Apparently he was threatening her or some [ __ ] And then she took my phone while we were upstairs, wouldn't give it back at all. She come out here, opened the door, threw my phone, literally [ __ ] cracked it.
And then she threw my [ __ ] out here and then I tried to go back in and she uh She threw this stuff out. Yeah.
And then she tried uh blocking me from going back in the house.
And then when I got into like the doorway where uh the side that he's standing on, Uh-huh.
she [ __ ] just started hitting me. What'd she hit you with? Just her arms and [ __ ] And then she went crazy. Did you need medical attention at all? Okay.
So, she started punching you? She she started slapping me and [ __ ] How many times did she slap you? How many times did she slap you?
She hit me like at least five or six times.

And just your arm? Well, yeah, cuz I like blocked my [ __ ] body and [ __ ] Okay.
And then that's when I called you guys.

Dispatch had us separate, so I went to the bathroom. So she hit you a couple times. And she threw your cell phone.

And after she hit you, what happened? I called you guys when I was on the phone with dispatch. And where were you at now? In the bathroom. In the bathroom.

Um so she hit you in her arms, so she used both hands to hit you?

And then she before all this, she refused to give me my phone so I could try to find somewhere to go cuz I have nowhere else to to go. My dad's in Iraq doing recon [ __ ] so I have nobody else to go to.

And then she could have easily left and just went to her [ __ ] mom's house or something. And you guys have kiddos inside, right? Mhm. There's two of them upstairs sleeping.

So, let's get back to what happened. So, there was some conversation between him and your ex I know what he told authorities and I told him I can't do this, Jake. And then what what happened after that?
Like what happened leading up to you throwing his phone? I took his phone from upstairs. I came downstairs. I sat on the couch. I I told him multiple times, "Please, step outside and I'll hand you your phone. Please leave and I'll give you your phone. Please, please just leave. Like please."
And that's He said, "No, no, no. I'm not going anywhere. I'm not leaving. I'm not doing this. I'm not doing that."
And I I threw the phone outside. Not my brightest moment, but I did. I threw the phone outside. He went to go get it and as soon as I went to slam the door shut, he was already in the door stopping me, shoving me and the door backwards. I got stuck behind the back of the door.

Okay, so based off of what you're telling me, man, they're both misdemeanors in California. Um they're hurting you.

Um so based off of what you're describing to me, they're misdemeanors, right? So because you were in a relationship, you guys have two kids in common. Um that would qualify as domestic violence in California. But because you don't have any injury, correct? No injury?
And it was this one. I like it's still stinging, but like It stings? Yeah, but it's not >> that's a complaint of pain. Yeah.
Okay. So you got no formal no formal injury, right?

Uh because there's no like visible injury, it's going to qualify as misdemeanor domestic violence.
Uh the other issue is your phone. It's technically vandalism.

So where I'm at, um in California, they're both misdemeanors. I didn't witness these misdemeanors. So what would need to happen would be that you would need to sign a citizen's arrest form for um the vandalism to your phone. You said it probably cost like Like 50 bucks. 50 bucks, so that would So that would be misdemeanor vandalism because she openly admitted to throwing your phone and there's clearly damage to your phone to your phone screen. So you would need to sign a citizen's arrest form for that because I didn't witness them. Is that something that you're willing to do?

So essentially what that entails is you sign a citizen's arrest form saying, "Hey, these things, although Deputy Farmer didn't witness these things, these things Yeah, the phone was damaged. true and forth, you know, everything's true. If it came out in court that these things weren't true for some reason, and I'm not saying they're not, but I just give everybody the spiel.
If it came out in court that these things weren't true, uh you could be held civilly liable, which means she could civilly sue you, you know, whatever comes out of that comes out of that, you know, what I mean?
They could get you for money, get you for, you know, realistically anything that you'll Okay. And you you understand that?
>> Yeah. It also says that you're going to um show up in court. You're not going to just like just fall by the wayside.
You're going to show up in court, whatever court appearances it may take.
And I would possibly be testifying on the domestic violence aspect, but the vandalism aspect would be you. So anything related to the vandalism aspect vandalism aspect, you would show up in court and testify to that. I wouldn't testify to that. Well Okay. Does that make sense? Yeah. Is that something you're willing to sign? Yeah. Okay. Um if you could just hold your phone up for me so I can document the condition.
And it wasn't damaged in any way, shape, or form. Uh just up here. And this was damaged prior. Yeah. Okay, but this was not damaged prior. Okay.
