Taylor Swift says it is her first amendment right. Trademarks be damned.
Taylor can name her albums, her things, whatever she wants. We're going to be covering this case on the YouTube channel, but essentially what's happened is Maron Wade has sued Taylor Swift over trademark infringement. Taylor was denied Life of a Showgirl because of Maron's trademark over Confessions of a Showgirl. And anyone that knows trademark Life of a Showgirl and Confessions of a Showgirl would absolutely be denied due to similarities. But Taylor's argument is this. Number one, that Maron Wade isn't big enough to compete with Taylor.
You're in these like 55-plus clubs. How is anyone going to confuse you with the Taylor Swift? That's argument number one. And then argument number two is, okay, so even if, all right, laws also apply to me as Taylor Swift, it's my first amendment right to name my album whatever I want because it's creative freedom. This is the same woman that trademarked all of her album names, sayings like Shake It Off, the year 1989, the word reputation, so that she could send cease and desist to Etsy fans making fan items to sell. Etsy shop owners spoke out saying they received cease and desist from Swift's camp.
Someone said, "We originally made the item for fun. We love Taylor. We had friends that love Taylor. We never intended for it to be a profit-making item. The cost of the item covered shipping costs, the production costs, was very little left over." But Taylor got those trademarks and then took out fans on Etsy. Taylor also blocked Swift Home because Taylor apparently owns any type of cursive writing saying that the cursive was too similar to hers. And well, they can't use Swift because she's trademarked it. And we could keep going with Olivia Rodrigo. And the interesting thing for me is when I look at Taylor Swift songs that I really enjoy, they are so similar to Paramore that I hear Hayley and Paramore in my head while I'm listening to those songs. So it's just so interesting to me that Taylor can continuously do whatever Taylor wants, but as soon as someone else is infringing on her trademark, as someone as soon as someone else is infringing on her brand, it's a problem. And Martin's lawyers have not backed down. Like they're following through on this. I don't think anyone's actually followed through on this. Swift home trademark issue, they tried and then eventually dropped it, but her lawyer says, "We have read the defendant's papers. The federal trademark office refused the defendant's mark, and rather than engage that finding, defendants argue about well, almost anything else. We file our response next week." Which I am dying for. This is how Taylor's always been.
People are afraid to go up against her because you're going up against someone with billions of dollars to fight you.
So, her and Blake just do whatever they want. They take what they want. They do what they want. And I have no doubt that Taylor thought in her head, like this has got to be the album, Life of a Showgirl, has to be the album. I have no backup. We're going to run with it because what's this lady going to do?
