[00:02:47]This incident is of 94 2019. When the general Lok Sabha elections were going on, Mohammad Azam Khan was the candidate of the United Alliance.

[00:02:58]And on 94th 2019, during his campaign, he gave a speech on his vehicle as you have seen in the photo and in the video and you have also made him listen to that speech, so regarding this matter, a case was first registered in Civil Lines Rampur because the place of incident was not very clear, so during the investigation, when the place of incident became clear, then this case was transferred to Police Station Bhot and after that, the charge sheet was sent in it by the investigating officer of Police Station Bhot and after the charge sheet was sent, the trial went on in the honorable court. A total of 10 witnesses were presented by the prosecution and after the debate, they had said that it does not fall in the category of hate speech, but the witnesses presented by the prosecution and the most special thing in this is that most of them were police witnesses.

[00:03:48]Except one cameraman, the cameraman was an employment officer. All other SDMs were also government employees. So in this way, the Honourable Court, during the debate, considered it as hate speech and an inflammatory speech that provoked the public and has given this punishment today. Under Section 153A of the IPC, two years imprisonment and a fine of ₹000.

[00:04:11]Under Section 153B, two years simple imprisonment and a fine of ₹000. Under Section 505 of the IPC, two years imprisonment and a fine of ₹000. These three are sections of hate speech and considering it a violation of the Model Code of Conduct, before this speech, the Election Commission had banned his speech twice, once for 48 hours and once for 72 hours.

[00:04:32]After that he committed the incident again, hence under section 125, two years simple imprisonment and a fine of ₹000 has been imposed. So all the punishments will run simultaneously, hence the punishment was only two years but the fine for all four is different, hence it was ₹00.

Therein, the Hon'ble Supreme Court had issued one for the first time for the State of Uttar Pradesh and Delhi. The Directive issued a law ruling that hate speech should be banned. Especially when Amit Devgan's case came up for the first time, it was filed in two states and after that in Uttarakhand also. One reason was that I felt that the indecent statements given by these types of leaders have a very bad impact and only the police administration knows how much hard work the government machinery has to do to control it, that is, they have to work hard, so when you asked why they do this, what do they do, then they know why they do it, but if a mistake is committed once, then it is fine, but repeating it again and again in this manner brings it under the category of crime, Shiv Prakash ji, I will add one more question to this because you said why do they do it? Is this done so that they have a Robinhood image, a phantom image? People should clap. People everywhere are getting excited because is it easier for leaders to ask for votes on the basis of their work and to convey such statements and issues to the people in such a way that they raise questions on the DM and this type of administration or is it more difficult to ask for votes on the basis of work? In which both the parties contested the elections together. In this, the number of Bahujan Samaj Party seats in the Lok Sabha increased from zero to 10. But the Samajwadi Party could win only five seats.

[00:16:35]Ghanshyam Singh Lodhi won the election and by doing so, the Lok Sabha seats of Samajwadi Party reduced from five to three till 24th, so in such a situation, let us first tell you what is the outcome of today's decision. Akash Saxena who is the current MLA of Ram. He is a leader of the Bharatiya Janata Party and remains in the limelight a lot. What did he say?

[00:17:00]Look, in the case that was discussed today, the court has imposed a sentence of two years and a fine of ₹000. While the sentence is certainly two years, it is a historic decision in itself.

[00:18:51]Rakesh ji, I would like to know from you who was advocating on behalf of Azam Khan in this matter? What arguments were being put forward on their behalf? Because there is often a long list.

[00:19:04]Did the court make any such comment regarding Azam Khan's statements or some of his old statements when the entire hearing was going on in the court? Was all this even discussed there?

[00:19:16]No, whenever the court tries a case, only the role of the accused is tried. So in this case, the trial was conducted only on that speech and on the defence side, Vinod Sharma ji was the advocate and Mursaleen, two people were cross-examining the witnesses. When the prosecution evidence was over, they said that they would present something in defence. But then he did not present any witness in his defense and the court conducted it in a simple and uniform manner like a trial. In this, no previous evidence was taken into consideration because in the past also he had been sentenced to two years imprisonment for hate speech, so that was not made the basis. This independent trial was conducted by the court and the sentence was pronounced in it.

[00:20:12]During this entire hearing, was any such statement made by the court, any such important line, that often Azam Khan's style has been about your style, this is not a statement, meaning Azam Khan often gives such statements, many times he is seen crossing that line which is one, touching it. Has [sound of clearing throat] no such comment ever been made by the court?

[00:20:38]We are not saying anything like what you are asking, every trial has its own grounds. There are separate sections. There is a charge frame. So the trial proceeds accordingly. The prosecution presents its witnesses. The defense gives its own. Isn't it? In this the defence did not give any witness of its own. The entire trial was concluded only on the basis of prosecution witnesses and the Honourable Court held them guilty.

[00:21:04]So approximately how many dates would have been given in this entire case because it was a long time, counting these conduct dates in 2019, there were a lot of them, that means approximately 94 are incidents of 2019, the first FIR was lodged on 15th 2019 in Civil Lines police station and then it was transferred to Vote police station on 11th and registered, then the charge sheet came [sound of clearing throat] the trial was going on since 2023, so there were a lot of dates for this, one or two hearings would take place in a month, so according to this, there were a lot of dates, but finally the prosecution was successful and a better message went to the society.

[00:22:04]So what do you think is this case against Azam Khan? Because Azam Khan and his family and the Samajwadi Party often say that this is a deliberate attempt to target them. But how does the court view these things? This working style of the court, this politics has been of Azam Khan. Is the court considering it a crime and giving punishment in the same manner?

[00:22:29]Because the allegations are against Azam Khan ji, Shivnarayan ji, see, the punishment for all the crimes is made in the Indian Penal Code. Ok? Now BASS, a new BASS, a new Code has come in its place. So, any person who talks or acts or does any act regarding the facts related to any offence under the Indian Penal Code. Okay, right? Or whoever attempts to do so or instigates to do so will come under its purview. If a person has done such an act once, then it is a crime.

[00:23:09]If the same person is doing such a thing repeatedly then it will be a repeat crime.

[00:23:14]Now, in all the cases of hate speech given by them, all the facts that I just mentioned are being found. So each crime became a separate crime season.

[00:23:23]Apart from this, all other FIRs that have been lodged have different facts. So it is not said about any person that he can commit only one or two crimes. Every person, no matter how many times he commits a crime, no matter what kind of crime he commits, if it comes under the Indian Penal Code or currently under the Indian Justice Code, then he will be prosecuted and when the prosecution takes place, the prosecution will bring evidence before the court, only then will it be successful and in these cases which are similar to yours, oral documentary evidence was successfully given by the prosecution, some of those cases have also been actualized, which you must be aware, in those cases where the evidence was not found sufficient, it was actualized and the prosecution felt that this is a case worth appealing, the prosecution has also appealed, so this is a process of investigation of the case in the court by the police, whatever facts are found during the police investigation, the prosecution feels that we have to add on something in it, then the prosecution adds on that thing further. Then it is placed before the court. The opposing party gets full opportunity to present its arguments in the court.

[00:24:32]He also gets full opportunity to give evidence to save the evidence. So the matter moves forward going through all these stages. So it is said that so many cases have been filed against him, it is not just a matter of saying this.

[00:26:04]Look Mohit Bhai, let me tell you one thing that Azam Khan's family is completely silent at this time and they are not even ready to say anything. No one is even ready to talk on political issues. Be it court cases. Just two-three days ago, his wife Tandani Fatima ji and his elder son had also gone to meet him in Rampur Jail Court Jail, just three-four days ago. Did you mix it or not, we were there. We asked him if he would like to talk? Absolutely refused. He is completely silent and is not willing to talk. He is not interested in any discussion on any issue and as far as his court cases are concerned, Azam Khan has a long army of lawyers. There are three very big lawyers and there are many lawyers from Supreme Court to High Court and also inside Rampur. So his lawyers decide among themselves about his advocacy and they go and silently meet Azam Khan and Abdullah Azam in jail. Whatever decision is taken from there, there is a team work going on.

Yes Mohit, absolutely, now if we move towards the political question, Aamir ji, then we saw that the politics of Rampur used to start and end with Azam Khan and whatever Azam Khan decided, the same was seen in Rampur and all the surrounding districts and in 2024 especially we have seen how the candidates were exchanged for the Moradabad seat, it came to light that Azam Khan was unhappy and after that ST Hasan's ticket was changed to Ruchi Meera and then there was a lot of tussle there too and apart from this, in 2024, something happened in Rampur which no one could have imagined that on behalf of Samajwadi Party, an outsider candidate, though he is from Rampur, but a candidate from outside, from Delhi, is sent and he too wins the election and reaches the Parliament and even after that we also saw that when Azam Khan comes out on bail in Rampur, people get angry. When Akhilesh Yadav goes to meet him, the Rampur MP, Mohibullah Nadvi, is stopped in Bareilly itself.
