just the way you came up to me. ID. Like, come on, dude.
You got to do You got to You got to You got You got to use your de-escalation techniques.
You got to take a breath. You got to No, no, no. Did I call you? Well, why why is this happening?
I'm exercising Okay, I'll tell you. I'm exercising my First Amendment right to film in public. Yes, in a public library. Correct. That's exactly what I'm doing here.
If If they would have spread awareness spread awareness He's definitely in violation here, too.
So Yeah.
Mhm. Sure.
Yeah. This is not going to end well with you, you know that. Okay, we'll see. We will see.
We will see.
I'm not scared of you. Sean tries to school Officer Tibbetts, but he doesn't take it well and gets offended so easily despite being in the wrong.
>> I'm not going to Listen, before you guys even arrest me, the thing that's going to happen is you have to tell me to leave, right? So >> no, no. We No, no. This is We're in charge here, okay?
>> going to tell me to leave. And then what what you're going to do?
>> give us an ID >> Not going to happen. then you're going to have to go Not going to happen. I'm not breaking any laws. Yes, you You're breaking their law. And they need to find out who you are >> They're going to love They're going to love that you said that.
>> trespassing They're going to love that they said that.
>> here's the thing. We have We have a um a thing where like they identify somebody and then it's considered trespassing if you enter again. So you can't just walk out of here cuz we don't know who you are.
Okay, watch this. Ready?
Ready? I'm going to walk out of here. Am I being detained? Yeah, you are. Cuz you asked for a supervisor and a supervisor's coming. So wait. So you're you're detaining me?
>> Yeah, I am. Okay. Utter, you're detaining me. Now Now you got a new >> leave because you broke a policy here.
>> [laughter] >> I'm just saying. And now we need to find out >> Are you law enforcement or policy enforcement?
>> saying policy. Would you like to see the >> said policy. That's not a law. Does it have a CR code next to it or something?
>> And you didn't, so now we're here. So now we have to find out who you are so you don't come back again. So we know that. That's not going to happen here.
Sorry.
Not going to happen.
Policy enforcement.
Good job. Who are you Who are you protecting right now? Who are you serving? Like I'm peacefully filming, working on my story. I'm press.
Freedom of the press. What com- Where Where company >> I'm independent. I'm independent. These cops try to bully Shawn into thinking he's committed some sort of crime. When in fact, it was just the library's ridiculous policies which don't have power over the First Amendment, which is why he mockingly calls them policy enforcement. Eventually, supervisor Sergeant Dickinson arrived on the scene.
>> Hey sergeant, how you doing?
Good. Nice to meet you, sir.
Hey s- The dis- I just like Sergeant Dickinson?
All right, thank you, sir.
Okay, so they would like you to leave Okay. Sergeant, if I Hey, have I got the sergeant to speak? Okay. How about you mind your business? Hold on. Are you going to leave, yes or no?
Am I if If I don't leave, will I be arrested?
>> Yes, you're trespassing. Okay, I'm going to leave then cuz you're under threat of arrest. I'm under threat of arrest, I'm going to leave. And no, you do not.
Well, don't touch me. Don't touch No, you don't. No, you don't. I have not committed a crime. No, I haven't.
Listen, man, don't You're touching me.
They asked you to And I'm leaving. Under threat of arrest. Okay, you're refusing to provide identification to us. We need your >> Because I haven't committed a crime. At this point, it seems like the total hierarchy of this police department is in shambles. Go ahead.
And don't touch me again, man.
Seriously.
>> Listen, we tell you not to go anywhere, you don't go nowhere. You understand?
Don't touch me. Don't touch me. Do you understand that though?
>> I'm telling you I'm telling you not to touch me. I'm telling you not to touch me. Do you understand that? Don't touch me. You don't leave until we say so.
>> Don't touch me. Nobody's scared of you, Tibbetts.
>> And no one's supposed to be scared of me. I'm talking over you cuz you keep yapping. Okay. You're not listening.
You're here to sit here and preach about everything. You know the law. You don't even know what simple trespass is.
>> I do know the law. Unfortunately, more than you. I'm sorry.
>> I'm sorry that I know the law more than you.
It's very sad.
You're sad. Okay. You really are sad.
Listen.
Come on, man. There's no There's no There's Sergeant Tibbetts kept trying to escalate the situation by getting all up in Shawn's face. Cops try this tactic to get a reaction out of the suspect so they have a reason to get hands-on.
Luckily, Shawn's calm demeanor was a thorn in his side. The library administration or designee, the gentleman right there, with the assistance or advice of the law enforcement authorities as necessary, may make decisions to remove or exclude individuals with or without warning who interrupt normal library operations by behaving in a disruptive or inappropriate manner towards customers or staff. This is This is what I do, sir. This is what I do. I've been to plenty of libraries. I've been to plenty of post offices, plenty of public You're You're Can I please speak to the sergeant, please? I'm talking to the sergeant.
So, like I said, sir, I'm engaging in a constitutionally protected activity. So, that's not committing a crime. Exactly, that's the exact opposite because I'm exercising my rights that the Constitution gives me. I'm not disturbing anything, sir. Okay. So, you had your say. Okay.
If you give me a lawful order, I will comply.
Okay.
They're going to officially trespass you. They need your ID to give you a letter to officially trespass you from the city. What I'm asking Okay. So, what I'm asking at this point Yeah. You You may leave.
>> Even though momentarily the supervisor was being reasonable with Shawn, the other officers were itching to put cuffs around Shawn and call it a day.
>> Here you go.
Cool. Great. Have a nice day.
Get out.
Where's my trespass? Where's my trespass uh warning?
After a bit of back and forth, Shawn eventually agreed to leave under the threat of arrest.
If you didn't have that badge and you touched me Hm? If you didn't have that badge and you touched me >> What is that What are you trying to say?
Don't touch me.
>> trying to say? Because if you didn't have You touched me.
>> What are you trying to say?
>> I'm trying to leave. Just go. Just go.
>> I'm trying to leave.
>> cuz it's not good for you. It's not good for me. It's not good for you.
I'm going.
>> Go. I'm going.
>> Bye. I'm going. I'm going. I'm going.
I'm not threatening. You're a douchebag.
You're a douchebag. Yep. Is that against the law? I'm going.
I'm going off the property right now.
According to the American Economic Journal, local governments spend over 12 billion dollars annually funding the operation of 15,427 public libraries in the United States just so civilians like Shawn can be kicked out for exercising their rights.
It's public. You don't get it? This is what I You think No, it's not. So because it's public, there's no laws or rules in anywhere? You can just do whatever you want?
>> not true. You can >> So they have a law that says what you're doing was wrong.
>> They have a policy. They have a policy.
So they would like you to leave and that's what we did. No, but the law protects me to do what I do. You understand? It's a constitutionally protected activity.
It's constitutionally protected activity. If I went in there and I was acting like an [ __ ] >> You're wrong. Don't touch me. Don't touch me. Don't touch me. Hey. Hey.
Hey. Hey, I want to file a complaint against him, sergeant. He just grabbed my arm.
Sergeant.
He just grabbed my arm. I want to file a complaint. Sergeant.
Shawn filed a notice of intent to sue the city clerk and filed formal complaints against [music] all tyrants involved. In Shawn's words, you don't always have to get arrested to bring change and he's a living example of that. Interactions like these give us all hope to stand against tyrants. If you thought that Shawn showed Tops who their real bosses are, this next hero took things up a notch. We can be right New York officers and be cruel and corrupt and ugly to the citizens, but we're not. I'm going to be arrested for for conduct for doing something that is legal. On June 26, 2013, a YouTuber by the name of Don't Comply was planning a safe rifle walk in his neighborhood in Little Elm, Texas to raise awareness of how the law permits open carry of rifles, but this activity soon backfired on him.
Hey, [clears throat] afternoon. How you doing?
>> Officer Sanford, Little Elm Police Department. Hey, good to meet you, Mr. Horton. Yes. All right. How you doing today? I'm doing well. How about you?
Excellent. What you got going on today, buddy?
Oh, we're just doing a normal Second Amendment exercise. We're going to walk around the neighborhood with a with my rifle slung over my back, pointed down with the chamber flag in in the chamber. Okay.
So, what are we what are we attempting to achieve here?
Uh we're helping to uh show the uh the general public that it's a perfectly legal activity in the state of Texas to open carry long gun.
And you think that your display is going to achieve that?
Uh it's it definitely will. People that that may uh not understand that it's a legal activity, call in to you know, say they moved here from New York and they come and uh call the 911 and they get a dispatcher and says, "Hey, there's a guy walking with a I got you. You know, wouldn't this the simple dialogue be um wouldn't the dialogue be, you know, "Well, is he wielding it around? Is he is he throwing throwing with it? No? No, he's not? Okay, well, that's perfectly legal in Texas. Uh if you want to call in about that, maybe call the non-emergency number or something of that matter."
I'm sorry?
>> have you lived in the community? Uh we've been here a couple years. All right, puppy dogs. He explains his perspective on the issue and the lack of education and awareness of the public about the laws regarding open carry in the state of Texas, something that these cops weren't able to get through their heads.
>> one of the safer communities in North Texas. Well, uh I've also been rated Yeah.
All right, go inside. Go inside.
as the safest in Texas with a population over 25,000. Yeah. Well, uh So, hold on.
Hold on. Hold on. It it What I'm what I'm trying to say is we don't we didn't achieve that by everybody showing their walking around the streets in order to do that, okay? And I don't believe that you doing that is going to is it going to achieve that.
>> In the first uh month that we lived here, our house was broken into and And I was the one that took the report.
>> Yeah, the back door got kicked wide wide open and uh you know, so it's not the safest neighborhood in in my eyes because I've been a victim of of those crimes. If more people were walking around displaying their their Second Amendment rights to to open carry long then maybe there wouldn't be little hoodlums walking around.
>> Officer Nordman has already explained the disorderly conduct law. The officers didn't agree with his narrative and considered their city as one of the safest. [music] The auditor, however, counters his point by giving his own example of how quickly his house was broken into after moving.
>> I walk in with it slung to my back in a proper venue or giving you forewarning that it's going to or it's going to cause an alarm. Okay. And I guarantee you we're going to get about 100 calls.
>> Uh-huh. And then yeah.
>> And and listen to me. You're a law-abiding citizen, I respect that.
>> Absolutely. Okay? I'm a law-abiding citizen or else I wouldn't be in the position that I am. Right. Okay? I love this. I've got my own collection. I don't see that it's fit for me to be walking around my own neighborhood showing I would understand if you were in Afghanistan. Well, that's a different story.
>> an opinion.
Right, and it's my opinion. And that's what we're having here. It's just an an opinionated talk between us, okay?
>> Okay. Two men, two grown men, okay?
>> Right.
>> Who both have the exact same rights.
Absolutely. I chose to live in this community because I feel it's a safe community. Right. The cop seems to imply [music] that his logic is sound and that his opinion outlays not just any law, but the US Constitution, the most sacred thing to any law-abiding citizen.
>> I have my family here as well as you.
And I feel that we're exemplifying the safety and those rights by going out and properly um open carrying our our long and you know, walking through the neighborhoods. But I'm sure you've heard the same before.
Just because you can doesn't necessarily mean you should.
Does that make sense?
I mean, I don't see why not. I don't see why we why we shouldn't >> because you can use the N-word, should you be going around town blasting it left and right? Well, I guess I could.
You could. It's a First Amendment. But, is it really in good taste to do it? I don't see how the law I don't see how the law enforcement in this town has anything to do with taste.
I think it should rely on >> or not, a lot of it has to do with taste. On how we present ourselves to people. How we treat people. It's surprising to see a cop talking about how they should be presenting themselves and that actions define who they are.
All the while being infamous for being corrupt tyrant. You know, we can be like New York officers and be cruel and corrupt and ugly to the citizens, but we're not. We choose not to be.
Absolutely. All right. So, we're here to serve you guys. All right. You want to practice your Second Amendment right? By all means, go ahead. Great. Okay. So, But, as soon as you you come in within the confines of a law that you violate, you're going to go to jail. Right. Okay.
And I don't want it to get to that point. That's why >> I am But, since I am not calculating to cause alarm in another person, I'm carrying it in the most un aggressive manner possible to be carrying a gun.
I will have it slung to my back pointed down. Not No hands on it. Completely hands-free. I don't see how that can be calculated on my part as to cause an alarm.
>> don't think that it's going to cause an alarm. I don't I don't think in a well-educated public that it it will cause an alarm. And I don't think And I don't think it should cause an alarm.
>> You obviously don't think our public's educated cuz you're saying that you're wanting to educate.
>> We are helping to educate. So, we've got an uneducated public through through what you've said. So, that's going to cause an alarm, sir.
Well, The The issue is this.
I have the right to open carry.
A lot What manner in your eyes is not calculated to cause an alarm? What do you mean carry it?
I wouldn't even put my I wouldn't No, I'm asking what is the way to do it? I wouldn't do it. So, you're saying that it's not legal? No, that's not what I'm saying. I'm saying >> Well you say you're saying if I if I do something that's legal I will I will be arrested. The cop evidently loses the argument when he's cornered into the query about what is the most appropriate way to open carry a rifle considering that he has the right to do so. The cop proceeds to chicken out.
>> Gordon, come on. Let's keep this civil, okay?
All right. Yeah, but you're just talking in circles around the issue that I'm going to be arrested for disorderly conduct for doing something that is legal.
And you and you keep trying to pin me into say that that I think that it's going to cause an alarm in a person.
>> opinion on this, ma'am?
Oh, I just I just stand by.
I don't know what he was thinking. Did he really think that his wife would go against him for one moment? This shows how badly this guy had this officer backed up into a corner. normal manner with it slung like like any responsible person would do. If he's if he's got it, you know, at the ready and he's got his hands on it like this, then sure. But just, you know, I mean some years back, you know, little kids would sling their over their shoulder and ride their bicycle down the road, right down Buckner in Dallas, you know, and go and shoot cans in a creek.
>> I would understand if you'd be down in Oak Cliff, Dallas or something to that effect wanting to do this, but this is a perfectly safe neighborhood.
Yeah, I I've had an incident.
It's not perfectly safe.
>> All right.
It's not perfectly Yeah, and that's not the issue at hand. The cops keep seeming to want to force the fact that it's a perfectly safe neighborhood when it wasn't the truth at all.
>> If I if I exercise the Second Amendment right, I will be arrested for disorderly conduct. You're telling me that I I don't have the right to do that.
>> I'm explaining to to you what the law exactly says.
>> Uh-huh. All right. That if you open carry and you cause an alarm, which obviously it's a calculated alarm at this point because you're being informed that it will cause an alarm and and you're well aware of it because you contacted us to tell us this in the first place. I contacted you so that you wouldn't have to rush out on a 911 call Oh, there's this crazy guy walking down the street fly through some red lights and endanger your officers' lives and the public's life by flying across town to find someone that is just doing what is perfectly legal and doing it in a responsible manner.
That's why I called ahead. I got you.
Because you cuz you worry that someone is going to be alarmed and call and be like, "Hey, there's a guy walking down the street with a rifle." Unfortunately, that's how the law is actually, but And and that's how I explained earlier our community Well, it's not.
>> have people walking around left and >> So, this isn't an an acceptable in our society. Well, we're going to make it the norm here then. We're going to get groups of people and we're going to do it every day.
I mean, if it has to come to that.
I mean, we did that in Temple. There was an incident in Temple and I brought 500 people down there and we walked right through the entire town with all of our ARs and AKs. I'm sure you were abiding by every single law that there were. Oh, yeah, absolutely. And I'm abiding by the law by walking down the street here in the same exact way. Temple is a different city altogether than than Little Elm. Well, yes. Temple is a different city than Little Elm.
Um but we went there and did that because of the the officers not respecting our Second Amendment. The officer's idea that since this is a different city, it would go wrongly is the exact reason why it needs to be done. The fact it was done in Temple City before was because the officers and public weren't properly aware of their Second Amendment rights. We have a duty to protect the community. Uh-huh. Okay.
Yeah.
And not just one individual person.
Okay? We've also have a duty to protect everybody's constitutional rights. All right. Yes, um but So, you would be violating my Second Amendment rights.
Our community, our motto is to have a better or have an impact a good impact on making this community a better community. Great. Okay.
And wonderful.
>> by you carrying a firearm out there is going to put people in fear for their own safety. Just be quite frank with you. It'd make them uneasy, is what you're saying? Right.
And and and it it troubles me that you don't see it the same way.
>> Well, then I guess that you know that that maybe the police should should do some sort of public uh educational classes so that when this arises, you aren't getting the the hundreds of calls. The cops didn't want to take any meaningful action, and their only way to solve anything was to throw threats around. Just arrest anyone who is practicing the First Amendment right in a way they don't like.
>> State of Texas, all right? Who practices the Second Amendment Second Amendment right now? Okay?
I'm asking you not to do Okay?
>> Got a good taste between you and I. All right, Mr. Horton.
You know, it's a Cuz you're telling me that you will arrest me if I go walk with my rifle.
>> the law, yes, you will be arrested. I guarantee you. If I violate the Second Amendment?
>> Nope. If you violate the law. the law.
Uh-huh. Any law, if you jaywalk, if you do anything to that >> the law says that I can open carry my rifle.
Second Amendment says that you can bear arms. Uh-huh. 4201 Texas Penal Code says that you cannot do it in a manner to that will calculate an alarm.
>> Well, if if I can't carry it in that specific manner, then there is a specific manner that I can carry it. And do you have any idea what that is?
No.
Any answer for you right now. Okay. So, you don't have an answer as >> Don't put words in my mouth, okay?
Right. You're saying you don't have an answer as to how I can carry it I don't know what the safest way to carry a weapon is the other person's safest way to carry a weapon. However, the YouTuber took no heed to the police's ridiculous warning and went on the walk anyway. He recounts his experience. I went on my walk and even bought an ice cream from the ice cream man. It was pleasant, and I didn't see one patrol car the entire [music] walk. If this isn't proof of ridiculous police narrative and incompetence, I don't know what is.
Well, that brings us to the end of this video. Today, we saw a couple of law-abiding citizens schooling ignorant cops on basic law. It's concerning [music] to see the lack of education and awareness these cops have on the Constitution and the law. It pains me to think that our protectors have no clue about our rights. It's these tyrants who end up doing the unthinkable. I believe every police department must ensure officers receive basic constitutional training and make sure that such cops are taught a lesson in the law.
