That prior observation provided the articulable individualized suspicion required under Terry versus Ohio to justify a brief investigative detention the moment the officer made contact. The officer's decision to request a receipt before making any physical contact is legally significant.
Under the Fourth Amendment, a detention must be no more intrusive than necessary.
Asking for proof of purchase is proportionate to the circumstances and consistent with de-escalation doctrine required by modern use of force policy.
The subject claimed she had paid via Apple Pay, but said her phone storage was preventing the receipt from loading.
She had multiple opportunities to produce it.
Each refusal accompanied by continued retreat narrowed the legal space available to her and widened the legal authority of the officer to escalate.
When the subject broke into a full run toward the parking lot, the encounter crossed a statutory threshold.
Florida Statutes Section 843.02 defines resisting an officer without violence as obstructing or opposing a law enforcement officer engaged in the lawful execution of a legal duty. Flight is not neutral conduct under Florida law.
The Supreme Court in Illinois versus Wardlow held that unprovoked flight upon the approach of law enforcement is a factor contributing to probable cause.
Combined with the active shoplifting detention flight here established probable cause to arrest independent of whether the theft itself is ultimately proven. The officer's trainee caught the subject and executed a takedown.
The applicable standard comes from Graham versus Connor, which held that the reasonableness of force must be evaluated from the perspective of a reasonable officer on the scene at the moment of the decision not in hindsight.
Graham directs courts to weigh three factors: the severity of the crime at issue, whether the subject poses an immediate threat to the safety of officers or others, and whether the subject is actively resisting or attempting to flee.
All three factors here supported the use of takedown and ground control techniques. The crime was a third-degree felony.
Florida Statutes Section 812.014 Subsection 2 Paragraph C classifies theft of property valued at $750 or more as grand theft, a felony, not a misdemeanor.
The elevated offense level matters when assessing proportionate force. The subject was actively resisting commands while on the ground, and the officer had already witnessed her flee across a public parking lot.
