>> First of all, Randy.
>> Yeah. You have an opportunity to view the film from your service. How many times?
>> Uh, three.
>> And would you go about having the judge here?
>> Uh, okay.

>> Okay, thank you very police department. And how long have you worked there?
>> I've been with Dan Young um almost 12 years.
>> Where were you at?
>> I was retired from the city of Frasier after 28.
>> And um why did you um or what drew you to the attention of my client? I observed uh Miss R operating in Portugal eastbound on I94 um near a street called Risner which would be um between Belleville and Lawsonville while eastbound on 994. Um at Risner she made a sudden hand turn as if she's going to exit the freeway. My concern was that there's no exit there.
Uh there's just uh a ditch and a fence and things like that. She straightened out from there. Um, that's when initially drew my attention to her and I continued following her respond. I pulled to that point.
>> And have you ever seen any car before, but she never stopped?
>> No.
>> You stop when they pull.
>> I I just I generally like, let's put it this way. Um, I generally observe them for a period of time afterwards to determine, you know, what what they're doing. If they uh continue leaving out their lane like Miss Rome did, um then I will stop them and investigate now. Um you know, if they're um swinging to avoid a deer in the roadway or an animal or something like that, they go, "Okay, well that that makes sense." But then they drive perfectly straight afterward, that might not stop them.
>> Okay. But you didn't observe her for a real long time after, did she?
>> I did. I followed her for probably anywhere from 3/4 of a mile to a mile.
Um just observing the driving behavior after that.
>> It was straight pretty much, wasn't it, until you turned your lights on?
>> It was not. I mean, as he's in the right curb lane, she's leading into the center lane. She's leading off onto the rumble strips on the side of the road. Um that's why I decided to um activate my lights at Bel Road. Uh cuz it just continued getting worse from that. Boom.
Would it be unusual for people to not tell where to go if you come on the head lines? Overhead lights are on things.
They're not sure if your stop is somebody else or you stop.
>> I didn't turn on my lights until the road. So I was just I was behind her at a distance um so as not to make her nervous or anything like that. I wasn't tailgating her. I was just observing driving behavior at that point. Um I didn't actually make the decision until her leg continued to get worse to stop her.
and her breathing got worse as she saw her. It would have been changed to let that be really go off.
>> Well, that's and I activated was I didn't know if she's getting off at BO or she just continued to weave off onto the rumble strips at that point in time.
So, um that's why we decided to stop her there um just to um to [clears throat] invest in investigate the driving behavior to say that her version could be very true. She's not sure. Are you stopping her or somebody else cuz I saw the traffic? Is that true? It was on the traffic.
>> I really don't know what she was thinking, ma'am. So, I just >> I thought >> I don't really that would be completely um I I really don't know what she was thinking. Um I'm just telling you what I observed and and what my thoughts were at that point in time.
>> When you start other people and they say that they have that was the reason, do you give them the benefit of the doubt?
Don't cheat. Oh, I try to give everybody that the job.
>> And what did you do for Crystal >> as far as giving a benefit of a doubt?
What did you do for Crystal?
>> I stopped and investigated um her driving behavior.
>> Okay.
>> I did my job.
>> My job is uphold the Constitution United States, the ordinance and laws of of as well as the state of Michigan. custom job I'm horse >> and as well for you also have to use common sense in your discrete correct >> yes ma'am >> okay let me show you >> yes sir >> all right Smith >> Do you know how far is from to um Rosville the entire width of the township every township 6x6 so the entire from Losville to Hy which is the width of our township 6 miles is approximately halfway so from Wville to Bville is about 3 miles >> about three miles >> approximate I haven't measured exact distance, but with the way the the township is plotted out, Los Baldo would be the halfway point. So about 3 months.
>> And um did you see where she came on?
>> No.
>> She was already out when you got >> the first my first observation of her is when she attempted to accident.
That's the first time I recall seeing her vehicle or paying attention.
Hopefully she thinks she was fast and she she took a I mean it was an abrupt right turn. I thought she fall into the ditch.
>> Could it have been down against something?
>> I don't know. I don't know. At that point in time, uh, she made no statement after the fact and anything contrary to it. I just don't know what I was.
>> Sure.
Did you ever have an opportunity to explain to her life stopped?
>> Um, I don't recall the exact sports, math, but I I would have I would have indicated to her she stopped believing.
>> She stopped leaving. Okay.
Officer, when you saw Miss Ro attempt to exit at Risner, did she depart the later trail that she was?
>> Yeah.
>> I want to go back to the makeup career as a police officer. You do patrol and do you do traffic control and be?
>> I I have in the past. I had a traffic assignment once was in Frasier. Um they became the supervisor there. I had a traffic assignment for about 3 years here in Vanurren. Um that night the night in question on October 27th. Um and my current assignment is as a um radio call zone car uh which is not um traffic in specific. We do stop cars for traffic infractions and stuff, but mostly we're out there to take care of complaints and respond to calls for service.
>> Thank you. And then I just have maybe one or two other ones. And you said you made lots of stops which I'm sure you have for [clears throat] specific drunk driving >> for a variety of things. Ma'am, >> how about specifically for drunk drivers?
>> Uh yes, specifically for drunk driving.
I have to >> they all resolve them being drunk.
>> What's that? Have they all resolved within the driver's behavior?
>> No. I mean, occasionally you'll run across um people who are having medical emergencies. Occasionally, I've stopped a couple of diabetics who hadn't been drinking at all and determined that they had not been drinking and actually got emergency medical assistance. It's been uh those are just a couple of examples.
>> Awesome. I'm so sorry. Go ahead.
>> Have you ever been stopped by a stop?
>> Yes.
>> Okay. And if they put their lights on?
>> Yes.
>> And were you want to make sure whether it was for you or for somebody else? So you decide anything go >> I usually see in common and know exactly who they're going to stop.
>> Okay. And then years of experience you used to grab >> No, I just say sometimes you just know you're doing wrong and you know and most of the times I've been stopped has been for speeding. Um, and I just, you know, you just kind of, there's been a couple times where I was stopped for, um, for something other than that, but I mean, I just, you know, typically people see the police come up and I have, that's been my experience, too. [clears throat] >> But if you, do you probably have friends that aren't police?
>> Oh, yeah.
>> And a lot of them tell you they get freaked out when they see the lights.
Isn't that fair? Uh, no. I've never had anybody say they're freaked out. Never.
>> I'll I'll take judicial notice that some people are quote unquote freaked out when they see the lights on behind them.
>> May one.
>> You may.

>> I say from these normally companies now I've been a police officer their whole career. I can say although I was for 10 years prior to that and you've been back with that and you say you can get freaked out as you are did I do something wrong and uh or um are they just to pull me over? So I think that her behavior was normal. Yes, she went over and did that other way, but she was driving pretty straight. Then when the she starts getting closer to hospital, then the lights start coming on and that's when she's all right. Which way do I go? Am I going to go into or are you going to go out or stop me? So, um we feel that we really didn't I mean I didn't think but from what I saw until the lights came that way.

>> Hey, your officer's testimony was that Friday regarding the reporting that the defendant's vehicle was scheduled to maintain her lane and that he was concerned that she was going to exit into the ditch where there was no exit ramp. Based upon that, she failed to maintain the lane, which is a bridge and officer could have stopped her at that point. Instead, based on his training and experience as a police officer, he allowed the vehicle that he would be traveling to see if that is just a a one time occurrence or there was something else going on. The court saw the video a couple times that showed that on at least a couple occasions the vehicle traveled over the the white fog line, was having trouble maintaining the lane, and was increasing the ability to m the inability to maintain the lane as as the vehicle approached the Belleville Road exit. which was all prior to officer King activating this light. And so I don't know that any argument about being freaked out about that patrol vehicle having his lights on is really impacting her behavior before the lights come on before before the defendant knows that she's being pulled over. Um there's sufficient probable cause for the traffic stop at these three or four different occasions. um based upon that we would ask the court to um find that there was a probable cause and allow the standard to proceed.

>> Just a quick um first of all right away that she could have done and quite frankly I thought a lot of the driving that we saw just before she gets to Rosville. no doubt about she was in the middle and definitely the lights that came on start to get activated and and um I think that quite frankly because I he couldn't really last or video on a lot faster and that would have been more convincing instead of doing it when she's almost to the road that she's going to be getting off. So I don't even need that video.
>> Also, you're not watching the same video I've watched twice. His video on was on long before he got the bell bell road.
He activated his lights when she got the bell bell road. But he videoed >> I didn't think >> okay he started going off base but instead of putting right on she didn't go be able to go straight. No, I'm sorry. I didn't make myself clear.
>> Okay. Well, once she's getting closer to Rosville and stay alive, that's when she can feel very bad driving.
>> Okay.

>> Okay. All right. I do find that there was probable cause just what I saw in the video, regardless of what happened at Rise. I always thought it was Risner, but I know a family that spells her name that way. Um, even without seeing what happened at Rise Road, what I saw in the video is she was not maintaining her lane. Um, and once again, like Miss Manuel said, the argument about the lights uh causing the problems, the decision was made to stop her and investigate before his lights went on.
>> And there it is. After all the back and forth, the judge reaches a decision that leaves very little room for debate.
>> Uh, I find probable cause. Do we have time for a pre-trial today or you had to schedule one?
>> If we could just Yeah, absolutely.
So you follow me, you know, if you're here, you know, down the road here.

Okay. I I notic he's sitting, right? So, I stopped and when I walk through and stop there truck right here. So, I stop don't I will stop signs. I admit I will stop signs. I didn't know this one, but I got her sitting. I got I got a roll sitting, you know, couldn't compromise, you know what I mean? So, I stopped here and he stops us here and as he pulled up, I'm like, "Oh, wait a minute. He couldn't even see me."
>> I'm like, "Okay, >> have a good day." He said, >> "Yeah." Yeah. Yeah. We were in the court car, so you know, he knew he knew what was going on before I walked up to him.
>> Yeah.
All right, ladies. We're back on the record on the people versus Ran. I understand Miss Ran has decided to take a plea to impair driving. Correct.
>> All right. Miss Ran, do you understand your rights and options after discussing same with Miss Finnegan? You don't have to get up. It's okay. It's okay. I don't I don't think it's disrespectful. Have you discussed your rights and options with counsel? You understand your rights and the options rights give you today?
And do you understand the possible penalty for this added charge? Are you pleading guilty today freely and voluntarily to the added charge?
>> All right. October 27:24, you drove a vehicle in Vander Township. Correct.
And prior to driving that vehicle on that date at that location, you consumed some alcohol.
Correct.
>> But may I ask you?
>> Sure. particularly bad to do.
>> Yeah. Okay. Um, was there council? Was there a breath test or blood test?
>> It was a breath.
>> Would you stipulate, counsel, that the results were 08 or higher?
>> Okay. Well, with that stipulation, I think I've got the facts I need to accept the plea.
All right. Miss Rowan, I'm going to dismiss the original charge. I'm going to send you downstairs to make an interview date with my probation department. You'll come back. They'll also set up a sentencing date council if you want some input today.
So, you'll come back. You'll be interviewed by the probation officer.
Then, you'll come back for a sentencing date with Miss Finnegan. The three of us will be here. We'll all have a chance to read the report and recommendation that comes out of that interview. And then we'll talk about whatever you ladies want to talk about, and then I'll decide what your sentence term should be.
