If you have hired your own lawyer and you uh want them to be here, we can continue the matter if they're not here today and give you give them a chance to get here tomorrow.
If you postpone the hearing, it's your responsibility to contact your attorney and let them know that when you have court, no one else will do that for you.
If you wish to move forward without your lawyer present, we can do that as well.
If you do not have an attorney and you cannot afford one, we'll determine whether you qualify for the services of the public defender.
You have your right, you have a right to have your attorney present before and during any questioning.
Third purpose of this hearing is to determine if there is probable cause. If there is probable cause or if your attorney feels like there's a challenge to probable cause, we'll address that as well.
Finally, we'll review your bonds and any other pre-trial release conditions. Be aware if the court places you on pre-trial release today, regardless of whether it is straight pre-trial release or a condition of your bond, the conditions announced in court today go into effect immediately.
Meaning they are in effect even while you remain in custody.
Throughout this entire process, you have the right to remain silent if you choose not to remain silent. Anything you say can be used against you. Everything that is being said where I am lo everything that is being said where I am located as well as where all of you are located is being recorded. There is an assistant state attorney present listening to everything that is being said. Do not say anything about the crime itself.
Keep these rights in mind as we go through this process.
