The Twisha Sharma dowry death case has reached the Supreme Court now and the bench took suo motu cognizance over the weekend based on what it called media reports and attending circumstances. So, why did the Supreme Court pick up this matter suo motu? Because the bench of Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice Vipul Pancholi said that there was a clear narrative of institutional bias.
The husband, Samarth Singh, is a practicing advocate and the mother-in-law, Giribala Singh, is a former district judge. The concern was related to the independence of the investigation. Today, Solicitor General Tushar Mehta confirmed that the CBI will take over the probe with administrative steps to be completed today itself. The Solicitor General also told the court that Giribala Singh was going from one news channel to another making statements maligning the victim and that this triggered the media coverage of statements from the other side. Senior Advocate Siddharth Luthra raised his own concerns. The Section 164 of the CRPC that deals with the recording of confessions and statements had been published in newspapers in full that very morning. The court made an appeal directly to the media asking it to stop publishing statements from either family and let the investigation proceed. As the Chief Justice of India put it plainly, let things move as per law and procedure. Samarth Singh has since surrendered and has been remanded to a 7-day police custody.
