Under United States law, specifically the Fourth Amendment, which protects against unreasonable searches and seizures, police cannot compel a person to identify themselves unless they have reasonable articulable [music] suspicion, RAS, that the person has committed, is committing, or is about to commit a crime.
Merely filming in public or acting suspicious does not constitute RAS.
When officers threaten arrest or use their authority to compel speech, in this case compelling identification, without RAS, they have exceeded their authority and violated the Constitution.
