Citizens have the constitutional right to record police interactions in public spaces, and during traffic stops, passengers are not required to identify themselves or consent to searches, as they are not the ones who committed the traffic violation; officers must justify their actions with legal authority and cannot detain or search individuals without probable cause or reasonable suspicion of criminal activity.

Cop Pulls Passenger Out For NO REASON! Citizen Records Everything | First Amendment追加:
What they pulling you over for?
>> Expired tags.
>> And she need to pat you down for expired tags.
That's a little obsessive.
>> At least I think so.
I thought expired tag you could just get a ticket. What's the need to pat down?
Don't consent to no searches or none of that.
>> Stop.
>> I can speak freely.
>> Hey, you need to back up.
>> I am back.
>> Just like I said, just don't consent to no searches or none of that. Now, that's a full search what you just did. You don't have to tell me how to do my >> Well, I know how to do it better than you, obviously. See, passenger, that's why you always film. You don't never let them pull you over. Driver as well.
Don't never get pulled over without taping. Can I get your name and badge number?
She acting like she can't hear me now.
You going to fail the ID or you going to give me your name and badge number? I'm >> finishing my investigation.
>> I'll wait.
Ask her.
>> I'm just asking you to let you >> Well, I'm not conducting the stop. You got to ask her what's going on.
>> Is this your car?
>> Is it? No, she got the people who car it. It is in there.
>> Okay.
So, you're just >> I'm just a concerned citizen. Okay.
>> Not just to film. Just to make sure she doing her job right.
She already overstepped.
She didn't searched the passenger without consent.
So that's that's already a violation right there.
>> And it's supposed to be just for Do me a >> favor a little bit.
>> Well, I'm I'm not too close. I'm That's why you here. I'm not too close. If I was too close, I'll be violating. I I'm keeping the distance. I've been distant since I got here. If all she stopped him for was just tags, I don't see what she need to pull the passenger out for. He didn't do anything wrong. He's just a passenger in the car. So why would he be searched and IDed?
What's your name and badge number?
>> Huh?
>> Co.
>> Curio. Baz number. What?
>> 061.
>> All right. But yeah, if it's just tags, couldn't she just cighted him and let him go?
>> She's taking the car now.
>> This look like it's back far enough. So, I understand that. But what about detaining the passenger and searching him and all that? He not the driver.
>> By by its very uh definition, when when there's a traffic stop, that's the passenger. Nah, no. This the the passenger the passenger don't have nothing to do with the stop. He he might have to stay, but he don't have to ID cuz he's not driving. He's not making the violation.
>> Voluntarily IDs himself.
>> Well, he didn't. She obviously just made him do it. He didn't do it. And then she fully searched him. She didn't do a pat down on the outside. She physically went into his pocket.
>> I see her like right there next to >> I got it on tape. I got it on tape. I heard it. I seen it.
>> I got it on tape. I seen and heard it.
>> Then you're probably a little too close.
>> Nah, never too close. That's what Zoom is for. outside.
>> The mic sounds zoom, too. Listen, the mic sounds zoom. Listen, the mic sounds zoom as well. And they was speaking loud enough to hear him.
>> Well, he's in the car and he gives her that information.
>> No, he was outside the car when that happened. See, if you was here, you would have knew.
>> If he's in the car and he gives her that information, >> but that happened outside the car over here.
>> Okay.
>> See, that's what I'm saying. If you was here, you would have knew. Right now, you just assuming cuz you're not sure.
You just got here.
>> I'm telling you as a witness to it. All right. So, if we talking about that, then I was here and you wasn't.
>> So, >> I would say primary would be him. He'd probably be like secondary.
I'm a primary source cuz I was there of it happened. I'm contemporary why it's happened. I'm there with it. I exist while it's happened. I'm here. So, I could be primary. I don't know if you know how sources work, but you know, if you did, you would have been more familiar that I would be a primary source cuz I'm a firsthand source.
>> I guess >> that's how it work.
You could not agree, but that's that's how it work. SH1890.
You guys can read that.
>> It's not reading.
>> That's not reading. That's just numbers.
That's not reading letters and numbers.
That ain't reading. It don't say anything. I said you you want to be a hard ass. I mean, you got a very condescending type of, you know, attitude right now. I don't see why.
Just cuz I'm here recording. Is that irritating you or something?
>> Not at all.
>> Then why you acting the way you acting?
>> I'm recording you just like you're recording me. Like, >> but I'm not giving you attitude. You being very condescending.
>> How is that making you condescending?
>> Your reactions, your whole body language, everything you've been doing since you got here.
You may call it condescending. I may just be calling it like I'm not going to get sucked into whatever you got going on.
>> I don't got nothing going on. I told you what I'm doing. I'm just watching.
>> All right.
>> Concerned citizen. Everybody should pull up and watch when police is here, right?
>> Yeah.
>> My question is, are you that concerned of a citizen within your own community?
>> Obviously I am >> outside of the police.
>> Obviously I am.
>> It's what I do. I hold government officials accountable. That's my main concern.
>> Hold community members accountable.
That's >> your concern is to do that. That's your job. That ain't my job. As a citizen, my job is to hold the government accountable.
That's your job to police the city.
>> You're a Republican.
>> I never said I was either or. I'm just a citizen standing up for people rights.
Now, if that's what you call a Republican, hey, that's your opinion.
>> I'm just I'm just wondering. I'm just >> I'm just giving you some side on my side. I'm just giving you a little information. I never said I was either or. I'm just a citizen.
>> I'm just a citizen and stand up for people rights. Like I said, if you want to call that a Republican, >> weated.
>> To each his own.
>> We We need more people out there looking after everybody.
>> We need more people like me. For sure.
>> Everybody.
>> For sure. We need more people like me. I hold people accountable. I file formal complaints. I follow up.
I do whatever. I make small claims and we go to court after that if we got to. I hold them accountable to the full extent of the law.
So >> hold you accountable.
>> Members of the government.
>> Do you do the same with council persons?
>> Yeah, any members of the government.
>> As long as you're fair about it.
>> That's why I said members of the government and not specifically police.
>> I'm good.
>> All members of the government.
Right now it's just specifically you guys cuz y'all here, but everybody get held accountable. So you typically do the same thing to passengers then cuz it sound like you're in agreeance with what she did. You'll pull a passenger out and detain him when he had nothing to do with the stop. He's just a passenger.
That's the same thing if he was in the Uber ride. You pull over the Uber driver, the passenger is not subject to your arrest or search or any of that. He can step out and let you search the car, but you couldn't search him just cuz he a passenger. So, what's the difference with a personal driver? He's a passenger.
>> Like I said, I wasn't here.
>> That's why I asked you. Would you have handled it the same way?
>> I don't know. I can't tell you.
>> I mean, you could tell me. You don't want to tell me.
>> I can't tell you because every situation is different.
>> Okay. When you pull over Okay, look. If you pull over a car that every every traffic stop, >> that's why I'm asking you. I don't want to assume. That's why I'm asking you. I don't want to assume.
>> That's simply not true.
>> That's why I'm not assuming. I'm asking you. Would you handle it that way?
>> I don't know. It depends on who the passengers are.
>> You don't know who the passenger are.
That's the whole thing. They're they're anonymous and they supposed to remain that way because they haven't committed any infractions. They haven't broken any law or broken any crime.
>> Probation of parole.
>> That's not an infraction.
>> Do you know for sure he's not?
>> That's still not an infraction.
>> You know for sure. That's still Do you know? You just got here.
>> I'm asking you.
>> Do you know?
>> I'm asking you.
>> From what I heard, she didn't ask him, so I wouldn't know. I >> We typically ask that question.
>> Well, I didn't hear her ask. I was right there.
>> Ask.
>> You didn't ask me.
>> I don't need to ask you. What we have right here, this is just a consensual encounter.
>> Yeah.
>> That's what it's supposed to be with a passenger. That's what it's supposed to be with a passenger as well. It's supposed to be consensual cuz he can.
He's supposed to be able to leave, too.
If he didn't if he didn't commit any crime, any infractions, why is he detained? He's not even driving.
Whatever reason you would stop the driver for has nothing to do with the passenger.
>> The passenger is seized upon any detention in the motor vehic.
>> He don't have to identify himself still.
But he still wouldn't have to identify himself. Even if you would say he had to stay, he still wouldn't have to identify himself cuz he didn't do anything wrong.
>> He doesn't have to identify himself.
>> That's what I'm saying. But you said typically y'all identify everybody.
>> Well, typically they'll they'll provide it voluntarily.
>> That's because y'all don't tell them their rights that they don't have to.
You just ask for it. So since you're in uniform, they think that's what they have to do. Now it would be a difference if you say you don't have to ID, but would you mind? I guarantee you 90% of them people wouldn't. But when you just say, "Give me your name and ID," they do it.
>> They don't have to pull over, but they do it, right?
>> Well, they do have to pull over if they being stopped.
>> I mean, I'm just saying it's free will.
>> No, it's a crime to not pull over. It's a difference. It's a difference between committing a crime and just doing what you want to do within the law.
>> The problem is you think that I have to I have to go provide a a criminal justice 101 class with every >> No, that's not what I'm saying. If I ask them, >> that's not what I'm saying. What I'm saying is as a passenger, you don't have to What I'm saying as a passenger, you can literally stay quiet as a passenger.
You don't you don't have to say >> even if they ask you if you're on probation or parole, you can literally not say >> 100%.
>> And is you wouldn't be violating any law. So, at that point, why would he have to be pulled out and searched or any of that?
>> If they don't say that they're on probation or parole and they're identified later as somebody that is on probation, >> Yeah. But that's something you would have to identify later, >> they would be in violation.
>> That's something you would have to deal with later. But in the course of what happening in that stop, he's not required to speak to you. So that's something you'll find out later if you do a investigation into a person that you don't even have to. Now that'll be something whole on the sidebar, right?
>> Just depends, man.
>> On what? You you you saying it depends on what?
>> There's a lot of factors that you're kind of over with.
>> Like give me some.
>> Like I said, I'm >> ah See, you ain't willing to talk. See, you just want to talk in circles. I'm not here for that at all.
>> Just blowing smoke.
>> I'm here to provide safety and a backup.
>> She was never unsafe.
>> I don't know that. I don't know.
>> Well, you see that now, right?
>> I'm saying right now.
>> You can see that now, right? She's not unsafe, right?
>> Maybe she wouldn't have been if I showed up. I don't know.
>> So, I was going to tape myself do something to her?
>> I don't know.
>> Sound crazy. Is that logical?
>> There's a lot of >> Is that something that is that something that typically happens?
>> There's a lot of >> But is that Do that typically happen?
>> Do that happen on the norm? I wouldn't be wearing this bulletproof vest if logic was applied.
>> But you still not answering the question. Is that something that people typically How often do officers get attacked versus a officer harming a citizen? I I guarantee you the numbers are higher.
>> Guarantee you.
>> Army would imply that I'm I'm not going out of my way.
>> Guarantee you the numbers are higher.
>> Warranted.
>> If you're talking about uses of force, >> I can guarantee you the numbers would be higher.
>> Uses of force of of course there's going to be force that goes both ways. Uses of force. I guarantee you the numbers are higher though. I guarantee you cops kill more citizens than citizens kill cops. I guarantee you cops hurt more citizens than citizens hurt cops. Cops mostly die in car crashes. But y'all act like the the citizens are such a problem. Y'all die more in car crashes cuz they make laws where y'all don't have to not be on the phone where you can actually hold your phone. And then most of the time y'all just not paying attention and have an accident. That's how most officers die. It's not by the hands of a citizen.
But when it comes to police versus citizens interactions, >> it would apply to any job where you >> Nah, nah, that don't. My job is probably more dangerous than yours.
>> Yeah.
>> Why is that?
>> Even someone who just climbed utility po's job is more dangerous than y'all.
More of them people died than police officers a year. That's the statistics.
That ain't just what I think. That's just some facts.
>> All right.
>> So, I mean, you tell me if I'm wrong.
Did you Did you feel unsafe with my presence here?
I don't know her name. She wouldn't give it to me yet, so I can't address her.
Excuse me, ma'am. Did you feel unsafe with my presence here? Little scaredy cop.
I don't got no guns and [ __ ] I'm at work. What's she scared of?
Come on, man. Make that make sense. I'm at work. I'mma do something to her.
Would you had a call back up if I was taping you at work?
>> You didn't call for backup. I just happened to see her. Ah, I seen her call for it. I seen her radio for it. I mean, you can lie to me because I know you can. Sure, if that's what you want to do, but I seen her radio.
>> Freedom of information.
>> I know. I know how to do that. I know how to do that as well.
>> I know how to do that. So, you just thought she needed backup.
>> I typically check on my partners when they're on traffic.
>> Ah, so you just thought she was unsafe.
She never said that.
>> I didn't even see you.
>> So, why you pull in then?
>> I'm just checking to make sure she's >> Cuz you don't have nothing to do.
There's no other crime in Compton.
>> Oh, there's plenty of crime in Compton.
>> So, why you here? She don't need you.
She didn't radio for you. You just here just to be here, huh?
>> I'm glad I came.
>> Ah, gave me a chance for me to find out.
>> You glad you came to to stand around and do nothing when there's other crimes that can be solved? You glad you're here?
>> Are you on the clock?
>> I am. Are you?
>> I am.
>> My job ain't to protect the city, though.
>> My job ain't to protect the city.
>> Yours is. So while you standing here with me with an officer that didn't request any backup guy protecting you >> with a with a with a officer that didn't with an officer that didn't request any backup. I feel like you just here wasting time.
You keep trying to shuffle out of my camera and get on that side so the sun will be on that side. I need you in frame.
>> I don't want to be sitting in the sun.
>> I need you going to be in the sun if you're on that side or not. You just won't be able to be seen in my camera good if you're on that side. So that's why I keep shifting around. That's your right to me when I know that's why I do it.
>> We're on public view or you're good to go.
>> Hey, that's why I do it. This private property though.
>> This not public.
>> We're on public view.
>> No, but we on private though. You know, I I just was making a distinction. So, cuz a lot of officers don't know the difference.
>> We're standing on private property.
>> Yeah. But a lot of a lot of officers don't understand the difference between the two. I've had officers try to trespass people from public property without them committing crimes and all type of [ __ ] cuz they think, "Oh, well, they said they don't want you here, so you got to go." When that's not how the law work. private property trespassing is completely different from public property. And a lot of officers don't understand it, too. Just like a lot of officers don't understand what an actual lawful order is.
>> No, I'm telling you from experience. I'm telling you from experience. I'm telling you from experience. I have video evidence of it. I'm not just making this up by >> I'm not I'm not making it up. I'm just telling you from experience. This is from experience. I've had officers arrest me in city hall for trespassing.
How do you trespass in city hall without breaking the law?
>> Exactly my point. But it's happened. So this not me assuming or just saying any old random comment. I'm telling you from personal experience. This happens a lot.
Officers don't even know what a lawful order is. A lot of the times they tell you it's a lawful order cuz I said it.
No, it has to actually have a law backing what you're saying for it to be a lawful order. So I I've just had it all. I've seen a lot of it, man. So a lot of times these officers just don't know what they're doing. The six weeks of training just don't suffice. It don't. But y'all do that to have qualified immunity. I understand. Y'all y'all tell people when y'all pull them over that ignorance of the law is no excuse. But then y'all get qualified immunity in court for not knowing the same laws. The judge will give you a slap on the wrist. And then it's it's it's it's justified then, right? That's crazy. Y'all get qualified immunity for not knowing the law, but then y'all turn around and tell the citizens, "Oh, that's no reason. Just cuz you didn't know it, that don't mean it's not illegal. Y'all go in court and that hold up for y'all. So, I don't really understand the system when it come to that.
Can you explain that?
I don't think so.
>> Hey, passenger, you should also request a supervisor cuz what she did was wrong.
Y'all should request a supervisor to come to the scene now so y'all can file your complaint now. Request the supervisor. They got to call them out.
Can I get your name and badge number now?
>> He hasn't.
>> No, I'm not. You you that's your policy to ID.
>> But that's I'm not asking him. I'm asking you. What's your name and badge number?
>> The num the badge number.
>> All right. There you go. What starts as a simple stop for expired tags quickly turns into a scene that leaves a lot of people asking one question. Why is the passenger suddenly being treated like a criminal? Instead of a quick citation and a drive safe, officers allegedly pull both men out of the truck, place them in the back of patrol cars, and even begin searching a passenger who wasn't driving and according to the man recording, had nothing to do with the violation in the first place. That's when a concerned citizen steps in and starts doing something most people are too afraid to do, speaking up. Camera rolling. He reminds the passenger not to consent to searches. Explains that passengers generally don't have the same obligations as drivers during a traffic stop and repeatedly tells them to get badge numbers and file complaints if their rights are violated. But instead of answers, the tension only grows. The officer rolls the windows up. Backup shows up. And now what was supposedly an expired tag stop suddenly looks a whole lot more serious than anyone expected.
The man filming doesn't let it go. He challenges the officers in real time, questioning why a passenger was searched, why IDs were demanded, and why this stop escalated so fast. In his view, this wasn't policing. This was an officer going fishing, assuming two black men in an old truck had to be guilty of something more. And maybe the biggest takeaway from this entire encounter is simple. Record everything.
Because without a camera rolling, this could have easily turned into another story where nobody ever hears the other side.
Well, you need to get out.
>> No, I don't.
>> Let's go.
>> You don't.
>> Let's go. Nope.
>> I have the right to be here.
>> As long as I don't interfere with you guys.
>> Visit us here for more information.
>> He better not try touching me. I'll tell you that.
>> We're not going to touch you, but the police will.
>> How much you want to bet?
>> You're in these ladies office and they don't want you in their office. So, >> you're not a cop. Don't talk to me.
>> Yeah. Well, the cops are on their way.
>> All right. Good.
>> Oh, police officer. Good. Can I speak with you, sir? Could Could you please inform these people that as long as I don't interfere with them, I have the right to film there? They're they're stopping the service. They're interfering with my job at this point.
So, please uh uh Deputy, what's your name? Grand. Deputy Grant, with all due respect, >> you took what what job are they interfering with you? I'm working I'm working on a video that's going to be published and they are they're stopping the business here to interfere with my job while I'm not interfering with them.
>> So I'm respectfully not filming people or children or anything. I'm working on a video about them.
>> So they need to they need to respect the law and and and the first amendment pretty much. Uh, just hold on. Just don't video inside the bathrooms because that'd be considered videom >> and you can't have access to the area that the public can have access to in video. However, >> we're getting allegations now that you're pushing people.
>> I I'm not I have I have pushing >> correct >> physically. I have not. So, there's videos in this place. Whoever said that, sir. And by the way, I've been filming for over 35 minutes. So, that's a lie.
Whoever made that call, uh, I did not. I said, I'm the why. You're going to learn about our rights, and that's why he's here. Unfortunately, he's here. So, you can go ahead and say anything you want, but this video is going to be published, and there's thousands of people that are watching our videos. I would never break the law. I don't I don't break I respect more than anything policies in private places. This is if if this was a private place and I and they tell me you can't film, I'll be more than glad to leave because I don't I don't run a place like that. But you need to you guys respectfully, ma'am.
>> I told you I for service and you're not.
You just walk. I don't need to. I'm this exactly he can.
>> Oh, there you go. Thank you. Thank you, officer.
>> But you need to come. You coming in here for service.
>> I don't need to. You don't understand what he's saying.
>> Okay. So, please let him speak. Don't interfere with his investigation. That's a crime. Give him a break.
>> The Lakeland Police Department is on their way. They're going to talk to you more in depth. I'm just making sure we don't have a crime here of you pushing anybody.
>> But I did not push anybody.
>> He just threatened saying that we're going to see what was going to happen.
And then he said that I was going to get fired. So >> Oh, exactly.
>> She's going to Yeah, that's not a That's not a >> She's a liar.
>> Unfortunately, I think he's I think what she's talking about is HIPPA.
>> Yes.
>> Hipp.
Explain to them what HIPPA is.
>> HIPPA law. We know what HIPPA is that I've been asking my clients and he's recording social. I'm asking I'm asking information about my clients.
There's private information.
>> HIPPA. There's no way that I can violate HIPPA. You guys can I'm not medical staff.
>> I'm not medical staff.
>> I'm not medical staff. You It's your job to It's your job to secure information >> for service.
>> I have policies that I have to follow when I publish these videos. I'm not going to publish anything uh that violates anyone's privacy. But you see, you guys have to respect me.
>> What's your what's your angle here?
>> I'm just trying to bring awareness on our rights, sir. You know, you guys took a note to that. They I don't have anything any heart >> curious if you actually have legit business to be here.
>> I do.
>> Okay.
>> I do. These videos are being taxed.
>> Are you about to go probation or anything like that?
>> I actually that's the first place I went and they were more than nice to me and they said, "Yes, sir. You have to you have the right to be here and film." So what's the difference about probation and children's and families?
>> That that I can answer. When you came to our lobby, we weren't asking.
>> No, this is our lobby. You're understanding that.
>> When you came to the probation lobby, >> you were asking questions. They gave you the right to do that. But when you're in there and you're recording them, they're saying HIPPA stuff.
>> They don't give me They don't give me the right. I have the right automatically.
>> There's EA that you're violating with my clients. You're not I was helping them recording them. You please informed her that there's no way I could violate HIPPA. I'm not medical I'm not medical staff.
>> You're recording. That's my client's personal information.
>> That's No one here is a client. Okay.
>> Yes, they are.
>> People are receiving paid services.
>> Can I explain something?
>> Sure.
>> You're flirting with between the fine line of disorderly conduct.
>> No, I'm not. I'm just stand no nbody.
Hold it right there. I'm defending my rights. I'm defending my rights.
Disorderly. I know exactly that. this Florida statute. What's the Florida statute for disorderly conduct?
>> I'm just letting you know you're flirting with it at this point in time.
>> No, I'm No, I'm not. People feel uneasy.
>> Well, you're causing great emotional distress.
>> Their feelings have nothing to do with me. You see, they're giving me emotional distress when they're violating my first amendment, right?
>> So, let's make sure that we retract that >> as you ask you nicely not to >> and I nice and and my those were my specific words, sheriff. I said I would like to nicely refuse. Those were my specific words. So, you're more than glad to stick around, you know, but they need to understand that that you took an oath to protect my right.
>> I'm making sure there's not a crime being committed.
>> There's not a crime and they're lying.
That Puerto Rican girl is lying about me making threats.
>> The police is here. I'm going to go talk to them.
>> What's up, brother?
>> I'm just working on a video at the at the Children's and Family Place. The sheriff, I just spoke to the sheriff. He says just making sure that a crime wasn't being committed. Okay.
>> Uh I'm not being disorderly. I'm not breaking the law.
>> Hey, watch out. You all right?
>> Uh they think I'm violating HIPPA, but you know I'm not medical staff. How you doing? Uh Sergeant, I have your name.
>> Yeah, I'm doing a ID on you.
>> Am I being detained?
>> Mhm.
>> For what crime?
>> Uh trespassing at this point. Your ID.
>> Hold on, ma'am. Let me explain to you something. I'm part of the first >> I don't I don't have my ID on me.
>> Okay.
>> You guys are You guys >> What's your name? They want you trespass.
>> Hold on. Let me speak for a second. Sir, >> your name. They want you.
>> The sheriff, the sheriff said that I was okay to film. So, >> Deputy Grant was here to warn about >> He said he said, "As long as I'm not breaking the law, they can't they can't trespass me from a public place." Ma'am, >> Chief Taylor, if you would like to know.
>> Yeah, you guys have no right to ask for ID in a public building. I'm not breaking the law. You can't you can't do anything to me.
>> Give me one.
>> So, you agree with this?
>> My name is Alic.
You agree with this?
>> They're requesting you to be trespassing.
>> I'm illegally detained right now. You know that, right?
>> Okay.
>> This is an illegal detainment.
>> Okay.
>> You guys are breaking the law.
>> Yeah, you are. Why is your hand on your firearm, though?
>> Oh, imagine. Yes, please. Yes, please.
>> You guys are You guys are breaking the law. You're You're trespassing some I have the right to speak.
>> I have the right to speak. You see? No.
Stop talking. She said I have no right to speak.
She's talking to him right now.
>> I have no right to speak.
>> You have a right to speak and and the same right that gives me my right to speak gives me the right of freedom of the press. As long as I'm not breaking the law, you guys can't interfere with me.
>> Okay?
>> I'm a photographer. And by the way, there's thousands of people watching our videos. I'm not rude. I'm not breaking the law. So, this is an illegal detention what you guys are doing right now.
>> This is an illegal detainment what you guys are doing right now. And I'm going to put the biggest complaint on you.
>> Okay.
>> Okay. What's your name?
>> You didn't have to give me your name.
Why do I have to give you my name?
>> Because you work for the state. You work for us.
>> Philip Hay.
>> All right. Thank you.
I detained over here in Lakeland, Pole County, where people have no rights. You see, your sheriff, Grady Jud, says what what does he say when people break into people's houses in in Pole County? What does he encourage the people to do?
>> Be very careful with where you're going down.
>> I'm asking you a question. Why does this put him the other day? He didn't tell me.
>> Well, he says it on all the time on TV.
>> So, >> that's because that's because we have the second amendment, right?
>> The same right that gives you the the second amendment.
>> The first amendment gives me the right to carry my camera in a public building.
As long as I'm not interfering with the with their service, they have no authority to tell me to leave.
>> I trespass.
>> They can't. This is not Walmart. You see, you don't even know the difference between public property and private property. I'm not You didn't even You didn't even You didn't even >> He could be lying, dude. I have all on video. Does he have a video?
>> Does he have that on video? No, I do.
>> I believe you recorded him, so he probably should have.
>> Exactly. That's fine. You guys can illegally detain me. Okay, no problem.
I'm going to I'm going to sue you guys.
>> Sounds good.
>> Yeah.
Could you Are you a good cop? Could you save me? I'm being illegally detained.
>> Oh, he's laughing at that.
>> No, he's just he's a >> I'm not a Second Amendment auditor.
>> Exactly. So, if I if you know exactly what I'm doing, >> if you know exactly what I'm doing, how are you guys trespassing me from a public place? You guys should know better than that >> based on what the >> No, listen. You have to investigate, bro. You don't just show up.
>> You don't just No, it's not. No, it's not. What law?
What Florida statue says that I can't film in public place? Tell me.
>> But they can say ask you to leave, though.
>> No, they can. They can ask, but I can nicely refuse. You see, you're a >> That's why we trespass.
>> You're crazy, bro. Go ahead and trespass me, but illegally. You're trespassing me illegally. I'm going to sue you guys.
You know this. It's not good, bro. It's going to cost your city and then I'm going to donate all the money.
>> That's what's going to happen. Is he a superior? I I I've been illegally detained, sir. Could you please help me out?
>> You're about to be legally arrested.
>> For what crime?
>> Going to tell the finish investigation.
>> For what crime? I've done nothing wrong.
>> Of course.
>> Please vacate the premise.
>> I'm going to sue you guys. You know that.
>> Okay.
>> Are you How do you feel about that?
That's terrible.
>> Stand in line. You're not the first one in my life.
>> Oh.
>> So, can you please walk?
>> I'm in a public sidewalk now. Am I supposed to leave the sidewalk, too?
>> Okay. Do not get back on the property.
>> That property belongs to us. I'm not going to because you guys are criminals who just illegally detained me for no reason. I haven't broken the law at all at all. I haven't been disorderly.
>> I know the Florida statue. I haven't been disorderly at all. Enjoy your walk of shame. Enjoy your walk of shame.
>> Yep.
>> Enjoy your walk of shame.
She probably gets by all these guys.
Damn.
>> Deputy Gran came in confused from the start, asking, "What job are they interfering with, as if documenting public officials somehow isn't a legitimate activity?" And the typical police tactic was deployed, fabricating allegations. Then the tired old hea excuse got thrown into the mix. It's amazing how many public employees still don't understand that it applies to medical professionals, not private citizens with cameras. If there's private information in public view, it's on the facility to secure it, not the responsibility of the cameraman to avoid it. As the situation escalated, officers from Pulk County arrived, and that's when things went from bad to worse. The unlawful detainment began, all while these officers refused to articulate what crime had been committed. Then, predictably, they demanded ID without reasonable suspicion of a crime, a clear violation of the Fourth Amendment.
What's even more telling is the demeanor of these officers. Sheriff Grady Jud even placed his hand on his firearm, as if exercising constitutional rights somehow warranted deadly force. That's the reality of policing in America.
Armed government agents treating basic civil liberties like criminal activity.
The worst part, the smug attitudes, the refusal to answer direct legal questions, and the clear disregard for due process. When confronted about their actions, the only response was mockery, arrogance, and a complete lack of accountability. Massive respect to the cameraman for holding the line, standing firm, and exposing these tyrants for exactly what they are. The only way to combat this kind of abuse is with exposure. And thanks to the power of the camera, the world gets to see exactly who these officers serve. And let's keep going.
Really difficult to figure out what this cat's up to right now.
>> Hey, brother. How you doing?
>> Good. How are you today?
>> I'm doing all right, man. And what are we up to right now?
>> Extra patrol. What's what can I do for you?
>> Okay. Yeah, I was just wondering I I noticed that you were kind of not indicating before you turned, not indicating before you got over, weaving through traffic, and I was kind of wondering what was going on tonight that you felt like that was that was necessary to to do that.
>> Have a good night, brother.
>> Sir, are you a sovereign citizen?
There you go.
Sir, I can see you got a bag there in the back.
This says Walmart extra patrol.
I really wonder if the taxpayers pay for Walmart to get patrolled by cops cuz I feel like Walmart should be providing their own private security, not the taxpayers.
But what do I know?
I'm just a idiot, I guess.
Sir, I was wondering, could I go around town and not indicate before I turn and weave in and out of traffic like you did? I'll be good. You won't try to pull me over under the threat of violence or will you still try to drag my ass out of the car if I don't comply with everything you say?
You can see you were driving through the parking lot pretty, you know, not following the roadway, just going right through parking spaces.
>> Something's coming up. Something's coming up through the scanner. Hold on.
They're talking.
>> They're talking to me.
>> He's at Walmart with Here we go.
>> Step away from the door there, buddy.
>> Go ahead, my brother.
He's at Walmart somewhere.
So, I don't know what your problem is.
I'm parked here doing extra patrol. I don't know why you've decided to acost me because you got upset because I drove through the back half of the lot and came around like I do every night and parked here because we're trying to deter shoplifting. That's what I'm doing here. So, I don't know what you guys's problem is. Okay. But the only problem is here is you clearly have hostility toward law enforcement. I don't know what your issue is.
>> They're me asking you questions about why you're >> radio and your phones. No one. No one's me asking you questions about why you're weaving in and out of traffic not indicating before you turn. That's not hostile, sir. I'm just trying to get to the bottom of this now.
>> Never weaved in and out of nothing. Calm down. Around the back half of the lot and park always do.
>> We got it all on camera.
>> Come over here with your hostility.
>> We got it all on camera. That's fine.
Glad you got it on camera. So do I. Cuz see I got a body camera recording you.
>> No, we got your traffic violations.
>> I don't know what your problem is. This is a private parking lot. There's nobody parked in the back half as you can see.
I just around and parked here.
>> Calm down. That's ridiculous. Are you kidding me?
>> Let's calm it down.
>> Did a officer accost you in some way, shape, or form?
>> When you're out When you're out by this stop light here, you didn't indicate before you turned into the into the turn.
>> Stop light here.
>> When there's a Yeah, there's a stop light right out on the highway. And when you were turning off the road, you didn't indicate before you got into the turnlight.
>> Is that true? Are you kidding me?
>> We You've got it on camera. I've got it on camera. Are you going to lie on camera, sir?
>> No, I'm not going to lie.
>> Okay. Well, then hey, let's calm down.
Why are you mad? Why are you so combative?
>> Falsely accused. No.
>> Why are you so combative right now?
>> Okay, so I've not caused a problem with you. I've just been sitting here and you guys swarm my truck, >> pull your cameras up and start falsely accusing me of weaving in and out of parking spaces. I did the same semicirc that I always do when I come here to park. I've been doing this for the last couple of year to deter shoplifters.
This is what we do. And I drove around the back half of the lot. I sat here and parked and you guys came over here and started very angrily and aggressively asking me all these why did you do this?
Why did you do that?
>> Sir, nothing was angry or aggressive.
Nothing was We've got it all on camera.
I've been very professional with you.
>> I don't know what you're trying to professional with me. What can I do for you? What are you trying to accomplish?
>> I was trying to ask why you didn't indicate before you got into the turn lane out there by the stoplight. You rolled your window up on me and so I continued to ask. I don't think anything I said there was a lie.
>> Yeah, you're clearly clearly being hostile, >> sir. No, no, nobody's being hostile.
>> Cuz there's other officers here watching you a little bit ago and guess what? My camera's been active the entire time.
>> I think that these guys probably went to their local training seminars and know not to give us any problems when we're asking them questions.
>> We I don't even know what you're talking What do you What's the problem? Just when people when members of the public come and ask you questions, brother, the best thing you can do is just answer them instead of being hostile and combative.
>> You asked me to leave. No, no one was combative. You asked me questions assuming that I had done wrong and I hadn't done anything wrong.
>> We watched over on the back half of the lot and sat here and park. What is your problem?
>> No, we watched you do wrong. We didn't We're not assuming you did wrong. We watched you out on the out on the road.
You didn't indicate before you got over.
>> Okay, >> look, it is what it is, man. I'm not >> That's not my memory of it. That's not my memory of it.
>> I'm not mad about it. You need to calm down. Okay.
>> Maybe I am calm, but I am frustrated that I don't know what this is. What are you trying to do, man? What are you trying to >> It's frustrating when when people kind of come back and ask you the same questions that you ask them every day.
Right.
>> Right. Did anybody cost you or cause you any kind of a problem? I don't get it.
>> No, but sir, I didn't break a traffic law today.
>> Are you sovereign citizens or something?
What are you doing, >> sir? I didn't I didn't break any laws today.
>> And I haven't either. So, what is your problem?
>> You did. You did, sir. We got it on camera around the back half of the lot and came over here and parked and I've just been sitting here like I always do.
I don't understand. What are you guys trying to accomplish, >> sir? We're just trying to get to the bottom of why you did why you broke the law.
>> Okay. I don't.
>> We just want to know why you broke the law.
>> I don't believe that I did. So, I don't know what your problem is.
>> Okay.
>> So, >> maybe you don't remember. Maybe you don't remember doing it, sir. We were just coming to ask, but there's no reason to be hostile with the police.
>> Nobody was being hostile with you.
>> Did I do anything or say anything?
>> Nobody was being hostile.
>> Okay.
>> And we weren't hostile to you. What did we say to you that gave you an indication that we were hostile?
>> Much more. You're not nearly as loud or aggressive as you were when you walked up to >> Well, when you got your window closed, bud. We got to talk a little louder.
>> You started doing that. When your window's up, we got to talk a little louder for you to hear us. You understand? Problem is you you rolling the window up is a little combative just in the first place.
>> Mr. Roll say, "Okay, whatever. I I don't I don't want any part of the conflict. I don't know what your issue is."
>> Hey, when you pull guys like us over, >> walk up to your car like that.
>> When guys pull us over, we don't like it when you make us roll our window down.
>> You over?
>> No, you didn't. But I'm sure you do it all the time, brother. But hey, look, it's not when the shoe's on the other foot, there's no need to get angry and combative about it.
>> I'm not angry. I'm upset. I'm frustrated with you guys. My understanding was why are you doing this?
>> Well, we just do it because we saw you break the law. I mean, there's nothing wrong with that.
>> No, I don't I don't believe that I did.
>> Okay. Yeah. You don't have to believe that.
>> You don't have to believe that you did.
>> Great. Okay. I don't believe that. So, I don't know what your problem is and why you guys decided to come walk up on my truck and asking all these loud aggressive questions. I didn't do anything wrong. I'm sitting here some providing extra control for Walmart. I answered that question. You didn't like that. You You continue to follow up and ask more questions to try and get me jammed up with something. Tyler, man, isn't that when when you see a guy break a law and he then he asking questions, it's combative.
>> Yeah.
>> Look, you don't have to believe that you did because we saw you do it, brother.
>> I don't believe that.
>> We saw you do it.
>> Back off of the lot and parked here and I'm sitting here like I always do and you guys come storming up to the car with three phones being all loud and aggressive doing the sovereign citizen thing trying to get him. I don't know what you're get all these guys. No, the only person that's that broke the law and got away with it, sir, was you.
>> No, not at all.
>> Cuz we didn't break the law. You falsely accused me of leaving and out of parking spaces. I drove around the back although like I always do every night and then I parked over here and sat here like I always do like I've been doing for a couple of years. Where were you the last two years? It's never been an issue. I don't understand what what your problem is.
>> I don't have a problem.
>> Okay.
>> All right.
>> Yep.
>> Okay.
>> But uh I was I was just asking is this your office here? You you with Vince Hens?
>> Yeah, we all we work for Vince.
>> Yeah, I I see some state guys here.
They've kind of just observing. But yeah, man. uh problem here with your guy when he was on the turn when he was getting into the turn lane up by the light up here. He just didn't indicate.
We don't look I understand sometimes, you know, you're driving, you're driving for hours, gets away from you. I just come up to ask questions. You know, there's nothing wrong with that. And >> your man here has been very hostile, combative with me. He's not really wanted to answer my questions. And I can see he called other men with guns to back him up, which I don't really think that's necessary dudes who were in my truck. I don't know what's going on. I don't know. Hey, the same thing goes when you pull somebody over, but they don't call their boys to come with guns and back them up, man. Nobody knows you either, dude. Like, >> so I don't see when the shoes on the other foot. What is the issue?
>> The problem is, man, I'm sitting here minding my own business, >> sir. I've told you I don't have a problem besides the fact that you broke the law.
>> I believe so.
>> Okay. So, so you said he didn't use his turn signal. You guys came up and credited him about it. Obviously, this has not been a productive conversation.
um he's going to continue to stay here at Walmart. The reason we're here is to deter shoplifterss. There's a huge problem with shoplifterss here. So, um honestly, guys, I don't see this conversation going anywhere. So, it's a shame that we couldn't all come to some kind of common ground, but that's probably not going to happen. We're going to go our separate ways.
>> I And I'm fine with you guys leaving.
You guys didn't break the law. I was going to ask this gentleman, you know, just to settle this traffic infraction.
And I don't know what's the going rate for a noturn signal. Is it about $35 per ticket or 100 or >> Can I just say something?
>> Yeah. I mean, we I I wouldn't mind getting paid for it. I think it would be pretty cool. But >> Okay.
>> We saw them.
>> Okay. I I understand that.
>> I'll write up a report and everything >> when I'm off duty.
>> Yeah.
>> Even if I'm in that truck.
>> Yeah.
>> Okay. And if I see somebody not use their turn signal or maybe they're going a little too fast or something, some sort of non-hazardous moving violation, I can't I can't pull them over. I can't confront him about it. And I'm in a marked vehicle. Okay. But it's just it's not important enough for me and plain clothes, maybe no armor to go up and confront them about it. Honestly, I gotta say I don't agree with you guys coming up here and and he's a he's a city police officer. You guys are absolutely in your right to come up and talk to the man, but to come up in an accusatory tone about him not using a turn signal.
How How did you think it was going to go? Man, >> I just I just kind of figured you guys do it to everybody all day and long, so I figured you guys would be pretty cool with it. I might I was wrong, I guess.
But we do it to people sometimes, some of the day, okay? But but we do a lot more than traffic infractions. It's part of what we do, but it's not everything that we do.
>> Yeah. But but we don't see a whole lot.
So when we see a traffic infraction, we just got to go check it out, man. And look, I don't have a power to ticket, so all I can do is ask questions, right?
>> Sure. And you're >> That's all I can do.
>> It's absolutely fine to ask questions.
Right. But I got to say, if you had said that that you saw an officer driving recklessly, if you saw him weaving in and out of traffic, if you saw him doing something that was hazardous, then you and me would be sitting down and we'd be talking about it. But if you're telling me that you saw him not use his turn signal, I don't agree with your decision to come up and and and >> have a conversation about that. So, we we'll agree to disagree. The fact is >> the man is here to deter shoplifters.
That's what he's going to continue to do.
>> Uh we're we're going to go our way and I'm going to tell you guys it didn't go well. So, we're going to part we're going to part ways now. Okay.
>> Hey, I'm fine if you guys want to leave, man. I mean, I uh >> if you guys want to continue shopping, that's your business. But yeah, >> right. Yeah. And I you know, I got some stuff that I need. When I see a traffic infraction going on, there's nothing wrong with just coming and asking a question. I get that you may not agree with that, but >> sure, >> that's okay. We, like you say, we'll agree to disagree, but you guys >> I mean, look, nobody's holding you here.
I don't I don't really care if you guys be here.
>> I just wanted to know, man. I wanted to know, do you cuz you keep asking me if I'm a sovereign. I wanted to know, do you feel like you can break the traffic laws with complete immunity? Cuz that's what I want to ask.
>> Listen to me. This is the last thing that's going to be said in this conversation.
>> You're going to try to limit my speech?
>> No. What's your name and badge number, sir? Lancaster. You say you're going to say that this is the last thing I'm saying, sir.
>> Uh, this is I'm saying this is the end of this this conversation.
>> Cool. Then leave.
>> Guess what? The Vincent Police Department is actually three officers short right now. One, two, three guys.
>> It doesn't look like it to be honest.
>> If you guys want to enforce traffic infractions, go to vincent.org and fill out an application. Guys, >> I I'll be honest. Seeing you guys with seven people, eight people here, it doesn't look like you're three officers short, man. Looks like he got a little bit too much pork going on around here.
>> Okay. Well, >> but that's my opinion, right? We all got the right to disagree. So, I mean, >> we sure do.
>> Absolutely.
>> Okay.
>> Are you a sovereign citizen?
>> No, brother. Have a good night.
>> Take care, y'all. Take care.
>> This video perfectly shows what happens when an officer is held to the same standard he enforces and completely falls apart. The cameraman notices an officer driving recklessly, ignoring signals and speeding through a Walmart parking lot. So, like any informed citizen, he steps up and starts asking questions calmly, directly, and with the camera rolling. But the moment the officer gets called out, he flips the script. Suddenly, he's the one under attack. He gets defensive, claims the cameraman is being hostile, calls for backup over a conversation, and to justify it all, he says he's deterring shoplifterss at a Walmart that closed 5 minutes earlier. Let's be clear, if you enforce the law, you'd better follow it.
And if citizens are expected to cooperate, cops should be able to answer a few basic questions without acting like they're under siege. So, here's the takeaway. Always film. Always ask, always hold them to their own standards.
Respect to the cameraman for staying calm and calling out the double standard. This is what real accountability looks like. Let's keep going.
>> Yeah. So, so just tell me one more time why you're asking me to step out of the vehicle.
>> Cuz I believe you're a suspect in various thefts.
>> Various thefts.
>> Various thefts.
>> Okay.
>> Step out.
>> So, I am I am asking for a supervisor.
>> Cuz you are a liar.
>> Okay.
>> You're a liar.
>> Okay.
>> You're tell you're telling me >> step out.
Can you please bring a supervisor?
>> Yeah. Space this way for me.
>> Okay. You don't have any weapons on you right now.
>> No, I do not. What? What is going on? I need an I I'm requesting Deputy Vargas.
I am requesting a supervisor. Okay.
>> Okay. Well, I'm requesting one ASAP. I don't have any weapons.
>> Listen, do you have you been to the Apple store recently?
>> No, >> not at all.
>> No, not at all. No, not at all. What's your What's your badge number? Whitaker.
>> Okay. I'm asking you questions right now. Well, I'm asking you a question.
What >> when you're done, okay? When we're done with this, I will provide you all my information.
>> Okay? I'm not denying you that at all.
>> Put your hands in your pockets, sir.
>> If you would like to put your hands in your pockets, do carefully pat you down.
It'll make us feel a lot more comfortable. Until then, we want you to keep your hands out of your pocket.
>> My hands are out of my hands or out of my pockets.
>> I know, but people will just naturally put their hands back in your pocket.
That's what I did. So, it make us feel comfortable if you let us.
>> I do not have any weapons. Deputy Whitaker, you know, you're going to get a big fat complaint in your jacket.
That's for sure.
>> Yeah.
>> Yeah, you are.
>> All right.
>> Yeah, you are. You're accusing me. You keep accusing me of crimes.
>> Come to the back of the car.
>> You don't have to face that way. Just come to the back of the car.
>> Okay.
>> I'm just trying to make you feel comfortable cuz you're you're a Nazi.
>> You are a Nazi. You know that.
>> Yeah.
>> What did I do?
>> Yeah. What did I do, Whitaker?
>> Because I called Captain Chips and and asked about you. Because I called Captain Mallik and asked about you. Is that what this is all about?
Do me a favor. Turn that way.
>> Can you uh just bend us down a little bit? I'm a little vertically challenged.
I just want to >> You're vertically challenged.
>> Me? You want me to bend down?
>> Look that way for us.
>> Yeah. Will you remove your glasses and look that way? C >> Can you please bring a supervisor out here?
>> We will get to that.
>> No. If you No, I'm I'm I You are being totally inappropriate.
possible.
>> I am not guilty of anything. I wasn't even there. I got it all tracked on my phone where I've been all day long.
>> It's not today. It's been over the past few months.
>> No, it's not me, Whitaker. It's not me, Detective Whitaker.
>> I'm not a detective.
>> Yeah, I know you're not deputy.
>> Yeah, I know you're not. You >> okay?
>> You >> You're entitled to that.
>> No, you are. You do.
>> Okay. You're again, you're entitled to that.
>> I 100% am because I'm not I'm not a thief.
>> Why are you so angry right now? Because you're an [ __ ] That's why.
>> What am I doing?
>> Because you're accusing question.
>> Yeah, you're you you pulled me. You saw me over here.
>> Someone Okay, I'll tell you.
>> Yeah. Well, you're a liar.
>> Okay, >> Whitaker. You're a liar.
>> Okay.
>> I'm trying to make a living over here doing stocks and crypto and you keep interrupting me. That's why I'm pissed off. Do you mind?
>> Uh do you have any >> Do you mind? Have you called the supervisor yet?
>> Okay. Well, like I said, we'll get there.
>> Well, let's get there fast because, you know, I'm sick of it. Call the watch commander.
I am calling I am asking for the watch commander.
>> So where were you on October 14th?
>> October 14th.
>> Yeah.
>> Yeah, I know who it is.
>> Probably in the library over at over at Thousand Oaks Library. You are costing me money, Whitaker. I'm trying to trade my stocks in crypto.
>> That's all I'm doing.
>> Okay.
>> Okay. Do you understand?
>> I mean, >> yeah. Do you my my iPad? Do you understand? It's paid for. I'm making payments at the AT&T store.
>> Do you have any external hard drives with you?
>> Do I have any? No, I don't.
>> Not at all.
>> No.
>> Okay. So, if I search your car, you won't have to.
>> You're not going to search my car?
>> I'm not asking.
>> You're not searching my car?
>> Okay.
>> You're not searching my car? You do not have permission to search my car.
>> No, I don't.
>> No, I don't. And you do not have You do not have the right to. This is unbelievable what you guys are doing.
>> Okay. Keep your hands out of your pocket.
>> I'm sorry. That's exactly what I wanted to pat you down.
>> Yeah.
>> When are you going to get the supervisor out here?
>> Do you always wear that same watch?
>> How much have you had to drink last night?
>> Really?
>> Yeah.
>> Okay.
>> How much have you had to drink this week?
>> Is that >> How much have you How much have you had to drink? Yes, it is.
>> Okay.
>> Yeah. Day after day after day after day after day after day after day after day.
>> Same one in the picture.
>> What's that? It's the same watch in the picture as well.
>> This is my watch. I bought it at Target.
Dude, >> would you like to see the picture?
>> No, I don't care about the picture.
>> Okay. Well, I'll show you the picture and I want you to tell me if you think that's you or not. But is that fair?
>> No, I'm not. No, not without a supervisor here. No.
>> What's a supervisor going to do?
>> A supervisor is going to get somebody out here who is not a Nazi like you.

>> Yeah, federal court.
>> I've already I You know what, Whitaker?
Hey, Whitaker. Octo I don't know, dude.
I'm always working on my stocks in crypto. That's what I'm working on.

>> Do you have external hard drives with you?
>> No, I do not. I already said that.
>> Okay. Do you care if we search?
>> Yes, I do. You're not searching my car.
>> Well, if you don't have them, then there's no reason then. That's what I'm thinking about.
>> Well, I don't care what you're thinking about. That is not law. That's not probable cause. That's not probable cause, Whitaker. Okay. So, let's get a supervisor out here who knows the law.
>> Who knows the law?
>> We are calling them.
>> Yeah, let's do it. I didn't do anything, Whitaker.
>> Okay.
>> Do you have your camera rolling?
>> Absolutely. Always.
>> Well, do you have it blocked? How can you?
>> No, I don't.
>> Well, that's what it looked like. Looked like you're blocking it.
>> My partner rolling his as well.
>> Good.
>> Okay. Just like our last incident where you thought that I wasn't recording, I was reporting.
>> Yeah. Well, you you you you're if anyone was instructing an investigation, it was you who took my camera away from me. Put it in my face.
>> No, I did not put it in your face. Yeah.
>> After you assaulted somebody?
>> No.
>> Yes.
>> After I was >> If you're going to give If you're going to give information out, like you're going to pose a picture. At least give all the information.
>> What are you talking about? Post a picture.
>> No. Pose a picture. Like you're going to impose that I'm such a bad person.
>> You are a bad person. You are a bad person. Whitaker, why are you stopping me?
>> Why are you stopping me?
>> Huh?
>> Why are you stopping? I believe you're a suspect in recent deaths.
>> Well, you're wrong.

>> You are insane. Okay. You know that.
>> Have you ever had a mental uh when when was the last time you had a mental uh evaluation, Whitaker? Cuz you're insane.
>> Regularly.
>> I'm sorry.
>> Regularly.
>> Well, you need another one.
>> Okay. Stay right there. Don't go anywhere.
>> I'm not going anywhere. I just don't want you. You're looking in there. I don't want you to, you know, I don't want see my hands.
>> Where would Why would I go anywhere? My car is here.
>> That's what I'm saying. You're an idiot.
>> Why Why would I go anywhere? I was here working on my stocks and crypto when you interrupted me, >> right?
>> I wasn't doing anything.
>> Okay. So, like I explained, >> didn't you say the other day? Didn't you say the other day, no crime >> at that time during that investigation?
>> Yeah. Okay. So, no crime. So, you have no reason to stop me.
>> Okay. I do.
>> No, you don't. No, you don't. No. No, I'm not. No, I'm not. Because you know what? You know what we care? Listen to me. I if anybody needs to know where I am, I've made so many calls into the police station. They've got all my information.
All they have to do is look it up. Hey, Black. Hey, Mr. Hamilton, can you please come in and talk to us about this and that? Can you please come and talk to us? You guys have all I have numerous phone calls. Why don't you go look at the logs? Just go look it up. Put my phone number in there.
>> Are you done?
>> Well, then hurry up and get the supervisor out here.
>> Okay, good. We're not We're not have another word until I have an attorney present. Okay.
>> Did I just not say another word until your your supervisor comes and attorney is present?
>> Attorney just going to naturally appear.
>> Well, let's get the supervisor first.
>> Yeah, cuz I'm tired of this monkey business.
>> Yeah, I'm tired of it.
It's going in your jacket, bro.
>> Yeah, >> it's going in your jacket.
>> That's right.
>> What's going in my jacket?
>> My complaints against you, >> right?
>> Okay.
>> Good. I hope I hope you do. Do you know who you guys serve?
>> The the the law-abiding public. You're servants of the public. The law-abiding public. Yeah.
That's me. What was I What was I doing?
What was I actually?
>> Why is there not a detective on this case?
>> There he is.
>> Who is it? Yeah.
>> Who? What's his name?
>> What's his name?
>> Detective James.
>> Detective James? What's his badge number?
>> I don't know his badge number.
>> I'm not Detective James.
>> Why didn't Detective James call me?
>> Why didn't he call me over these alleged thefts?
Why did Why didn't he call me?
>> Cuz no one knows who you are.
>> Yeah, they do.
>> I've talked to Captain Chips.
>> I've talked I I leave my phone unblocked. I leave the number unblocked when I call the police station.
>> Okay. We're not going to just call people up like that.
>> Well, the detective will. He's not afraid of me.
>> Okay.
>> Do you think a detective's afraid of me?
I'm sure he's not.
Detective James or whatever, if he even exists.
>> How much have you had to drink this week, officer?
>> Do you want to talk to him on the phone?
>> No, >> absolutely not.
>> How much have you had a drink this week, officer?
>> Alcohol.
>> Yeah, alcohol.
>> None.
>> None. How much last week?
>> None, actually.
>> You don't drink at all?
>> Rarely.
>> Rarely. Okay. Have you done any cocaine or any?
>> No drugs.
>> No drugs. No. No pot or anything here if I wasn't >> Well, I don't know that. I mean, I'm just I'm asking you on the record. I have no idea what your policies are cuz obviously you don't harassing a law-abiding citizens is okay with you guys.
>> No.
>> What do you mean no? Well, that's what you're doing. I mean, that is what you're doing.
>> That's what you think of.
>> No, that's what you are doing. That's what you are doing. I was trying to make a living over here.
>> I didn't know that.
>> Well, I told you guys six 17 times. I'm telling you now, you're stopping me from making a living.
>> The stock market closes at 4:30.
>> Yeah. Have you ever heard of crypto? It trades 24 hours a day, dude.
>> What What do you have? I just sold all of my Doge coins, >> dude. Give me a break, dude. I'm trying to make a living over here. You are actually Yeah, I'm trying to trade.
>> What do you trade?
>> What difference does it make to you?
>> Well, I don't care about you.
>> It's very simple. Okay. So, I believe you're the suspect in the in the thefts.
Okay. Based off everything that I know about you, your your physical features.
And >> where's the supervisor? Where's the supervisor?
>> I bought this watch at Target.
>> I'm not saying that you stole that. You have very distinct features that stuck out in the video. Okay. And I believe that you're the suspect in it. So, you have two options. You can accept a citation for shoplifting or you can say no.
>> What?
>> Or and it'll get submitted as a warrant deck and you can get picked up later on with a warrant.
So, there's two options for you. It's your choice.
>> I want to talk to a watch commander now.
>> Okay. You have the right to do that. But right now, I'm asking you, would you like a citation now or would you like us to submit it to the district?
>> What is involved with a citation? I haven't done anything, deputy.
>> Okay.
>> Otherwise, you're going to arrest me?
>> No. So, it's a citation. It's a I'm not going to book you in jail. No. if that's >> But if I don't if I don't if I refuse to sign the citation >> if you don't if you're not willing to accept a citation right now, what will happen is that the I'll basically write the report and it's going to go to the district attorney's office and the district attorney's office >> you do that. You do that. You >> choose to put a warrant out then you do that.
>> And then at that time you'll be taken to jail.
>> You do that.
>> Yeah, you do that. Yeah, you do that.
>> Goodbye.
>> We're not done yet.
>> What is good uh phone number for you?
Talk to your uh to go look it up. Look it up by name and go look it up yourself. Tired of doing your job for you, Whitaker.
>> It's in the database.
>> It is in the database. It's there >> because because you know why? Do you want to know why? Because I've gotten calls when when my car was parked and they had to and the the doing the telephone polls. Guess who they called?
They looked up my >> Is it 818293?
>> Good job. Wow. You can do some work.
>> Good job. Good job, dog.
>> Is the 100 North Skyline Drive a good address for you?
>> No. You want to send me some mail or something?
>> Yeah. In case they send they send you >> PO box. Here you go. P Box.
>> Is it 7323?
>> Yeah. Good job. Wow. You are detective.
>> No, I'm not. You have that wrong.
>> I'm being sarcastic. Just like your friend. What's his name? Zamora. Oh, do you know do you know about the the Constitution of the State of California?
Oh, no I don't. Oh, you don't? Oh, yeah.
Of course I do. I'm being sarcastic.
Okay.
Yeah.
>> So, it's it's okay for you guys to be sarcastic, right? What what are we looking for, deputy?
>> Okay. What's your badge number, please?
>> One2.
You had to look that up.
>> Put your phone that way.
>> You guys are You guys are unbelievable.
You know that?
>> Will you look that way for me?
So, >> is this the way it's going to be from here on out until I move out of this town? Is that the way it is?
>> What does that mean?
>> Well, it seems like you guys just want you want to harass me.
>> No, there was a crime committed to >> But I'm not anybody like that. Okay.
>> So, it's going to be submitted to the district attorney's office and if you have a warrant out for your arrest at that time, then you'll be booked in jail. Does that make sense?
or the citation. You'll be given a court date.
>> I'm not guilty of anything. You guys, >> I'm not saying you're guilty.
>> Yeah, you are.
>> All right. We're not going to argue with anymore. It'll be submitted attorney.
>> Are you the supervisor?
>> Then why why did one never come out?
>> Why did one ne why did one never come out? Do I speak English or what?
>> I'm sorry.
>> Oh, but you you have time. You have time. You guys are so busy with all your crime busting. You have time to stop me.
a middle-aged man, 57 years old, who who's trying to make a living over here.
>> 57 year old man do not commit crimes.
>> Well, I'm 57. Okay.
>> So, 57 year olds not commit crimes.
>> Well, I don't.
>> You're 57y old.
>> Well, it would be nice if you guys had some respect for the people of the community.
>> What do you mean?
>> Well, every time I meet you, you have a problem. And both times >> because you stopped me. I'm busy.
>> You're right. Cuz you committed a crime.
>> No. Oh, see. Oh. Oh. We see now you say I committed a crime.
>> Yes.
>> So you said that?
>> Uh yes.
>> So you So you do believe I'm guilty.
>> I believe you're the suspect of the Yes.
>> So you say it's from the Apple store?
>> Yes.
>> On October 14th?
>> Yes.
>> Okay. Deputy, I am going to find the best lawyer. I'm going to knock you out of the park.
>> Yeah, that's for sure.
>> Are you done? Do you need anything else from us? You good?
>> Is Is this how I mean is this how it's going to be from here on out? You're going to harass me every time you see me.
>> All right. Have a good day. Okay.
>> Where? What happened to the supervisor?
>> He's not coming >> because there again, you lied. You said he was coming and then he didn't come.
>> I'm not taking you to jail for anything.
I'm submitting it to the attorney's office. It's done.
>> I write the report. It goes to the district attorneys. If they choose to file a warrant, >> this Apple store over here says I stole something.
>> Listen, >> do you want to know where I'm going to go right after this? Straight over there.
>> Well, if you do, they file a complaint.
We're going to get We're going to go over there. They're but they're saying that I but if if they're saying that then they're defaming me. Okay, that's defamation.
>> Which employ they don't know you by name either.
>> Well, that doesn't matter.
>> You guys are here harassing me. Three cops out there.
>> Pardon?
>> They're not putting your specific name out there.
>> That doesn't matter. You You guys have my name. You guys stopped me. You're saying that I'm the one that did it.
>> Listen, if you go to the Apple store and they call us, we're going to show up.
>> Well Well, if they call it If they call, but I have a right to go. I'm a customer. I haven't done anything.
>> I beg you pardon.
>> If I go over there to harass them. Yeah.
To harass them. Yeah. I agree.
>> That's what you're going to do.
>> I can I can go and ask them if they think I'm the person.
>> Who's the one that filed?
>> Pardon?
>> You don't know who's the one that filed the charges.
>> Oh, but did you Oh, there are charges that have been filed.
>> Charges have been filed.
No, but you said >> listen, but no, no, because you guys are No, you guys are playing with words.
>> We go in circles with you. Okay.
>> No, because you guys you're the ones who go in circles over there. Okay. And they call for us to call for service and we show up and you are harassing them in any way. You're going to be removed from the property. It's that simple. Okay.
So, right now, there's no other questions that we have for you. We've got what we need. You're going to There's >> What's your name?
>> Attorney. Petro.
>> Um, so do you have it? Why? Like why is when if there's this footage, Deputy Petro, why why is there is there an actual Detective James that you know of?
Why why why did Detective James not uh follow up with me on this?
>> That's why on patrol, you're in the area we control going through the investigation. He doesn't have time to go through every single case. So, we're doing this on his behalf to help Okay, that better be true. It better It better be true.
>> I'm sorry.
>> These guys Yeah, these guys are accusing me of being a shoplifter.
>> Okay. No, I just want to make sure.
>> So, you're accusing me of having stolen um hard drives. Is that what it is?
suspect that >> for hard drives.
>> Okay, I just want to know.
>> Goodbye.
>> This is just another textbook case of cops using intimidation tactics instead of doing their jobs properly. The officer straight up accused this guy of being a suspect in a theft without any real evidence or probable cause. It's painfully obvious that they were trying to trap this guy into giving up his rights. First, they say he's a suspect in various thefts, but when asked for details, it's all just smoke and mirrors. No specifics, no real proof.
The officer wouldn't even get the supervisor. That's a huge red flag. You have every right to request a supervisor. And let's talk about the whole nonsense of if you have nothing to hide, why not let us search your car?
That's manipulation, pure and simple.
Refusing an illegal search is not suspicious behavior. It's a smart move.
It's your constitutional right. If this ever happens to you, demand a lawyer.
Once you do that, the police are legally required to stop questioning you until your lawyer is present. It stops them from fishing for incriminating statements or twisting your words.
Without a lawyer, anything you say can and will be used against you. Always ask for their badge number, film everything, and refuse to comply with unlawful orders.
Your better explain to me why you're breaking the law and driving on a sidewalk.
>> Huh?
>> I don't give a damn what you got to do.
WHY YOU DRIVING ON a sidewalk?
It's not from motorcycles. It's not from motorcycles.
>> Ask you to let me work.
>> I don't give a damn what you're asking me to do. It's not from motorcycles.
You're driving with no lights on the sidewalk.
You think you're above the law? Piglet, do you think you're above the law?
Sha Bean Police, do you think you're above the law?
Yes or no? The law doesn't apply to you.
law does not apply to you.
>> Yeah.
>> And by the way, you don't you don't have any business here. What do you What's your business? What's your business on this private lot?
>> I'm doing work.
>> You're doing work. Go park on a public street, then.
Go do your work on a public street.
This private lot is not for you to do circles around the building.
>> Sure. I'm going TO ASK YOU, >> WHAT WORK ARE YOU DOING RIGHT NOW? TELL ME WHAT is the work. What's the traffic stop? What is the traffic stop? What's the traffic stop?
>> Give me room to work.
>> I have every right to do exactly what I'm doing. I'm addressing my grievances with my public servant in whatever tone I choose to. You don't like it, you can jump back on that piece of garbage of yours and ride along so I can work.
>> You're not working.
>> You're not working. When you're actively with your emergency lights on, you're working right now. You're in the course of your duties and I have every right to record you. I have every right to address my grievances and you don't tell me where to stand.
>> I'm going to ask you.
>> I don't give a damn. Your request is denied.
>> Okay.
>> Kiss my >> They may or may not want that to happen.
Okay.
>> They may or may not. Exactly. Until they say so, you can kiss my ass.
>> Until they say so, you can kiss my You want to go over there and solicit a trespass? I don't want >> Do you want to go over there and solicit a trespass?
>> Okay.
>> Do you want to go and solicit a trespass?
>> You're not involved in the in what?
>> What's involved?
>> You're not involved.
>> We shouldn't be too long.
>> Okay. Right in.
So, what are you doing?
>> What's your work?
>> Well, I'd like to be able to do my work, but you're so close to me.
>> What's your work that I don't want that I don't want to do?
>> What's your work? What's your work?
>> I do traffic enforcement.
>> That's not That's That's not part of your duties.
Your duties are to enforce criminal law.
Law? What are you doing?
>> Traffic.
>> No. No. That's That's not what you're doing. That's not what you're doing.
Yes.
>> You're fishing.
>> I don't know what you're saying.
>> You don't know what I'm saying? You don't know what fishing means?
>> I don't know what you mean by that.
>> Oh. So, what what Okay, tell me what were you doing when you were driving on the sidewalk looking into people's cars?
What were you looking for?
>> Cell phones and >> Right. So, is that is that active policing?
>> Yes.
>> Or is that really really active policing? So, does that also involve you breaking the law? Does that authorize you to break the law?
>> Does that authorize you to break the law?
>> I'm not having this conversation.
>> I am. I'm having this conversation with you.
>> You are.
>> I'm having this conversation with you.
So, here's the question again. Are you authorized to violate the law when you don't have emergency lights?
>> SHUT THE HELL UP. When I told you to stop, you should have stopped when I involved in what I'm trying to do.
>> What are you doing? You're not engaged in anything right now. Are you actively engaged in something right now? Tell me, are you actively engaged in something right now? Where's your emergency light?
There's not even a single light turned on on your on your motorcycle right now.
Where is it? Show me. Show me what you engaged in. I don't see anything.
I don't see any single light. I don't see you engaged in any traffic stop currently. Uh any police work? What What are you doing? What are you doing on this public or or excuse me, this private lot of this business establishment parked unlawfully by the way? Okay. Because you're not parked properly in in a in a space that you're supposed to be parked in, but you're actually then you broke the law. I confronted you. You tried to run from me and now you're telling me, "Oh, leave me alone." Well, [ __ ] this is how it's going to go. This is how it's going to go.
I'm going to report everything I see.
>> Step away from my bike.
>> You can kiss my >> I'm a free man.
>> That's good.
>> I'm a free man. I can stand wherever I want. If you don't like it, you can piss off. Oh, good. Is that your supervisor?
>> No.
>> Who's that?
Who's that? Who are you?
>> Beaverton police.
>> Who are you?
>> Identify yourself.
>> I just did.
>> I didn't hear you.
>> Well, you're not paying attention.
>> I want your business card. You got a business card? No, I don't. So, >> who are you? Hey, >> I I'm talking to you.
>> I don't need to talk to you.
>> Why are you >> Am I detained?
>> No.
>> Am I detained?
>> Why are you >> Am I detained?
>> No. So, you're free to leave. So, how about >> All right. Free to stay, right? Free to stay.
>> But I'm going to be >> free to record.
>> What is going on with you?
>> What's going on here is I'm confronting my public servant for breaking the law.
>> What are you Why are you here?
>> To cover that officer because we're freaking out on him.
>> Oh, really? So, so what law? What law did he break, sir?
>> What law he break?
>> Yes. What?
>> He rides a motorcycle on a on a sidewalk.
>> Yes.
>> What law authorizes him to do?
>> Right over here.
>> Yeah. What is it? What does it say?
>> Look right here.
>> Yeah.
>> Okay.
>> What does it say?
>> What does that say?
>> What? What does it say?
>> What does it say right here?
>> What?
>> Oh. Oh, you think so? Oh, you think so?
Oregon exam otherwise it seem to break the law. Is that what you're saying?
>> That's what that means right there. You think I'm stupid? No, I'm I'm explaining that to you, sir.
>> So, you think I'm stupid?
>> No. Now you're educated on that.
>> About what? About Oh, oh, exempt. Exempt means that he can break the law.
>> Yes.
>> What law is that?
>> What law exempts him?
>> The law. You can look it up.
>> What law? Well, tell me what the law is.
>> Uh, I don't remember off the top of >> Oh, you don't remember? 135.
>> Go look it up. Go look it up. Look it up. Here's Go look it up.
>> Go look up the exempt law. Yeah. What?
trespassed you from the property.
>> Really?
>> You need to stand on the side.
>> Show me a paper where it says I'm trespassed.
>> I asked them. They did that. If you want to get arrested, you can stay here.
>> I'm going to go ask them just to confirm it.
>> You need to identify yourself.
>> You need to leave.
>> I never refused. I'm not I'm not going to leave.
>> You need to leave the property.
>> Okay, fine.
>> Go to the sidewalk.
>> Let's go. Right here.
>> Right here. Now what?
Now what?
If you return to this property, you can be arrested for criminal trespassing.
>> I'm on the sidewalk. Now what?
>> Yeah. No, we're letting you know that, right?
>> You're letting you know what?
>> You were criminally trespassed from his property and if you return, you could be arrested.
>> No, nobody said I need until you leave.
>> Oh, he just solicited a trespass.
>> Really?
>> Uh, who's the who's the manager there?
>> Who's the manager there?
This video is a masterclass in holding road cops accountable. And this officer couldn't stand a second of it. Caught red-handed, a motorcycle cop was riding on a sidewalk, no lights, creeping through a private business lot like he owned it. But when the cameraman called him out, he had nothing. He started with silence, then tried to deflect because there's simply no justifying breaking the same laws you're supposed to enforce. And when he realized he had no defense, he pulled the typical coward move. Tried to get the business owner to trespass the cameraman. When they can't cite a law, they try to hide behind private property lines. What really matters is this. Police can't just cruise sidewalks and pretend it's part of the job. Being exempt doesn't put them above the law. And as a citizen, you have every right to film, challenge, and hold public officials accountable, especially when they're stepping out of line. So, never back down just because a badge barks louder than the law. And let's keep going.
>> Can I help you?
>> Sup? So, are you following me?
>> Sir, can I help you?
>> Are you following me?
>> Who are you?
>> Are you following me?
>> Who are you?
>> Are you following me? That's all I'm That's all I'm asking.
>> Who are you, sir?
>> Huh? Are you following me?
>> Why are you approaching a police officer and asking me what what's uh what's up?
>> Cuz I saw you at the police department over there at Murray when I was over there. I haven't been to a police department in Murray.
>> You weren't park in Murray.
>> No.

>> You're the captain.
>> What can I do for you?
>> You're a captain.
>> What's your badge number?
>> Sir, what's your name?
