This video demonstrates how a person's refusal to comply with lawful police commands during a public intoxication incident can escalate from a misdemeanor charge to a felony charge. When an individual refuses to leave a premises, refuses to provide identification, and physically resists arrest, they may face additional charges such as assault on a peace officer and obstructing official business, even if the original charge was only public intoxication. The key lesson is that knowing one's legal rights does not exempt individuals from complying with lawful police commands, and resistance to enforcement can significantly increase legal consequences.

The Moment 'I Know My Rights' Turned Into A FelonyAdded:
Just get out of the car.
>> No.
>> How long was she here for, ma'am?
>> It's been a couple hours.
>> She drinking.
>> I can smell on her.
>> I told her.
>> Okay.
>> She needs deodorant. And she smells like [ __ ] Touch me.
>> On February 20th, 2026, officers in Ohio dispatched to a local lounge where an unruly customer was causing a major disturbance. The bartender reported that a heavily intoxicated woman had been drinking for hours and was now holed up inside her SUV, refusing to leave.
Here's what the officers did next.
>> I asked her just to leave. She was supposed to leave. Um and and then she finally just came out like I don't know 2 minutes ago, but she's sitting in her car. So if you can just tell her she's not welcome back here.
>> I was about to say so that way. Yeah. So that way it's just totally I'll advise her that if it happens again, then she'll be trespassed.
>> Right.
>> Okay. Which car is it?
>> Okay.
>> Hello.
Hi.
>> Hi.
>> So, I understand there was an issue at the bar.
>> Yeah, there was not an issue.
>> Okay. Well, either way, we're to the point where they don't want you here.
>> Okay, that's fine.
>> Okay. Do you have your ID?
>> No.
>> Okay. Well, I have to I have to get your information, ma'am. Ma'am, this can be a very simple process.
>> Okay. Yes, I do.
>> No, you do not.
>> Yes, I do. Because they >> No, you do not. I know my rights.
>> Okay. Okay, I'll be honest.
>> I'm glad that you think that >> I need you to leave.
>> Okay, ma'am.
>> Like I'm saying, this does not have to be a difficult process.
>> As a second officer arrives on the scene, he is updated that management wants the suspect trespassed from the bar and she has so far refused to show ID.
>> I told she needs deodorant because she lived in my home for 6 months and didn't shower and she smells like [ __ ] So, I gave her deodorant. Okay. OH, I'M so bad.
>> Okay. And all of that doesn't even matter. It's just going forward. You're not going to be able to come back.
>> I am not going anywhere. I did not start my car.
>> Okay. And that's Yes.
>> Yes.
>> Okay. I'm not accusing you of anything.
>> I need you to leave me alone.
>> Okay. Well, that's >> because I did not do anything wrong.
>> Okay. Why would you want to be at a place that you're not welcome at?
>> Why do you want to be here?
>> Okay, the issue is is that you have to be advised that you cannot come back here.
>> Is that you are >> I mean she just has to be advised that she's going to be trespassed.
>> Go ahead.
>> This is not trespassing.
>> I'm saying if you come back here.
>> Okay, fine. I'm not >> Okay. I didn't do anything wrong, but this girl deodorant cuz she smells like ass.
>> Okay, either way, they don't want you here.
>> Okay, cool. I didn't start my car. I'm not driving. I'm not going nowhere. You both need to leave me.
>> So, listen. You're That's not the case.
Get out of the car.
>> No.
>> So, what's going to happen is this. If you don't get out of the car, we're going to drag you out of the car.
How much have you had to drink? You've been drinking. Okay.
>> I didn't drive my car. I DID NOT STIR MY CAR.
>> IT DOESN'T MATTER. LISTEN.
>> I TOLD MY NEIGHBOR TO come get me.
>> Okay, good.
So, when's your ride coming?
>> This doesn't have to be a difficult thing. We're trying it. We're >> So, if you don't have a ride coming, you're going to you're going to go to jail.
>> So, the officers give Jessica an out. If she can get a sober ride home, she avoids going to jail. She calls her neighbor to come pick her up. But listen to how that conversation goes.
>> He said, "If I don't have a ride in coming, I'm going to get >> so I'm not doing anything. I'm not driving anywhere."
>> Why is your husband not allowing you to come get me when you stay in my house for 3 days? Because your husband is you're coming to get >> I am not. She's not getting out of the car. He will not let me drive the car.
>> While she's on the phone, officer Ogle steps inside to confirm exactly how much she's had to drink.
>> How long was she here for, ma'am?
>> Yeah. How long was she here for?
>> Uh, it's been a couple hours.
>> She drinking? I can smell it on her. I just want to make sure. Okay. Cuz she ain't got right home. So, she's she's causing a disturbance on site for us.
So, I just want to verify. Thank you.
>> Now, the situation has shifted. The bartender confirms she'd been drinking for over 2 hours. Under the law, you cannot be intoxicated while in physical control of a vehicle, even if the engine is off. Outside, Jessica finds out her friend will not be able to give her a ride home.
>> This is so interesting.
I told she used to own her house. This is why all because I let her stay in my house for 6 months and she wouldn't shout.
>> Okay, we need to see. Are you calling the Uber?
>> I need you to leave me alone.
>> That's not going to happen. And we're >> Yes, I do.
>> You cannot have physical control of your vehicle while you are intoxicated. It does not matter that you're not driving.
>> Are you going to be calling an Uber?
>> You're going to go to jail.
>> I mean, if you want to go to jail, then you want to go to jail. It's a >> We're trying to talk to you and trying to be reasonable with you. If you don't want to be reasonable, then that's fine.
You can tell us that you know the law and that >> I heard her on the phone. She's not going to come get you.
Husband. Come on.
>> Ma'am, >> you are not.
>> DO NOT DO THIS. Do not do this.
>> You You have no right to do this. I didn't >> I did not do anything.
did not do anything. I DIDN'T DO ANYTHING.
>> NO. NO. I DIDN'T DO ANYTHING. I did not do anything.
>> Ma'am, just sit down.
>> No, I didn't do anything. I don't do anything to deserve this.
And I will take you INTO say she was here for 2 hours to drink.
Yeah.
>> All right.
I didn't do anything.
>> I have the same on my back seat. She's going to be on her being rout to the station.
Oh, >> her purse is in there yet. Should we take that?
>> So, she's being placed under arrest just for DCI.
Um, she wouldn't listen to any kind of reason or speak to us. So, she was clearly We will be advising her that she'll be trespassed.
>> Okay. Thank you.
>> And we've given her a couple chances.
>> Yeah. She was beyond any kind of reason or >> Right. I know. She would not listen to me at all today. So, >> no, we were willing to have her have somebody come pick her up and telling us that we can't be speaking with her and we need to walk away. So, she was past any kind of reason. Since this is private property, I mean, if it's an extended amount of time, you know, you guys have your abilities of like telling or what not, but I would imagine when she gets out, she'll come take it out.
We just let you know that's going to do you know how long?
>> No. I mean, she's probably not going to be, you know, in jail very long. So, >> Okay.
>> But, um, soon she'll come pick it up after, but I'm going to advise her that she can't come back here.
>> Okay.
>> Thank you.
I didn't do anything.
I did not do anything to warrant this at all.
>> Well, you're in public and you're causing A DISTURBANCE.
>> I'M NOT.
>> I DID NOT.
>> I was in my car.
>> Well, and you've been drinking.
>> No, I asked my neighbor to come get me.
>> And she said no.
>> I did. I was not going to drive drunk.
>> Once you sober up, you'll be on your way.
>> No. I hate you. to realize I didn't do anything. I know my rights. I did not do anything WRONG AT ALL for you to handcuff me and put me in your car.
>> Okay.
>> What did I do? Explain it to me, please.
>> It's called public intoxication. It's against the law.
>> Are you kidding me?
>> No.
>> What did I disturb?
What did I do?
>> GOT CALL FOR A DISTURBANCE.
>> OKAY. SO, WHAT DID I DO? DID you see me disturbing anything?
>> Did I Did you see me disturbing anything? I was not. This is so not necessary.
I didn't do anything wrong at all.
>> During the transport to the police station, Jessica's demeanor shifts from physical resistance to entitled outrage.
She attempts to use her profession as a shield, arguing that her background as a nurse somehow exempts her from being arrested.

>> Are you going to get out of the car on your own or am I not do anything wrong and you know that?
>> Seeing that Jessica continues to get more agitated in the back of the police car, the officer calls ahead, anticipating that he will need assistance getting her into a cell.
Come on.
Come on.
Do I have to literally physically remove you? We don't want to do this.
>> No, you put me in here for no reason.
>> Okay, let's go.
I'm not giving you any more. I've already explained this to you. I'm not doing this to you.
>> No, you have not. You haven't explained anything.
>> Yes, we did. I'm not going to sit there.
>> You have not.
>> I'M GOING TO ASK YOU I'm asking you one more time to GET OUT.
>> DO ANYTHING. I'm asking you to get out or you going to get >> I did not do anything.
>> I'm going to drag you out. Be a dog. Be an adult or walk.
>> Look at body cam. You have to start walking. Come on. Let's go.
>> Let's be a lady. Get this over.
>> I have a 3.
>> I believe you. It's fine. Come on.
>> No. Touch me.

>> You're going You're going to go in the rap.
Stay [ __ ] away from me. Dirty mother.
>> You're going TO GO INTO IT.
>> I DON'T WANT TO PUT YOU IN YOU. YOU want to search her real quick?
>> Search me. Oh, okay.
Do you have anything in your pockets?

>> YOU MOTHER. NOW YOU'RE GOING TO CHARGE ASSAULT.
>> NOW YOU'RE GETTING CHARGED WITH ASSAULT.
After the arrest, Jessica was initially charged with assault on a peace officer, a fourthderee felony in Ohio, along with misdemeanor charges of resisting arrest and disorderly conduct. When the state formally presented the case to a grand jury, she was indicted on the felony assault charge, and a new fifthderee felony charge of obstructing official business. The original misdemeanor charges for resisting arrest and disorderly conduct were declined by prosecutors. She pleaded not guilty to the indictment and was released on a $2,500 personal bond with an order to have no contact with the victim.
