In criminal proceedings, a defendant may be found incompetent to stand trial if they lack the mental capacity to understand the charges against them or assist in their own defense, as demonstrated by the case of Tony Becerra, who was charged with arson and burglary for starting a fire at an apartment complex under construction in Denver but was subsequently found incompetent to stand trial.

The man charged with starting a five-alarm fire at an apartment complex under construction in Denver was found incompetent to stand trial today.
38-year-old Tony Bessara was arrested in connection with that fire January 2nd on Leetsdale Drive. He's now charged with burglary and arson for the massive fire that took days to extinguish. Police say they tracked him using surveillance video.
His next court hearing is scheduled for mid-July.
