Um, so of course while we were under lockdown, he didn't do it, but once things got back to normal, I did bring them in. He's been negative for each and every test.

[00:08:02]>> Oh, because I trust him. Uh I been knowing him. I know that he's a great guy. Like we've been talking throughout these 10 years. So, I trusted him to come into my life like that.

[00:08:24]>> Uh yes, when we were younger.

[00:08:28]>> Has he used marijuana in your presence since you have moved into it?

[00:08:37]>> Uh the uh So, what does Juan do in your home uh for this past week? What has he been doing? Uh, he helps me get up in the mornings and wake up for the kids to school because I'm bad at waking up early. He helps me with their homework.

[00:13:08]>> Okay. What type of rehab?

[00:13:10]>> And for what type of drug were you gi?

[00:13:14]>> Okay. So, you went to rehab approximately when did you get out in in connection with this?

[00:13:20]>> I had just recently got out like a week or two before.

[00:13:25]>> While you were in rehab, who took care of the kids?

[00:13:28]>> My son.

[00:13:30]>> And how did you take care of those kids?

[00:13:32]>> Um, he went to work. Um yeah to make sure that they were okay that >> okay did he also uh supervise them?

[00:13:42]>> Yeah.

[00:13:43]>> Okay. Where was he working at at that time?

[00:13:45]>> Was it full time or part?

[00:13:47]>> Full time.

[00:13:48]>> Okay. Now the day uh that this this incident occurred. Uh where had you and your son been immediately prior to it?

[00:14:01]>> Um it's kind of a home. He was dying.

[00:14:06]>> Did he survive? Did he ever leave the hospital?

[00:14:08]>> No, he passed away.

[00:14:09]>> And what was the purpose of you and gone visiting him?

[00:14:12]>> Um, not only was he my dad, but after his dad was killed, he was a father to my kid as well.

[00:14:19]>> Um, and then after that occurred, did we still maintain employment?

[00:14:23]>> Yes.

[00:14:25]>> Now, I'm moving to the date. So, you got out of rehab immediately prior to this, correct?

[00:14:30]>> Yes.

[00:14:31]>> Okay. And you remember the date of this incident?

[00:14:35]Not not physical date. I mean uh you remember the day it happened. You're familiar with it. You remember it?

[00:14:41]>> Okay. And a couple of things I have mentioned to you on multiple times and I visited with my uh with uh Juan about parties and their responsibility and liability. If one person does something that basically everybody can hold be held responsible.

[00:15:03]>> And were you in fact um how many people were there that day?

[00:15:08]>> There at my home?

[00:15:30]>> He threw me to the ground.

[00:15:41]>> I see Anthony Montes and I'm 14.

[00:16:48]The court well knows that this involves the death of a 14-year-old child that was simply watching TV in his upstairs bedroom and the death of an elderly individual who got lost in his car. And uh we are asking the court for justice today for the families who are here. And uh we're asking the court to um sentence Mr. Martinez to the 25 years.

On behalf of Mr. Martinez, um throughout his representation, I've explained to him about responsibility on in this matter, and he does accept full responsibility for being a part of being involved in this activity. He has always been steadfast that he did not uh fire any fire that day and that it was the other two individuals. As part of our plea agreement, he has agreed to testify against either or both. But it appears that uh Andres Martinez has worked out a plea in his case, assenting representing him, I believe. And that plea is for 23 years.

[00:17:50]>> 22 years, sorry. Um and we would ask the court to consider the responsibility here. Everybody's responsible. There's no question about it. But the responsibility for Mr. Martinez should be less than an individual who's actually shooting the gun. His mother testified that she never saw him fire a gun that day. That doesn't mean he's not responsible. He is. But we're asking the court to uh to place his case in comparison to to uh uh Andre Andres's case. Uh we would ask the court to consider 20 years on this case. Uh I realize the cap is 25. We had asked the court to uh accept or or sentence Mr. marking as one for his responsibility.

[00:18:38]Um, oh, and pardon me. Uh, an additional thing since it's been out of um out on bond and I think Miss um Miss Laneir testified up here. She's a neutral party. She has nothing to gain in the states or lose, but she demonstrates in the field that uh Juan Martinez has basically been a model individual funal GPS monitor. He's had zero infractions and that's in a little over three years and additionally he's been drug tested and he's never come up positive. I think those show um very good traits that the court can consider. So with that we would ask the court to consider 20 years.
