>> So, what was the direction when you took the girls to him? You'd been getting your hair done by him for 5 years, so you obviously had a rapport. Yes, we did.

>> I I gave him creative freedom. I told him to make the girls feel confident and make them feel beautiful and like young little girls, like make their hair look nice. When you go to pageantss, you think of curly hair, big hair, you know, full, maybe even long. But they went to their grandmothers for the summer. Um, and they have been hanging out, swimming, having a good time. My mom, she doesn't really know how to do hair.
So, the girls kind of kept up with their hair on their own. So, by the time I got them back, their hair was uneven, unfortunately, and a bit dry. So, they did need some work done to it. But, he could have clipped their ends. He didn't have to cut all their hair off. He could have even added extensions. Like, the hairstyle is not It's just not appropriate for a beauty pageant.

So, that was their clothing for their dresses, their shoes, the competition costumes, um, for the competition shoes for the talent accessories. Then the payment for them to get their hair done, it was 750, a little over 750 each.
>> So, you're saying this hairstyle that he gave them just ruined it? You couldn't even put them in the pageant?
>> Yes, I couldn't.
>> Okay. Wait, wait, wait, wait, wait, wait. Listen, your daughters could have still done the pageant. A bad haircut shouldn't stop them from being able to participate. And the thing is, the haircut isn't even that bad. I mean, if it was me, I would have still let them participate because those prices are astronomical.
>> They I wanted them to stand out. I wanted them to be in the page. I wanted to stand out for good reasons.
>> I mean, this hairstyle you gave him, I don't know what you was thinking, Mr. Ellington. I say be creative, but I will say the style is a little mature. Well, I was researching the trends.

>> Okay, now that they're saying that, I can realize how the haircuts are bad. If they weren't trying to go into a beauty pageant, then whatever. Who cares? But dude low-key gave him the Karen special.
They look like they're about to walk into a Target and rip the manager a new one.
>> He could have gave them curls. He could have added.
>> But don't they look beautiful? I don't understand.
>> They're beautiful girls.

Now, when you got there and you didn't like the hairstyle, how did that conversation go? When I walked in the door, I didn't even recognize my kids.
Like, my feelings were so hurt and I really wanted to cry because there was so much preparation getting ready for this pageant. They were so super excited. They were happy about their hair, but I just knew that putting them in the competition like that would literally have them standing out for >> You just answered my next question. How did they feel?
>> They liked it, but I just knew that it it wouldn't [clears throat] allow them to stand out in the proper way for the show.
>> Okay, I'm going to stop you right there, girl. At the end of the day, your kids like the haircut, and honestly, that's all that matters. And again, they could have still done the pageant. you were the one that decided against it because you had your own opinion about the haircut. For someone that says that there was a lot of preparation that went into this, it's kind of wild to me that you would approach a hair stylist and say, "Be creative, have fun, and not have a plan at all." So, at the end of the day, it's on you, girl.
>> Like, for the for the >> the pageant, I really wanted them to be able to win and to have a good time. And it's like what's what what is that's not even the same little girls anymore.
>> Well, you know what would really not help them win. Not entering the pageant at all.
>> But okay, let me ask you this. You know what? Before I do address that, I will let you respond. Mr. Ellington, go ahead.
>> When I when she dropped off the girls, they were in distraught. The hair was damaged and I had to work a miracle.
So, what you're saying is you had to cut all that off to just get their hair to grow back, right?
>> I had to [laughter] cut it as it was.
>> This is reminding me of the time my son CJ when he was like five. He going to be mad I'm telling this story, but he was playing with his little friend and they were having fun and the friend had a low cut hair and my son wore a big big curly fro and they decided they wanted to be twins. Oh no.
>> And so the little boy cut a whole patch out of his [laughter] head and and we had to go wear a mohawk. He had to wear a mohawk for like a whole year and cut all the sides down and wear a mohawk which is so funny cuz I just posted the picture the other day and I saw I was like this is so funny. This is when he got his hair cut off. Um, so I do understand when things happen and you got to work a miracle because whether a mohawk was in style or not, he was wearing one. Um, but I'm trying to understand how damaged this hair would be that you would have to cut this much off. Mr. Ellington, did you take pictures of the damaged hair where you could maybe show the mother, hey, listen, this was all in knots. This was This was Yeah.
>> Uh not at this time. No.
>> No. So when you got there and you didn't love the hair, but they felt cute, which is important, right?
>> Yes.
>> When you didn't like it, then what was the conversation? I I'm not paying you or either I paid you for this. I want my money back or what happened?
>> I asked him for my money back. So I paid him when I dropped the girls off.
>> How much was the service? It was $200. A hundred a piece.
>> You paid him in advance?
>> Yes. I paid him when I dropped him off >> because we have such a great rapport. I felt comfortable in doing it. I left to go get some things together for the pageant because the pageant was the very next day. So, I left to get things together and make sure we would be good to go once they came back from getting their hair done. So, he was already paid. I asked him for the money back. He said no because he didn't see anything wrong with the work. I let him know like their hair was not that damaged. You cut off their hair. you shave their heads and you didn't even like make sure that that was okay with me. I didn't ask for that. And then they were going to be in a pageant. If you knew that the hair was that bad, maybe after you cut it, trimmed the end, you couldn't add extensions, do curls, or anything like that. You had to >> That's what I was about to say. In today's day and age, nothing has to be permanent. It does.
>> I mean, for one day, couldn't you have added a track or two or or 10?
>> I I don't do basic ponytails or braids.
>> It didn't happen. knew what she was getting into.
>> I've styled her for 5 years.
>> You do her hair?
>> Yes.
>> Is this the cut you put on her hair?
>> Not today.
>> The shade.
>> Well, I mean, he is being sued by her.
So, I understand the shade.
>> So, the point is is that you do her hair regularly.

>> He normally does wig installs, quick weaves, sewins, and different things like that. So, he knows how to add hair.
I don't understand why he couldn't do that for the girls.

>> No, I gave him creative freedom because >> No, but after you didn't like it and didn't think it'd be right for the pageant, >> what is he going to add? He shaved off the hair. He shaved off the back. So, at that point, I didn't even feel conf and he was also busy. He was booked. He told me he wasn't even available. That was the all the time that he had and that was it. There was nothing else for me to do.
>> All right. And so you're suing him today for $5,400. Can you outline all of these expenses? This is the $3,700 we see right here.
>> Yes. I have it all right here in my evidence. And then there I even missed out on an extra what? $20,000 because had they won the pageant that was 10 a piece.
>> So you should have entered period. The defendant's right. That's what I've been saying this entire time. You still could have put them in the pageant. At the end of the day, what's really going to go against her is she said, "Have creative freedom." And she said it multiple times in her testimony. So, I have a feeling this is not gonna go her way.
>> 10 a piece.
>> So, you should have entered.
>> No, because the hair was terrible. They wouldn't have been one. It would have been good. That's not good work. I don't know what you're talking about. And that's not good work.
>> What was your creative vision for that look?
>> I was >> Can you explain it to the court for sevenyear-old girls? What was your creative vision?
>> She told me she wanted them to stand out. So, what better way to stand out than give them this very beautiful shaved curly mohawk.
>> No, it was like a sidehawk.
>> It was a Yes, it was. It was a vision.
>> Seven in a beauty pageant. When you think of beauty pageant, that's >> you want them to stand out. This is what you get.
>> And what is your policy, Mr. Ellington?
Once a mother comes in, and this is a long-standing client, she's paid you in advance and says, "Wow, I don't like that." Even though you're booked up, >> you know, they have the pageant. Did you say, "Hey, give me a minute. I can try to figure something out."
>> No. This is the creative vision that I was going for. And she wanted winners. Did it ever dawn on you because you knew how drastic this was going to be to call her, confirm or send her a picture of someone else wearing a similar style to go, "What do you think about this?"
>> No. Cuz whenever I do her hair, it's always bold, innovative.
Miss Williams, when you're suing for breach of contract and you're dealing with a situation where you feel like you paid somebody for a service you didn't get >> or they were unjustly enriched, we can only deal in the direct damages and what is foreseeable, right? The girls are beautiful. You may not have loved their hair for the pageant, but not entering them in the pageant, I think, was a little bit too far yourself. And the thing about it is you said you wanted them to feel confident and it sounded like they felt pretty. So why is it that you chose to take them out the pageant when they could have just stayed in even with their short hair? Or look, USE YOUR MAMA MAGIC POWERS. HONEY, I'D HAVE BEEN AT THAT BEAUTY SUPPLY. THE WAY I WOULD HAVE HOOKED THAT UP SO quick and had them ready for the pageant. Am I alone gallery?
>> ALL THAT money spent, we not missing the pageant. And cute as they are, >> cut as buttons. I was worried that they would stand out for all the wrong reasons. And I didn't think that that hair even matched any of their looks or anything like that. And so I thought it would be best to not move forward because I thought that it would go wrong.
>> Wrong decision.
>> Well, you thought wrong because I think it wouldn't have hurt them at all. At the end of the day, they are seven years old and it is a child's beauty pageant.
Okay, you already paid for everything.
They love the haircut. The kids were having fun and then you ripped that AWAY FROM THEM. HELL NO. [screaming] >> I'm glad the babies didn't care. I I'm one of those people, too. I'll cut my hair off in a minute and just grow it back is just hair. But they did have an obligation. They were in a pageant. And I think for that reason, you did owe the mother a a call, a question, something before you just delivered the children with this hairstyle. Once she didn't like it and didn't feel comfortable, even though the children felt pretty, she's the mother that's entering them into the pageant. She has a better understanding about what pageantss are looking for. And at that point, it doesn't seem like you even attempted to cure to mitigate the damage to somehow make this fiveyearlong client happy.
It's almost like, oh well, I've served you for 5 years. You don't like the hairstyle. I don't know what to tell you. In that way, this court feels like you were not acting in good faith.
And for that reason, judgment for the plaintiff, not for $5,400 because they could have gone to the pageant, but for the $200 you paid him for a hairstyle that was way [music] out of bounds. Judgment for the plaintiff for $200. Court is ajourned. All right.
I thought that she was about to award the entire amount. Thank goodness she didn't. You know what? At the end of the day, I agree with that judgment because I said it from the very beginning. She could have let them enter into the pageant regardless. [music] The kids were happy. They liked the hairstyle and it's a fun thing for them.
Let them do it. You already paid. Now, is the hair stylist wrong for not trying to remedy the situation? Sure, you could argue that because he needs to act in good [music] faith. But other than that, you know, he didn't necessarily do anything wrong. He was told to have creative freedom and have fun with his haircut and uh he sure had fun. I mean, what do you guys think about this? And also, is it just me or are beauty pageantss kind of like icky? I just kind of find them weird. I don't know. Maybe it's just me.
