Cops Quickly REALIZED He Knew His RightsAdded:
So today we got a journalist who's investigating a bank. He's out taking video and taking pictures of the bank out on a public sidewalk exercising his first amendment right. Now what do these bankers do? They get triggered immediately and they do what they usually do is waste taxpayers money and waste resources and dial 911.
>> Are you like a private investigator? Is that what you're doing?
>> I mean I'm just here doing an investigation. I really can't get into it. You're kind of impeding my investigation at this point.
>> Yeah, I'm impeding your investigation.
>> Yeah.
>> Okay.
>> Are you a police officer?
>> So, it looks like we got a little flip the script situation here. And it's a brilliant job at this auditor. Now, this is what made this cop quickly realize that this man knew his rights.
>> Huh?
>> Auditor, >> I think. So, um, he's a investigator conducting an investigation and I'm impeding his investigation.
>> So, >> now that cop's partner that you see right there was the one that made this video interesting with his little a-hole attitude. All because of a simple CAD number that was requested by the auditor.
>> Do you guys have call for services or numbers or CAD numbers?
>> Yes. Um, you'd have to call a PDA and get this one. We not assigned him right off the bat. We have to go back to the office and upload to our body cam.
>> So, you can't call over and get a CAD number?
>> Yeah, I could.
>> Yeah, I'm not.
>> You're not going to?
>> No, I'm not. You can call up there and get it.
>> Really?
>> Yeah, I don't have it right now, man.
>> Well, yeah, I understand you don't have it right now.
>> Yeah.
>> Um, it would just, you know, be professional for you.
>> We have other people talking on the radio. I'm not tying up to ask for a CAD number. No.
>> Like I said, ladies and gentlemen, this one's going to be interesting. And I just don't understand uh why is it so hard? Such a simple request. And these cops actually know they're going to be on YouTube. This cop knows that he's an auditor. Now, let me tell you today, this cop tried it on the wrong one.
Southern Illinois's Accountability, guys. This man does a fantastic job putting this cop right in his place and putting him in check just like he should. Guys, I'll make sure to drop his link down below. Go show him support.
Subscribe. Let them know that the surreal cam sent you. Now, with that being said, pop your popcorns and roll on up.
>> What's up, man?
>> I don't know.
>> Huh?
>> I don't know.
>> Uh, the bank the bank just called.
They're just kind of concerned with you out here taking pictures or well with the video and the mask on. They just got a little concerned. So, I just want to see.
>> Yeah, I don't know >> what's going on.
>> Probably should ask them.
>> Why? What? Is something going on inside the bank or?
>> Yeah, I don't know. I'm doing an investigation. So, >> Okay.
>> Can't really talk at this moment. What's your name, badge number?
>> Okay. My name is Officer Smart Eight.
Yep.
>> Smart eight.
>> Are you like a private investigator? Is that what you're doing?
>> I mean, I'm just here doing an investigation. I really can't get into it. You're kind of impeding my investigation at this point.
>> Yeah.
I'm impeding your investigation.
>> Yeah.
>> Okay. Are you a police officer?
>> Did I say I was a police officer?
>> No, but you said I'm impeding your investigation.
>> Yeah. Yeah.
>> But you're not a private investigator.
>> No, I'm just investigating this this uh branch here.
>> Okay.
>> Might be somebody inside, you know, that has a sneaky link or something like that. So, >> yeah. I'm going to get back to it, man.
>> Okay.
>> You're 108.
>> Okay. Have a good one. All right.
So, this cop already knows that this man is an auditor. He knows he's going to be on YouTube and he's getting tested, right? So, he goes and tell his little a-hole partner now. And we're going to take a look at when this cop goes inside and we're going to hear what everybody says inside the bank after we see this interaction first with the a-hole cop.
So, make sure you stick around to the end of this video, guys.
>> I think so. Um, he's a investigator conducting investigation and I'm impeding his investigation.
>> So, he's out in public.
>> I mean, he's out >> Yeah.
>> in public.
>> Go outside and talk to him and just >> Yeah. I'll just let them know. I think he's just trying to bait a little bit.
>> So, yeah. Yeah.
>> Yeah.
>> You guys got stickers to make feel better?
>> Stick. Stickers. I sure don't have any.
I I don't know.
>> That might make him feel better. Is it Dereks?
>> Derks? Yes, sir.
>> Yep.
What's he telling him? It's going to be all right.
>> What's that?
>> What's he telling him? It's going to be okay.
>> I'm sorry. Say it one more time.
>> What's he telling him in there? It's going to be okay. Or >> Yeah. What? I don't know. I didn't really He just told me what was going on. I showed up late, so he was just going in there to talk to him.
>> Well, hopefully he's got his uh body cam rolling. I can get that call.
>> Yeah, we have all of our body cams going anytime we get out our patrol car.
If you guys have call for services or numbers or CAD numbers?
>> Yes. Um, you'd have to call a PDA and get this one. We not assigned them right off the bat. We have to go back to the office and upload it to our body cam.
>> So, you can't call over and get a CAD number?
>> Yeah, I could.
>> Yeah, I'm not.
>> You're not going to?
>> No, I'm not. You can call up there and get it.
>> Really?
>> Yeah, I don't have it right now, man.
Well, yeah. I understand you don't have it right now.
>> Yeah.
>> Um, it would just, you know, be professional for you.
>> We have other people talking on the radio. I'm not tying up to ask for a CAD number. No.
>> Really?
>> Nope.
>> Nope. You can call up there and get it anytime or anything like that. You can swing by and grab it, anything like that, but I'm not going to tie up the radio while we have other officers out on other issues right now.
>> So, you may not be familiar with what I do.
>> I don't know who you are. No.
>> Well, I'll give you that one, officer.
You might not know personally who he is, but you definitely know what he's doing and what he's about and why he's doing what he's doing.
>> Yeah, I know you don't. And that's probably why you're not going to do this. So, now what I'm going to do is I'm going to file a complaint with you.
I'm going to pull out all your jacket.
>> Okay.
>> And um you know, I go to city hall meetings. I I um you know, speak at city hall meetings. And that's probably why somebody wanted me to come down here and check on you guys because your department I guess two of your officers already are under internal investigation.
>> I have no idea, man.
>> Yeah, they are.
>> Okay.
>> Um and I guess you guys are using the odor of burnt marijuana to search people.
>> I have a dog, so I just run my dog on vehicles.
>> Y Well, I guess canine.
>> Yeah, I understand that. I've seen it.
And uh you know that's been struck down by the Supreme Court. You can't just use that alone.
>> Okay. Um, so that's exactly what I'm doing here.
>> Gotcha. Videoing the bank.
>> Well, you know what I mean. I'm I'm here investigating you guys.
>> Okay.
>> To see what you guys would do in certain situations.
>> Okay.
>> Um, my next stop is the city hall and then your police station.
>> Okay.
>> To talk to someone of higher authority.
>> Okay.
>> Um, so I'll be up there and do all those things to pull your jacket to see if you had any complaints on you.
>> Cool.
>> To, you know, see if anybody's investigating you.
>> Right. Right on. and then see why, you know, you just don't have respect for the First Amendment one and why you wouldn't just be professional and pull the CAD number. It's not hard, >> dude. I'm There are other people on the radio. I'm not being disrespectful whatsoever.
>> Well, I would if I earpiece in.
>> I do.
>> Oh, and there they're just ton You guys are that big of a department where there's just >> No, the other officers are doing things.
Yeah.
>> Well, I understand that, but it would be like, "Hey, can I get a CAD number?" I do these all over the country. Okay. And I've never had no one not give me a >> not one.
>> Not one.
>> I'll be down. Well, whenever the other officer comes out, he's the officer assigned. If he wants to call dispatch on the phone or whatever and get it, he can. I'm not even sure if she's assigned one yet. I'm not up there. Obviously, I'm out here, so I don't have one right now.
>> It's worth getting a complaint over >> for what? Not giving you a CAD number?
>> Yeah. I mean, it's it's just it's a professional thing to do.
>> I don't know if she had one right now.
I'm not going to call call over the radio while he's in there talking on the radio. So, if he wants to give it to you, he's more than welcome to. He's the He's the officer assigned to it. I'm just came up here because he was up here.
>> So, are you willing to give me a CAD number or call for service?
>> So, this is the cop that just came from inside the bank. The one that approached the auditor in the beginning that's impeding his investigation. Now, do you think that this cop is also going to give this auditor a hard time over the CAN number? We'll be back to this, guys, as soon as we figure out what happened and what was said inside the bank. Let's go ahead and take a look.
Sorry, we weren't sure. We locked the door.
>> No, it's okay. Um, >> I think he might be like a like some kind of auditor or something with us.
>> What? Okay. Auditor.
>> Yeah, >> this is our independent. We've gotten emails about those how people try to claim to be independent auditors.
>> Um, so him videoing stuff. He is out in on the public street. He can >> here. I'm gonna put Annie on speaker.
Okay. This is Annie Sterns.
>> Hey, Annie.
>> Hey.
>> Hey. So, I mean, he is out in the public. Um, he can video. I can't do anything about that. Um, if you guys want to keep the door locked while he's outside, that's fine with me. That's that's your decision. But I can't make him leave cuz lawfully he's not doing anything wrong.
>> Okay. So here's here's here's my situation. I had just got to Mexico. I am not anywhere near. I need to make sure that my girls are safe.
>> That's the number one priority, right?
>> How can we not make a person with a ski and not videotape? I mean, that's that's not okay. I can't leave my doors locked all day. How can we not protect my girls right now?
>> They said they cannot ask >> I don't think it's like it's not like a ski mask. It's not fully covering his face. Um, it'd be the same like if he was wearing a like a medical mask. It's kind of similar.
>> Have you identified this person? Do you know who it is?
>> No, I have not identified him yet. I just spoke with him outside and I came inside and spoke with you guys.
>> Uh, but we have another officer. We have another officer that's speaking to him now.
>> Okay. So, at the end of the day, my girls should be aware of who this person is, >> right?
Uh, so I feel like we should know the identity of this person and they also need to know what uh proper protocol is for when you're around a bank. I know that you can't stop him from videotaping, but >> is he aware of common >> uh yeses or nos that you don't do in a bank? I mean, this is that's not okay.
And I can't have them being fearful when they're there.
>> That's not okay.
>> Yeah. Um, we will we'll we're still out there talking with him, so we will do our best here to get some identification from him. He's going to be difficult, but >> I mean, we have blinds, so >> we will >> Well, I mean, here's the thing. We're >> If he's difficult, >> how can we not remove him from our property or tell him that he's >> Well, we can't be doing that.
>> But he's if he's inside, that's a different story. But he's out on the public sidewalk. I can't remove him from the public sidewalk.
Okay. So my ask would be first of all I know that you need to properly identify a they need to know who he is and will somebody call me because I want to know who he is. I'm not there. I need to notify corporate security. I need to notify my boss. I need to know I need to let everybody know because this is not okay.
>> Right. I agree with I'm just saying, you know, right now lawfully, you know, I I can't remove him from outside. But, um, but I will tell you, we've had some incidents. I don't know if you guys remember, but once the space ends up in the back of my car when I left there a couple years ago, like this kind of stuff, >> I have to make sure that my girls are safe when they're there. That is one of the number one priorities. I mean, I Is he combed? Is he And what's going on in your conversation with him? No, he's he's just he's not being like physically combative or like aggressive or anything with us. He's just not very forthcoming with information. So, but like I said, we're still out there talking with him.
Uh I just came in here to check with the girls in here. Um but I'm going to go back out there and see what's going on and I will update you once we get further. Okay.
>> And and I apologize. I didn't even get your name. Who am I speaking?
>> This is Kevin.
>> Okay. Okay. Will you please call my cell phone? Heather will give you my cell phone number. I I will need an update.
>> Okay. Yep. We will give you an update once we're done. Okay.
>> Okay. Appreciate it.
>> All right. No problem.
>> Heather, take me up. Heather, take me up here.
>> Now, I do give credit where credit is due and especially when it comes to cops. So far, this cop is doing a great job. And now he's going to walk outside.
And do you think he's going to fulfill this auditor's simple public records request, which is the simple call for service number? Let's go ahead and get back to that, shall we?
>> The officer assigned that I'm came up here because he was up here.
>> So, are you willing to give me a CAD number or call for service?
>> Sparty, what's my cat number?
>> Very professional. Thank you.
>> What?
>> I didn't hear it.
>> Sparty, could you say that?
>> So, now I'll give you accommodation.
Give him a complaint.
>> What's six? What' you say?
What did you guys 1644?
>> 104 count number 1644.
>> Yeah, that's it.
>> Okay. Yeah. 1644.
>> So, I appreciate that. I mean, it's that easy. I'm just looking for a little accountability and transparency. That's what I'm doing here. I heard that you guys were having some problems. There was a couple officers that uh were under internal investigation. Um so I came out here to see stress test our rights here in in Spart Illinois. Um so my next stop was the city hall. Um and but now I'm going to go and file a complaint on him for unprofessionalism >> because I wouldn't give him the CAD number.
>> Okay.
>> Yeah. He said I had to actually go down to your police department.
>> What else did I say? Or you could call >> if you wanted to file a complaint. Yes.
That's how That's how you would >> Well, he said I had to go down there to get the CAD number in >> because I wasn't assigned that you were.
But >> the other thing is I could just make a foil a foy directly to you on your body cam and make you write it down. Uh that's >> I'm not going to write anything down.
>> Well, you have to under >> No. No, I don't. I'm not an admin.
>> You don't have to be.
>> I'm not an admin. I don't do for you.
>> Um so he's he was out here taking some pictures, videoing. Uh the girls inside got a little nervous, concerned while he was out here. They locked the doors. Um Andrew wants to know who he is, what he's doing. They told me he's conducting an investigation because of recent events that have gone on within the department. Some people being under internal investigation. So I told her that he's out here on a public sidewalk.
I can't make him leave a public sidewalk. I can't make him stop videoing in public. Um she's not very happy with that. She wants to know who he is cuz the girls inside are concerned about him being here.
>> You want me to talk to her?
>> Uh cuz she they got her on the phone cuz she just left.
>> Okay.
>> So good.
>> Yeah, I think so.
>> I I won't be here too long. I was uh I was just walking by. I'm just I'm a first amendment journalist. I'm out here just stress testing our rights uh to record in public. Um >> that was a w Sorry. damn thing. Um, so I just have a little bit of a problem with Derek here. First of all, he wouldn't he wouldn't give me a CAD number, which is I know it's minute. Um, but then he thinks that if I would give him a foyer request, he doesn't have to take it. I do these all over the country. I know that I can give it to him verbally on his body cam and then he would have to go back and pull it. Um, now he says that he's not admin. He doesn't have to do it. the Illinois FOYA uh laws are very clear. I can give it to any member.
I don't have to go down to your police department and do it because it's for my convenience. And the ADA says that I don't have to write it down. He can take it. I can make him do it. Um you know what the ADA is?
>> Yeah.
>> Okay. Um so there's reasons like people don't know how to read and write and stuff like that. So he would have to to write it down. Now, him being very defiant and like, I'm not going to write it down. That's that's >> No, that's not what I said. I said I don't do that. My admin that >> I understand that, but if I was to give it to you, it the onus is on you to forward it to to whoever. I don't have to go to all these different departments. And uh I'm just here to try to educate you guys on our rights. So your department for one doesn't get uh sued and two so you guys are aware that uh we the people have rights and uh you know you guys you know I've received a lot of stuff on on my pages that you know you guys were in a little bit of a hot water and that's what brought me out here. I was asked to come out here. You know what I mean? I just didn't show up from hours away for nothing. Um, so I'm trying to educate you guys a little bit on our rights. You know what I mean?
>> Was there anything you need from last?
>> Uh, no. He was very professional and gave me the CAT number and I think he needs an accommodation and he needs a little bit of an attitude check. So I would like he was the assistant chief, I would just like to, you know, thank him for doing a good job and I would I would like to, you know, I mean him tone it down. They they work for us, you know what I mean? We paid their taxes. We paid their check, you know, with our taxes. And uh we just like to hold them accountable for their actions. I think when they do a good job, they need highlighted. And when they do a bad job, they need to be, you know what I mean, critiqued a little bit. And uh I think that this is a cheat. It should be brought to your attention. That's all, you know what I mean? I'm not trying to scold anybody cuz you know what I mean?
I'm nobody. I'm just a messenger. But okay, >> that's what I'm out here doing. Um, all right. I'm going to go talk to you just make sure that >> Yeah, I'll be out of here in no time.
>> We'll get out of here. No reason for us to >> Thank you.
>> sir, is all right if I get your name just so I can document within our CAD and stuff that I that I spoke to you and we know who you are with our >> I mean, you understand I don't do that.
>> You see, ladies and gentlemen, this is where this gets me at. A lot of these cops try to kill you with kindness. to try to be cool, calm, collected, and professional with you, but they will still try to violate your rights and try to be slick about it and ask you for your information at the end of the conversation just to see if they can get it out of you, ladies and gentlemen, and violate your rights just like this cop just did. He was doing such a great job.
Why is he asking him for his information and stuff? He knows that this auditor is not going to give it to him. He already knows he's going to be blasted all over the internet. Why ask? Is it all right if I get your name just so I can document within our cab stuff that I that I spoke to you and we know who you are.
>> Well, yeah. I mean, you understand I don't do that, but uh I appreciate you for trying. I can't can't you know what I mean? Um but you you'll end up seeing it. You'll you'll end up finding me and you you'll know who exactly I am.
>> Okay.
>> You know what I mean?
>> Okay.
Well, we're just going to wait for him and then we'll be out of here.
>> Yeah. Yeah. I I'll wait till you guys book on out and then I'll be out of here.
>> Okay. Sounds good, man.
Now, I think this auditor did a great job here. The way he took care of business and the way that he gave this a-hole cop what he deserved and he stood his ground and he let these cops know exactly what he was doing. He wasn't sugarcoating anything. He made it very clear to these cops. Now, these cops were a little triggered, but you know what? At least it didn't end up violating his rights. Let me know what you think in the comment section about this video. I would love to know, guys.
