[00:00:34]They're trying to send a message to other retired veterans, and really, to all of us.

[00:00:42]If you say something that the president or this administration does not like, they're going to come after you.

[00:00:50]A sitting United States Senator was openly threatened with execution. His 25 years of service, his pension, and his military rank, everything was aggressively targeted for destruction in a single moment. What was his crime?

[00:01:03]Simply telling soldiers do not follow illegal orders. President Trump called it treason. Defense Secretary Hegseth labeled it a mutiny. They used their full power to politically destroy Mark Kelly, but then the tables suddenly turned. An American court stepped in, and in a historic ruling, judges pushed back against the government's actions.

[00:01:44]Just like these folks behind me, I I signed up to serve our country and protect our freedoms, including the freedom of speech.

[00:01:55]Most of us joined to be part of something bigger than ourselves, to protect and serve the country we love.

[00:02:09]I know Donald Trump doesn't understand that.

[00:02:12]And he doesn't understand us.

[00:02:15]And sadly, it seems that Pete Hegseth doesn't understand that, either.

[00:02:23]Because even after a federal judge ruled earlier this year that his attempts to silence me were unconstitutional, he wouldn't stop.

[00:02:35]And today, this administration argued in federal court that not only do I not have the same freedom of speech rights as other Americans, but that the millions of other retired veterans across the country don't, either.

[00:02:57]Including many of the individuals standing besides me today.

[00:03:03]According to them, anytime a retired veteran says something that the Secretary of Defense doesn't like, they can be punished.

[00:03:12]So, the people who have given the most in service to this country wouldn't be free to say what they believe.

[00:03:23]It's absurd, and it's outrageous.

[00:03:26]It is an outrageous violation of our constitutional rights.

[00:03:33]One of our most fundamental rights is the right to speak out about the government.

[00:03:41]It's the right that guarantees all others.

[00:03:46]And it's how we hold our government accountable.

[00:03:50]And it's especially especially important right now.

[00:03:57]Donald Trump is two months into a war with Iran that he started without a strategic goal.

[00:04:07]13 Americans have died.

[00:04:10]The same Iranian regime is in charge and their enriched uranium is still in their possession.

[00:04:18]The Strait of Hormuz is now closed and Americans are suffering with skyrocketing gas prices.

[00:04:27]And without any explanation from this president of what this war is trying to achieve.

[00:04:34]Who better to speak out and share their perspective than the people who served?

[00:04:42]Retired military members who understand the risks and sacrifice of sending brave Americans into combat.

[00:04:53]Who understand how to use combat power but also understand its limitations.

[00:05:03]And also who have seen the mistakes of past administrations that thought wars could be fast and simple only to get bogged down for years or for decades.

[00:05:18]Retired veterans have always been an important part of our democracy.

[00:05:25]And that's exactly why I am not backing down.

[00:05:37]After 25 years in the Navy, I've given too much to this country to be silenced by an administration that does not want to be held accountable.

[00:05:48]So, today this was a day in court, not just for me, but for the First Amendment rights of millions of us.

[00:06:00]This administration has bullied and coerced the press, private companies, and universities.

[00:06:09]The list goes on.

[00:06:11]But, in this case the president and the Secretary of Defense picked the wrong guy.

[00:06:18]Because when it comes to our most fundamental rights, I will not back down.

[00:06:27]Given what's at stake, I appreciate the judge's quick and careful consideration in this case.

[00:06:34]We have the Constitution and the law on our side.

[00:06:39]And I've never been more confident than I am today standing here with my wife Gabby, my daughter Claire, and the guy who I flew almost all my combat missions with, Paul Fujimura.

[00:06:51]But, also with these brave men and women who served our country.

[00:06:58]Don't give up the ship.

[00:07:00]Friends, what you just watched was not a movie. This is the reality of America.

[00:07:06]Arizona Senator Mark Kelly served his country in the Navy for 25 years. He flew 39 combat missions. He went to space four times. And after retiring, the American people sent him to the Senate. But, in November 2025, he released a video. In that video, he told the military, "Do not follow illegal orders." That alone was enough. Trump wrote on Truth Social, "This is sedition. This is treason.

[00:07:31]He should be executed." Hegseth ordered from the Pentagon, "Reduce Kelly's rank, cut his pension, destroy his military record." Kelly responded, "You picked the wrong person." And then he went to court. In January 2026, a lawsuit was filed. In May 2026, the case reached the DC Circuit Court in front of three judges, and what happened there shocked Trump and Hegseth. The judges directly asked, "Should retired veterans lose their pension simply because they criticized the government?" The answer was clear, "Absolutely not." The court clearly stated, "This is a violation of the First Amendment. This is against the Constitution, and this will never be tolerated." Trump and Hegseth suffered a major defeat. One senator alone forced the entire government to back down.
