In New Jersey, leaving the scene of an accident involving personal injury under NJSA 394-129A is a serious criminal offense that can result in up to 180 days in county jail, mandatory driver's license suspension, fines, court costs, and other severe penalties; however, being charged does not mean being guilty, as there are multiple potential defenses including lack of knowledge about the accident, confusion, weather conditions, unreliable identification, and psychological factors like shock or panic, making it essential to consult an experienced attorney immediately rather than making statements to police.

Leaving the scene of an accident in New Jersey when someone is injured. What am I facing?Added:
My name is Edward Appel. I've been practicing criminal defense law since 1988.
I'm licensed in New Jersey, Pennsylvania, and admitted to the United States Supreme Court Bar. Today, I want to talk about one of the most serious traffic related charges you can face in New Jersey. Leaving the scene of an accident involving personal injury under NJSA394-129A.
A lot of people think leaving the scene is only a minor traffic ticket. It is not. In many cases, it can completely change your life. And here's what surprises people the most. Many individuals charged under this statute were not hardened criminals. They were scared, panicked, confused. Sometimes they didn't even fully understand what had happened in the moment. But prosecutors and police in New Jersey take these cases extremely seriously, especially where there's an allegation that somebody was injured. Under New Jersey law, if you are involved in an accident that results in injury to another person, you are required to immediately stop your vehicle and remain at the scene. You must provide your name, address, driver's license information, registration information, and render reasonable assistance if someone is hurt. If police believe you knowingly left the scene without doing those things, you could be charged under 394129A.
Now, let's talk about the penalties because this is where things become very serious. A conviction for leaving the scene involving personal injury can expose you to significant fines and court costs, up to 180 days in the county jail, a mandatory driver's license suspension, motor vehicle points, dramatic insurance increases, potential civil liability exposure, and in some cases, immigration or employment consequences.
For many people, losing their driver's license is devastating. They can't get to work. They can't support their family. Their entire life gets disrupted. And prosecutors often look at these cases emotionally because somebody allegedly got hurt. That means the state may aggressively pursue the matter even when there are substantial defenses available.
Now, one important thing I want people to understand is this. Being charged is not the same thing as being guilty.
There are many defenses that can arise in these cases. For example, did the driver actually know there was an accident? Did the driver know someone was injured? Was there confusion, darkness, bad weather, or heavy traffic?
Was the alleged identification reliable?
Did the police properly investigate the matter? Were there witness inconsistencies?
Was the defendant suffering from shock or panic after the accident? These facts matter. I have handled cases where people were falsely identified. I've handled cases where damage was so minimal the driver genuinely did not realize contact occurred. I've also handled situations where fear and confusion cause terrible split-second decisions that later needed to be carefully explained and defended in court. Another important issue is what people do after the accident. If you realize something happened, contacting an experienced attorney immediately can make an enormous difference. Statements made to police can absolutely be used against you later. Many people unintentionally damage their defense because they try to explain everything before obtaining legal advice. That is a mistake. These cases often involve surveillance footage, witness statements, body cam video, accident reconstruction, medical allegations, and detailed police investigations.
An experienced defense attorney needs to review every piece of evidence carefully. In some situations, it may be possible to negotiate a reduction of charges. In other cases, weaknesses in the state's proofs may justify fighting the matter aggressively at trial. Every case is different, but one thing is certain. This is not a charge you should walk into court handling by yourself.
I've been defending people in New Jersey court since 1988.
I understand how prosecutors evaluate these cases, how judges look at them, and how to identify weaknesses in the state's evidence. If you or somebody you care about has been charged with leaving the scene of an accident involving personal injury under 394-129A, do not wait until the last minute to get legal advice. Early intervention can be critical. Contact the law office of Edward Appel today.
