Um, as somebody who spent the first 40 years of their life completely closeted uh due to the indoctrination, the punishment um the mental uh torture and physical torture of being interrogated for years about being gay. I can say that this is cruel.

Okay. So you have to get the signatures.
Uh you have to show a map of what you're you know representing the 51% or more of the people abuing it. Okay.
And of real property owners detailed MA and then you have to why right why why do you want this? Okay. Uh you have to submit all of that your petition your map and a $5,000 fee. You got to pay that to the Bureau of Land Development.
Um, and you can mail it in or or bring it in. Then there it goes up for public review. Okay.
The city engineer issues a notice of proposed street name change which is mailed like it would be mailed to Scientology and then if objection or files the city council holds a formal public hearing which is what we need. We need a formal public hearing. The street was named North Barendo. That little segment was called North Barendo.
Okay. Um and if the change is approved, they adopt it and they would have to tear that down and they don't get to just everybody assume it's a private street.

And uh yeah, I think we should do this.

The defendant states as follows. Point number one. On April 14th, 2026, the defendant was tried be by jury before judge Kathleen Hessinger on a single count of battery pursuant to this statute um first-degree misdemeanor battery. This was a second battery trial for the defendant as approximately one month earlier and before the same judge, the defendant was found not guilty of battering a different Scientologist member uh by a jury. Not by the judge.
By a jury. Not by the judge. The defendant was a former Scientologist.
So, he's a current Scientologist.
Was a former SC. This is very badly worded.
uh that had been abused by the organization for years and Scientologists have attempted to destroy him for many years due to him leaving the organization and being an outspoken critic.
Uh, number four, the defendant has a YouTube channel uh known as Growing Up in Scientology, as well as a foundation dedicated to assisting Scientologists from escaping the organization, as well as locating Scientologists that have not had communication with loved ones or parents for many, many years, some decades.
I don't believe that's a stated mission statement on the SPTV Foundation website.

Number five, the defendant also organizes protests in downtown Clearwater, Florida regarding Scientology's policies and treatment of individuals. No, no, no, no, no, no, no, no, no.
The protests are a pizza donut party with cardboard cutouts of Tom Cruz, John Travolta, and David Muscavage and an inflatable Zenu and somebody who dresses up as a butterfly for some unknown reason. What the [ __ ] does that have to do with Scientology's policies? It says Scientologyy's a honk if Scientology is a cult.
I the rare times that Aaron actually discusses the the crimes of Scientology is when he's having a one-on-one interaction with a fan. Otherwise, he doesn't really want to talk to people unless they know who he is. you know, the defendant uh on April 10th, 2026, the trial court held motions in lemony.
It also entertained the defendant's request for judicial notice of the property appraisers's website photo which says on the website that it is not accurate and for fully accurate records you have to do you know the survey depicting the boundaries of the property line of the building in question where the battery is alleged to occurred. So, it does not Here's here's where the legal argument falls apart. Here's where the legal argument falls apart. And the fact that Aaron insists that he was on public property does not matter.
Does not matter.
Okay? Because a battery can occur on public or private property. It's still a battery.
The location where said alleged battery occurred does not matter in the legality of whether or not it's a battery. Also, a public location has the right by law to refuse entrance, service, or anything else to any member of the public if they choose to do so. Okay? We all pay taxes, okay, here in America. And our taxes go, for example, to public libraries. That is a public place. My taxes, they pay for that.
So, I can go into the public library for whatever reason the librarian decides that I need to get the [ __ ] out of the library.
Okay, that means I need to get the [ __ ] out of the library.
There is no, you know, I mean, I can stage a protest.
That's also legal. I could just sit down and be like, I'm protesting the library for whatever god knows reason. And I would do that. I wouldn't. But if someone's attempting to close a door to a public place and you leave your foot there, that's a you problem.
That's a you problem because the closing of the door is a nonverbal communication to the person that you are not welcome.
We are not admitting you into this space in any way, shape, or form.
Like, it's just it's that simple. It's that it's really not hard to understand.

Uh so the area okay uh where the battery is alleged to have occurred. The area of the alleged battery was disputed throughout the motion hearing and at trial. As the defense stated, it was the belief of the defendant that the public in general that the location uh and the public in general that the location of the alleged battery occurred on public property due to it the property appraisers boundary depiction while the state was of the opinion that it was private property. It does not matter.
This is the dumbest argument in the history of legal arguments.

Uh at the motions hearing, the issue regarding the Penllis County property appraisers website photograph of the boundaries of the property in question were discussed as the defense claimed the boundary depiction gave credibility to the defendant's position that he was on public property. It does not matter. At a minimum, what the judge failed to understand was the defendant's state of mind was completely relevant based on his understanding that it was public property based on his public document.
Throughout the trial, the judge's bias and animosity towards the defendant clouded her decision, causing her to exclude this testimony, even though it qualified as an exception to hearsay by simply finding that it was not relevant.
The judge made the defendant redact the state of mind statements from the defendant's video from his phone of how the defendant was simply asking let's go down to the other thing here sci a scientologist employee Pat Harney if she could help him if she could help him by uh talking to Scientologist Flavio Lugley and getting a message to him to call his parents in Italy as they have not spoken to him in years and were concerned with his well-being, the jury was left with no impression that the defendant was protesting. And even the judge referred to him as a protester in front of the jury. So, I'm sorry, the jury had no impression that he was protesting. Yet, the judge referred to him as a protester. So, clearly, they got the impression when the judge said that.
Like, you can't have it both ways. That sentence is insane.
That sentence right there is absolutely nuts.
How do you say the jury had no impression yet the judge said it?
It's okay. At one point during the motions hearing, the state concealed conceded, I'm sorry, conceded that they were not going to argue the defendant was trespassing. Note, the defendant was never charged with trespassing.
And the defense stated that since they're not going to allege he was trespassing, the photographic document from the property appraisers website was not an issue. The defense even stated that it was their position that the document is relevant if an allegation of trespassing were made.
But no, they didn't al they didn't say that.
So you just defeated your own point.

Uh, the first the state's first witness, Norman Shape, the state clearly violated the court's motion in lemonade regarding ruling their stipulation that he would not be arguing the tres uh defendant was trespassing when Norman Shape stated, "I said he was on private property."

You must usually have more than 90 days left on your probation. So that would mean that he is moving his probation from the state of Florida to somewhere else. If you leave before receiving approval, that can result in absconding violation, which can lead to incarceration.

Um, you cannot be out of the state for any amount of time without prior express permission. Uh, leaving your county of residence usually requires consent and leaving the state entirely is an automatic uh without authorization to be perfectly clear is an automatic violation of probation which carries an immediate risk of a warrant for your arrest. Because a first-degree misdemeanor battery carries a maximum penalty of up to one year in county jail, a judge can sentence you to serve that jail time if you violate your travel conditions.
Uh there's zero automatic days. There's no grace period. So no crossing state lines without an approved travel permit.
Uh your probation officer has the authority to approve or deny short-term outofstate travel. They will heavily weigh the reason for your verified family emergency or mandatory work travel versus a leisure vacation.
How in good God's name is this mandatory work travel for Aaron Smith Leaven to shack up with his mistress and do one live stream that was over an hour long on one day in front of the test center and then every other day and even skipped a day doing under 20 minutes every time. How on God's green earth is that work travel? How do you justify less than an hour of work a day being work?
And even if he took time to do the research, guys, that doesn't take an additional eight hours to do the research for the thing that he just found. He read an article, guys, about Grant Cardone. He probably has a YouTube alert set up.

To even be considered for out of state travel, you must be in complete compliance with all court-ordered terms.
