In contract disputes, courts calculate damages by comparing the original contract price against actual payments made and additional costs incurred due to the contractor's failure to perform. When a contractor breaches a contract by not delivering materials or completing work as agreed, the client may be entitled to recover the difference between what was paid and what was received, plus any additional expenses needed to complete the work. The court also considers whether the contractor was licensed and whether they fulfilled their contractual obligations.

This Court Hearing Feels Like A South Park EpisodeAdded:
Okay, they did bring it up.
>> I got all kinds of stuff. Iris put me on to this. Zach's been helping me out with it.
>> Did I not?
>> I would have been better off just just streaming all McN this morning.
I've got tons of it.
All right, let's go on this uh recalling Malinowski versus uh Alejandro Camarina or Rasco Israel 2601696.
Oh boy. Did I do something with my nuggets?
I didn't give them, did I?
>> Sie, >> I didn't give you my notes, did I?
>> Your names again. Your name?
>> Your name? Mr. Ro, right?
>> Your name.
All right. I gotta make sure I'm gonna I think I did the prior hearing on this.
I'm not sure.
>> I went out and looked at the property, but you're going to have to refresh my recollection, both of you. But I ask everybody here to raise your right hands. You sound soly swear firm under penalties of perjury that the testimony given these proceedings should be the ultras. Miss Malinowski, >> Mr. Israel, I >> ma'am, I >> Okay.
Can you can you break this down for me again? I'm so sorry.
>> He was hired to do the kitchen remodel.
>> Right.
>> The uh price was $5 to do the job.
$5,500 down, $2500 at the end.
>> And between that time, he was given $4,100 >> forward.
$900 was for the wood for the trim.
>> Wait a minute. You gave him 2500 down.
>> Yes. And and then you gave him another 900, right?
>> 900 supplies.
>> So you So at that point you paid him $3,400, >> right? And then there was additional funds given in between that time, but the $900 plus moldings would to be burnt and the labor for the wood.
>> I have no wood. I have no stain.
Actually, the stain.
>> So you gave him 4,100 total.
>> Yes.
What? What?
Maybe I'm misunderstanding. The contract was for $5,000. You gave him $2,500 down. Later, you gave him $900, which was supposed to be for wood, >> molding, stain to burn the wood. And you believe them up.
>> Okay. When did you give him another 700?
25 + 9 is 34, right? 1221 was given $400 because the >> of what year again?
>> 26 25.
>> Okay. You gave him $400 for what?
>> It was for the after work that when underneath the sink the pipes needed to be replaced.
>> Did he do that work?
>> Yes, he did. But when my new contractor came in, he had to be fixed because it was leaking. And the water line that went from the sink to the fridge that was put in was the wrong line. and it was growing mold.
>> Okay, let me ask you this. How much did you pay the new contractor?
>> $2,800.
>> So, how much do you have into the total job? You had 25 + 28, which is 53 + 9, which was 62 + 4, which was 66, right?
So, you have 6,600 into it and you have it done now as you want, right?
>> It's functional >> as you've contracted with Mr. Israel, right?
The only thing that you didn't include in the initial contract that you added on was the $900. Am I right?
>> The $900 >> and that was for the wood mulling stain and uh um to have him install the wood. Right.
>> Correct. And that was given to him on 113 $900. He picked up >> of 26.
>> Yes. And so, but that was not included in the original contract price. Correct?
>> No.
>> So, so honestly, I just want to make sure I'm following this correctly. Had you had Mr. Israel do everything, you would have paid him 5,900, right? And you paid him how much?
>> 2500 at the start of the >> 900 more and then 400 more.
So you paid him 38, you paid 66 total, right?
>> Correct.
>> And then there was additional receipts that added up to $315 that he did me the receipts for and I paid him cash when he handed me the receipt. So that was on top of the 3500 or 3,800, right? So it was you actually paid him 4115.
And how much do you think you're entitled to?
>> I would like I I would I feel that did by placing the bridge I feel that was worth $10,000.
It had to be all replaced. the lines.
>> Wait, wait.
Let's just start with this.
You contracted with him for 5,000. You paid another contractor 2,800, right?
>> Just to get us functional. We were 7 weeks without no sink, no water.
>> All right.
>> No means to cook. But am I not correct that you should be looking at it like all right I paid 4115 to Mr. Israel I paid another 2800 to this other contractor.
Therefore I paid $6915.
And now ask yourself, how much more did you add on from the initial contract price?
Do you understand what I'm saying?
>> I'm looking at the money that was that I spent and gave him. You >> gave him 415, >> right?
>> And you paid another contractor 2,800.
>> That's functional. You think you're entitled therefore to $1,915?
>> No. No. I'm saying in my opinion, I feel that he the work he did do was maybe worth $1,000 on every day. He did place the fridge in the wall and fix the >> Well, am I right? You basically hired somebody else to do Mr. Israel's work.
>> I did. And he's >> And you were going to pay him 5,000 bucks to do the work, right?
>> Right. So, he must have done some work because you only paid the new contractor 2,800, right?
>> Correct. That was just to get us functional with new estimate.
>> I don't know what you mean when you're saying functional. Is this contract is this work been done now between Mr. Israel and the new contractor, Listen to my question before you start to answer.
Did that cover everything Mr. Israel was supposed to do for the 5,000?
>> Yes.
that I'm having a hard time understanding.
>> We still have to finish the bar, but we are functional as far as kitchen and needs to cook with the stove and the lines being >> Did he agree to do the bar?
>> No, >> the bar was supposed to he was supposed to on the layout that I turned into the court. It was supposed to come this way, this way, and then a bar on the other side to sit at with a kitchen book. That still has not been done. My new contractor is going to be finishing up the job.
>> And when we went out there Monday, Mr. Israel, you didn't find any of the wood in there that you claimed that uh uh that you provided for, did you?
>> There was sparkly wood there. There was a plywood that I put underneath the bridge and also underneath the sink to raise it up.
>> No, no, no. But but I'm talking about in the garage.
>> Oh, no, no, no. The that the trim >> You said that that you said you put that that uh uh >> where that pile of wood was at. That's where the trim was stacked at as well.
And it was stacked with a strap.
>> Listen to my question. When you went back there, did you see any of the supplies that you bought with the $900 sitting in the garage?
>> Some of it >> is Was there any, ma'am?
>> No. That wood that was in the garage was purchased by my new contractor. She put my kitchen countertops and raised the sink up. I'm having a hard time with understanding compreending or comprehending I should say why you are getting how you are are coming to the damages you were going to pay him $5,000 >> correct >> you paid him $4115 >> correct >> you paid another contractor your 28 >> correct >> that's $6915 >> correct >> assuming everything that was in your initial agreement with Mr. Israel was covered. Why aren't you why wouldn't you at at best case scenario?
Why would you only be entitled to $1915?
>> No, I misunderstood the question, your honor. I was saying that he did do I'm not denying that he didn't do any work.
He didn't do work. He placed the fridge, cut the hole in the wall, and placed the fridge and did the water lines.
after he was let go and I had to call a new contractor in to get us functional.
Hook our sink, he discovered that the plumbing was leaking and the line that went from the sink to the fridge was moldy. It was the wrong line initial.
So, he had to redo that.
>> Comprehend, calculate your damages and tell me how you're entitled to whatever you think you're entitled to.
It would be the everything that I had given him, the 25 plus the 9 plus the four and the $2,800 that I had just >> plus the 315, right?
>> And the 315 and the additional receipts.
>> But you were going to pay him $5,000 to do all this, right?
>> Correct. That was the agreement. That's what >> Right. And now you paid 6915.
Follow me.
>> Correct. That >> Why aren't you only entitled to $1,915?
>> I should not be entitled to $1950. I should be entitled to the whole thing.
>> To what whole thing?
>> The $5,000 plus the 28 I had to spend on another contractor to get us functional.
>> What?
>> You never paid him 5,000.
You paid him 4,115, >> right? 40 to feel I'm entitled at least 4,100. The money that I that I give gave >> Well, he did. But you only paid another 2,800 for the contractor to finish up the other work he was supposed to do.
>> It's not finished. It is still not finished.
>> What isn't finished, ma'am?
>> Our bar's not finished.
>> Was the bar supposed to be finished as part of the original contract with Mr. Israel?
>> Do you have a quote to have the bar finished?
>> I turned it into the court. Well, tell me what it is.
>> This was the layout that was discussed on August 15th, 25.
>> Dan, you gota you got to make sure, man, that you get things in writing. I mean this >> it says up in the corner the day we met what was discussed and that was before plan that he drew out.
>> Okay. How much do you figure that it would cost to finish up the bar?
>> It is going to cost me another $1,500 to have the contractor come in and finish.
>> Is that what the contractors provided you with an estimate of?
>> Yes. So then this would cost you $8415 to do a $5,000 job. Why did you walk off of this? Why didn't you do this diligently? I can tell you I remember that you did not you you were not diligent about doing it and you didn't have any of the materials that you claimed that were going to be in the uh garage in the garage.
>> So initially the black dolphin were for the cabinets only. Just the cabinets, nothing else. the cabinets and item.
That was the only $5,000 that was agreed upon. No inserting the fridge. No covering up the um there was a next to the fridge there was like a little closet like a spice cabinet. I closed a pantry. I took the door off of there and I closed that as well. I'm showing right here on the picture.
We did have to close that up, your honor. The fridge was originally supposed to go in that space. The fridge and stove will order according to his measurements. When the fridge was delivered and he came to do the job the first day, I lost my bedroom closet because he miscalculated. He said, "I cannot put the fridge here because of the stairwell to the basement."
>> Okay. Tell me what you want to say, but be one of you guys.
>> Okay. So, Um, this was additional. The >> what is it?
>> The bridge was getting inserted and the drywall were tearing out the hole to put it in the bridge. I had to tear out the whole wall to insert that bridge because there was a sliding door in there. So, the walls were real weak. So, I I had to tear everything out and reinforce it. We agreed me and her agreed upon on the police report her son's involved in it.
I don't know why, but the whole agreement was between me and her. And I specified that to her in the beginning of the contract. I only deal with one person and that's it. If you want to pay me and your husband gives me the orders, I'm good with that. But both of you giving me orders and both of you paying me, that's not going to work. Um, so I was supposed to start on the cabinets around August. the cabinets didn't get delivered.
Um, around December, I started doing the job. I started doing the the inserting of the fridge cuz nothing could get done with the cabinets. Nothing was uh turned to her right. The cabinets were messed up. They were damaged. Whatever happened, the material wasn't there for the cabinets.
>> She paid you. She had to pay another contractor 2,800 in addition to the 4115 she paid you. So the 2500 that me and her agreed upon, I told her I will insert the fridge for you, cover that cubby go, and that will be for the down payment. We agreed upon that. That's not a $1,000 job. Tearing out a wall, drywalling it, mudding it, framing it, passing the electrical, running the the line from the bottom of the basement all the way up. That's not a $1,000 job.
That's a $3,000 job easily.
You're out of the >> See, the fact is that you you breached the contract as far as I'm concerned.
No, >> you breached the contract.
>> We did.
>> You did. You did. You did.
And you didn't have the materials in the garage that you you were telling me you'd put in the garage. And I don't believe that those materials were in the garage. Did you want to say something?
>> I did. Um, this job would have been completed if her son didn't threaten him with a CPO >> and also giving me a firearm.
>> I can't go back.
>> I can't be around weapons or people giving me weapons while they're intoxicated with something and giving a felon a weapon. I can't be doing that. I had to walk away. Either I'm going to be in prison for 5 years. I'm not I'm not losing my kids over her son coming to her house while he lives there, too.
Going to the basement high with his cousins and trying to give me a gun to shoot his cousin.
>> That That is not true, your honor. He was let go.
>> My son doesn't work there no more cuz my son was racially profiled by your son.
He has a text message that he sent his cousin calling my son a black kid.
>> All right. Wait a second. Wait, wait, wait, wait, wait.
>> Your son has that.
>> Wait.
>> You guys aren't going to talk to each other. You want to talk to each other, you can go out in the hallway. You're going to address the court with your comments.
Go ahead.
>> Israel was the one who called the police because his tools were left there. He was going back to to work on the house.
His tools were still there. When they got there, the police were there, too.
Israel met them there. He was trying to get his tools back. They said there were no tools there, right? his tools were there along with the police report everything else and them saying his tools weren't there threaten PD had called us three to four days later four weeks >> yeah like >> three to four weeks somewhere around then saying that his tools were at the station so we went from them not having his tools to them having the tools and returning them to Trenton PD >> not all the tools either >> but not all the tools are there >> so the receiver. She >> You're not a licensed contractor, are you?
>> What was that?
>> You're not licensed.
>> No, I'm not.
>> She's aware of that.
>> You're not supposed to be doing this.
You're not supposed to be getting anything off of these.
You can't do that.
You can't do that.
You can't do that.
Can I have one more thing?
You can add whatever you want. I mean, I'm just >> the receipts that she has, the copies are receipts that I paid for and she paid me back. She reimbursed me. The receipts that I gave her without me taking pictures of were her receipts that she paid for out of her pocket. So, there was no reason for me to keep um uh take a picture of them cuz they were not purchased by me with my money. They were purchased by me but not with my money.
Anything else anybody wants to say before I make my ruling?
>> I would like to say something.
>> Go ahead.
>> Um, the agreement that we had in August to do the job, the order for the kitchen countertops and everything to do the kitchen remodel was not even ordered below until September.
The stove and refrigerator did not come until December.
My memory is correct. He started in December 12th. And that was when the fridge was in place because it wasn't even delivered until December.
and the day that I wasn't supposed to come, he did come to my house on Saturday, March 7th and said that he couldn't do the countertops because it was raining. I said, "Can't you just work in the house in the fireplace room?" That's our work area. He said they had to be taken outside because they had to be put together and because if it was raining, he didn't want them to work. But he said he would be back the next day, Sunday, the 8th, to do countertop, if weather permitted. It was beautiful all day. I gave him the benefit of the doubt and texted him around 11:00 a.m.
Are you coming today? It is not raining.
I was ghosted all day.
>> Okay, I've heard enough. I really have.
>> And that's when he was let go.
>> Anything else?
>> And then that's when I got caught. I was threatened. Then I called the TR police and had them dispatched to their location. Um the police told me that my tools weren't there and that there was nothing for me to get from there. I did tell her son to leave my tools on the porch. I'll pick them up. He said no. He said if you know if you come here, you know I have a CPL.
>> All right.
>> And I will use it.
>> I don't want to hear any more of this. I don't believe you you complied with the contract. Okay. You didn't. And I made up my mind last week that you not only breached the contract, you didn't deliver those materials.
I'm going to do the best I can here. I'm awarding the plan of $3415 plus $83 in filing and service 3498. Can you pay all of that today?
>> No, I can't.
>> How much can you pay?
>> I I don't get where he gets that number.
I I have no idea.
>> Today?
>> I'm not working right now.
I'm temporarily. I have I was just diagnosed with diabetes type two. Well, I'm not even they don't know if it's one or two.
>> Well, you took the money. I'm going to expect you to pay this and you're going to tell me when. I'll let you pay it in installments of $200 weekly. I'll tell you what, I'll make it 200 bi-weekly and I'm going to start this on June the 8th. If you don't if you uh if as long as you comply with that they can't garnish wages. She can't garnish wages.
That's the best.
>> That's why he's working as an unlicensed contractor. He can't get a job because he's a felon.
>> Ask them to do it. And she could subpoena you for >> you need to be a W2 employee. Ain't going to happen >> for a creditor's exam and it could get really ugly. So if I was you, I would make figure out a way I could stick to that PL payment plan and I would do so.
Do you understand everything I'm saying?
>> Yes. Look, I can't I'm not I can't drive her now.
>> Well, you got until June 11th. You're going to have to figure out something.
You were glad to take her money and not deliver materials and not finish the job. Listen, I'm not going to quarrel about it.
>> Hang on.
>> I was threatening.
>> I made my decision. I think I made that clear. I'm not arguing with you. $200.
You have to pay $200 in that starting weekly on that date. If they don't, you can have him subpoenaed for a credit exam. You can make him brings all bring all of his real estate, bond holdings, stock holdings, bank accounts, uh, you know, savings and and, uh, checking accounts. You can make them bring everything is tax returns. They got a form order. You got to stick with this.
You were wrong. Period. You can't be doing this. You're not licensed. Should have been worse. I don't want to hear anymore. Good luck. Abdul Samad, go down the hall. Get a copy. The judge.
This is file number 26W842475 A and P.
>> If you have type 2 diabetes like I have, you're confronted with choices.
>> That was nice.
investigation report.
That was nice.
All right, guys. This is a um MTRP new allegation.
>> This isn't that long. It's just it's just judge Stevens completely disgusted with two defendants and they are disgusting.
>> I had a chance to meet >> Judge. I had a chance to u meet with my client regarding the most serious u allegations in emotional revokeless probation, the burglary of the habitation and there was also uh indecent exposure as two new offenses that were allegedly on February I mean February of 2026. He's informed me that those charges have been dismissed that what you told me.
>> Yeah, they're not there.
>> That's what he told me. It could be, but that doesn't mean a motion can go. They can whoever it is could dismiss it, but the state can still present it. Just because it's dismissed by some entity doesn't means that it can't be resurrected in a motion to revoke probation. That's the way things are.
That's for somebody else to decide. Then the state file this motion. They've got one, two, three, four, five, six rounds of failures.
Burglary of inhabitation, indecent exposure.
Uh, let's see. Failing.
>> This is the defense he went with.
>> No, that guy was Mitchumstein.
>> To report probation office. Uh, failing to provide verification of performing community service hours, failing to provide verification of completing batterers intervention program.
and then a just in uh fees and costs. So there's six different grounds here.
>> Judge, just because a case dismissed by some entity doesn't mean that it can't be moved here in this room on a motion to revoke probation. That doesn't that doesn't mean it's over with. It's for the prosecution to decide. And until they dismiss that, it still depends. But anyway, let's move. Uh it's a motion for hearing. When can y'all be ready?
on a Friday.
>> I can be ready anytime.
>> When Friday, which Friday?
>> Uh, well, not the not Friday the 21st.
What? 27. You know what I got on out?
>> So, anything but the 21st, 22nd at whatever time. If we're around that time, anything other than that, I can do.
>> Okay. We're going to set this and have a hearing on it two weeks from this Friday. Okay.
>> Yes, sir. So, that's the one.
>> Let's see. Today's the 11th. So, uh, 16 * 2 is 30.
>> Yeah. Yeah. So, yeah, that'd be fine.
That'll work. Long as it's not that 21st.
>> All right. And you're looking at 10 over uh 10 years in prison, probated for 10 years. So, if this is revoked, you're looking at no less than two more than 10 years confined in prison. And it's up to the court to decide.
>> That's the way that works.
>> Y'all be ready.
No, if not with regular probation. No, sir. No, >> you're not entitled to regular probation. You can't on deferred. You're not on to >> Okay, we're going to have a hearing. We let you go until we finish this.
>> Julia, sister Mendoza, and you said Michael D.
>> Michael, Mr. Dome, come on.
>> He has two cases. He >> has two cases.
I hope that's You're not going to like this guy.
>> First one is uh 25 CR1819.
This is an indictment handed up by the grand jury of Jefferson County, Texas on December 3rd of 2025.
And you are Michael Denson. Yes, correct, sir.
uh speak out. There we go. Okay. Thank you. And you were here with Mr. Dooler, your attorney, and the state's attorney.
And >> I don't have to tell you >> the serious nature of these, >> correct?
>> You know, you're here with some serious charges. Yes, sir. on uh in 1819.
It alleges that you committed the firstdegree felony of aggravated sexual assault of u a female and that would carry with it no less than five nor more than 99 years confinement in prison or life in prison and a fine up to $10,000. Do you understand?
>> Yes, sir.
But the grand jury also includes another paragraph to all of this that prior to being charged or prior to committing this aggravated sexual assault as alleged, this states that you were finally convicted in the 178th District Court of Harris County, Texas in September of 2014 for the uh felony of assault impeding breath, which means strangling someone.
So, if that was proven true, you were found guilty of this aggravated sexual assault. Your punishment range is no longer no less than five, no more than life imprisonment. It's no le >> Whoops.
Yeah, Judge Stevens isn't going to like this.
>> Less than 15. No more than life. Do you understand? It starts from 15, please.
26 CR377 is another indictment handed up by the grand jury on March 18th of this year.
And this alleges a much older case uh for some reason. It's old uh much it alleges that only about June 2nd, 2021, which is going on five years ago that Do you understand this?
Okay, I understand. Wait, it was it was strangulation.
Okay, this is going to uh be uh an allegation of manslaughter by strangulation.
And let's don't get it confused with the prior strangulation conviction that you have in 2014 because that's alleged here as well. But in paragraph 1 of 377, this alleges that on or about June 2nd, 2021 in Jefferson County, Texas, you committed the secondderee felony of manslaughter by strangulation, which carries with it uh no less than two nor more than 20 years confinement in prison and a fine up to $10,000 and be assessed. This indictment also alleges the prior strangulation conviction, a seconddegree felony from 2014 out of Harris County that we discussed before. That is alleged as the second paragraph. So it enhances if found true, it enhances this indictment to a firstderee felony if all of this is found true. So in this case, you're looking at no less than five nor more than 99 years confinement in prison or life imprisonment.
And these two cases, uh, the sentence is no less than 15 up to life imprisonment in 1819 and no less than five, no more than life imprisonment in 26 CR377.
those uh two cases uh since they are alleged on separate dates. Those if found guilty and sentence can be the sentences can be added together on top of each other or made consecutive.
Do you understand that you can be looking at up to two lives in sequence?
One life >> and then after that's completed a second life.
>> Yes, sir.
>> All right.
uh you know what you're charged with and what you're facing as a consequence. Go ahead.
>> Well, he's asking that be settled trial off it and because of my case load that I'll be relieved and so they'll support.
>> Is that what you're doing, sir?
>> Uh yes, sir.
>> Okay. Do you understand you're not eligible for uh probation on any of these due to the allegations. If those are found through and we will try one then the next one and if sentence uh the court can stack those on top of each other. Do you understand?
>> So going to be concurrent?
>> No.
>> Okay.
>> No. We're going to try one and then the other.
>> And it can be something can be concurrent if y'all agree to it but not when you're coming to me.
>> That's no problem.
>> It is actually a big problem. It's a very serious problem as long as you understand.
>> That's why we love him. He says, "Can it be concurrent?" This guy knows he's guilty of sin. He's looking for for just He wants to get it down to one life sentence.
Stephen says, "Not if we try him. It's not going to happen.
Not if this crap is in front of me.
Those things are going consecutive. you are going away for as long as I can put you away. I mean, he didn't say it, but that that was the vibe I'm getting >> and appreciate it.
>> And uh anyway, I'm going to grant the request of the defense based upon your uh defense attorney, based upon your agreeing to this, the next lawyer on the u you're unable to hire somebody, correct?
>> Correct. the next lawyer on the rotation wheel will be selected and will be appointed to handle these cases. Do you understand? Yes, sir.
>> And then you'll find out who those are.
I don't even know who it is yet.
>> Yes, I do.
>> Yeah. Go ahead.
>> On my indictment, I was telling Mr. Beautiful here. On my indictment paper, they were saying that this this murder happened in 2021, which is incorrect. Uh they were saying it happened in 2018.
Uh, I'm not sure, but I was told that, you know what I'm saying, that I was supposed to tell you about it and tell >> Yeah, you need to tell your lawyer and then the lawyer >> my new lawyer.
>> Either lawyer, him, the new one, tell everybody you can if you think there's an issue.
>> Okay.
>> But I don't know what you're I'm looking at the documents. I don't see anything that reflects what you're talking about, but that's for y'all to bring up as a legal matter and then the DA's office to respond to if they if necessary. But those are legal actions that need to be done in a legal way through your lawyers. Okay. All right.
>> That is all.
>> See you loser.
>> Decon 267842180.
Chung.
>> Okay. Mindy got this to me hours ago, but I'm just getting it up now. And and uh Zach, of course, helped get it over to me.
>> Chung, this is fun.
>> 24W842. I'm sorry. 26842180 A, B, and C.
How you doing, Mr. Chong? Mr. Chun, can you speak English? Can you hold on?
How much? Enough where we can conduct a hearing where you can understand interpreter.
>> You need an interpreter because I cannot hear. I don't have an eardrum.
>> What?
>> I don't have ear.
>> He doesn't have an ear.
>> I see. I see. So, is it is it more a hearing issue or is it you can't speak English? Which is it?
>> Well, you can teach me a little. H. We need to get Lao in here.
>> No, I can't do that. I can't do that.
Did they offer you anything? Oh, your record's bad, huh?
Your record's bad. Bad. Bad. Bad.
Why you driving so fast?
>> I said your record's bad. Bad. Bad. I don't know what to tell you. Uh, they're not going to dismiss it.
They're not going to dis I don't I don't post that only idea echo.
>> What is going on here?
>> I can't take this seriously.
>> Did they offer you anything today?
>> Let me call what?
>> Yeah. Lieutenant your name?
>> Lieutenant David told please offer him anything today.
>> Yes, your honor. Uh the the problem was is that um he was questioning the circumstances of the staff and thought that he was racially profiled.
>> Okay.
>> All right. Good enough. Good enough.
Good enough. We'll we'll just set a formal hearing or an informal hearing.
We will set an informal hearing.
>> You hear that informal hearing?
>> Like we spoke about you tell the story then you can dismiss or >> I'm not dismissed in this story.
>> Come on. I already told you so.
>> I said you had to had have the officer present cuz I wasn't there to recover.
>> He looks and sounds like the South Park shitty walk guy.
It's so hard to take seriously.
>> Yeah. Well, you can't do either.
>> We're going to set an informal hearing.
We'll set an informal hearing. Informal hearing date. Go down the hall. get your notice.
>> Can you bring the federal agents police?
>> I told you to make a complaint with the police department regarding that.
>> Listen, I'm going to set an informal hearing date. Your record is leaves a lot to be desired. Can you now you you go you come back on the date of the hearing.
>> I know, judge, but >> I haven't heard anything yet, sir. I can't just start throwing out a case because you say there was racial profiling.
>> But you can bring the federal agents for race religion and discrimination.
A police officer race and discrimination.
I don't want an internal investigation.
I want a federal government to jump in.
>> Well, you go. I don't know what you're asking me. You have the right to make complaints with any discrimination.
>> So, I'm a federal government.
>> Dude, you drive like [ __ ] That that that's what's going on here.
The fact that you're Chinese is not the problem.
coming in here that then federal government they can charge you for I'm going to listen to the evidence.
>> Stop me behind. Did he come in?
>> I'm going to listen. Hang on.
I'm going to listen to the evidence and I'm going to make a determination as as to whether or not you had defective equipment, whether or not you had proof of insurance, and whether or not you had you committed the offense of improper lane use. That's all I'm doing. If you've got a complaint to make, you can go to whatever agency you want to make your complaint with. But don't ask me just to throw this out. I don't even know anything about the case.
So, we'll give you a hearing date. What date is that going to be, Heather?
>> Yeah, but >> it'll be May 26th at 1:00.
>> May 26th at 1:00. May 26th at 100 p.m.
Are >> you going to be testify? So, if me here, then they can charge you.
They needed they know they know this is government but discrimination and racism is a federal >> I don't know what you're talking about.
I don't know what you're talking about.
They wrote you a civil infraction charge. I'm going to listen I'm going to listen to them and I'm going to listen to you. Sir, the officer's not here right now. The officer That wasn't an expression. He literally doesn't know what he's talking about.
I mean, you can't understand him. It's that simple.
>> Is not here.
>> When he shows up, I'll listen.
>> We do that after that.
>> We're going to do it May 26th at 100 p.m.
>> We go to police officer and then we go into >> What is he saying? Hang on. Come on back up here. Wait a minute. Come here.
>> Your honor, if I if I may. I believe he was when he was referring there, he's referring that he wants somehow the federal uh agencies to be involved in this.
>> You can make your complaint with whoever you want. I'm not subpoening the federal agents.
>> He says you can make your complaint with whatever agency you wish.
>> You can make your Hey. Hey.
You can make your complaint with whatever agency you want. I'm going to listen to this testimony with respect to these three civil infractions and I'm going to make up my mind as to whether or not you committed those civil infractions.
>> I don't period.
>> Period. That's it. And we're going to do that May 26th at 1:00. Okay? That's the best I can tell you. If you want to make complaints with other agencies, have at it.
>> Yeah, but I don't have a they can see right there. They can charge me >> in the spot, you know. She need to believe not talking about she then believe time out. Okay.
>> He doesn't know the timeout sign.
He literally doesn't know what it means.
That's like a cultural reference. It's not working.
>> I don't know who you think you are.
>> Well, you judge.
>> I don't know who you think you are.
>> You judge. You can do everything.
>> No, I have rules and I comply with the rules.
I'm a judge. I can do anything. Are you May 26th 1:00 May 26th 1:006:00 >> Louis Lozan Who do you think you are?
Who do you think you are?
>> Mr. Hey, if you would turn on your camera, please.
>> Thank you.
>> Yeah, good morning.
>> Good morning. This is 260 1983.
This is a >> I got this and some more McNal.
I think MGT is involved as well as Zach.
Of course, >> ticket that was issued on the 6th of April at about 12 after 11 in the evening in the area of Royal Oak near Krooks and Estonia streets. The citation was issued at 40 and a 30. You can admit or deny responsibility or you can admit responsibility with an explanation. How do you wish to proceed sir?
>> Uh I would like to admit responsible with explanation and u >> that's just uh it's re really not want to use as an excuse your honor. I just uh you know with the construction being done I work at Southfield. I get off and that 696 is closed from there. Um, and I was just driving and that area is kind of hilly, you know, and I you when you go downhill, it kind of accelerates. I know that's really no excuse. I have a good I have a very good record and all I really really really am requesting of the court is uh to drop it down as low as it can so that there's no points. I My fear is my insurance going up. it's already really high and uh I'll just I'm very careful. I I take the same route when I get off work now. I make sure that I'm going extra cautious and slow and uh that's it. Besides that, there's nothing else that I have to add, your honor.
>> You know, there's no hill on Crook's road.
>> No, when I was going That's on Crooks.
When you're going down, you know that by the >> Going down >> by by the school by the school area, your honor. when when when there it's it's kind of slloy, but either way either way it's still north it's still there.
>> This is um >> it's kind of slloy.
I haven't seen this one yet. This is good. You know, if somebody was from Colorado or West Virginia, they might hear Michiganders talk about hills and laugh at us like I because we don't have any hills. Um, the closest thing we have to a hill is the underpass on Woodward where it goes under 696.
>> Not down there. You don't. Up north where I'm from, lots of hills. And if you take your foot off the accelerator when you're at the top, you will lose speed going down that hill. But the bottom line here is that uh you were cited for 10 over, you were measured at 17 over. Is there anything you want to add to this officer?
>> Uh no, Mish. I cut I cut him a break on the road for almost half the speed.
>> Well, you brought it from four points to two as well. uh given his record which is good but he has taken the class so that's not available to him again. So the fine on this is $135 I believe. Okay.
Yes.
So you rightly admit responsibility and the fine is 135 which can be paid online or by mail or at the courthouse counter.
>> Okay.
>> Have a good one. Thank you.
>> All right. Wait. So that's uh that's all set like um there's going to be points from my record.
>> The points don't come from the court.
They come from the secretary of state.
The Secretary of State has a program for drivers with good records who were cited for civil infractions three points or less, not including careless to take a once in a-lifetime class. You took that class before for another traffic stop and um that was on the 25th of January 2019. So you did it six or seven years ago but it is just once in a lifetime.
Yeah.
>> So there there will be two points instead of the four.
>> Is there any way we can drop this to impeding traffic? Anyway, please I I really that's really all I request of the court. I'll come down there today, pay it all off completely. That that's just my I humbly request that. I just want to maintain my clean driving record. That's all.
>> Proud of her record. It has to reflect reality, sir.
>> Yeah. I I I understand. I But but again, that was 2019 that I took that class that I've had that infraction, right?
I'm trying. I'm really I have I have three daughters. I have a fourth one on the way. Please just that that's that's all. Please, is there anything that you can do? I'll come pay it off right away.
I just don't want the points on my record. Please.
>> The court does not have the authority to unilaterally amend ticket absent a hearing.
You rightly admitted responsibility.
>> Yeah, I'm not going to lie about the violation. Non officer, he he was the nicest officer that I've ever encountered in my life as well. I would like to for him to know that as well. No officer too too many because there's only one other ticket that I'm aware but >> yeah but just just in general even in general outside any of interactions I ever had officer Hall if you're hearing I just wanted to thank you for that interaction and then magistrate whatever I'll leave it in your hands you you know what I'm asking for if we can just drop the ticket down lower so it does so I don't have to worry about the points that's all that's that's all that I'm asking if that's possible to do so Please, >> as I indicated, the court does not have the authority to unilaterally amend the ticket.
>> Officer Holland, it appears that you you will get nothing and like it. This is the Chisnator. He's not out to get you, but you admitted it. You were guilty.
You get the fine. Period. End of statement. Then you try to BS him about a hill that doesn't exist in a place that he drives all the time.
Let it go, dude.
>> You're muted at the moment.
>> Yes, man. Straight. I mean, 47 and a 30. I I caught him a break on the road.
>> Yeah, you did. That's um 135.
>> Okay.
Okay.
I know it's 11 o'clock at night, but it's right next to a school, too.
>> And you didn't say school >> Harper Aaron James Harper 2514851.
Okay, I've got more stuff here. I don't know if any of it's a repeat. If it is, we'll skip over it, but uh it was coming in fast and furious, so I didn't have a chance to check.
But so far >> 26841103 25w841736 24B 146691 B 25839353 25838256 25W3 838175 and T5F244556 your name.
Thank you.
>> All right. I took your plea on the April 14th case. You had a lawyer at all of this, didn't you?
>> Yep.
>> Who's your lawyer?
>> I forgot the guy's name, but it was the guy in the uh room to the left when you >> It was Mr. Haynes last time, it looks like.
>> Is he here today?
>> He's not.
>> No, we have Mr. Gratziani now.
>> John, we have to go. does. Yeah.
>> Okay. Have a seat in my hallway.
>> So, you can have a seat out there and bring the all the files to him. Okay. We had a change of the lawyers after a few months here.
>> Aaron James Harper.
>> Good morning again. Chaping on behalf of Harper.
>> This is 25B148510.
And I've got a whole slew of other cases too. Please identify >> 26844 I'm sorry 841103 26841736 24B146691B 25839353 25838256 25838175 and 25F244556 I don't like these Mr. Harper you like to ignore courts is that what you want to do >> judge in his um >> your name Mr. Harbor, you shook your head. No, that isn't what you want to do is ignore courts cuz these are all old. These are all all six of these files. And then this one here, I don't know who you think you are either.
>> Judging his defense, he >> I can't wait to hear it.
>> He does have some money available. He did most of the court work for him.
There's one more day left, but unfortunately, he has these tickets that he has to go.
>> Call in uh Jessica.
I don't like this. Tell me what Tell me what you want to say. I mean, I took his pleas to attend the court work program.
30 pay fines and cost. I told him bring a bunch of money. We've got all kinds of cases here. I mean, he owes all kinds of money.
Well over $1,000.
>> What does he have $1,000 to pay? He he lost his job and he just recently >> I told him pay $400 bi-weekly beginning.
That's what he told me he could pay on October 28th. I told him that on October 8th. He never showed up. He never did anything. And you haven't paid on any of these others. And you just keep missing court dates like you're running the Pentagon or something.
I'm serious.
>> Yeah. So since last time I came the the two issues that I had was tax.
>> Go ahead.
>> I missed the court program when I was behind on my payments.
>> Well, that's no shock. You were on the other six or seven cases you added into your account.
>> Yeah, I had all like a payment plan with the other other stuff too. So since >> Well, wait slowing.
>> Yeah.
>> What do you mean? You had them. We gave you a payment plan on this and you just ignored the payment plan.
>> Yeah. And then I came to the hearing to uh basically let you know that I uh basically lost my last job. But since the last time, like the last time I was here, like a couple weeks ago, >> that was April 14th. That was almost a month ago.
>> Yeah. I got job >> where?
>> Company.
>> How much you make an hour?
>> Uh 15th.
>> Did you graduate?
>> Yeah, I I went to the college and everything.
>> You graduated college?
>> Yeah. Community college job.
>> That's okay. Where? Uh, it's called K.
But >> would you get an associates degree?
>> Yeah.
>> Why you working for 15 bucks an hour?
>> I mean, we get like we get >> I mean, don't get me don't get me wrong, it's better than zero dollars an hour, but you should be getting a better job than that. Unless your criminal history is following you around and going to hurt you for years to come.
>> Yeah, I don't history again. But um since the last time I I got a new job at the woman company and stuff. So and then I I went to most of my court work programs cuz that's was another reason I had to >> Why' you miss on that date that I took your plea on? Why'd you miss on March 4?
>> Um I believe I was late and I got end up getting >> Why were you late?
>> I honestly was there but I'm thinking it started at a whole different time like >> and I was literally there. I was sent home. But I have one more.
>> Are you going to Are you going to uh Are you going to grow up?
>> Holy.
>> Uh, we're thinking it was a different time.
>> Sir, you got to take your hat off, sir.
Take your hat off.
>> What do you mean you think? What time did you think you had to be here for the court program?
>> 8:45. But it was >> Did you tell him when he had to be here?
What time did you tell him he had to be here?
>> Complete at 8:30. He's completed a day before, but he obviously was on time prior to >> You got to grow up.
You got to grow up.
>> Anything.
Josh, he's he's made an honest effort.
He like I said, he lost.
>> You're you're smiling there is why I'm smiling you, Mr. Gra.
>> No, I'm just saying this this man's made mistakes, but he's catching up to things. He does work unlike a lot of folks that you encounter and I think he'll be successful.
I told him that it's necessary to give blood, you know, make ends meet. He is living with his parents and he can do this with charge.
>> This was defrauding an end. Keith paid nothing on this. How much did you owe on this? The original amount.
>> I believe it's the original. I don't have to pay anything.
>> Judge, it is $1,467.79.
I ordered you to pay that back in October, right? And I said I'd let you pay. You told me you could pay $400 bi-weekly beginning October 20th.
>> Yeah.
>> You told me that. I wouldn't set that kind payment plan unless somebody told me that. What were you doing then?
>> That's what happened.
>> What were you doing then?
>> The time that I actually lost my job.
What were you doing at the time you were here to make you believe that you could tell me that you could pay $400 by weekly?
>> Oh, I I was still work, but that's like a lot of time that I actually lost.
>> Are you listening to my question, sir?
I'm asking you what you were doing for work.
>> Oh, I worked at FedEx.
>> Well, how'd you lose that job?
>> Lay off.
I >> mean, you're way behind for it. And I I'm planning on making a payment today, too. Like I said, >> for $200.
>> Yeah, I have a new job. Heather, >> tell me how much he owes on all these other tickets, will you?
>> You just tell me the amount.
>> This one says 197. I don't have the figures on them.
>> 197, 248, 260, 23, 180, and 185. And then the probation one I just gave you. Do you want that amount?
>> Close to $3,000.
I didn't write those down, but that's where you're at. Including this $1,476 1467.
You're to serve one additional day on the court program on top of the one that he owes.
>> Yes.
>> And pay $35 for that.
Well, I'm just not appreciative of this.
Paid 200 today.
Defendant to pay 100 per week beginning.
This is on the probation case.
$100 per week beginning May the 22nd.
You understand, sir?
>> Yes.
>> And I want all the rest of these scheduled for show cause. Heather, you're going to schedule all these for show cause and failures to pay. We can put them about 5 6 weeks out and he's going to do everything in his power to get a second job. That's what I wrote down, by the way, is get a second job.
Did you get a second job?
>> What? When I told you that April 14th, >> did you get a second job?
>> I got the first one. So, I had another one, but I haven't got another. But I not I don't have I already had two jobs.
I have one.
>> Well, I wrote down get a second job on that date. I wouldn't write down get a second job unless you told me you had a first job. And if you had a first job and if it was different than the one you were doing, tell me what you were doing.
So the last time I came the actual the job I was doing at that time like the April I was doing Uber Eats. So the basically the second job I got now >> maybe you should be doing that on top of this one. It's your life son. Go down the hall pay your 200. She'll set the rest for show cause. You can give them the dates down there. Heather. Thank you.
>> We have Matthew Glenn Malone here.
Matthew Glenn Malone 25B148976 26B150688B >> 25B149968 25T647324 >> Good morning judge today 378 on behalf of Mr. Ne state your name for the court sir >> that name yes Matthew Malone >> so Mr. Malone has missed court dates.
Wait a minute. He just got possession.
Let me let me just double check these.
He's got a possession used a controlled substance from May the 10th. So, he must have been arrested yesterday.
He's got from the same date he Well, then he also has a trespassing case that he missed missed on in front of Judge Hessen. That's December 19 at 25 defense state. He missed a couple of the court dates. He was supposed to be here on January 21 of this year and February 4.
Did not show and a warrant was issued.
And then he was also in here or supposed to be here I should say on 25T647324 that's in front of me. So let's take those three. That's on a drive suspense for which he missed on January 15 and January 29th. Does he stand mute and wave formal reading on those three charges?
>> Yeah.
>> All right. And then I've got here another case where I sentenced him to 12 months probation and he didn't show up on January. You don't like to show up in court, huh, Mr. Malone?
>> You must be a busy >> You must be a busy guy.
>> Um, >> he what? He's had a lot going on. He's homeless. So, he was sleeping behind a dumpster. He didn't come back to court.
He understands that he should have come back to court and ask for some sort of a payment arrangement at least on that probation violation case.
He's got some significant health issues.
>> Where was he? Detective, your name?
>> That doesn't sound like a lot going on.
Sleeping behind a dumpster.
That reduces your home maintenance quite a bit.
>> Where was he picked up at?
>> He's on telegraph riding his bicycle in uh near sibling, I believe.
>> Thanks ago. Where did you stay, sir?
>> Behind the Family Dollar store on sibling telegraph.
>> You have anybody here that you can stay with?
>> No, sir.
>> into a program and I Googled it. It's a community outreach program. Uh Henry Ford Hospitals sponsors it.
>> Sure. Yeah.
>> And if um your does issue a personal bond, he plans to go there to see if he get policy. I understand.
>> Yeah, that's not good.
>> I mean, I'd like to help him. I feel bad when you know, people run up against Tuck, but I can't have you just ignoring case after case after case.
I just I apologize about that, your honor, but I had nobody to help me. I was going to get in a Henry Ford wind out last winter, but they were jammed because of the cold weather. I'm willing to do anything you want me to do to go hospital. I want to get back on my feet.
I have absolutely nothing. I mean, I don't have nothing. And I want them to help me get a job, get somewhere to live, and get back on my feet cuz I'm lost. I need help.
>> All right. So I have to deal with this violation of probation first. It's they say you fail to refrain from having contact with T Valley mobile park. This is part of a show cause dated January 12 26 and you didn't show up on like I said on January the 28th. So that for that how is he going to proceed on this?
the police with an explanation and he understands the right he giving up guilty to the probation of the police.
>> Do you understand that sir?
>> Yeah, I plead guilty.
>> Hang on. I want to make sure that you understand everything here.
If you plead guilty, this would be punishable. I just want you to know since you absconded this would be a non-technical violation and you could get 90 days on this. Do you understand that?
>> Yes, sir.
>> You are presumed innocent. They have to prove you guilty on a probation violation by a prepoundonderance of the evidence. Do you understand that?
>> Yes. I got an explanation for everything.
>> All right. And at that hearing, you would have the right to question their witnesses, to bring in your own, to use the subpoena powers of the court to bring in those witnesses. If you plead guilty, you're giving up all of those rights, and there will be no trial. Do you understand that?
>> Yes, sir.
>> All right. To the charge, fail to refrain from having contact with Tel uh Valley Mobile.
>> My god. Throw him in jail for a couple days so he can get a shower and something to eat. Seriously.
>> Home park. How do you plead?
>> Guilty.
>> Were you at Tele Valley home uh Tele Valley mobile home park?
>> Yes. I was there watching a friend's house. Derek Bane. He went to the house.
>> What day was that?
>> I don't remember.
>> But it was after I told you not to go back there when I placed you on probation. Correct.
>> Yes. He >> Why did you violate the order like that?
>> Cuz he is schizophrenic. He was scared.
He says, "I left my house open. I had nobody to watch my house met, and I just took my chances to help a friend out.
That's the only reason I was in there. I had not been back."
>> Anybody force you to plead guilty?
>> No, sir.
>> Is accepted.
How old is he?
>> 59 years old.
>> This is sad.
>> Yes. Telling you about living behind that dumpster. I have nobody to help you. I need to get into the hospital. I I'm I'm just lost. I'm worn out.
I'm lost. I need a job. I want to go to work. I need somewhere to live. This is not me. I was not brought up like this.
I was not brought up like this. I was brought up by very good parents. But my family abandoned me. I took care of my parents caregiving for 5 years, sir. And my family abandoned me. And this is what I got. I'm pleading for help from you to get me to Henry Ford Hospital. and turn myself in there today or prove to you that I will do the right thing. I'm just asking for your help.
>> He also has therapist to support him with his shrine and help him. Your honor >> and I will not mess up this time. I guarantee if I'm getting the hospital today, tomorrow, I will second. Does he already does he also stand mute on this trespassing charge in front of Judge Hessen from December 19 to 25?
>> Yes, sir.
>> I'm entering a not guilty plea there.
>> Here's the fact though.
You needed to come in front of me >> and you don't do Wait a minute. You don't do that. And now you put yourself in an awful position >> because I can't let sir I can't let people not show up in court.
>> I mean I'm I'm sympathetic to everything you're going through but you don't show up.
I I didn't know what to say sir. I didn't I don't know what to say about that. I apologize. I disrespected you and the court and I apologize but this will not about the system. That's what I'm worried about.
>> This will not happen again. I guarantee you.
I get in the hospital and I'll prove to you and I guarantee you I'll prove to you that I'll do the right thing.
This guy is a really weird case because you don't see this very often. He seems clean. He's rational. He's respectful.
He has good manners.
I I mean I don't I don't know. Maybe maybe he's using and it's just he's clean today. I But he doesn't seem like that. He seems like he makes sense and he's and he's not and he's sober.
That's usually enough to get you a job.
So he then went, just so you know, and went and committed another trespass at >> the days before.
>> Yes.
And then he didn't show up on this suspend and the drug charge and the bicycle on roadway charge.
Well, the bicycle and roadway and then the the >> That's on That's in default. That's been in default. Oh, no. That was yesterday.
>> We'll sort this out. Do you want to say anything else?
>> Times. I think that >> if he is released, he does have a plan to try to get back on his feet. I think going to jail would probably set him back.
>> How long has he had this plan on going?
>> So, he tried to get into that community outreach program over the winter. I think the >> Well, this is May. I mean, what do you mean he's got a plan? He he everybody comes up with these plans.
>> Throw him in jail so he gets a shower for crying out loud. Like to be nice.
Not like long. He's not like a hardened criminal. just throw him in the clank so he gets a damn meal and and a shower in him >> when they don't have >> because he heard that the community outreach program might have some openings.
So, he's going to try that again.
>> Yeah. Okay. Well, here's what I'm doing.
You got a controlled substance charge out of Brownstown from May the 10th and you've got the bicycle charge. So I'm setting $1,000 10% on 688B and A on 25T647324.
I'm setting 1,10%.
>> There you go. That might as well be a million dollars. That's a remade.
>> So I'm going to go as light as I can.
And I'm setting 1,0% on 25B149968 as well as on uh uh 25B148976.
So I think that should be four of those and should be to $400 you're going to have to sec uh pay to secure your release. You cannot leave the state. You cannot violate a law. You must appear in court as directed. You're not to go near T Valley. You comply with all terms and conditions of probation. and uh no alcohol and no drugs. You're not to purchase, possess, or consume any one of those. Uh this supposedly was a gabapent, no alcohol, no marijuana, no illegal controlled substances. You cannot leave the state. You cannot violate a law. You must appear in court as directed. I'm going to give you the earliest court date I can. And uh you can you can enlighten me when you come in here as to where you think you can go, but it sounds like you're not really pursuing it with much diligence if you ask me. If you were talking about doing it in the winter and you still haven't done it. So listen, that's listen to me.
That's what I'm going to do. I wish you didn't force me to do this. I really do.
But you got to you got to do the right things here. So, I'm going to give you the earliest court date. Tether, are they May 13th?
I got May 13th written down on Brownstone and that's at 9:45 in front of Judge Hess. And then I've got on my case, I'm going to ask you guys to bring them over, detective, earlier. sentencing date May the 13th at 9:15 on this uh probation violation. And then on the other two cases, it looks like one's out of Trenton. So, I'm going to give him May the 13th again at 9:45. Or I'll make these pre-trial dates May the 13th at 900 a.m.
And uh then >> what is Gaba Penton?
I don't even know. I don't even know what's going on in the world >> on the suspend charge that's out of Trenton and I don't believe I have a date on here. Uh there was Trenton here again.
I don't think I do. I mean, are they here this week in front of me?
>> Sorry, I was muted. Um, they're not here this week because Judge Hass's off.
>> We don't have until the 21st.
>> Um, yes, but we only have a visiting judge on Wednesday for her.
>> But she's not here today either. She's off. She's here today. I'm sorry. She's off the rest of the week.
>> All right. So, I got to make that one.
Tell you what I'll do on that one, Heather. I'm going to give him a personal bond on that one. The Trenton case, $1,000. Sir, you're going to only have to post $300 to secure your release. And I'll give me the earliest court date for Trenton. Is that on the what? 21st.
>> Yes.
>> And we'll make that at 8:30 in the morning, sir. So, you have to be here on Wednesday, whether you post or not. And you have to be here, I think, at uh what did I tell them? The earliest time would be >> 9:15.
>> 9:15. Okay. So, I wish you well and I'll give you a bond on the Trent case. So, if everything's resolved on these other 10, maybe I can trust you to go. Okay.
>> I I'll be there, sir.
>> Good luck to you. You're going to be able to post this or not?
>> No. Is that going to see if I get a personal, please?
>> I'm not going to give you a personal.
You can't miss 10 court dates and get a personal out of me. I'm sorry. Under these circumstances, I'm sorry. Good luck. Thank you. Mary Deborah McDonald 26648168.
>> How you doing, Miss McDonald?
>> Your name?
>> McDonald.
>> All right. So, they said they're going to allow you to plead to impeding because there was no injuries and minor no vehicles towed or anything. So, to that charge of impeding traffic, how do you plead? Responsible or not responsible?
>> I don't know what impeding traffic means. It means zero points and it won't go on your record.
It's like a very good deal.
>> Okay.
>> And that cost >> It's going to cost you $195.
>> You what?
>> I will not accept it.
>> You don't want to do that?
>> $195.
>> Well, then you can go to you can go to hearing on this, but I >> Grandma says, "Hell no.
I did not see that coming. I thought she was going to be sweet about this.
>> I And I'll be glad to set an informal.
Listen very carefully.
If I said it informal though and you lose, the charge is fair to yield.
That's two points. And that would go on your record and your insurance rates are going to go up. Okay? If you want to take care of it today, if you >> little old lady from Pasadena right there, >> but I don't want you to plead if you don't think you were responsible. But fa to yield. Let me see what it says.
Driver failed to yield to traffic on eastbound west road. Were you pulling out of the parking lot?
>> I headed west on West Road. The G was headed east and west road >> at Parkwood.
>> Near there.
>> Okay.
>> And he turned in front of me. I did not even see him. He s the side of me.
the how this police officer wrote this up is the opposite of what it was.
>> You don't have to you don't have to plead to this. If you want to have a hearing, I'll be happy to set a hearing for you. I might very well agree with you, but if I don't agree with you and and the and I find you responsible, I just want you to be aware the conviction would go on your record in two points of dust. Do you understand that?
>> I do, but I don't believe it.
>> That's okay. I should have to pay $195.
>> Well, I mean, that's what I'm going to charge you if you're convicted here.
That's per our that's that's per our chart. It's not >> something new.
>> And I So, I wouldn't worry about the 195 as much as I would worry about whether or not you're going to be fine.
>> I mean, how many more times you're going to use your license? Let's be honest.
>> Responsible or not responsible. Do you understand what I'm telling you?
>> Yeah. It'll be a lot worse paying 195 if you're found responsible and conviction goes on your record in two points.
>> But if you want a hearing, I'm all ears.
I'll be glad to listen to you, ma'am.
>> Fine.
>> You think you were wrong then, don't you? Why are you coming up here and tell me you didn't think >> Well, then why would you pay $195? I wouldn't pay 19 cents if I didn't think I did anything wrong. Then you don't find the doctor. It's not money. Then let's set it for How's that? You okay with that?
>> You do what?
>> I'll set it for an informal if you want and you can come back and explain your situation. We'll have the police officer here.
>> But I just want I'm just trying to tell you nicely here. If you lose, the convictions going on your record. That's all.
Do you understand that?
>> I do. But I'll just face it. I don't mind a record because I welded.
>> Oh, sweet Jesus.
>> So, ma'am, listen to me.
>> Oh, sweet Jesus. What?
>> I'm not trying to talk you into it. I'm not trying to talk you out of it. The >> Grandma, pay the damn ticket.
I don't know. Maybe it's not your fault, but just don't. You don't want two points.
>> Only thing I'm trying to say is you can't have it both ways. You can't come in here and have a hearing and lose and say, "Now I'll take the impeding." You can't do that. If you truly don't believe you did anything wrong, then I'd encourage you to fight it. But if you fight it and you lose, you're going to have two points and the convictions going on your record.
>> I'm just dating today.
>> You think you did?
>> Okay. I I've got one question for grandma, but I I I ask it with respect.
>> Ma'am, are you a [ __ ] >> I object to the relevance of that, your honor.
>> There's something wrong then, don't you?
>> Then why would you why would you just pay?
>> Bad mic. I suspect that she is not. I just couldn't help myself >> today.
>> Because I don't want to have to I don't know. Someone just mad about the whole thing here. It just was not right. The police officer didn't really even speak to me and my my >> She's hoping to get a spanking from McN >> damage. It's $8,500 in damage.
Damage now. I mean, it's rival, but apparently You had insurance though. You had collision coverage, right?
>> Yes.
>> Okay. So, you're How much is your deductible?
>> $500.
>> I'm ashamed of myself.
>> Do you want me to give you time to sit down and think about this?
I'll be glad to do that.
>> If it's going to make it worse for me, no.
>> I don't know what's going to happen. I haven't heard anything here. You just told me you're going.
>> No, I'll just pay it today. going to be down with it.
>> Oh, she was probably something before electricity.
>> Why would you do that if you don't think you did anything wrong? I don't want >> Well, then let's set it for informal.
>> Okay.
>> And if you change your mind, I'll talk to him about still giving. Give me a date. Set in formal. Okay, Heather.
>> Okay, judge. We can do the 26th at 1:15.
May 26, ma'am, at 1:15. Okay. We'll summon the officer. I'll listen to what he has to say. If you change your mind, you come back here and you you remind me that they offer you peing and I'll still do it for you if that's what you want to do. Okay.
>> All right. So, here's what you do, Grandma. Here's what you do.
You ask for the hearing.
You show up.
You look for the police officer.
If the police officer is there, you take the deal. You don't go to hearing, but he might not show up.
>> All right. So, go down the hall. We'll give you a notice. Good luck.
>> Thanks.
>> You're welcome. Nicholas Jones 266.
Oh, that's good stuff.
Good stuff. Thank you, Zach over at Lonard's Unite, MGT, Mindy.
I don't know if I'm forget forgetting anybody. I actually had some other ones, but it it it was weird. I had nothing.
I'm like, "Oh, I want to do a stream."
And I didn't have anything. It And then I had the one I had the uh the City Walk case.
That was the funniest of the group that Mindy sent me, but it was only eight minutes, so I wanted to have more of a I wanted to have more of a stream than that.
I mean, sometimes you do short ones, but I I feel like, you know, if I if I'm calling a group meeting, let's let's have let's let's have a couple things to look at.
And then then they just started coming in fast and furious. Oh, who else? Iris Iris uh put me on to that uh construction thing that started off this whole debacle.
All right. All right.
Thank you'all for coming out. I will see you all soon.
