Judge Ratha’s decision asserts the primacy of procedural integrity over the subjective demands of the accused, ensuring that administrative order is not sacrificed for tactical delays. It is a necessary, albeit forceful, exercise of judicial authority to maintain the momentum of a high-stakes trial.

JUDGE RATHA FORCES THE HANDS OF THE ACCUSED IN THE NAME OF PROGRESS AND BEING THE BIGGER PERSONAdded:
You see Om Shaol Lolo, she is an advocate over there for the crime intelligence bosses who are under the jail or out on bail because of an HR related matter with regards to the BMW Brigadier. Okay, we're not there. Okay, but focus focus. There's a reason I'm telling you all this. And I imagine with with working with such high top ranking officials, she literally um gathered some, you know, experience and she told my lord on Friday, if you remember, your conflict management skills 0%. You could have done better. You could have handled this like a boss, but you handled this like a a low-level employee and were very petty and quick to make a decision without consultation with all the stakeholders involved aka the defense attorneys, the state including Jonas and reach an amicable working ground. Okay?
In the interest of justice, of course.
Nothing personal here. Even though Jonas takes everything personal, but we are not there. Okay, we are not there. Thank you to everybody who watched my earlier video on Jonas where I proved to you that the man is fully capable of speaking without yawning, of doing his job, of being corrected and not speaking under his breath. If you haven't caught the video, I know at first sight it looks like it's so long. at second sight. It's like I'm starting from the men case, but it there's a reason I did it in that uh format. Make sure you go and watch it so that this commentary will make sense to you. Hi everybody.
Welcome back to another great edition.
This is your host of course the one and only witness you independent podcaster in the building as Lieutenant General Omnazi likes it. Okay, because mainstream media ain't I confirm my presence on behalf of members of the public jury bondaba. I also confirm my presence on behalf of blue lies. It is a lie that Jonas has quit the Senzo Mayua trial. In fact, you got to stay till the end. I have a mouthful to say about that. I also confirm my presence on behalf of I'm not afraid to die, but I've got five protectors and a driver to drive my V12 engine. I don't even drive my own car anymore. I also would like to confirm my presence on behalf of h justice for the Mayua family because they absolutely deserve it. So, with that said, let's get into today's video. You know the house rules. Like, comment, and subscribe. We're on the road to 100,000 subscribers and I absolutely need your help to get there because you know there's some things that I need to do and we got to get to that 100,000 faster than later. Okay, so please do the right thing. I did get someone in my live stream saying, "Oh my goodness, I didn't even notice I wasn't subscribed." So do me a favor. Check. If it says subscribe, it means you're not subscribed. It has to have the D after the E. It has to say subscribe. and then you turn on your notifications and that's it. You've done it once in a lifetime event. Okay? You don't have to do it ever again. With that said, ladies and gentlemen, Jonas, Jonas, Jonas. So, oo sholo.
Um, I guess she kind of made my lord understand that that's not how it works in the real world. Okay.
I don't care that you're throwing around that Jonas can sue you. Like, we were all threatened by my lord unprovoked.
It's like, whoa, when did we get to the extreme? When did we get to the part where Jonas is going to sue you? When did we get to that part? Because the defense and by we I mean the defense and the accused and yourselves included.
Okay. So, when did we get to the part where we're not talking labor relations and Jonah suing you because nobody said he's not competent in doing his job? I repeat, I will continue to beat the dog, beat the dog, beat the dog until the owner comes out. Jonas did something physically in that courtroom that triggered all five accused to have the same impulse reaction and that um so my lord came and came to court today to tell us well guess what Jonas is not going anywhere what what what do you mean like we had made peace with it we had said our goodbyes Guys, I even played a song for his exit. What am I supposed to do now? Delete my videos? What am I supposed to do now? My lord, you you can't say one thing. And within 48 hours, as if we are under arrest and now appearing at the magistrate court on a Monday morning and then you say, "Hello, guess what? Jonas is not going anywhere.
In fact, I'm going to have him take an oath again because I fired him on Friday, which ended the oath. But now he must reath himself. What? What in the what? I couldn't believe what I was watching. I was like, wait, wait a damn minute.
No one asked him to leave. He chose to leave very proudly so. And most of you in the comments said, "Jonas was expecting my lord to say, please don't go. Freddy, please stay. We love you so much. You're the best thing since sliced bread. your interpretation is second to none.
Instead, my lord said, "Well, I've got no choice. Thank you so much. It was nice knowing you."
So, when did they get to Chambers?
Clearly, after the cameras were off, they went to Chambers and they renegotiated Jonas's terms and conditions. Clearly, we don't know what that negotiation is, but I can assure you Jonas didn't yawn today.
I can also confirm Jonas's voice was not shaking. I can also confirm there was an element of patience and professionalism.
Maybe taking the oath away from him and bringing it back. It was kind of like a reset for him, a reality check. Like if you're not in the sense of may you at trial, where are you going to work?
Where are you going to work? Because everybody else is assigned.
It sounds to me like somebody higher up said, "You better put your tail between your legs and man up." But anyway, let's hear the judge cuz you got to hear it yourself cuz it's still unbelievable to me. Here goes.
We had it a meeting in chambers concerning what happened on Friday. Is it The upshot is we have settled whatever happened on Friday.
The only request I want to make is for the accused themselves to withdraw that uh demand because they said they don't want Mr. Jonas and I told them in chambers that there are consequences for firing a court officer. I've got to rewear him again because a smart alec will say that this guy took an oath and that oath is revoked because he took an oath to interpret in this court for this case.
He can't just come back again.
Unfortunately, I hate to pick apart on petty petty little details.
So the accused have been forced strong armed to retract withdraw their demand for Jonas to leave the building because guess who's sitted in the witness box right next to the general Jonas himself.
He is not going anywhere. He is part of the court furniture. Now have you ever heard that when my lord speaks of himself as in when he talks about the court he's actually talking about himself? He speaks in the third person.
He doesn't say I I I I I except of course when he's talking about his history lessons and his self-self. But when he's actually doing a ruling, he speaks in the third person. Jonas is doing the interpretation to the five accused and he is speaking of himself in himself in his dead. Let me let me let me speak properly. He's speaking of himself in his dead. He is not speaking of himself in the third person. Do you know who speaks of himself in the third person?
Mr. JM Batani.
I know I promised I wouldn't talk about him anymore just to help Jonas with his ego. But guess what? Jonas didn't meet his end of the deal. He didn't leave. So guess what? I'm also withdrawing my commitment. Okay, Mr. When he speaks of himself, he speaks in the third person, which is how Jonas should have also spoken in the third person, which I therefore still remain. He's still taking this personal. Jonas needs to grow. Yes, he has the experience, but he also needs to grow or should I say be developed further in his leadership role because his leadership qualities are lacking. He can't be speaking in the third person, in the in the first person. and he has to speak in the third person. Um, but that's not important.
It's just a minor thing I wanted to bring to your urgent attention. Let's hear the terms of condition, shall we?
Or should I say the terms of reconciliation? We are having a reconciliation act in that quadrum. Here goes.
>> Okay. Are we going to do it or Oh, Mr. Niss, are your clients going to do that or are they not going to? And I'm not forcing them. This is just good good etiquette.
Mr. Mu and Mr. Chambers and this will be on behalf of Mr. Mu and Mr. I've spoken to them about what we have already discussed in chambers with the judge Malot. They've got no reservations. are wholeheartedly um agreeing that I should convey the instructions on their behalf that what happened on Friday could have been treated differently. Okay, thank you.
on behalf of Tanzani, IO the same sentiments, malot and the request that Mr. himself is hereby with the court system on behalf of number four and number five.
Okay, thanks.
Just because my Lord says I am not forcing you, it is just etiquette.
Doesn't mean they were not forced. I'm just saying I'm just going to say what no one is going to say out loud. It's giving gaslighting. It is giving it. You better withdraw or else. But we don't know what happened in chambers. So I can only speculate from where I am sitting.
It looks like terms and conditions were set. Ground rules were set. At least I am hoping that Jonas was also given ground rules on how to proceed and move forward because even us members of the jury, our tired was tired. We were tired of complaining. We were tired of saying the same thing over and over again. And we were also tired of watching a grown man literally belittle big giants like General Lisha and the others. In fact, it should not matter who is in that witness box in the video I referred to you about that I did with the Benena case. That witness I mean that interpreter, she's so gentle. She's so kind. You can see it in how she carries herself next to the witness without her saying, "I am gentle and I am kind." Her body language, how many times do I tell you about body language? Body language is the bigger language before you even use your words. Her body language when she needs to speak, she will gently tap on the witness. Oh yes. The same thing we saw it over there at the um Nathan Arasmus Joshin Smith case and the judge dim the female interpreter. Same thing.
She would pat the witness on their arm or on their back so that they can pause and nice and seamless. I think Jonas should have such nonverbal cues. Maybe it will improve relationships and not sound like he's on the attack or on the rampage. We did also see um again back at the Benen case, she of course she can't touch the lawyers cuz they're far away from her, right? So she would just write down write down and they would go on and on and on and then she will then interpret. Everything is done with such humility and humbleness. And I think Jonas needs that humble pie. Somebody needs to bake Jonas a humble pie. Well, let me ask you members of the public jury. I mean, we do confirm our appearances every day.
I guess we also need to decide. Are you going to retract your demands as well?
Let me know in the comment section down below. But let's continue listening on.
>> Yeah, you're swearing section on the top of my head now of the magistrate court act. Is that not so?
>> Okay, fine.
>> Okay, just raise your right hand.
I think the court as I've said is obliged to restoear Mr. Interpreter here. It's in terms of the magistrate's court.
I'm not sure of the section at the moment but just that you will repeat your performance to interpret to the best of your ability as a juris interpreter of this court. I confirm a lot that I will duly uh perform my duties and perform uh as a court interpreter or as a swan interpreter of this court.
>> Thanks. Yeah. Okay.
Mr. Baloya, are we starting again?
>> Yes. Um it did appear that the relevant section of >> 67 >> um it's >> we can even get it under the 217. Is it >> 16? I think section 165.
>> 165.
>> Yes, section 165.
>> What does it say? Just repeat it >> so that some of us can remember it when I'm dead.
>> 248.
Um that's okay. Fine. As long as you know that.
>> Yeah. It says when unsorn or unaffirmed evidence admissible. No, that's not the relevant section.
>> 161. They say >> no. No. This that refers to a witness to testify under oath.
>> No, no.
Section 165.
>> Oh, yeah. See section 165 just says when a person concerned is to give evidence through an interpreter.
>> Okay, fine.
>> Uh the oath of information shall be admissed by the pre ID. No, it doesn't refer to the M state court.
>> Yeah. Yeah. Yeah. Yeah. Yeah. It does.
It does.
>> At official.
>> That one is for a witness.
>> Yes.
>> Okay. But at least we know that the ministry squad says that the funny thing is even the Arasmus also mentions it. I think it's somewhere in section >> six or eight.
>> Yeah. I see on pages 24 to 49 of him.
Yeah. Says official oath of interpreter.
>> The form of the oath which the interpreter must take is not prescribed anywhere verim as to the high courts.
Then refers to rule 611.
>> Yeah.
um of the uniform rules of court only provides that evidence given in a language which the court or a party or its representative does not understand must be interpreted by a competent interpreter who has taken an oath to interpret faithfully and to the best of his abilities in the languages concerned for lower courts. The oath or affirmation for permanent interpreters and casual interpreters is separately provided for in rule 68. So that will be uh rule 68 of the mist court rules.
>> Yeah. Okay.
>> It says translation of evidence. The court only takes into account what the court says translation of evidence. The court only takes into account what the interpreter conveys in the language the court understand.
>> Nobody asked for the reading of the magistrates and don't do any oath because nobody cares. Okay. Even Jonas Jonas should have known that. I think at a bare minimum. I mean he's been there 20 years taking this oath. Are you telling me he's never paid attention to which oath and dun he is? Anyway, never mind. I'm a being petty. But let's talk about it in the comments section. Have you revoked your demands for Jonas to leave? Clearly, my lord is the has the final say. Jonas stays. Mr. Batani does not come in yet.
Will Jonas behave himself for the rest of the day? That's the bigger picture.
I'm not even going to say for the rest of the week. I'm just going to say for the rest of the day. Cuz old habits die hard. And when someone shows you who they are the first time, you already know. You better believe them. I love you so much. Thanks for watching. Remember to like, to comment, to subscribe. I'll catch you in the next one. Bye.
