What she failed to tell us was that her husband was incarcerated. And I found out myself when I accessed the court records, he was incarcerated for several counts of embezzlement.

Um, he didn't get out of uh jail until, I believe it was late June of last year.

>> Yes. Because had we known what he was in jail for and we would never have moved there. He's also been charged in the past, your honor, with forced oral culation on his own spouse.

>> Say it. woman proceeded to badmouth and talk to about the owner of the property stating that he was a something and something and landlord who was quick to complain and to do repairs.

[music] Janie claims she never had any problems with the defendants until the day they abruptly moved out and one of the defendants assaulted her and she has the video to prove it. Janie [music] suing for property damage.
Defendants Leah and Estrosa and her girlfriend Eileen Morales admit they never had any problems with Janie. But on the day they decided to move out, Janie tried to provoke a fight and they were forced to call the police. [music] They're counter suing for stolen property.
>> Start with you, >> sir. As a young woman, I struggled through life. I um went to school and I went full-time and I had a child, so I try to make a better family for myself.
So, I figured I gave these two young ladies a chance. Um they seem to be a very nice family. They had a child. So, I figured, you know, I'll go ahead.

Remember you said you put yourself through school.
>> I put myself through school.
>> Did they do that or were they >> They they worked full-time and they went to school full time. So they reminded me a little bit about myself. So I said, "You know what? I'm going to give these girls a chance. They're like the perfect family.

>> When did they move in? [snorts] >> They moved in on December 1st, 2009.

>> When did things turn?
>> It turned on uh July 26th. And so prior to that, everything was fine. Everything was fine. There was no problems.
>> All right. Let me hear from them about that and then we'll get to some of the specifics of the property damage.
>> Ladies, first of all, your honor, Eileen and I have been together for 4 years. We have a son together. We go to school full-time. We work full-time and we also coach. Um, normally we don't tell people we're a couple because we like them to get to know us as individuals first cuz we feel there's a lot of discrimination in the world and we would just like it if we weren't judged based on who it is that we love. So everything was good, your honor. Um, we like she said, we had no problems in the beginning, you know.
Uh, everything was fine up until the time that she wanted to do a walk through because we had did a lot to the house as fixing it up.
>> What month is this?
>> This is in about April in 2010.
Let me get back to her then, then I'll allow you all to respond. Ma'am, >> before the lease, they had asked if they can do some improvements. I said, "You're allowed to do the you're allowed to do the improvements. I'm going to put it on the lease, but as soon as your lease is over, you you are not to remove any of the improvements." I did a walk through. The house looked very nice and there was like, "Oh, yeah. We love it here. We have our privacy. Our kid can run around the yard. The property is actually on three lots, so it's a big yard." And they were happy. And they even told me that they wanted to stay another 6 months if it was okay.
>> I said, "Sure." And maybe after the 6 months, I can probably try to sell you the home.
>> Okay?
>> You know, and it stayed like that. On [clears throat] uh July 26, I get a call from my sister stating that there's a U-Haul at the property. Um I go out there and when I arrive, they are shocked that I'm there. And I asked, I said, "Are you all moving out?" And they said, "Uh yes, we had a family emergency." I said, "Well, y'all should have had the courtesy to call me and let me know y'all are moving out. It takes five minutes."
>> Their things were packed.
>> Their things were packed in the U-Haul.
>> And they said they had to attend a family emergency.
>> They had to attend a family emergency.
>> Oh, no. Some Whatever was going to happen, it already happened. If you all had to pack up, [laughter] >> go ahead and tell me what the emergency was.
>> There was family emergencies. It was like that where my brother was in the hospital. It caused us to change up our living arrangements because after that day we need or her family needed somebody to stay there with her brother because it was um kind of like a behavioral >> needed both of you to stay there.
>> No, no, no. Eileen to stay with >> Why did you move?
>> Because I couldn't afford to to stay at the place by myself.
>> Okay. And she intended to stay with him indefinitely.
>> Yes.
>> All right. Why didn't you all tell her?
Didn't have time for that either.
>> We really didn't. We had a whole lot of stuff going on as well. We also needed to >> had a lot of stuff going on as in black >> as in um we needed to get ready for our starting school the following semester in the fall semester. We needed to get you know figure out how where we were going to stay and what we're going to do and we just needed everything settled by the time school start.
>> So with all that on your mind of course who has time to call the landlord and say I'm moving out in the middle of the night [laughter] >> I can understand. Yeah that's a lot on your mind. So [clears throat] yeah ma'am does it take five minutes to talk to you? You're long-winded, [laughter] Miss Ortiz. We have a family emergency, so therefore, we're going to have to leave immediately and hope you'll consider, if you don't mind, we'll talk with you about it later and see what we can work out.

How did they damage the property? honor. Um after the uh July 26, 2 days later, the neighbors call me that there's a window open and the fence is opened and the girls have not returned to the home. So during that week, I had to work. On July 31st, I went to the property. It was my day off.
The yard was 3 ft high. There was trash all over the place. So me and my son, my 19-year-old, we went out there to cut the yard. And as I'm cutting the yard, her mom arrives. The police got there and um I was trying to videotape before I left.

>> I was trying to videotape the yard that I had cleaned the yard.
>> Okay. Why did the police come?
>> Because um Miss Eileen, while I was videotaping, she smacked me in the face.
>> Your honor, that's not true.
>> She smacked me in the face. And while I was trying to pick up the camera, she still kept on pushing me. And I have video.
>> Okay. And you say what?
>> No, your honor, that isn't true. On that day on the 31st, what happened was that I showed up and my grandmother was waiting for me. Yes. Did you hit her while she was holding?
>> I didn't hit her, your honor. No, I did not.

>> No, she kept insisting and putting it in me and I have a voice recording as well putting the video camera in my face and coming at me.

>> The damages. I went the next day. I went the next day and I when I walked in the property, I was devastated. I wanted to cry and fall on my knees. I couldn't believe these girls had done this to me.
On the wall, they had they printed, "Watch your back."

>> I have pictures where they No, we did not. I have You can check all these pictures. I have pictures where they rip the cabinets off. I have pictures of all the damages they did and all the mess they left inside the home.

>> No, your honor. We took what was rightfully belong to us that she never paid us for.
>> I admit we took the cabinets did belong to us, your honor. We have a repair man who we have his witness statement explaining all the repairs that he made in the house that Janie refused to pay >> um to pay for. And we also volunteered to pay at least half of those for those repairs, labor. Ma'am, I'm sure that you can't lease someone's property, put your own fixtures in, pulling her fixture out, her cabinets. Then when it's time to leave, you take your cabinets and she's left with no cabinets.

Um also during that time I was told that there were various financial difficulties and also difficulties with a heroin addiction.

>> Um, Steven calling me and begging me to let you stay there and I said you had to do 30 days of treatment.

>> In the beginning of April of 2009, um, Megan had called me. I had moved out of state. They knew I still had a home in Rockford, Illinois that I was renting out at the time. At the time, my ex-husband was staying there. But they were frantic. they were getting kicked out of their current condo and they needed someplace that they could go and they only had like 3 weeks to get all their stuff out of their other house.
So, I was made promises that there would be no late payments, that there would be nothing illegal ever going on, that everything would be fine. We came to an agreement. They signed the lease, everything else, and I let them in. They wanted it to be as of I wanted it to be as as of May 1st, but I had given them an extra week to go in and paint and get it ready to go. After the first month, they were starting to fall behind already. Within the second month, that's when I had heard the story and was told the story that she was found in the garage and needed to be taken to the hospital. At that time, I spoke to Stephen and agreed to let them stay there if she did 30 days of inpatient treatment. And then they had went for a couple weeks and never answered the phone. Uh when I did finally get in touch with them again, then I had found out that she had checked herself out after only 4 days. Um >> checked myself out of what?
>> Then >> let me allow her to give some background. She's anxious to talk.

>> Stacy is a well-known scam artist as well as a compulsive liar, obviously.
Okay. Uh this year she filed taxes for her uh boyfriend in Missouri. Uh he was award he got back like $5,000 in a refund. She went ahead and kept that uh and then proceeded to put a restraining order against him so that you know to make him seem like he >> took his money and then put a restraining order. But even after the police looked into it, they found it all to be completely false. It never happened.

>> Not the second time it barely. The first time it honestly I don't remember. I think the second time they only passed it pending repairs.

Ma'am, you need to know that out of the 150 items that were inspected, >> there were only three things that they told them needed to be done, and they're very minor things.
>> And we did have those repairs done by the due date of April.

And so your experience with her staying there is that she had people smoking uh marijuana inside. How did you know?
>> Well, actually, we uh received a letter from concerned parent who >> in the neighborhood because her son was hanging out with her son. They were skipping out of school together and her son was punching holes in the walls along with her. We if you'd like to see the letter from the neighbor.
>> Ma'am, did you have minors in there smoking pot?
>> No, never. My son did not smoke weed in the house. His friends did not smoke.
>> And also our upstairs tenant said that she that's all what she could smell was pot. The kids were running up and down the stairs all the time. She didn't want to say anything because she had to live in the same property.
>> All right. How do they owe you for the security deposit? That's what you're suing for.
>> Um [laughter] because they're saying that I did or my family did all this damage to their property. Um I took pictures of everything.
>> Um showing how I left the property when I moved out and it's not 30ome 3,000.

And so obviously they won't return your security deposit, correct? of $820 because they allege you left with um over $3,000 worth of uh damage done to the property. And these are the pictures that you took when?
>> I took them on July 1st. And >> when did you move out?
>> I moved out on July 1st. That was just to protect myself in case if they ended up pulling what they pulled. Exactly what they pulled.
>> What is this? That's the cupboards that they supposedly would glue back together and started falling. That's another one.

>> That's the kitchen floor that they said they had. And it's miraculous that there's no >> stayed like this from the time you moved in.

>> There are the last ones. They also turn out >> because that's the biggest expense here are the holes in the walls followed by the hardwood floors.

>> That's the problem. We we could not he would every time he come home, it would be a different job he had planned for me. It went from windows and siding to doing drain tile around the exterior perimeter of the basement. One second, sir. Did you ever request that he do windows and tile?
>> There was discussion about that being potential work, but >> was anything wrong with the drain and the windows that you were discussing that he potentially might have to do?

>> All right, sir. I would assume that he wanted me to do it, too, because that's the reason you said you had him there is for the upkeep of the house. So if you pointed things out and said something's wrong with the drain, something's wrong with the window. I would expect that that's what he wanted me to fix. Go ahead.
>> Yes. And then he would switch it up every time he come back. It was a new idea.

>> So you're saying for five and a half months this man did absolutely nothing in return.
>> I would estimate maybe 20 25 man hours worth of work.
>> Okay. Now, how many times how many times did you come in and out within five and a half months?
>> Um [snorts] and here's and here's probably here's the other part. How many times did you come in and out within 5 months? How many times per week would you come in?
Let's go over that. From January to May, >> sir, you don't have to read that. You can estimate. No, no, no. That's not what I'm I'm asking you something very specific. You can estimate how often you would come to your own home.
>> Once every 3 weeks, once a month, depending on.
>> Okay. So, you came home at least five or six times.

>> All right. And when you came home those five or six times, didn't you notice by the second time nothing had been done?

So, they had no choice. And I do have a statement from them here stating that he did. So, um he has >> He threw your things out in the street.
No, he didn't throw him out in the street. He called the place and told them that he was going to throw them out in the street and they needed to come and get it. So therefore, I my my belongings were repossessed.

What happened was [laughter] this used to be funny but now it's quite frustrating particularly after I have received a letter telling him that he owes you nothing.
