get everybody here. So, here we Good morning.
We're here on first appearance for the uh Pulk County jail sites which is central and south central. Swear everybody in please raise your right hand.
>> Please raise your right hand.
Yeah, I do.
>> All right, lower your hands. So, good morning. We're conducting first appearances this morning. I'm the circuit judge handling them. I'm circuit judge Brandon Rael in Pulk. Um there's four purposes for the hearing. First, I'll advise you the charges that have been brought against you by the state.
Second, I'll ask if you'd like a lawyer to represent you. If you've already retained your own attorney, please advise me. If you'd like to have your attorney present with you, we will attempt to make those arrangements for you. If you want a lawyer appointed by the court to represent you, then I will ask you some questions pertaining to your financial situation to determine if you meet the statutory criteria for the appointment of the public defender. Be advised that there's a $50 application fee for applying for those services.
Additionally, the court may require you to pay a reasonable value for those services. If you get appointed at a lawyer, they'll either come see you if you're in jail or if you get out of jail, it's your best interest to go see them. Make an appointment. Third, what I'll determine is that is there probable cause to hold you for your arrest. That means there are reasonable grounds to believe that a crime may have been committed and that you are the person who committed the crime. The fourth purpose for the hearing is to review your bond status. In some cases, the bond set for set for you through bookending might be too high and in other cases, it might be too low. Each of you has the right to remain silent.
Anything you say can be used against you. There's an assistant state attorney here in the courtroom with me listening to everything that's being said, and it's all being recorded. So, please not say anything about the facts of your case or the crime itself. The questions I'll be asking you pertain to whether you want a lawyer and to review your bond. You may refuse to answer those questions. You have the right to communicate with your family, friends, and your attorney. I ask you keep these rights in line and when your name is called, step forward. Do we have any Spanish cases at either place?
>> All right, y'all.
>> South County does not have any.
>> South County does not have any. What about Central? Do you have any Spanish?

You got 90 days.
>> 90 days. That's Yeah, the offer was 90 days. So >> I I So that case is already >> I'm not going to parker you on 26 mm1521. If something changes, I'll let the state file something. All right.
>> So he's got you got $10,000 bond on those other ones. All right. Unless the state wants me to revisit that of >> No, sir. That's fine.

>> Defense.
>> Well, your honor, you know, I've had expansive checks whether people had fire renders or not. Um I would the presumptive bond is normally $5,000.
Um the reason it's even a felony is because alle victim, I believe it's um is it his father?
>> Yeah.
>> Um is is older than 65. So that's the only reason that it's been up to a thirdary felony. I would ask for a reasonable bond on this case.
>> I do 5,000. Okay. Good luck.
>> And you gave him one time.
>> One time. Yeah. So who's my next person, sir? What's your name?

>> Yes, sir.
>> Thank you. Good luck, Jeffrey Mallaloy.
>> Yes, sir.
I know that it's hard to find sign no bond on his warrant, but he's only violated for owing money on this violation of probation case. He has $123.54 in a rears and then he owes $772.86 in a rears for some other condition. Um I I would ask for either RO a bond or an earlier court date because he's only violated for not paying money.
>> Mr. Malloy.
>> Yes, sir. You have you post $1,000 cash bond.
>> All well all the the $700 that's already paid. That's all paid up.
>> How much can you post cash bond? Can you post $500?

>> Against public defender.
>> I'll provisionally appoint the public defender. I do find problem calls on all the charges and I'll set bonds and if the state or defense wants to tell me anything different please do once I set you're on pre-trial release no contact with the victim stay away from the event location go back one time no guns weapon ammunition knives your prior conviction DV battery is $20,000 bond your DV battery prior conviction is $20,000 bond and your child abuse with great bodily harm is $25,000 bond anything further defense or state >> um just no contact and no weapons >> so how I get out of me, sir.
>> And >> I don't want to say that. I'll let your lawyer say that. I read the probable cause affidavit about the child in the crib being slammed down. But go ahead and state.
>> That's not true, sir.
>> That's my baby. I want to do that's not true.
>> Yes, ma'am.
>> All right, sir. I found probable cause different standard than beyond reasonable doubt. Speak to your attorney. Good luck. Except where they tell you >> how much the bonds are. Could he say can you restate the bond release condition?
Go ahead, sir. How much was his bond, your honor?
>> His bond is 25,000 for the child abuse, 20,000 for the DV batteries each count.
So total is uh 65,000.
>> All right. Anything further from the jail?
>> No, your honor.
>> Thank you. Good luck. We're going to shut things down. Thank y'all for appearing and I will see y'all tomorrow 8 o'clock.
>> Thank you.
>> Thank you. Courts adjourned.
>> I didn't sign anything.
>> Yes.
What I need >> that plea that you took?
>> That ple I took. I figured something's going to have to happen. All right, I'm going to leave.
>> Yeah, please not. I'm going to leave Lozano on the desk. We'll deal with him tomorrow.
Yeah, some of these were not. What happened was you go into the pre-trial release folder and they were in the takeoff folder and then some of them went south county and I guess they >> SPC is sharing center. So that's not South County. That's what it's that's that that's newer because I haven't done this up here in a while.
>> Okay. So, STC is a process. I need I >> I need to I'm glad you told me because I mark always the color.
>> All right. We'll see y'all tomorrow.
Yeah. All right. I'm going to shut down everything right here.
