We are reporting live from the Ptoria High Court uh on our YouTube uh channel, the IPAC YouTube channel known as IPAC Yatau. We are here at the Pritoria High Court on the second day of what has become known as the IPC eviction trial.
Just to recap on what happened on the first day which is yesterday. Yesterday we were here as we reported that uh in the morning it were argument that were presented by uh the lawyer of the IPC in the afternoon that uh there were argument by the opposition or opposing um application for to oral evidence as as as it were. So we continued today h when we got inside at about half 9 the court proceeding started basically the the lawyer that represents Modis H started to present his argument and obviously his argument were more based on the opposition of referral to oral evidence as it were. In actual fact, h they they even want h to dismiss the application on rule 7 like we said yesterday as well to say why would the people who claim to be the owners of IPC h to say the people that are here belong to them. Why would they oppose something that they claim it belongs to them? So they must come take the box h take the stand and and and h provide statements and and and and witness h to to the extent that they believe h what they claim is theirs. Now just to give a summary of what has happened this morning at the court in the middle of the presentation by the lawyer of Sebiso Modis. Now there's this affidavit that was filed on Monday by a Mr. Malakay who deposed to that affidavit on behalf of Leonard Modis.
The essence of that affidavit as it were is that Musalak says there is an affidav there is a constitution that was signed in 2009. Remember that from the onset when this uh court case or when it started as a leadership court case in 2016 brought by Tiso Bodis a 2007 constitution of the IPC is the one that was used in all the litigations for 10 years that constitution was used but only on Monday that Mr. Musalagay brought a constitution that supposedly was signed in 2009. Then you ask yourself what kind of tactics are they trying to play here? Because for 10 years there's been judgment. There has been orders that were used that were ruled on a 2007 constitution. 10 years later now there's a 2009 constitution.
It is very clear that there's a game here. There's a tactic. There's a trick that has been played. But that is what is currently h playing at in court. We will give you an update as to what has happened in regard to the arguments with regards to h that affidavit as it were.

We we are here because of a court matter that has become known as IPAC eviction trial. Not long ago, we reported the proceedings that were on a tea break earlier on. H however, as we speak, the court proceedings have ended.
What has happened, like I reported earlier on, there's a a Mr. Malagay who comes from the Leonard's Modis affection. So what he did on a Monday, I mean you must remember that this eviction application was filed by IPC in October 2022 and apart from that filing in October 2022. H the litigation of IPC, various of them starting from the leadership in 2016, there was a constitution that has always been filed and deposed to by um all the applicants or the respondent or defendants in litigation matters. It's been 10 years now. So after 10 years, Mr. Malagay come and depose you an affidavit that he says is a rightful affidavit dated and signed in 2009. So the constitution that has been used in all the litigation since 2016 is the constitution of 2007.
Now you ask yourself why has the 2009 constitution not being h revealed all these years for 10 years. Now ask yourself that question. Why do you ask yourself that question in the first place? The second question is he says in that affidavit he has been in position of that affidavit for all these years.
Now ask yourself because he knew that litigations have been ongoing in the IPC. Why has he not come forward to produce that constitution of the IPC?
That's the second thing. The third thing, how can you as a member at a time that was part of the protocol uh to to keep a constitution to yourself alone that h governs the entire institution h that is unheard of. There's a bit of selfishness there and also there's a bit of um a red or there's something fishy about him filing that constitution in the aid of Leonard Maurice's argument as it were. So now what has happened in the arguments in the morning when Leonard's lawyer who represented him in the standard bank matter started to argue about uh this constitution h obviously that constitution has to be admitted in court and uh for it to be admitted in court there must be a procedure that must be followed according to the court rules. So according to the court rules now the IPC must reply must answer to that h affidavit h that brings the constitution into the play into the court h proceedings. So that is going to happen today by 5:00 p.m. the IPC would have answered that affidavit and uh tomorrow morning at 11:00 Leonard's lawyer will then reply to our answered affidavit at 5:00 p.m. the lawyer representing Tiso or Leonard in the eviction matter will also have to reply or answer into that affidavit. So tomorrow is given for that affidavit to be h replied and answered upon. We are coming back here on Friday morning at 9:00. The proceedings will continue on Monday at 9:00. Like we said before, they can run but they cannot hide. Whether they like it or not, it can take two years, it can take three years. This con court proceedings will have an end. There's going to be an order. There's going to be a judgment. If on Friday the court proceedings do not allow the judge to issue an order, obviously a new date will be issued, we will come back here.
This matter will see the end of day.
This matter will have to h come to an end whether they like it or not. So uh we are saying h uh watch and tune in as h uh we invite you to follow us uh on these proceedings on Friday but we'll come back here on Friday morning. We'll give you uh the previews before we we go in. will give you an update as to what happened on Thursday when the lawyers were preparing for the replies or the court papers in respond to the affidavit that Musalakay handed in on Monday that was argued today.
